1.22 PUBLIC CONVENIENCE AND SAFETY

(a) Roads to be closed. No road shall be closed to the public by the Contractor until construction of the new facilities infringe upon the public safety or until construction of the new facilities obliterate the existing facilities. The Contractor shall obtain the Contracting Officer's approval before closing any roads. Barricades, danger, warning and detour signs, as required, shall be erected before closing any roads.

(b) Storage of materials. Materials and equipment shall not be stored within roadway rights-of-way or in such a manner as to pose possible danger or obstruction to the traveling public.

(End of Clause)

1.23 MAINTENANCE DURING CONSTRUCTION

From the first day any work is done, the Contractor shall maintain in an equally satisfactory condition all of the items of work covered by the contract until they are finished, placed in service unfinished, or until all of the work is finally accepted. This maintenance shall be continuous and effective work prosecuted day by day with adequate equipment to the end that roadway and structures are kept in satisfactory and acceptable condition. The Contractor shall be responsible for maintaining all barricades, danger, warning, and detour signs and lights as specified hereinafter. (End of Clause)

SECTION 01 10 00.10 38 Page 11

1.24 PARTNERING

In order to most effectively accomplish this contract, the Government proposes to form a cohesive partnership with the Contractor and its subcontractors. This partnership would strive to draw on the strengths of each organization in an effort to achieve a quality project done right the first time, within budget and on schedule. Integral to the partnership would be a joint Contractor/Government effort to settle any disputes that may arise without costly and time consuming litigation. To that end, a non-binding procedure such as the Alternate Dispute Resolution process could be developed and agreed upon by both parties when it is determined to be necessary. This partnership would be bilateral in make-up and participation will be totally voluntary. Any cost associated with developing this partnership will be agreed to by both parties and will be shared equally with no change in contract price.

(End of Clause)

1.25 LOAD RESTRICTIONS

The Contractor shall comply with all legal load restrictions in the hauling of materials on public roads beyond the limits of the project. A special permit will not relieve the Contractor of liability for damage which may result from such hauling. The Contractor shall not operate equipment of such weight or so loaded as to cause damage to drainage structures or the roadway, or to any other type of improvement, either completed or under construction. Hauling of materials over the existing surface shall be limited as directed, and in no case shall legal load limits be exceeded unless permitted in writing. The Contractor shall repair, at his own expense, all damage to the work caused by his equipment.

(End of Clause)

1.26 BARRICADES, DANGER, WARNING, AND DETOUR SIGNS

The Contractor shall provide, erect, and maintain all necessary traffic control devices in substantial conformance to Part VI of the 1988 "Manual on Uniform Traffic Control Devices for Streets and Highways" as published by the U.S. Department of Transportation, Federal Highway Administration, and available from AMERICAN ASSOCIATION OF STATE HIGHWAY AND TRANSPORTATION OFFICIALS (AASHTO), U.S. DEPARTMENT OF TRANSPORTATION (DOT). This requirement shall include flagman as shown in the manual when necessary and the use of electric flashers as conditions of construction may require during hours of darkness. The Contractor shall take all necessary precautions for protection of the work and for the safety of the public at or near the site of construction. Signing, barricades, lights, and other devices shall be well maintained and repositioned or removed as the progress of the work requires. No substandard, poorly maintained device will be acceptable. Particular attention shall be given to the following:

(a) Removal of barricades and warning signs. As soon as construction advances to the extent that temporary barricades, and signs such as "Detour", "One Way Traffic," etc. are no longer needed to inform the traveling public, such signs shall be removed promptly.

(b) Replacement of signs. When new work is necessary during any period of construction or maintenance, necessary signs shall be replaced as are needed to adequately warn and protect the public in accordance with the

SECTION 01 10 00.10 38 Page 12 provisions outlined above. As soon as the project has been accepted for maintenance, all temporary barricades and warning signs shall be removed promptly.

(c) Cost of protective devices. Unless otherwise shown in the Bidding Schedule, the cost of furnishing, erecting, maintaining, and removing protective devices will not be paid for as separate bid items.

Where the Contractor is required to perform any of these functions, the cost thereof shall be included in the overall bid submitted. Ownership of the temporary warning devices shall remain with the Contractor provided the devices are removed promptly after completion of the work as specified above. If such warning devices are left in place for more than 30 days after the specified time for removal, the Government shall have the right to remove such devices and to claim possession thereof.

(End of Clause)

1.27 PROTECTION OF EXISTING FACILITIES

The Contractor will not be responsible for any alterations to existing structures or utilities except those made by him for his convenience. The Contractor shall protect all existing structures, including bridges, roadway embankments, utilities and improvements from damage, and, in the event of damage as a result of his operations, the Contractor shall be responsible for their repair, restoration, or for all cost of damage resulting therefrom. In addition, the Contractor shall be responsible for any damage to bridge or culvert structures or railway embankments or track caused by the unauthorized excavation or excavation beyond the project dimensions shown on the plans. If the Contractor elects to have alterations made to any existing structure, utility or other improvements for his convenience, he shall make arrangements with the owner of the facility for such alterations and the agreement shall be approved by the Contracting Officer prior to their alteration.

(End of Clause)

1.28 CONTRACT AREA AND TRESPASSING

Property owners have signed easements which will allow the Contractor to enter and perform the work required by these specifications upon all land lying within the right-of-way limits shown on the drawings. The Contractor's operation shall be confined solely to those areas for which permission has been granted by the owners to enter. The Contractor shall cut only such timber as may be necessary for the prosecution of the work.

The Contractor shall not inflict damage upon land outside the contract area by unwarranted entry upon, passage through, or disposal of material on such land. The Contractor may make a separate agreement with any other party, regarding the use of, or right to, lands or facilities outside the contract area. If such an agreement is made, it shall be in writing and a copy shall be furnished the Contracting Officer. The Contractor shall hold and save the Government, its officers, and agents free from liability of any nature or kind arising from any trespassing or damage occasioned by his operations.

(End of Clause)

1.29 COORDINATION WITH OTHER CONTRACTORS

Other Contractors may be working in the vicinity during the time period of

SECTION 01 10 00.10 38 Page 13 this contract. The Contractor shall coordinate the contract operations with other Contractors in the area as needed to avoid conflicts and delays.

(End of Clause)

1.30 EQUIPMENT TESTING AND INSTRUCTION

(a) The Contractor shall perform full-scale operational testing for a period as recommended by the equipment's manufacturer to ensure that each individual piece of equipment and all equipment systems installed under this contract are functioning properly. Tests shall be made in presence of the Contracting Officer's Representative and shall be made using all fluids, solutions, and materials required for actual operation with the exception that clear water will be used for testing components of the wastewater systems which handle wastewater or treated effluents under normal operation.

The Contractor shall notify the Contracting Officer's Representative a minimum of two working days prior to the date that testing is scheduled to begin so that the Contracting Officer's Representative can be present to observe critical phases of testing.

The above sentence is to be used when the required period is so long that it would be unreasonable for the Contracting Officer's Representative or his representative to be present for the full duration of testing. If only a few hours of operational testing are required, it should be done in the presence of the Contracting Officer's Representative.

(b) The Contractor shall make any necessary adjustment to and retest any equipment which fails to perform satisfactorily and in accordance with the contract requirements. The Contractor shall continue to adjust and retest the equipment at no additional cost to the Government until suitable results are obtained.

(c) Portions of the work which include any piece of equipment will not be accepted as substantially complete before the equipment is fully operational both individually and as part of any system in which the piece of equipment is a component.

(d) No less than ninety (90) days prior to the anticipated date of Government acceptance of the work, the Contractor shall furnish a list of spare parts recommended by the equipment manufacturer to be kept on hand at all times by the operator.

(e) No more than thirty (3) days prior to the date the Government takes possession of the work, the Contractor shall make arrangements with the Contracting Officer's Representative to train the anticipated operator of the equipment. As a minimum, the Contractor shall furnish a manufacturer's representative, supplier, or other person thoroughly familiar with the equipment for 8 hours at the site to demonstrate the operation of the equipment to the operator and answer questions pertaining to the equipment. The Contractor shall provide written operational instructions, including a troubleshooting guide, for each system and/or piece of equipment, as applicable, and a list of sources for spare parts and repairs.

