1.32 ACCEPTANCE

1.32.1 Partial Acceptance

If at any time during the prosecution of the project the Contractor completes a portion of the project, such as a section of the training wall, in its entirety, he may ask the Contracting Officer to make final inspection of such work. If the Contracting Officer finds upon inspection that the work conforms to the requirements of the Contract and that acceptance is in the interest of the Government, he may accept the work as being completed, and the Contractor will be relieved of further responsibility for the work, except as noted in paragraph FINAL AND CONDITIONAL ACCEPTANCE OF SEEDED PLANTING and as specified in paragraph CONTRACTOR'S RESPONSIBILITY FOR WORK. Partial acceptance shall in no way void or alter any terms of the Contract.

If any damage attributable to causes beyond the control of the Contractor is sustained by the accepted section or portion of the project, the Contracting Officer may authorize the Contractor to make necessary repairs as a change to the contract.

1.32.2 Final Acceptance

Upon receipt of a written notice from the Contractor of presumptive completion of the entire project, the Contracting Officer Representative will make an inspection. If all work specified in the Contract has been completed, the inspection will constitute the final inspection and the Contracting Officer will make the final acceptance. The Contractor will be notified of final acceptance in writing within 5 days.

If the inspection discloses that any work, in whole or in part, is incomplete or unacceptable, the Contractor shall immediately correct the deficiency. Upon completion or correction of the work, another inspection will be made that will constitute the final inspection. In such event, the Contracting Officer will make the final acceptance and the Contractor will be notified of final acceptance in writing within 5 days. In any event, the Contractor shall maintain the project until final acceptance except under conditions that may be specifically exempted.

1.33 CONTRACTOR'S RESPONSIBILITY FOR WORK

Until final acceptance of the work by the Contracting Officer in accordance with the requirements of paragraph ACCEPTANCE, the Contractor shall have charge and care thereof and shall take every precaution against damage to any part thereof by action of the elements or from any other cause. The Contractor shall rebuild, repair, restore, and make good damage to any portion of the work occasioned by any of the foregoing causes before final acceptance and shall bear the expense thereof. The Government may reimburse the Contractor for repair of damage to work attributable to unforeseeable causes beyond the control of and without the fault or negligence of the Contractor.

In case of the conditional acceptance of the permanent seeding work in a

SECTION 01100 Page 17 work area, the Contractor shall be responsible for the project and shall take such precautions as may be necessary to prevent damage to the work resulting from normal erosion processes, maintain and provide for erosion and sediment control measures in accordance with the Virginia Erosion and Sediment Control Handbook at his own expense. During the conditional acceptance of the permanent seeding work, the Contractor shall properly and continuously maintain in an acceptable growing condition all living material in newly established plantings, and seedings furnished under the Contract and shall take adequate precautions to protect new tree growth and other important vegetation against damage.

1.34 NON-HAZARDOUS SOLID WASTE CONTAMINATED SOIL

The Contractor may encounter soils contaminated with non-hazardous solid wastes during the excavation of the inspection trench. This non-hazardous solid waste may be comprised of various materials disposed of along the river from single and multiple residences and commercial operations.

There are no known landfill sites within the Contract construction area.

However, it is likely, that some unknown quantities of non-hazardous solid waste contaminated soil may be encountered within the Contract area.

If solid waste contaminated soils are encountered during project excavations, the Contractor will immediately stop work and notify the Contracting Officer. The Contracting Officer will notify the City of Roanoke as appropriate. The Project Action Plan for Materials Management (Appendix B) provides for how each type of waste is to be managed. For all non-hazardous solid waste generated as a result of project construction activities, the City shall be the "generator" of such wastes and will complete the waste profile form required for waste removal and disposal.

It shall be the responsibility of the Contractor to segregate the waste stream from all others, properly stage it so as to not create an "open dump" condition, and to arrange for the proper transportation. The Contractor shall properly remove and dispose of non-hazardous solid waste and in accordance with the requirements of Section 02111 and the Project Action Plan for Material Management. The excavation and handling of the non-hazardous solid waste shall also include the requirements listed below.

Excavation of the non-hazardous solid waste shall be paid under unit price for "Common Excavation".

Contractor shall only excavate non-hazardous solid waste contaminated soil from within the planned excavation limits.

The Contractor shall excavate a sufficient number of test pits to delineate the quantity of solid waste to be removed for proposal preparation purposes.

