Questions and Answers

NOTE: THIS IS A FIXED PRICE CONTRACT. PAYMENT WILL ONLY BE MADE

BASED ON THE UNIT PRICE THAT IS PROPOSED AND INCORPORATED INTO

THE AWARDED CONTRACT. NO ITEMS WILL BE REIMBURSED AT ACTUAL COST.

ESTIMATES PROVIDED IN THESE RESPONSES ARE FOR INFORMATIONAL

PURPOSES ONLY AND ARE NOT SET AMOUNTS TO BE UTILIZED FOR QUOTING

PURPOSES.

1. Question: Can we provide a quote only on the states in which we service?

Answer: In order for a quote to be technically acceptable, you must be able to complete all work as described in the Performance Work Statement, including the ability to perform in all locations listed. Subcontracting is not prohibited in order to meet these requirements. However, any subcontractor must also be able to meet all legal requirements and certifications per the Performance Work Statement.

2. Question: In title it is standard practice and fully insurable to the lender to be provided a location drawing and not a boundary survey due to the cost. A location drawing cost is significantly lower and shows the exact detail as prescribed in the sample that was provided. For example the cost of a Boundary Survey is starts at $750 but can exceed $3,000 depending on the State, the acreage of the parcel and if there are preexisting markers that can be found. However, the cost of a location drawing would be between $250- $500 and requires an onsite visit that last but a few minutes and can be issued in a matter of days as opposed to a Boundary Survey that can take weeks to perform and document.

The cost for a boundary survey is mainly dependent on the location, acreage, and typography of the land or parcel and could exceed that amount if the property is heavily wooded or not a standard rectangle or square. However a location drawing provides the same detailed information however absent of marking the property with stakes. Also if a Boundary survey is required are only the corners to be identified or the entire parcel and each change in direction. (Regarding Section V & VI, paragraph 5). Also Surveyors who perform such Boundary Surveys require deposits before the work can be initiated, whereas a location drawing is performed and invoiced.

Answer: Department of Justice (DOJ) requires a boundary survey performed by a licensed surveyor. Location drawing or plot plan is not acceptable.

3. Question: What was the approximate number of closings by region, closed in any of the previous years since the prior 2012 Award. Or the number of transactions estimated for future closings to be performed?

Answer: See numbers below based upon actual and projected closing. Projected locations are based upon received property locations that have been approved or pending approval for HAP benefits.

4. Question: According to the SOW it states we are to price the cost of the required DOJ Inspections for Pre-closing. (Section II, Paragraph 6b, Sec V Paragraph 1. VI paragraph 5) how is access to the property gained? Does the Contractor hire the Realtor or is this performed by the Government or seller.

Answer: Most properties are occupied by our Applicant (Owner) or their/Tenant. Our Applicant provides us with POC information, which we will provide to the Contractor at the time of the initiated title order.

5. Question: For Estimating purposes for the quote, can you provide a price for the estimated amount of consideration for the properties as well as some sort of geographical location, or region? Title insurance is based on price, and most not all states have filed rates, also the cost of the abstract may differ based on how the municipality in which the property is located maintains their land records. A 60 year search in Texas cost a lot less than a 6 year search in New York, as an example.

Answer: Average Consideration $175,000 (ref. locations above).

6. Question: For estimating the requested Boundary Survey, again can you provide a basis for the quote, if a property is in a subdivision, vs a single home on 1 acre, the cost will be significantly different by several hundred dollars. If the homes are located near a base it is likely that they are potentially large in lot size therefore the cost will be based on the square footage of the property.

Answer: Average Residential size lot located in neighborhood setting of less than ½ Acre. (ref. locations above).

7. Question: According to the quote sheet for services the government request the cost of Title Exam including, Title Binder, Endorsements, Title updates and curative actions.

Can the government provide an estimated value or sales price since the cost is predicated on the value to be insured? Also what endorsements will be required? Each jurisdiction has different cost, and endorsements in certain states are included and in some areas they are not.

Answer: Endorsements – typically we see Alta Form 4 Condominium, 5 Planned Unit Development and 9 Restrictions, Encroachments, Minerals.

8. Question: According to the requested quote form, the government asks for an estimated cost for Recording Fees (Section II, paragraph 4 and Section VI paragraph 3) as well as Deed Stamps in that same section. Without knowing the consideration amount, State, and municipality this is impossible to determine, can you amend this or give a specific example for quoting purposes?

Answer: Average Purchase Price $175,000 (Ref. locations above).

9. Question: Section 1, paragraph (f): This section says generally that for houses that are acquired by the US Government as part of the HAP program are subject to a pre-closing inspection “to insure that the property is completely vacant, inside and outside, prior to closing.”

Does this mean that the soldier/service members have moved out PRIOR to closing? If so, how will we get access to the property to conduct the inspections? Does the government provide a contact that will let our agent in to the homes to complete the inspection, or does the service member do this?

Answer: Yes, the HAP Applicant is required to move out at least 3 days prior to scheduled closing and home is to be left broom clean and clear of all debris. POC for access to the home during occupancy and after they have moved is identified and an information sheet is provided at the time the property is initiated for title services, DOJ Survey and Inspection.

10. Question: For Clins# 1-4: I am not sure that I understand the differences between these items. I understand that Clin #2 is for government acquisition of properties, Clin #3 is for Resale of those properties, and that Clin #4 is for cancellations. What is Clin #1 for? Is this for when the servicemember obtains a home refinance or similar product from a different lender and the government assists with that process?

Answer: No, Clins 1 is for the Initiation part of every government acquisition closing.

This portion of the work is usually invoiced upon completion and does not need to wait until the closing is complete, unlike the Clins# 2 and 3 are invoiced after the closing.

11. Question: Section 5: DoJ inspections and property boundary surveys: This section states that the surveys must have a “Department of Justice Inspection certificate.”

Would you happen to have a sample of this item? Section 6, part (5) also discusses “Department of Justice Inspections” and “Property Boundary Surveys”. Are these 2 separate things or are they the same thing?

Answer: Sample of DOJ Inspection and Survey are attached and were included in the solicitation. DOJ requires a property survey and inspection as we initiate a government acquisition. Also, if there is no resale, the DOJ requires and pre-closing inspection.

Below is list of sample forms as referenced within the solicitation:

DOJ Certificate of Inspection and Possession (Section VI Paragraph 5)

DOJ Property Inspection Report (Section VII Paragraph 5)

DOJ Survey (Sample) (Section VI Paragraph 5)
