52.228-15 PERFORMANCE AND PAYMENT BONDS--CONSTRUCTION (OCT

2010)

(a) Definitions. As used in this clause-- Original contract price means the award price of the contract; or, for requirements contracts, the price payable for the estimated total quantity; or, for indefinite-quantity contracts, the price payable for the specified minimum quantity. Original contract price does not include the price of any options, except those options exercised at the time of contract award.

(b) Amount of required bonds. Unless the resulting contract price is $150,000 or less, the successful offeror shall furnish performance and payment bonds to the Contracting Officer as follows:

(1) Performance bonds (Standard Form 25). The penal amount of performance bonds at the time of contract award shall be 100 percent of the original contract price.

(2) Payment Bonds (Standard Form 25-A). The penal amount of payment bonds at the time of contract award shall be 100 percent of the original contract price.

(3) Additional bond protection. (i) The Government may require additional performance and payment bond protection if the contract price is increased. The increase in protection generally will equal 100 percent of the increase in contract price.

· Clarify the end project survey timeline **The Specification Section 35 20 23 DREDGING, paragraph 3.13 states "Dredging soundings will be taken within 14 days (weather permitting) after the completion of an acceptance section…”. Therefore, our specification gives us 14 days to do an AD survey but typically we complete the AD surveys within 5 days of a survey request by the Contractor.

· Confirm any qualities that are confirmed by the base engineering.

The estimated volume required for the dike construction is 2,900 bcy and the estimated excess volume removed from the pit and required to be hauled away by the Contractor is 5,700 bcy.

Bulk factor of 1.3. (It is 5,700 bulk cubic yards excess yardage removed from the pit and hauled away offsite.

· Can you supply the last project Solicitation/Contract number. The last contract number was DACW60-99-B-0009.

Can you confirm whether or not the Dredging at Marine Corps Air Station is to be done hydraulically, or can mechanical dredging be done by clamshell? I have checked the specs and they do not specify “only” hydraulic dredging.

. A hydraulic dredge is specified in the fill-ins of spec section 00800 where it states "The Contractor will be required to maintain a dredge production rate while pumping within the range of 175 - 485 cubic yards per hour."

- Please confirm that the material that needs to be removed offsite can be disposed of at a location of the contractor’s choice and contamination is not a concern.

The site was never tested in the past because it is sand. There are no contamination details available on the site.

- Will there be a small extension on the bid date due to the unplanned site visit and subsequent amendment for questions so close to bid date?

No extension.
