Dredging shall commence no sooner than 15 December 2008 in Savannah Harbor and 1 January 2009 in Brunswick Harbor depending on conditions prior to issuance of NTP.

The Contractor will be required to commence work under this Contract after acknowledgement of receipt of Notice to Proceed, to prosecute said work diligently and to complete the entire work ready for use not later than 31 March 2009 in Savannah Harbor and 28 February 2009 in Brunswick Harbor.

Dredging will be based on when the task orders are issued. The time stated for completion shall include final cleanup of the premises.

1.3 CONTRACTOR QUALITY CONTROL

The Contractor shall provide and maintain an effective quality control program that complies with Contract Clause "INSPECTION OF CONSTRUCTION (FAR

52.246 12)".

1.3.1 Quality Control System (QCS)

The Contractor shall establish a quality control system to perform sufficient inspection of all items of work, including that of the subcontractors, to ensure conformance to applicable specifications and drawings with respect to the materials, workmanship, construction, finish functional performance, and identification. This control shall be established for all dredging except where the technical provisions of the Contract provide for specific Government control by inspections or other means. The Contractor's control system shall specifically include the surveillance required in the technical provisions of the Contract Specifications.

The Contractor's QCS is the means by which he assures himself that his dredging complies with the requirements of the Contract plans and specifications. The controls shall be adequate to cover all dredging operations and should be keyed to the proposed dredging sequence.

1.3.2 QCS Personnel

The Contractor's job supervisory staff may be used for quality control, supplemented as necessary by additional personnel for surveillance or special technicians to provide capability for the controls required by the technical provisions of the specifications. The Contractor's QCS shall be organized with a chief and supplemental personnel as necessary to perform adequate quality control of the various provisions of the specifications.

The QCS chief shall be:

1.3.3 Pre-Dredging Meeting

After the Contract is awarded and before dredging operations are started, the Contractor shall meet with the Contracting Officer (CO) or the Contracting Officer's Representative (COR) and discuss quality control requirements. The meeting shall develop mutual understanding relative to details of the system, including the forms to be used for recording the quality control operations, inspections, administration of the system, and the interrelationship of Contractor and Government inspection.

Unless specifically authorized by the CO, no dredging shall be started until the Contractor's quality control plan is approved.

1.3.4 Inspections

All compliance inspections shall be recorded on the form Daily Contractor Quality Control Report (Attachment 1 to Section 00800), including but not limited to the specific items required in each technical section of the specifications. This form, to include records of corrective action taken, shall be furnished to the Government as required by the CO.

1.3.5 Deficiencies

If recurring deficiencies in an item or items indicate that the quality control system is not adequate, such corrective actions shall be taken as directed by the CO.

1.4 PROGRESS PAYMENTS

Progress payments made pursuant to the Contract Clause "PAYMENTS UNDER FIXED PRICE CONSTRUCTION CONTRACTS" for any item of work in the Schedule (Section 00010) shall be based on the Contract unit price or lump sum amount set forth in the Schedule for that item of work. If the amount of the unit price or lump sum bid for any item of work is in excess of 125 percent of the Government estimate for such item, the CO may require the Contractor to produce cost data to justify the price of the bid item.

Failure to justify the bid item price to the satisfaction of the CO may result in payment of an amount equal to 125 percent of the Government estimate for such bid item upon completion of work on the item and payment

USCG personnel will monitor the disposal of the material and obtain any necessary dredged material samples. Meals as normally provided to the crew shall be served to the USCG personnel onboard. Likewise, quarters shall be provided for USCG personnel if the dump operation requires two or more continuous shifts.

1.8.4 Communications

Directions as to the Contractor's method of operation will be channeled through the CO or the COR.

1.9 COMPLIANCE WITH APPLICABLE NAVIGATION RULES AND REGULATIONS, MARINE

EQUIPMENT

a. The Contractor shall ascertain that all vessels utilized in project operations consequent to this project are commanded, equipped, navigated, and/or operated so as to be in strict compliance with the general regulations of the Department of the Army and of the USCG, including applicable section, safety, environmental and navigational rules and regulations of the Code of Federal Regulations (CFR), parts 33 and 46.

b. Installations placed by the Contractor on or over the seabed of the work area, i.e., pipeline, pipeline risers, and booster stations, are obstructions or structures in accordance with 33 CFR 67.01. Such installations or portions thereof, are subject to applicable regulations set forth in 33 CFR 64, 33 CFR 66, and 33 CFR 67.

c. The Contractor shall notify, and obtain necessary installation approvals from, Commander, Seventh Coast Guard District. The Contractor shall maintain and operate the jobsite installations and vessels in accordance with applicable laws.

1.10 CERF IMPLEMENTATION

If the work specified in this Contract is performed by hopper dredge, the owner must have an active Basic Ordering Agreement (BOA) for the hopper dredge on file with the U.S. Army Corps of Engineers. The Contractor shall make the hopper dredge available to serve in the Corps of Engineers' Reserve Fleet (CERF) at any time that the hopper dredge is used under this Contract. When the CO is notified of the decision to activate this dredge into the CERF, the Contractor shall take appropriate action to release the dredge. The CO may then extend or terminate the Contract to implement whatever action is in the best interest of the Government. The Contractor shall also be subject to the following conditions:

a. The Director of Civil Works may require the Contractor to perform

SECTION 01 10 00.11 Page 7 emergency dredging at another CONUS (48 contiguous states) site for a period of time equal to the remaining time under this Contract at the date of notification plus up to 90 days at the previously negotiated rate which appears on the schedule of prices in the BOA.

b. The Chief of Engineers may require the Contractor to perform emergency dredging at an OCONUS (outside CONUS which includes Alaska, Hawaii, Puerto Rico, the Virgin Islands or U.S. Trust Territories) site for a period of time equal to the remaining time under this Contract at the date of notification plus up to 180 days at the previously negotiated rate which appears on the schedule of prices in the BOA.

c. The CERF shall be activated by the Chief of Engineers or Director of Civil Works; then the CO will notify the Contractor. From the time of notification, the selected dredge must depart for the emergency assignment within 72 hours for CONUS or 10 days for OCONUS assignments.

d. A confirming delivery order will be issued pursuant to the BOA by the CO. Such delivery orders shall utilize the schedule of rates in the BOA for the specific hopper dredge.

e. If during the time period specified in the items above, a CERF vessel is still required, the Contract performance period may be continued for additional time by mutual agreement.

1.11 WEATHER CONDITIONS

When navigation is hazardous due to inclement weather (such as heavy fog), the plant and related equipment shall be moved to provide the maximum possible channel width for passage.

1.12 PLANT

The Contractor agrees to keep on the job sufficient plant to meet the requirements of the work. The plant shall be in satisfactory operating condition and capable of safely and efficiently performing the work as set forth in the specifications and shall be subject to inspection by the CO at all times. The plant listed on the Contractor's Plant Data Sheet (Attachment 1 to Section 00800), is the minimum which the Contractor agrees to place on the job unless otherwise determined by the CO, and its listing thereon is not to be construed as an agreement on the part of the Government that it is adequate for the performance of the work.

1.12.1 Additional Plant

In the event of collision, fire, major breakdown or any other action preventing continuation of dredging operations for a period of more than 48 hours which is anticipated to continue for a period of 30 days or more, additional dredging plant shall be delivered as required by Paragraph COMMENCEMENT, PROSECUTION AND COMPLETION OF WORK. In the event the additional plant, as directed by the CO, is not delivered and placed in operation within the allowable 30 days, the Contract will be terminated under the Contract Clause "DEFAULT (FIXED PRICE CONSTRUCTION) (FAR 52.249 10)".

1.12.2 Reduction In Capacity

No reduction in the capacity of the plant employed on the work shall be made except by written permission of the CO. The measure of the "capacity

SECTION 01 10 00.11 Page 8 of the plant" shall be its actual performance on the work to which these specifications apply.

1.12.3 Approved Plant

Approved plant includes only crane, bucket, and dipper dredges, scows, bottom dump barges, pipeline, hopper dredges, and similar equipment.

Dragging I-beam, plow, or similar devices is not approved.

1.12.4 Condition Of Plant

All scows must be kept in good condition, the coamings repaired and the pockets provided with proper doors or appliances to prevent leakage of material. All pipelines for hydraulic machines must be kept in good condition at all times and any leaks or breaks along their length must be promptly and properly repaired.

1.13 NAVIGATION AIDS AND PERMITS

1.13.1 Navigation Aids

Navigation aids located within or near the areas required to be dredged will be removed, if necessary, by the USCG in advance of dredging operations. The Contractor shall not remove, change the location of, obstruct, willfully damage, make fast to, or interfere with any aid to navigation. The CO shall request the USCG to relocate the aids if it is determined that the aids will interfere with the dredging process. Should the Coast Guard determine that they cannot respond to the CO's request, the CO may direct the Contractor to remove the navigation aid(s).

1.13.2 Dredging Aids

Do not color or place dredging aid markers and lights in a manner that obstructs or confuses them with navigation aids.

Submerged pipelines shall be marked with signs, buoys, and lights. The appropriate signs and lights shall be posted at the entry and exit points.

Buoys shall be placed a minimum of 500 feet apart between entry and exit points. These buoys shall be lit with flashing lights which are visible around the horizon.

1.13.3 Coast Guard Permits

The Contractor shall maintain and operate the job site installations and vessels in accordance with applicable law.