(f) The requirements of this paragraph are in addition to any testing and instructional requirements of the technical provisions.

SECTION 01 10 00.10 38 Page 14

(g) No separate payment will be made to the Contractor for fulfilling the requirements of this section. The work shall be considered incidental to the installation of the various equipment systems.

(End of Clause)

1.31 CONTRACT DRAWINGS AND SPECIFICATIONS

(AUG 2000) DFARS 252.236-7001

(a) The Government will provide to the Contractor, without charge, five (5) sets of contract drawings and specifications, except publications incorporated into the technical provisions by reference, in electronic or paper media as chosen by the Contracting Officer.

(b) The Contractor shall—

(1) Check all drawings furnished immediately upon receipt;

(2) Compare all drawings and verify the figures before laying out the work;

(3) Promptly notify the Contracting Officer of any discrepancies;

(4) Be responsible for any errors that might have been avoided by complying with this paragraph (b); and

(5) Reproduce and print contract drawings and specifications as needed.

(c) In general--

(1) Large-scale drawings shall govern small-scale drawings;

and

(2) The Contractor shall follow figures marked on drawings in preference to scale measurements.

(d) Omissions from the drawings or specifications or the misdescription of details of work that are manifestly necessary to carry out the intent of the drawings and specifications, or that are customarily performed, shall not relieve the Contractor from performing such omitted or misdescribed details of the work. The Contractor shall perform such details as if fully and correctly set forth and described in the drawings and specifications.

(e) The work shall conform to the specifications and the contract drawings identified in Section 00 01 15: LIST OF DRAWINGS.

11 33 70 02.00 10 1.3 Installation Engineer CERTIFICATES FIO switch enclosed in a float. Use pipe mounted float assembly. Use float molded of rigid high-density polyurethane foam, color-coded and coated with a durable, water and corrosion-resistant jacket of clear urethane. Provide connecting cable and support pole in accordance with manufacturers recommendations. Provide a cast aluminum NEMA Type 4 junction box to connect float assembly. Use box with a gasketed cover with tapped float fitting and conduit entrance pipe threaded opening. Mount floats at fixed elevations as shown. Use floats designed to tilt and operate their switches causing sequential turn-on turn-off of the pump, when the liquid level being sensed rises or falls past the float.

2.5.2 Alternator

Provide an alternator control switch to operate in connection with each float. Use alternator control switch to alternate the operation of the pumps and operate both pumps if the water level rises above the second high water level. Incorporate time delay function and devices in the alternator controls such that both sewage pumps cannot be started simultaneously for an adjustable period of 10 to 120 seconds after shutdown. Use delay function designed to operate in any condition of start-up in either normal or emergency operational mode.

2.5.3 Sewage Pump Alarm and Control Panel

Enclose alarm panel in NEMA IV enclosure and with a flashing red light with long life bulb in guarded enclosure and 6 inch diameter horn. Horn must emit 120 DB at 10 feet. Power alarm horn and light from 12V DC power supply with battery backup. Provide a rechargeable battery rated to power both the horn and light for a minimum of two hours upon loss of main power.

Provide circuitry to automatically recharge the battery after main power is restored. Full charge of battery must take no more than 20 hours. Use panel swith power on light, push to test button for horn and light and push to silence button for horn and light with automatic reset for next alarm.

Provide automatic dialer equal to United Security Products AD-2000 for PS-1 only. Program alarm voice messages and numbers called with Contracting Officer. Use alarm designed to activate under the following conditions:

a. High liquid level as sensed by float switch

b. Loss of main power

2.5.4 Electrical Requirements

Furnish motors with their respective pieces of equipment. Furnish internal wiring for components of packaged equipment as an integral part of the equipment. Provide power wiring and conduit for field installed equipment.

2.5.5 Microprocessor Pump Control Panel (Duplex)

Pump control panel to include a transducer operated duplex pump controller. The controller will manage the level in the wet well utilizing set points for off, lead, lag and high level with the provision for a low and high level alarm. Additionally, the controller can use floats as a backup to the transducer. Transducer input will be 4-20 ma signal. The controller should have the following features:
