About this file

This document is a justification and approval for other than full and open competition for the procurement of fire alarm and mass notification systems at Fort Gordon, Georgia. The U.S. Army Corps of Engineers Savannah District requires the installation of Notifier Onyx fire alarm control panels and related equipment from Honeywell in various construction projects at Fort Gordon totaling approximately $534 million through fiscal year 2027. The justification cites Defense Federal Acquisition Regulation guidance allowing for other than full and open competition when only one source can meet the agency's requirements. Compatibility with the existing Monaco mass notification system at Fort Gordon is required by Department of Defense standards to ensure emergency messages can be delivered across the base, and only the Notifier Onyx system will integrate fully with the Monaco system. The estimated total value of the required fire alarm control panels and related equipment is $550,000.

FAR Part 6 Justification and Approval for Other than Full and Open Competition

1. Contracting Activity: U.S. Army Corps of Engineers (USACE), Savannah District, 100 W. Oglethorpe Ave, Savannah, GA 31401

2. Description of Action: USACE Savannah District is requesting approval for the usage of a brand name item to be incorporated into construction projects; Notifier Onyx Fire Alarm and Mass Notification Systems that integrates with the Monaco transmitter.

This is the fire alarm and mass notification signal system that uses proprietary frequencies and software that require both the Installation Emergency Center and Fire Department Dispatch to use the same equipment. This also requires the compatible equipment be installed in required buildings on Fort Gordon so that emergency transmissions are transmitted on the base all building can receive the transmissions. As a result, this Justification and Approval is applicable to various types of facilities due to the numerous projects which will be procured by the District. This Brand Name Class Justification and Approval (J&A) will cover all new construction contract actions requiring use of a brand name, Monaco and Notifier Onyx Systems a Honeywell subsidiary, at Fort Gordon, Georgia. The resulting contracts will be Firm Fixed Price (FFP), Design Build or Design Bid Build construction contracts utilizing Military Construction (MILCON) or Sustainment, Restoration, and Modernization (SRM) funding.

3. Description of Supplies/Services: USACE has requirements to design and construct approximately $534M of new facilities at Fort Gordon, Georgia over the next five years (2023-2027). As a result of planning and programming, the Army developed and Congress approved 16 distinct projects, each approved on a separate DD Form 1391, required for MILCON or SRM of the base. The type of unique facilities will include, but are not limited to, training areas, classrooms and training centers, barracks, headquarters complexes, training ranges, MWR facilities, child development centers, recreation facilities, and all supporting infrastructure (gates, utilities, drainage, roads) across Fort Gordon. As part of the design and construction effort, mass notification and fire alarm systems will be installed in these buildings. This Brand Name J&A is for all new fire alarm and mass notification signal system units to be incorporated into the construction contracts at Fort Gordon from the approval date of this J&A through FY 2027. The Government will not purchase these items directly, but will require the construction contracts to provide and install the following depending on building size, number of detection equipment (smoke alarms for example), number of suppression equipment (fire sprinklers), or notification equipment (loudspeakers) connected to the control panels detailed in the below table 1. The more equipment required to be connected to the control panel, the larger or more capable the control will be needed for the install. Table 1 lists the control panels in order of size and capability, with the Notifier NFS-320 utilized in smaller buildings with fewer detection and suppression equipment managed by the panel. The Notifier NFS2-3030 and N-16E utilized in larger building or those with higher number of detection and suppression equipment managed by those panels.

4. Authority Cited: The statutory authority permitting acquisition of the requirement by other than full and open competition is 10 U.S.C. 3204 (a)(1) as implemented by FAR Part 6.302-1 (a)(2); Federal Acquisition Regulation (FAR) 6.302-1(c) Only one responsible source and no other supplies or services will satisfy agency requirements;

and Defense Federal Acquisition Regulation Supplement (DFARS)206.302-1(c)(2) and (S-70)., as implemented by Federal Acquisition Regulation (FAR) 6.302-1 (a)(2), only one responsible source and no other supplies or services will satisfy agency requirements. This authority is applicable to brand name justification in accordance with (IAW) FAR 6.302(c)(1).

5. Reason for Authority Cited: As described at FAR 6.302-1(a)(2), when the supplies or services required by the agency are available only from one responsible source, or for DoD, NASA and the Coast Guard, from only one or a limited number of responsible sources, and no other types of supplies or services will satisfy agency requirements, full and open competition need not be provided for. As further described in FAR 6.302-1(c), an acquisition or portion of an acquisition that uses a brand-name description or other purchase description to specify a particular brand-name, product, or feature of a product, peculiar to one manufacturer does not provide for full and open competition, regardless of the number of sources solicited; and shall be justified and approved in accordance with FAR 6.303 and 6.304.

a. Background: Due to post wide compatibility requirements and based on the capabilities described below of a Notifier/Monaco Fire Alarm system, all new construction and renovation projects at Fort Gordon are now featuring the latest version of the Notifier Onyx Systems. New Fire Alarm installations must interface with the Monaco Mass Notification Systems (MNS) in accordance with DoD Unified Facilities Criteria (UFC) 3-600-01 and 4-021-01, which cover Fire Protection Engineering for Facilities and Design and O&M: Mass Notification Systems, respectively. The existing Radio Frequency (RF) infrastructure provided by Monaco supports the UFC requirements for primary MNS communications.

b. Justification: In order to satisfy UFC 4-021-01 requirement of a Mass Notification System, a seamlessly compatible system must be installed. The Notifier/Monaco Fire Alarm System is used throughout Fort Gordon. Due to compatibility requirements, only the Notifier Onyx System compatible with the Monaco system can guarantee delivery of emergency messages to all persons located on the base. For items as important to life, health, and safety as the Fire Alarm and Mass Notification Systems there is no room for error when these products are called upon to be operational.

c. Alternatives: The Notifier/Monaco Fire Alarm and Mass Notification System in use at Fort Gordon Fire Department Dispatch is not compatible with equipment from other manufacturers, and there are no alternatives. Only the Notifier Onyx System will incorporate into post-wide Monaco Mass Notification System fully.

Previously, other control panels were able to incorporate into the post-wide Monaco Mass Notification System with a third-party gateway software (DACR Gateway). That software was discontinued by the manufacturer in 2021 and did not offer the full notification capabilities that Fort Gordon requires (it lacked certain Control and Paging functions).

Impact: If the J&A is not approved and a different Fire Alarm System is installed the fire alarm system would fail the mission requirement to provide an integrated fire alarm system with a mass notification compatible with Fort Gordon Fire Department Dispatch. The system would not function properly during an emergency, putting the life, health, and safety of Soldiers and civilians at Fort Gordon at risk

6. Efforts to Obtain Competition: The Contracting Officer shall publish the notices required by FAR 5.201 and any bids or proposals received shall be considered.

a. Effective Competition: The District has multiple Acquisition plans to execute each requirement. Effective competition will be achieved via multiple ways, including full and open, small business set asides and competition for multiple award task order contracts. While it is understood that any Brand name Justification and Approval automatically limits competition, no requirement is intended to be a sole source action. If approved, this Justification and Approval will be posted at the same time as each solicitation. Potential Contractors will be made aware that specifications for subsequent projects will require the installation of Onyx Notifier Systems. This then alerts them to engage subcontractors that are certified in installing this item.

b. Subcontracting Competition: Multiple suppliers will be available to compete to provide Notifier Onyx Systems at a subcontracting level. It is likely that the competition will exist for installers and suppliers. The Savannah District will have multiple strategies for the 16 projects at Fort Gordon providing for multiple opportunities for companies to compete for this opportunity.

7. Actions to Increase Competition: Based on Market Research (Section 8 of this document), there are companies in the commercial marketplace that offer the Onyx Notifier System. A Notice of Intent (NOI) was not posted due to the knowledge that there is commercial availability of the brand name item. It is apparent that there are adequate numbers of suppliers available to provide the required item. The UFC 4-021-01 requirement to use a standardized and compatible fire alarm system in all buildings at each installation means that only the items listed in this Justification and Approval will be required. Due to this standardization requirement, there are no planned actions to increase competition for the requirement.

8. Market Research: Market research indicated that competition for the brand name product, Notifier Onyx Systems, will exist since they are readily available in the commercial marketplace and there are multiple companies that are licensed to sell the products. A search of the manufacture’s website detailed 25 distributors in the Fort Gordon area. Nationwide, there are 200 distributors. Because there are multiple sources, it is reasonable to expect that a fair and reasonable price will result from adequate competition at the subcontracting level. Notifier Onyx Systems do not require certified installers but do require certified technicians to interface the new building control panels with the existing Notifier Onyx System and Monaco Mass Notification System. The equipment is installed based on drawings and specifications by the electricians and installers of fire alarms and fire suppression systems utilizing both electrical and network connections. There is a certification for bi-directional Amplifier (BDA) and Distributed Antenna System (DAS) but those are national standards for Mass Notification and Fire Alarm Systems and not specific to Notifier Onyx Systems. BDA and DAS are requirements for specific frequencies for the Mass Notification Systems and the radios used by fire fighter/first responder personnel within buildings to maintain radio contact with each other, commanders, and dispatch.

9. Interested Sources: As stated previously, a NOI was is not required per DFARS 206.302-1(d). The availability of the required system in the commercial marketplace indicates there are interested sources. Subcontracting will be available for these systems. This J&A will be posted with the issuance of the solicitation in accordance with FAR 5.102(a)(6).

10. Other Facts: Reasonable efforts were made to retrieve other facts from computer records, contract files, and other sources to support the use of other than full and open competition as follows:

2) The competitive status of these actions: Full and Open.

3) Authority previously cited if less than full and open competition was used: Not Applicable.

4) If a justification was prepared to support the procurement made before this one, a summary of the contents of paragraph 7 of the justification for that procurement and an explanation of the results: A Justification and Approval for use of brand name (Notifier Onyx Systems) was prepared for W912HN21C3003. The requirement for the use of brand name equipment was discovered after award.

Regulations UFC 3-600-01 and 4-021-01 require that new fire alarm equipment integrates with the existing mass notification system (Monaco Mass Notification System). The brand name requirement was added with a modification to the award and request for equitable adjustment settled with the contractor for including different equipment in their bid since the brand name requirement was not included in the solicitation.

5) If any prior contract for this requirement was accomplished using full and open competition, include a detailed explanation of the changed circumstances causing this action to now limit the sources: As stated in item 4 above, it was discovered that brand name equipment is required for the Mass Notification and Fire Alarm Systems on Fort Gordon.

6) An explanation of any unusual patterns that may be revealed by the history, e.g., several consecutive, urgent buys: Based on the historical acquisition of these items in Table 3 and the estimated workload found in Table 2, there are no unusual patterns present. The equipment is required by UFC 3-600-01 and 4-021-01, but it does not constitute urgency or consecutive buys. There have been several acquisitions in close proximity, as demonstrated in Table 3, but only due to funding and acquisition schedules that push a majority of acquisitions into the third and fourth quarters of the fiscal year. .

7) If a justification was prepared to support the procurement made before this one, briefly describe the circumstances justifying the procurement and whether there have been any significant changes:
