AMENDMENT 01 - RFIS

RFI: QUESTION & ANSWERS

#1 Question: The sample BLA requires an amount of 1.5 Mil US$ for the three regions of the contract Germany West, USAG Ansbach and USAG Stuttgart. Please confirm that this amount may be adapted pro rata if a proposal is laid for one or two regions only.

#1 Answer: See Amendment 01 BLA letter sample, provided as Word attachment. BLA revised amounts are as follows: $1,500,000 for Germany West, $750,000 for USAG Ansbach, and $750,000 for USAG Stuttgart. In Section 01 11 00 “Summary of Work”, 1.1 General Information, Paragraph g. “BANK LETTER OF GUARANTEE and LETTER OF ASSURANCE”, is amended as follows: “The Bank Letter of Assurance shall be $1,500,000 for Germany West, $750,000 for USAG Ansbach, and $750,000 for USAG Stuttgart. The Bank Letters of Guarantee will be provided per task order.”

#2 Question: In the solicitation requirement it is stated that the amount for the BLA is $1,500,000 per contract.

Does that mean $1,500,000 each (one for JOC West, one for Ansbach and one for Stuttgart), because in the sample BLA all three locations are listed for $1,500,000.

#2 Answer: See #1 Answer.

#3 Question: Section 00010, Summary of Work, Sub-Section 01 11 00, Para 1.1g 3rd page of Section 00100, Para 4 Proposal Format Sample BLA; Para 1.1g states that BLA will be in the amount of $1,500,000 PER CONTRACT.

The first sub-para of Section 00100 Para 4 indicates a Volume II is required for each JOC for which the offeror is submitting a bid which includes a BLA. Subject line of sample BLA lists all three JOCs which could indicated only one BLA or offerors are to use the sample for all JOCs and merely identify the appropriate JOC. Is a separate BLA required for each JOC area that an offeror submits a proposal?

#3 Answer: See #1 Answer.

#4 Question: 2nd page of Section 00100. The bold near the bottom of the page states that, “All members of the JV shall sign … the BLA … Make sure to include as part of Volume I.” There are two problems with this: first, offerors do not sign BLAs, only bank officers do that, & second, the BLA(s) are required in Volume II not Volume I. Recommend that the phrase about JV members signing BLA(s) be deleted from this page and section. Also, recommend that Volume I be changed to Volume II.

#4 Answer: 2nd page of Section 00100 – delete “*** All members of the Joint Venture shall sign the SF 1442 and the Bank Letter of Assurance or Bid Bond. Make sure to include as part of Volume I.” and replace with “*** All members of the Joint Venture shall sign the SF 1442. Make sure to include as part of Volume II.”

#5 Question: 5th page of Section 00100, Proposal Format for Volume II, Submission Requirements. Sub-para 7 indicates offerors are to provide their TAX Identification Number. Foreign bid entities are tax exempt and do not have US TINs. Recommend either removal of this requirement or adding the phrase (if applicable) behind TAX Identification Number.

#5 Answer: Section 00100, under “4. Proposal Format”, Paragraph “Proposal Format for Volume II”, Point 7 Add “(if applicable)” behind TAX Identification Number. Statement is revised to read: “Name, Address, DUNS, CAGE, and TAX Identification Number (if applicable) of the Contractor submitting the proposal.”

#6 Question: Section 00600 – Representations and Certifications; As this is a frame work contract, offerors cannot provide DBA without knowing the composition of the workforce of the individual task orders which requires a project scope. Recommend moving this clause to Section 00700.

#6 Answer: Section 00600 – Representations & Certifications, Clause 52.000-4106 “DEFENSE BASE ACT INSURANCE RATES – LIMITATION – FIXED PRICE (APRIL 2011)” is moved to Section 00700 – Contract Clauses.
