52.215-1 INSTRUCTIONS TO OFFERORS--COMPETITIVE ACQUISITION (NOV 2021)

(a) Definitions. As used in this provision--

“Discussions” are negotiations that occur after establishment of the competitive range that may, at the Contracting Officer's discretion, result in the offeror being allowed to revise its proposal.

“In writing or written” means any worded or numbered expression that can be read, reproduced, and later communicated, and includes electronically transmitted and stored information.

“Proposal modification” is a change made to a proposal before the solicitation's closing date and time, or made in response to an amendment, or made to correct a mistake at any time before award.

“Proposal revision” is a change to a proposal made after the solicitation closing date, at the request of or as allowed by a Contracting Officer as the result of negotiations.

“Time”, if stated as a number of days, is calculated using calendar days, unless otherwise specified, and will include Saturdays, Sundays, and legal holidays. However, if the last day falls on a Saturday, Sunday, or legal holiday, then the period shall include the next working day.

(b) Amendments to solicitations. If this solicitation is amended, all terms and conditions that are not amended remain unchanged. Offerors shall acknowledge receipt of any amendment to this solicitation by the date and time specified in the amendment(s).

(c) Submission, modification, revision, and withdrawal of proposals. (1) Unless other methods (e.g., electronic commerce or facsimile) are permitted in the solicitation, proposals and modifications to proposals shall be submitted in paper media in sealed envelopes or packages (i) addressed to the office specified in the solicitation, and (ii) showing the time and date specified for receipt, the solicitation number, and the name and address of the offeror.

Offerors using commercial carriers should ensure that the proposal is marked on the outermost wrapper with the information in paragraphs (c)(1)(i) and (c)(1)(ii) of this provision.

(2) The first page of the proposal must show--

(i) The solicitation number;

(ii) The name, address, and telephone and facsimile numbers of the offeror (and electronic address if available);

(iii) A statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation and agreement to furnish any or all items upon which prices are offered at the price set opposite each item;

(iv) Names, titles, and telephone and facsimile numbers (and electronic addresses if available) of persons authorized to negotiate on the offeror's behalf with the Government in connection with this solicitation; and

(v) Name, title, and signature of person authorized to sign the proposal. Proposals signed by an agent shall be accompanied by evidence of that agent's authority, unless that evidence has been previously furnished to the issuing office.

(3) Submission, modification, revision, and withdrawal of proposals.

(i) Offerors are responsible for submitting proposals, and any modifications, or revisions, so as to reach the Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that proposal or revision is due.

(ii)(A) Any proposal, modification, or revision received at the Government office designated in the solicitation after the exact time specified for receipt of offers is “late” and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; and--

(1) If it was transmitted through an electronic commerce method authorized by the solicitation, it was received at the initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day prior to the date specified for receipt of proposals; or

(2) There is acceptable evidence to establish that it was received at the Government installation designated for receipt of offers and was under the Government's control prior to the time set for receipt of offers; or

(3) It is the only proposal received.

(B) However, a late modification of an otherwise successful proposal that makes its terms more favorable to the Government, will be considered at any time it is received and may be accepted.

(iii) Acceptable evidence to establish the time of receipt at the Government installation includes the time/date stamp of that installation on the proposal wrapper, other documentary evidence of receipt maintained by the installation, or oral testimony or statements of Government personnel.

(iv) If an emergency or unanticipated event interrupts normal Government processes so that proposals cannot be received at the office designated for receipt of proposals by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation, the time specified for receipt of proposals will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.

(v) Proposals may be withdrawn by written notice received at any time before award. Oral proposals in response to oral solicitations may be withdrawn orally. If the solicitation authorizes facsimile proposals, proposals may be withdrawn via facsimile received at any time before award, subject to the conditions specified in the provision at 52.215-5, Facsimile Proposals. Proposals may be withdrawn in person by an offeror or an authorized representative, if the identity of the person requesting withdrawal is established and the person signs a receipt for the proposal before award.

(4) Unless otherwise specified in the solicitation, the offeror may propose to provide any item or combination of items.

(5) Offerors shall submit proposals in response to this solicitation in English, unless otherwise permitted by the solicitation, and in U.S. dollars, unless the provision at FAR 52.225-17, Evaluation of Foreign Currency Offers, is included in the solicitation.

(6) Offerors may submit modifications to their proposals at any time before the solicitation closing date and time, and may submit modifications in response to an amendment, or to correct a mistake at any time before award.

(7) Offerors may submit revised proposals only if requested or allowed by the Contracting Officer.