Should the area of solid waste extend beyond the planned inspection trench excavation limits, the Contractor shall over-excavate the area no more than

2.0 ft and replace the over-excavated area with compacted fill as defined in the specifications. The over-excavation shall be performed under the direction of the Contracting Officer's Representative.

The locations of the excavation discussed will be monitored by the Generator's (City of Roanoke) assigned agent. Contractor shall provide an appropriate Transportation Coordinator to oversee proper execution of the contaminated material removal.

Contractor shall submit survey data (before and after excavation) and amend the Excavation and Contaminated Materials Handling Work Plan. Following

SECTION 01100 Page 18 the excavation and proper disposal, the Contractor shall submit a Closure report.

The Contractor shall provide the Transportation Disposal Coordinator and coordinate the limits of disposal, waste characteristics and record keeping.

An optional bid item has been included for encountering non-hazardous solid waste material during the excavation of the inspection trench. For the purpose of this Contract, the quantity of non-hazardous solid is subdivided within the following ranges:

0 - 250 Tons Over 250 Tons and further subdivided:

Quantity in tons suitable for daily cover at RVRA, Smith Gap Landfill Quantity in tons unsuitable for daily cover at RVRA, Smith Gap Landfill

The optional Bid item shall only be exercised upon encountering non-hazardous solid waste material within the inspection trench excavation and shall extend through the completion of the excavation of the inspection trench. If solid waste contaminated soils are encountered during project excavations, the Contractor shall be required to take the solid waste contaminated soils directly to the landfill (Monday - Friday) 9AM-3PM and not the Transfer station.

Payment for the additional handling, transportation, stockpiling, and off-site disposal of non-hazardous solid waste contaminated soils encountered within the inspection trench will be made at the applicable contract unit price for "Non-hazardous Solid Waste Contaminated Soil" as listed in the BIDDING SCHEDULE which price and payment shall constitute full compensation for furnishing all labor, equipment, tools, supplies, and incidentals necessary to complete the additional handling, transportation, stockpiling, and off-site disposal of non-hazardous solid waste contaminated materials and other work as covered by this Section. Payment will be withheld pending Government approval of disposal manifest. The Contractor will be compensated at the contract unit price for the actual number of tons of non-hazardous solid waste contaminated soils removed and satisfactorily disposed of. An associated time extension may be issued by the Government if demonstrated impacts to the critical path of the approved schedule are approved by the Contracting Officer.

1.35 CONTRACT DRAWINGS AND SPECIFICATIONS

(AUG 2000) DFARS 252.236-7001

(a) The Government will provide to the Contractor, without charge, five (5) sets of contract drawings and specifications, except publications incorporated into the technical provisions by reference, in electronic or paper media as chosen by the Contracting Officer.

(b) The Contractor shall—

(1) Check all drawings furnished immediately upon receipt;

(2) Compare all drawings and verify the figures before laying out the work;

(3) Promptly notify the Contracting Officer of any

SECTION 01100 Page 19 discrepancies;

(4) Be responsible for any errors that might have been avoided by complying with this paragraph (b); and

(5) Reproduce and print contract drawings and specifications as needed.

(c) In general--

(1) Large-scale drawings shall govern small-scale drawings;

and

(2) The Contractor shall follow figures marked on drawings in preference to scale measurements.

(d) Omissions from the drawings or specifications or the misdescription of details of work that are manifestly necessary to carry out the intent of the drawings and specifications, or that are customarily performed, shall not relieve the Contractor from performing such omitted or misdescribed details of the work. The Contractor shall perform such details as if fully and correctly set forth and described in the drawings and specifications.

(e) The work shall conform to the specifications and the contract drawings identified on Attachment 1 of this section.

* an existing published wage determination

* a survey underlying a wage determination

* a Wage and Hour Division letter setting forth a position on a wage determination matter

* a conformance (additional classification and rate) ruling

On survey related matters, initial contact, including requests for summaries of surveys, should be with the Wage and Hour Regional Office for the area in which the survey was conducted because those Regional Offices have responsibility for the Davis-Bacon survey program. If the response from this initial contact is not satisfactory, then the process described in 2.)

and 3.) should be followed.

