SECTION 00010 - NOTES TO OFFERORS

ELECTRONIC PROPOSAL SUBMISSION IS REQUIRED THROUGH THE WEBSITE LISTED

BELOW. ELECTRONIC SUBMISSION SENT VIA E-MAIL OR FACSIMILE WILL NOT BE

ACCEPTED. HAND CARRIED PROPOSAL SUBMISSION IS NOT AUTHORIZED.

DIRECTIONS FOR SUBMITTING PROPOSALS

In an effort to reduce paperwork and reduce cost, all proposals shall be submitted electronically. All submissions shall be in Adobe PDF format. The Price Proposal and Technical Proposal shall be submitted as “separate” single files. Offerors may use compressions utility software such as WinZip or PKZip to reduce file size and facilitate transmission.

Title the file(s) in the following format:

W912HN-14-R-0026_COMPANY NAME_VOLUME I

W912HN-14-R-0026_COMPANY NAME_VOLUME II

Submit the Price and Technical proposals electronically via the AMRDEC SAFE website at:

https://safe.amrdec.army.mil/SAFE2/Welcome.aspx. At the AMRDEC SAFE website select the link: I do not have a CAC or this machine is not configured to read my CAC and I would like to access SAFE as a Guest User, to register, access the site and submit your proposal(s). [Note: It has been reported that documents are more quickly uploaded into the AMRDEC SAFE website when using a Firefox web browser. The Government cannot verify that this is true and offers no guarantee that offerors will have more success utilizing any particular browser.]

When completing the information for transmittal at the AMRDEC SAFE website, you will be asked to enter e-mail addresses for the recipients. When your proposal is submitted via the AMRDEC SAFE website, the website will provide notification of the submittal to the recipients.

For this solicitation, the recipients will be the Contracting Officer and Contract Specialist. The Contract Specialist for this project is Mr. Addison Layfield, whose e-mail address is Addison.G.Layfield@usace.amy.mil. The Contracting Officer for this project is Mr. Bruce Helms, whose e-mail address is bruce.a.helms@usace.army.mil. These e-mail addresses are to be entered as the recipients.

In addition, after uploading your documents, you will be required to verify your email address before AMRDEC will send notification to the Government recipients. This is a very important step – even if you successfully upload your proposal to AMRDEC SAFE, notification will not be sent to the Government until you verify your email address, which may result in the rejection of your proposal for lateness. Follow the instructions on the AMRDEC website and confirmation emails you receive from AMRDEC.

Proposal Due Date and Time:

Request For Proposal No: W912HN-14-R-0026 Due Date of Proposal: December 11, 2015 Time by which Proposals are Due: 2:00 P.M. (Eastern Time) Title of Project: Single Award Task Order Contract (SATOC)

Lakes and Dams, Georgia and South Carolina

The date and time of delivery will be established by the time of receipt of the e-mail notification to the Contract Specialist and Contracting Officer by the AMRDEC SAFE website, not by the date and time of uploading of the proposal into the AMRDEC SAFE website. Do not assume that electronic communication is instantaneous – in fact, it can take several hours in some cases. Please make allowances for delays in transmittal. If an electronic submission is uploaded minutes before the deadline but notification is not actually received in the recipients’ e-mail inboxes until after the deadline, the submission will be considered late.

The Government will not be responsible for proposals delivered to any location or to anyone other than those designated to receive proposals on its behalf. Offerors are responsible for ensuring that proposals are submitted so as to reach the designated recipient of proposals. Offerors are responsible for allowing sufficient time for the proposal to be received in accordance with the information provided.

QUALITY CONTROL SYSTEM (QCS): Any contract award resulting from this solicitation will require the mandatory use of the automated Quality Control System. Please see Section 01 45 00.10 10 for additional information.

WAGE DETERMINATIONS: The appropriate wage determination will be incorporated on a task order by task order basis.

TECHNICAL MATTERS: Submit technical inquiries and questions relating to this solicitation via Bidder Inquiry in ProjNet at (https://www.projnet.org) at least 10 calendar days prior to the date established in the RFP for receipt of proposals. The Government reserves the right to decline addressing questions received less than 10 calendar days prior to receipt of proposals.

If an Offeror believes that the requirements in this Request for Proposal contain an error, omission, or are otherwise unsound; immediately notify the Contract Specialist in writing with supporting rationale. The Government reserves the right to award this Request for Proposal based on the initial proposal, as received, without discussion.