(8) Proposals may be withdrawn at any time before award. Withdrawals are effective upon receipt of notice by the Contracting Officer.

(d) Offer expiration date. Proposals in response to this solicitation will be valid for the number of days specified on the solicitation cover sheet (unless a different period is proposed by the offeror).

(e) Restriction on disclosure and use of data. Offerors that include in their proposals data that they do not want disclosed to the public for any purpose, or used by the Government except for evaluation purposes, shall--

(1) Mark the title page with the following legend: This proposal includes data that shall not be disclosed outside the Government and shall not be duplicated, used, or disclosed--in whole or in part--for any purpose other than to evaluate this proposal. If, however, a contract is awarded to this offeror as a result of--or in connection with-- the submission of this data, the Government shall have the right to duplicate, use, or disclose the data to the extent provided in the resulting contract. This restriction does not limit the Government's right to use information contained in this data if it is obtained from another source without restriction. The data subject to this restriction are contained in sheets [insert numbers or other identification of sheets]; and

(2) Mark each sheet of data it wishes to restrict with the following legend: Use or disclosure of data contained on this sheet is subject to the restriction on the title page of this proposal.

(f) Contract award.

(1) The Government intends to award a contract or contracts resulting from this solicitation to the responsible offeror(s) whose proposal(s) represents the best value after evaluation in accordance with the factors and subfactors in the solicitation.

(2) The Government may reject any or all proposals if such action is in the Government's interest.

(3) The Government may waive informalities and minor irregularities in proposals received.

(4) The Government intends to evaluate proposals and award a contract without discussions with offerors (except clarifications as described in FAR 15.306(a)). Therefore, the offeror's initial proposal should contain the offeror's best terms from a cost or price and technical standpoint. The Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary. If the Contracting Officer determines that the number of proposals that would otherwise be in the competitive range exceeds the number at which an efficient competition can be conducted, the Contracting Officer may limit the number of proposals in the competitive range to the greatest number that will permit an efficient competition among the most highly rated proposals.

(5) The Government reserves the right to make an award on any item for a quantity less than the quantity offered, at the unit cost or prices offered, unless the offeror specifies otherwise in the proposal.

(6) The Government reserves the right to make multiple awards if, after considering the additional administrative costs, it is in the Government's best interest to do so.

(7) Exchanges with offerors after receipt of a proposal do not constitute a rejection or counteroffer by the Government.

(8) The Government may determine that a proposal is unacceptable if the prices proposed are materially unbalanced between line items or subline items. Unbalanced pricing exists when, despite an acceptable total evaluated price, the price of one or more line items is significantly overstated or understated as indicated by the application of cost or price analysis techniques. A proposal may be rejected if the Contracting Officer determines that the lack of balance poses an unacceptable risk to the Government.

(9) If a cost realism analysis is performed, cost realism may be considered by the source selection authority in evaluating performance or schedule risk.

(10) A written award or acceptance of proposal mailed or otherwise furnished to the successful offeror within the time specified in the proposal shall result in a binding contract without further action by either party.

(11) If a post-award debriefing is given to requesting offerors, the Government shall disclose the following information, if applicable:

(i) The agency's evaluation of the significant weak or deficient factors in the debriefed offeror's offer.

(ii) The overall evaluated cost or price and technical rating of the successful and the debriefed offeror and past performance information on the debriefed offeror.

(iii) The overall ranking of all offerors, when any ranking was developed by the agency during source selection.

(iv) A summary of the rationale for award.

(v) For acquisitions of commercial products, the make and model of the product to be delivered by the successful offeror.

(vi) Reasonable responses to relevant questions posed by the debriefed offeror as to whether source-selection procedures set forth in the solicitation, applicable regulations, and other applicable authorities were followed by the agency.

52.216-1 TYPE OF CONTRACT (APR 1984)

The Government contemplates award of a Firm-Fixed Price contract resulting from this solicitation.

52.222-5 CONSTRUCTION WAGE RATE REQUIREMENTS--SECONDARY SITE OF THE WORK (MAY

(2) If the offeror is unsure if a planned work site satisfies the criteria for a secondary site of the work, the offeror shall request a determination from the Contracting Officer.

(b)(1) If the wage determination provided by the Government for work at the primary site of the work is not applicable to the secondary site of the work, the offeror shall request a wage determination from the Contracting Officer.

(2) The due date for receipt of offers will not be extended as a result of an offeror's request for a wage determination for a secondary site of the work.

52.228-1 BID GUARANTEE (SEP 1996)

(a) Failure to furnish a bid guarantee in the proper form and amount, by the time set for opening of bids, may be cause for rejection of the bid.