With regard to any other matter not yet ripe for the formal process described here, initial contact should be with the Branch of Construction Wage Determinations. Write to:

WAGE DETERMINATION APPEALS PROCESS

1.) Has there been an initial decision in the matter? This can be:

* an existing published wage determination

* a survey underlying a wage determination

Write to:

Branch of Construction Wage Determinations Wage and Hour Division U.S. Department of Labor 200 Constitution Avenue, N.W.

Washington, DC 20210

2.) If the answer to the question in 1.) is yes, then an interested party (those affected by the action) can request review and reconsideration from the Wage and Hour Administrator (See 29 CFR Part 1.8 and 29 CFR Part 7). Write to:

Wage and Hour Administrator U.S. Department of Labor 200 Constitution Avenue, N.W.

Washington, DC 20210

The request should be accompanied by a full statement of the interested party's position and by any information (wage payment data, project description, area practice material, etc.) that the requestor considers relevant to the issue.

3.) If the decision of the Administrator is not favorable, an interested party may appeal directly to the Administrative Review Board (formerly the Wage Appeals Board). Write to:

Administrative Review Board U.S. Department of Labor 200 Constitution Avenue, N.W.

Washington, DC 20210

SECTION 01100 Page 27

4.) All decisions by the Administrative Review Board are final.

CITY OF ROANOKE REPORTS AND OTHER REFERENCES

Final Project Action Plan for Materials Management, First Channel Construction Contract, Roanoke Virginia. Huggins, Faulkner, and Flynn, October 2002. (Referred to herein as Materials Management Plan)

1.2 MEASUREMENT AND PAYMENT

1.2.1 Measurement

All materials excavated for this project have certain characteristics that guide how the materials are to be managed. The Final Project Action Plan For Materials Management is provided in Appendix B and identifies materials which may be encountered and disposal requirements. The measurement requirements will depend on the Waste Stream Type and Disposal Requirement.

Based on initial excavation quantity estimates, it is estimated that the majority of materials excavated and removed during construction is classified as "Clean Fill." Clean Fill includes soil, sediment and broken rock removed during excavation. The remaining part is classified as "solid waste" and will be managed in accordance with the Materials Management Plan. The Contractor shall be responsible for proper segregation, SECTION 02111 Page 1 management, and disposal of contaminated materials associated with project excavations. In all cases, the Contractor must properly stage all waste so as not to create an open dump as defined in 9 VAC 20-80-10 Definitions.

Permitted solid waste treatment or disposal facilities will require that the generator develop a specific waste "profile". Test reports will be used to define the extent of the contaminated soil within the project area. For all non-hazardous waste generated as a result of construction activities, the City shall be the "generator" of all such waste and will complete the waste profile information at the time of waste removal and disposal.

This contract does not have any known locations where the excavations of non-hazardous solid waste contaminated soil is required. If material is encountered, it will be excavated in accordance with the requirements of this Section. The quantity of non-hazardous solid waste contaminated soil to be paid for will be the actual number of tons of non-hazardous solid waste contaminated material which has been excavated and removed from the site. The non-hazardous solid waste contaminated soil will be measured by being weighed in trucks on approved platform scales or by other approved weighing devices.

1.2.2 Payment

1.2.2.1 Excavation,Transportation, and Off-site Disposal

Payment for the additional handling, transportation, stockpiling, and off-site disposal of non-hazardous solid waste contaminated materials encountered within the inspection trench will be made at the applicable contract unit price for "NON-HAZARDOUS SOLID WASTE CONTAMINATED SOIL" as listed in the BIDDING SCHEDULE which price and payment shall constitute full compensation for furnishing all labor, equipment, tools, supplies, and incidentals necessary to complete the additional handling, transportation, stockpiling, and off-site disposal of non-hazardous solid waste waste contaminated materials and other work as covered by this Section. Payment for excavation of the non-hazardous solid waste shall be paid under bid item for "Common Excavation". Payment will be withheld pending Government approval of disposal manifest. The Contractor will be compensated at the contract unit price for the actual number of tons of household waste removed and satisfactorily disposed of. An associated time extension may be issued by the Government if demonstrated impacts to the critical path of the approved schedule are approved by the Contracting Officer.

1.3 SUBMITTALS

Government approval is required for submittals with a "G" designation;

submittals not having a "G" designation are for information only. When used, a designation following the "G" designation identifies the office that will review the submittal for the Government. The following shall be submitted in accordance with Section 01330 SUBMITTAL PROCEDURES:

SD-02 Shop Drawings

Surveys; G

Separate cross-sections of each area before and after excavation and after backfilling.

