Albania/Kosovo MATOC Questions and Answers
1) Since we are a US Registered Company, is Key Subcontractor’s permission to operate and to do business in Albania and Kosovo sufficient for this project?
Answer: The permission to operate and do business in Albania and Kosovo must be held by the
Prime Contractor or in the Joint Venture (JV) name.
2) Is Albanian Key Subcontractor’s bond acceptable for this project?
Answer: No, the bond must be in the name of the Prime Contractor, or if a JV, in the name of the JV.
3) In case of a JV Agreement, do we as a JV, have to obtain e specific DUNS, NCAGE AND SAM
Number? Or each of the entities might have its own numbers as above?
Answer: Yes, the JV must obtain a specific DUNS and CAGE Code. Please see the section titled
“Joint Venture Proposal” in the solicitation.
4) Can you tell us if we can provide a bank letter of assurance in the name of one of the JV members (non‐US company with a Non‐US Bank) or it has to be in the name of the JV itself
Answer: The Bank Letter of Assurance may be in the name of one of the JV members provided it meets the requirements of the solicitation.
5) Can we provide a letter from our bonding company (Surety) in US in lieu of bank letter of assurance? In other words, the same wording of the letter of assurance but issued by our bonding company in US
Answer: Yes, as long as the bonding company is on the list of US Treasury Certified Companies.
The Bond would have to be in the JV name.

6) Offer will submit 3‐5 projects to meet the pass/fail requirement aspect of factor 1 but we want to confirm that if these projects are not relevant, the offeror would receive a neutral rating as opposed to a fail. More specifically, we would like you to clarify between the unknown confidence (Neutral) Rating vs the Pass/Fail element.
Answer: The pass/fail element refers to the Prime Contractor performing at least 3 of the 5 projects submitted for past performance. See the Note at the end of Factor 1: Past Performance
Submission requirements.
Under Past Performance, each submitted project will receive a Past Performance relevancy rating (is the project relevant to the criteria as outlined in Factor 1: Past Performance Evaluation
Criteria) and a Past Performance Confidence Assessment (this is based on the evaluations, positive and/or negative comments that are provided on Solicitation Attachment 3‐Past
Performance Client Form or CPARS). If a project is not relevant, it will receive a not relevant rating which could impact the overall Past Performance Confidence Assessment. If a proposal lacks recent past performance, it will receive an Unknown Confidence (neutral) rating.
7) Please confirm that you would like the Bank Letter of Assurance and Bank Letter of Guarantee from A US Bank in US Dollars.
Answer: The Bank of Letter Assurance does not need to come from a US Bank, but it needs to be in US Dollars. Please see Solicitation Attachment 4, Sample Bank letter of Assurance.
8) Due to the upcoming Holidays, will the offer due date be extended?
Answer: The Proposal has been extended an additional week until
14:00 CET on 15 January 2019.
9) Is it possible to provide as a Letter of Assurance a Surety Bond from a Surety Company instead of the Bank letter of Assurance?
Answer: It is possible to use a Surety Company for the Bank Letter of Assurance, only if it is on the list of approved US Treasury Certified Companies.