(b) The bidder shall furnish a bid guarantee in the form of a firm commitment, e.g., bid bond supported by good and sufficient surety or sureties acceptable to the Government, postal money order, certified check, cashier's check, irrevocable letter of credit, or, under Treasury Department regulations, certain bonds or notes of the United States.

The Contracting Officer will return bid guarantees, other than bid bonds, (1) to unsuccessful bidders as soon as practicable after the opening of bids, and (2) to the successful bidder upon execution of contractual documents and bonds (including any necessary coinsurance or reinsurance agreements), as required by the bid as accepted.-

(c) The amount of the bid guarantee shall be 20 percent of the bid price or $3,000,000 whichever is less.

(d) If the successful bidder, upon acceptance of its bid by the Government within the period specified for acceptance, fails to execute all contractual documents or furnish executed bond(s) within 10 days after receipt of the forms by the bidder, the Contracting Officer may terminate the contract for default.-

(e) In the event the contract is terminated for default, the bidder is liable for any cost of acquiring the work that exceeds the amount of its bid, and the bid guarantee is available to offset the difference.

Accordingly, offerors or quoters are urged and expected to inspect the site where the work will be performed.

(b) Site visits will be provided for Phase Two of the solicitation process.

52.252-1 SOLICITATION PROVISIONS INCORPORATED BY REFERENCE (FEB 1998)

This solicitation incorporates one or more solicitation provisions by reference, with the same force and effect as if they were given in full text. Upon request, the Contracting Officer will make their full text available. SUBMISSION INSTRUCTIONS

PROPOSAL SUBMISSION

INSTRUCTIONS

1. DESCRIPTION OF WORK

1.1 Volunteer Army (VOLAR) Barracks Building 632 at Fort Stewart, GA is a three-story enlisted unaccompanied barracks building (approximately 48,027 SF) built around 1977.

The building consists of 4 modules (towers) of walk-up barrack rooms. The current living units are designed to house 2 Soldiers per room, totaling 4 soldiers per floor per module. The project is to replace all failing systems within the building, convert the 2+2 living units to 1+1 units, and bring the building into compliance with current Life Safety and Accessibility Codes. The 1+1 units are to consist of a shared living space with kitchen, laundry, and dining space and separate bedroom suites with bedroom, bathroom, walk-in closet, and desk space. Handicap accessibility to building Activity spaces shall be upgraded. Activity Rooms and support spaces are required to be fully accessible.

1.2 Repairs include demolition and replacement of interior walls, windows, fire protection, doors, insulation, interior finishes, floors, ceilings, plumbing, HVAC, HVAC controls, electrical, building information systems, site utilities, and access drives. This project is needed to repair failed Building 632, Enlisted-Unaccompanied Personnel Housing (UPH) barracks to improve and maintain the Quality of Life and well-being of Soldiers. The current barracks configuration fails to meet current Army Standards for permanent party Soldiers and requires immediate repair and maintenance.

1.3 For the purposes of this solicitation, the Government will utilize the Two-Phase Design-Build Selection Process. In Phase One of the Two-Phase Design-Build selection procedure, interested Offerors will submit specified performance capability proposals for review, consideration, and evaluation by the Government. The Government will evaluate these performance capability proposals in accordance with the criteria described herein.

1.4 The Government will evaluate the performance capability proposals in accordance with the criteria described herein and will target five (5) of the most highly qualified Offerors to participate in Phase Two.

1.5 Only those Offerors who receive a written notification from the Savannah District Contracting Officer that their firm has been selected to participate in Phase Two of this solicitation will be invited to submit a Phase Two proposal. Those Offerors selected for Phase Two will be provided the technical requirements package for the subject project number 95738 Repair and Repair Bldg. 632 VOLAR Barracks, Fort Stewart, Georgia.

1.6 Evaluations of both Phase One and Phase Two factors using a Best Value Tradeoff in accordance with FAR 15.101-2.

2. GENERAL INSTRUCTIONS

2.1 This requirement will be advertised as a competitive 100% Total Small Business Set-Aside, Two-Phase Design-Build RFP solicitation; any legally organized firm may submit a proposal. Offerors submitting as a joint venture must provide the agreement forming the joint venture and the joint venture shall be registered in sam.gov.

2.2 Information submitted about any company other than the Offeror, whether a predecessor company, affiliated company, subsidiary (including wholly owned subsidiaries), or subcontractors that will perform major or critical aspects of this requirement, or other associated business, WILL NOT be evaluated for any factor. The only exception to this is that the designer of record will be evaluated in Factor 2 and information about members of a joint venture will be evaluated in Factor 1.