SD-03 Product Data

SECTION 02111 Page 2

Excavation and Contaminated Materials Handling Work Plan; G

Work Plan within 5 calendar days after notice to proceed. No work at the site, with the exception of site inspections and surveys, shall be performed until the Work Plan is approved. The Contractor shall allow 5 calendar days in the schedule for the Government's review. No adjustment for time or money will be made if resubmittals of the Work Plan are required due to deficiencies in the plan. At a minimum, the Work Plan shall include:

a. Schedule of activities.

b. Method of excavation and equipment to be used.

c. Shoring or side-wall slopes proposed.

d. Dewatering plan.

e. Storage methods and locations for liquid and solid contaminated material.

f. Borrow sources and haul routes.

g. Decontamination procedures.

h. Spill contingency plan.

i. Identification of Disposal Facilities in accordance with the Materials Management Plan.

j. Waste disposal manifest procedures and forms.

Closure Report; G

Ten (10) copies of the Closure Report within 14 calendar days of work completion at the site.

1.4 SURVEYS

Surveys shall be performed immediately prior to and after excavation of any contaminated material encountered to determine the volume of contaminated material removed. Surveys shall also be performed immediately after backfill of each excavation. The Contractor shall provide cross-sections on 25 foot intervals and at obvious break points for all excavated areas.

Locations of confirmation samples shall also be surveyed and shown on the drawings. Surveys shall be performed in accordance with Section 01100.

1.5 REGULATORY REQUIREMENTS

1.5.1 Permits and Licenses

The Contractor shall obtain required federal, state, and local permits for excavation and storage of contaminated material. Permits shall be obtained at no additional cost to the Government.

1.5.2 Air Emissions

Air emissions shall be monitored and controlled in accordance with Section 01355A.

SECTION 02111 Page 3

1.6 DESCRIPTION OF WORK

The work shall consist of the excavation of contaminated soils which requires special management considerations.

The Contractor may encounter old landfill sights along the Roanoke River containing non-hazardous solid waste contaminated soil during the excavation of the inspection trench. There are no known landfill sites within the Contract construction area. It is likely, however, that some unknown quantities of non-hazard solid waste contaminated soil may be encountered within the Contract area.

Hazardous Waste

The management of these types of materials is outside the scope of the Project and is not the responsibility of the Contractor.

If potentially hazardous materials are encountered, Contractor shall immediately stop work and notify the Contracting Officer.

1.7 CHEMICAL TESTING

No chemical testing is required with this contract.

1.8 SCHEDULING

The Contractor shall notify the Contracting Officer seven (7) calendar days prior to the start of excavation of contaminated material. The Contractor shall be responsible for contacting regulatory agencies in accordance with the applicable reporting requirements.

PART 2 PRODUCTS

2.1 BACKFILL

Required backfill material shall be in accordance with Section 02300.

2.2 SPILL RESPONSE MATERIALS

Spill response materials shall be available at all times when contaminated materials/wastes are being handled or transported. Spill response materials shall be compatible with the type of materials and contaminants being handled.

PART 3 EXECUTION

3.1 EXISTING STRUCTURES AND UTILITIES

No excavation shall be performed until site utilities have been field located. The Contractor shall take the necessary precautions to ensure no damage occurs to existing structures and utilities. Damage to existing structures and utilities resulting from the Contractor's operations shall be repaired at no additional cost to the Government. Utilities encountered that were not previously shown or otherwise located shall not be disturbed without approval from the Contracting Officer.

SECTION 02111 Page 4

3.2 CLEARING AND GRUBBING

Clearing and grubbing shall be performed to the limits shown on the drawings in accordance with Section 02231 CLEARING AND GRUBBING.

3.3 CONTAMINATED MATERIAL REMOVAL

3.3.1 Excavation

Areas of any contamination encountered shall be excavated to the depth and extent as determined from the initial site surveys and field investigations and as directed by the Contracting Officer. Excavation shall be performed in a manner that will limit spills and the potential for contaminated material to be mixed with uncontaminated material. An excavation log describing visible signs of contamination encountered shall be maintained for each area of excavation. Excavation logs shall be prepared in accordance with ASTM D 5434.