To submit and review inquiry items, prospective vendors will need to use the Bidder Inquiry Key presented below and follow the instructions listed below the key for access. A prospective vendor who submits a comment or question will receive an acknowledgement via e-mail, followed by an answer after it has been processed by our technical team. Approved answers to all timely questions will also be posted on the FedBizOps in the form of a report generated from ProjNet as soon as the comment/question entering period is over and answers are all finalized. 2.1. The current year edition of the R.S. Means Construction Cost Data is hereby incorporated by reference and the current edition at the beginning of each calendar year will be incorporated into the contract for the duration of this contract including option periods. The Offeror shall use the Electronic Version of R. S. Means Building Professional’s Package which includes Building Construction Cost Data, Mechanical Cost Data, Plumbing Cost Data, Electric Cost Data and the Square Foot Cost. Offeror must purchase “Assemblies Cost Data” separately.

For renovation projects, the offeror shall use the Repair and Remodeling Cost Data. The

Offeror may use the quarterly pricing updates to the R.S. Means. Offeror shall use Means Cost Works Estimator to prepare and submit task order proposals. These items may be obtained from the R.S. Means Company at www.rsmeans.reedconstructiondata.com or 1-800- 334-3509.

2.2. Area Coefficient: The Offeror’s area coefficients shall be represented as a percentage “increase” or “decrease” to the R.S. Means. When pricing material, labor and equipment, the “Total Bare Costs” column in the R.S. Means will be used, NOT the “Total Incl O&P” column (with the exception of Professional Consultants (designers), see paragraph 2.5 below) . Overhead and Profit will be accounted for as follows:

Fringe Benefits and Labor Burden

- The Total Bare Costs column in R.S. Means includes fringe benefits such as vacation pay, employer paid health and welfare costs, pension costs, etc. If the R.S. Means Bare Costs are insufficient to cover your fringe benefits, you must account for the difference in your area coefficients; they will not be separately negotiated.

- All items that constitute labor burden (e.g. federal and state unemployment costs, Social Security and Medicare taxes (FICA), Workers’ Compensation Insurance, etc.) shall be accounted for in your area coefficients. The only exception is for labor burden on Field Office costs. On a task-order by task-order basis, the contractor may propose a separate mark-up on Field Office costs to account for labor burden and this mark-up will be negotiated.

Home Office Overhead (HOOH) will be set at the rate(s) proposed by the offeror for the base and option year periods and will not be negotiated. The awarded HOOH rates will be binding for the life of the Contract.

Profit will be negotiated for each task order. The Government prefers that the contractor use the weighted guideline method, specified in Specification Section 01 08 00. Other methods are acceptable as long as they are analytical.

2.3. Items Included in Area Coefficient:

2.3.1. There will be NO allowances for any additional costs beyond what the Area Coefficients cover; therefore the coefficients must be all inclusive of costs incurred.

2.3.1.1 The following items will not be paid separately and shall be included in the Area Coefficient:

2.3.1.3 Cost Adjustments. When pricing items, no R.S. Means cost adjustment factors shall be permitted, except for:

Vertical work that exceeds 15 feet.

Security, but only if workers are required to be escorted while working in a secured compound.

2.3.2. Offeror WILL NOT be allowed to use the following items from the R.S. Means.

• 01 31 13.40 – Main Office Expense. This item should be taken into consideration when proposing the Home Office Overhead rate.

• 01 31 13.60 – Installing Contractor’s Main Office Overhead.

• 01 31 13.80 – Overhead and Profit. (See paragraph 2.2 above.)

2.3.3. The following line items will only apply after completion of a new facility or interior facility rehabilitation:

• 01 74 13.20 0100 – Final by GC at end of the job.

2.3.4. Sales Taxes. For the state of North Carolina, the Government will pay sales taxes for material cost only. The appropriate sales tax will be calculated on the material bare cost after to applying the area coefficient.

2.4.1. All proposed non-priced items shall be separately identified and priced.

Proposed non- priced items must be documented by supporting information as specified below:

(a) A minimum of THREE (3) competitive contractor quotes (or) if requested and approved by the Contracting Officer,

2.4.2. Non-priced items proposed by the offeror will be fully negotiated prior to award.

2.4.3. The Area Coefficient SHALL NOT be applied to non-priced items. The Non-Priced Item(s) as proposed, shall include ALL Subcontractor markups (e.g. Home Office Overhead, Field Office Overhead, Bond Premium and Profit). However, the Home Office Overhead rate fixed in the contract shall be used and will not change.

2.5. Work to be performed by the prime contractor and subcontractor(s) shall be priced using the “BARE COSTS TOTAL” column in R.S. Means. The appropriate area coefficient will then be applied to the total of these costs. Work performed by the Professional Consultant (designer (s)) shall be priced using the “TOTAL INCL O&P” column in R.S. Means.

2.6. Union Rates will be used for pricing Labor. Offeror shall consider any Davis Bacon wage rate increases in their proposed area coefficient.

2.7. The Area Coefficient will apply for the two (2) year base period and three (3) option periods of the contract or up to the maximum capacity of $45,000,000.00.