2.3 Offerors shall submit their proposal electronically to the address shown in accordance with paragraph 4.3 Electronic Matter Submissions below.

3. SUBMITTAL OF OFFERS

3.1 Offerors submitting proposals for this project should limit submissions to data essential for evaluation of proposals in preparing information required herein. However, in order to be effectively and equitably evaluated, the proposals must include information sufficiently detailed to clearly describe the Offeror's experience and capability, past performance, and use of small business necessary for successful completion of the project. Requirements stated in this RFP are minimums.

3.2 Innovative, creative, or cost-saving proposals that meet or exceed the requirements are encouraged and will be rated accordingly.

3.3 The Offeror’s conformance with the specified format, submission requirements, and the Offeror’s attention to detail will be considered during the technical evaluation and trade-off. Material omission(s) may result in a deficiency, which will cause the technical proposal to be rejected as unacceptable. However, in accordance with FAR 52.215-1, the Government may waive informalities and minor irregularities in proposals.

3.4 Technical proposals that do not provide the specified information in the specified location in accordance with the submission instructions may be found to have weaknesses or significant weaknesses. The Government is under no obligation to search for information that is not in the specified location.

3.5 Responses that are essentially blanket offers of compliance are not adequate substitutes for the detailed and complete technical information necessary to establish that an Offeror can meet Government needs. The proposal submission instructions are written to give prospective contractors, where feasible, an indication of the level of detail desired by the Government. The Offeror’s failure to include information that the Government has indicated should be included may result in the proposal being assigned a (significant) weakness and/or being found deficient if inadequate detail is provided.

3.6 Any prescribed page and formatting limitations will be strictly adhered to and enforced by the Government. The Government will not evaluate any excess information resulting from the Offeror’s failure to comply with the submission instructions.

3.7 Conditioning of Offer. Do not include exceptions to the terms and conditions of the solicitation in either the technical or price proposal volumes. Inclusion of any standard company terms and conditions that conflict with the terms and conditions of the solicitation may result in a determination that the offer is unacceptable and thus ineligible for award. Resolve questions about the terms and conditions or technical requirements of the solicitation prior to submission of the offer; see “Instructions to Proposer”, located in Section 00 22 16, for instructions. Notwithstanding the above, the Offeror must clearly describe in the proposal cover sheet submitted with the price volume any exceptions, within the offer, to the contractual and/or technical terms and conditions of the solicitation.

PHASE ONE EVALUATION

SUBMISSION REQUIREMENTS AND EVALUATION

CRITERIA – PHASE ONE

1. PHASE ONE, VOLUME TWO, TAB G – FACTOR 1 - PAST PERFORMANCE

1.1 SUBMISSION REQUIREMENTS

1.1.1 The Offeror shall demonstrate a record of construction performance and experience on recent and relevant projects using the Past Performance Questionnaire Summary Sheet (Attachment 2) and the Past Performance Questionnaire (PPQ) (Attachment 3) or CCASS/CPARS. The PPQ is provided for the Offeror to submit to the client (Point of Contact) for each relevant project submitted. Offeror must ensure correct phone numbers and email addresses are provided for the client. Completed PPQs must be submitted with your proposal by the specified closing date and time. Offerors should follow-up with clients to ensure timely submittal of completed questionnaires. If the offeror is unable to obtain a completed PPQ from a point of contact for a project(s) before proposal closing date, the Offeror shall complete blocks 1 – 5 of the PPQ and submit it with the proposal. Please note that, at a minimum, this first page of the PPQ must contain sufficient information for the government to determine the relevancy of the project including contract number. In addition, this will provide contract and client information for the respective project(s).

1.1.1.1 The Government may call and confirm information provided by the Offeror on the PPQs with the points of contact to the extent necessary to verify the information in the PPQ or to obtain additional information.

1.1.1.2 The Government reserves the right to interview other individuals if the point of contact is not available. By exception, the client may request submission of questionnaires directly to the Government’s point of contact (Contract Specialist), Michael Welch. Request may be made via email to michael.j.welch@usace.army.mil.

This request must be coordinated by the client in advance no later than five (5) business days before the proposal due date. PPQs submitted directly to the Contract Specialist shall be mailed via trackable means (certified US Mail, FedEx, or UPS). If the PPQ fails to arrive before the closing date and time, or if the information on the PPQ is insufficient to determine the Offeror’s name and appropriate solicitation number, it will not be considered.

1.1.1.3 Offerors are cautioned that the information submitted pertaining to a project shall be limited to the PPQ or CCASS/CPARS form, and one additional page referenced below and shall contain enough information to determine the similarity and relevancy of a project. Likewise, Project Information submitted in a format other than or in lieu of the PPQ format or CCASS /CPARS will not be considered. Offerors shall not incorporate by reference into their proposal PPQs previously submitted for other solicitations. Offerors may submit PPQs submitted on other procurements provided they are on the NAVFAC/USACE Past Performance Questionnaire Form. Offerors may attach one additional single-sided page (per PPQ or CCASS/CPARS) to further describe how the project is similar to the RFP requirements.

1.1.1.4 In addition to the PPQs or CCASS/CPARS, the Offeror’s proposal shall include the Past Performance Questionnaire Summary Sheet (Attachment 2) to provide a summary of the PPQs included and/or submitted to clients. The summary sheet shall include information for all columns.

1.1.1.5 Offerors may identify state and local government and private contracts that are similar to the Government’s requirements described in Sect. XI, paragraph 1.2.

1.1.1.6 If the Offeror is a joint venture, the projects do not have to have been performed by the joint venture submitting the offer. These projects could have been performed by either company in the joint venture. Offerors are advised to submit projects wherein the Offeror, or proposed joint venture members, played a significant role and to clearly define those roles. If any Offeror has multiple functions or divisions, limit the project examples to those performed by the division or unit submitting the offer. Ensure that the PPQs or CCASS/CPARS submitted for this Factor clearly describe the relevant characteristics of the project.

1.2 PARAMETERS

1.2.1 Offeror shall submit:

a required total of three (3) recent and relevant projects. Any more than 3 will not be reviewed or evaluated.

that have a minimum value of $12 million each.

1.2.2 Recent: All projects must be successfully completed or fully designed and at least 50% construction progress completed within eight (8) years preceding the date of this solicitation. Projects that meet these criteria will be evaluated to the recency of the offeror’s past performance.

1.2.3.1 Please note that projects submitted by design firms will not be evaluated in this factor. Design firms shall submit projects in accordance with the requirements in Factor 2.

1.2.4 Offerors shall submit no more than three (3) PPQs or CCASS/CPARS in accordance with Sect. XI, para 1.1). Project information on a PPQ shall be limited to the PPQ or CCAS/CPARS and one additional page. Where a project was awarded as a task order or delivery order under an IDIQ type contract, Offerors are cautioned to submit information specific to the task or delivery order considered relevant to the requirements of this RFP, rather than the umbrella contract. For purposes of this Request for Proposal if the Offeror is submitting as a Joint Venture, no more than three

(3) total project examples may be submitted for the entire JV. If an Offeror submits more than three (3) total project examples, only the first three (3) will be evaluated. Offerors shall submit only projects wherein the Offeror or proposed joint venture members were the prime contractors and played a significant role in the successful completion of the project. If any firm has multiple functions or divisions, limit the project examples to those performed by the division, unit, or team member submitting the offer.

1.2.5 Other Sources. In addition to the above, the Government may review any other sources other than those provided by the Offeror for evaluating past performance and experience. These other sources may include but are not limited to, past performance and experience information retrieved through the Past Performance Information Retrieval System (PPIRS), including Contractor Performance Assessment Reporting System (CPARS), using all CAGE/UEI numbers identified in the proposal on the Proposal Data Sheet, inquiries of owner representative(s), Federal Awardee Performance and Integrity Information System (FAPIIS), Electronic Subcontract Reporting System (eSRS), and any other known sources not provided by the Offeror. If a CPARS evaluation exists for a submitted project, it will be considered.

1.2.6 While the Government may elect to consider data from other sources, the offeror must provide detailed, current, accurate and complete past performance information for evaluation by the Government.

1.2.7 The experience and/or past performance of individuals will NOT be considered under this factor.

1.3 EVALUATION CRITERIA

1.3.1 Past Performance Evaluation

1.3.1.1 The past performance and experience evaluation results in an assessment of the Government’s confidence in the ability of the Offeror to meet the solicitation requirements. The past performance evaluation considers each Offeror’s demonstrated record of performance and experience on recent and relevant projects that involve a similar scope and magnitude of effort and complexities as this solicitation requires. One performance confidence assessment rating is assigned for each Offeror after evaluating the Offeror’s recent past performance and experience, focusing on performance and experience that is relevant to the contract requirements.

1.3.1.2 If a firm has multiple functions or divisions, the Government will only evaluate the past performance and experience of the unit or division submitting the offer.

1.3.1.3 Projects must meet the minimum criteria in Phase One para 1.2 to be considered recent and relevant and will be evaluated against the requirements of the
