SECTION SF 30 BLOCK 14 CONTINUATION PAGE

SUMMARY OF CHANGES

RESPONSES TO CONTRACTOR QUESTIONS

Q1. Please confirm if this RFP is a two step proposal process (Phase 1 and then Phase 2 Submissions) or is a one step process.

R1. It is confirmed the Government will utilize a two-phase source selection process to evaluate contractors for award.

Q2. If this is a two step procurement process, please confirm that Phase 1 submittal requirements are only Experience and Past Performance.

R2. Phase 1 submittal requirements are only Experience and Past Performance. Phase 2 submittals will be qualification of two (2) key personnel, organizational management approach, and price.

Q3. For Experience and Past Performance, if we have experience on the continent of Africa but not specifically Botswana, will that be scored less?

R3. Projects demonstrating experience performing work in Botswana will be considered more relevant. However, experience on the continent of Africa may also be considered relevant although to a lesser degree.

Q4. SF 1442 indicates that due date is 3 Dec 2012; while Section 00100 indicates that the due date is 30 Nov 2012.

R4. The due date for Phase I submission is 3 Dec 2012. Information corrected via current amendment

Q5. SF 1442 indicates that the Project duration is 360 days from NTP, Section 00100 and the Bid Schedule indicates 240 days from NTP.

R5. The project duration is revised to reflect 365 calendar days. SF 1442 and bid schedule is corrected via current amendment.

Q6. As we are located in CONUS, is it acceptable to email in our proposal prior to the closing date and time and follow up with the hardcopies via Fed Ex after the closing date.

R6. Proposal format and delivery location will be revised via current amendment to allow email submissions for Phase 1 only. Phase 1 submission may be emailed to frank.j.johnson@usace.army.mil and wendy.d.fields@usace.army.mil. Email submissions will NOT be accepted for Phase 2.

Q7. Attachment 2 Experience line 1 indicates Croatia, assume that is a typo, please confirm.

R7. Confirmed typo error corrected via current amendment.

Q8. Phase 1 Submission: Technical Proposal. How much design do you want included in this proposal?

mailto:frank.j.johnson@usace.army.mil mailto:wendy.d.fields@usace.army.mil

R8. The Offeror should submit enough information within the confines of page limitations (If Applicable) to demonstrate capability and experience as specified in the solicitation.

Q9. Could you please clarify your terminology re “contractor, subcontractor, key subcontractor” etc and which category a Consultant falls under for a JV. (Referring to Attachment 2 – Experience Information Sheet)

R9. If the consultant is a legal member of the JV via a legally binding JV agreement, that consultant is considered part of the JV, and relevant experience and/or past performance of that consultant will be considered as the experience and/or past performance of the JV.

Q10. It is mentioned in section 00010, Instructions to offerors that the 1st page of attachment #3 (Past Performance Questionnaire) is required to be filled by offerors and the remaining pages were to be filled by the client. However, the attachment #3 in the RFP package seems incomplete (does not have the past performance information page).

R10. Missing 1st page of attachment #3 is now included (attached) via current amendment.

Q11. What documentation do you want us to submit for our Architects, Civil Engineer, Electrical Engineer, etc, etc?

R.11 See Response R.8

Q12. Please confirm the Percentage of Retainage. (Currently at 20%). Is there a limit to the amount of Retainage that will be with held?

R12. Confirmed. The Government will withhold 20% of all progress payments until the Government has withheld 10% of the total contract value as a security withholding. This security withholding is in lieu of requiring a construction bond, bank letter of guarantee, or irrevocable letter of credit. After the Government has withheld 10% of the contract value, the Government will no longer withhold funds from progress payments, however, the Government reserves the right to retain up to 10% for quality or other issues in addition to the security withholding. Offerors may also have the following options: 1. Provide a Bank Letter of Guarantee (BLG) for 10% of the total contract value with 7 days of contract award, 2. Provide Performance and Payment Bonds, 3. Provide a Cashier’s Check for 10% of the total contract value with 7 days of contract award, or, 4. Provide an Irrevocable letter of Credit 10% of the total contract value.

Q13. Please stipulate the type of Face Bricks that are required in the buildings.

R13. The base bid includes standard bricks with painted plaster finish. The option includes “baked brick” which does not require any finish work.

Q14. Please supply the existing Sewer Pump Performance data.

R14. Existing Sewer Pump Performance Data provided (attached) via current amendment.

EVALUATION FACTORS FOR AWARD

The source selection process will use a two-step phase selection approach as authorized under 10 U.S.C. 2305a.

The first phase of the selection process will determine if the contractor meets the minimum qualifications outlined in the solicitation. If a contractor’s proposal is considered among the highly qualified in Phase I, they will be required to submit additional information for Phase II for evaluation.

PHASE I

1. Evaluation Factors:

The following factors will be considered in evaluating the proposals:

a. Technical Factor One (1) – Experience

b. Technical Factor Two (2) – Past Performance

The SSA will use the concensus ratings from the evaluation of the Phase 1 proposal submittals. Offerors evaluated as most qualified will be notified by the Contracting Officer to submit the Phase II Proposal Requirements.

PHASE II

1. Evaluation Factors:

In accordance with Federal Acquisition Regulation (FAR) 15.304, the following factors will be considered in evaluating the proposals:

a. Technical Factor One (1) – Qualifications of Key Personnel

b. Technical Factor Two (2) – Organizational Management Approach

c. Factor Three (3) - Price

2. Basis for Award:

Subject to the provisions contained herein, award will be made to one (1) Offeror who is deemed responsible in accordance with the FAR, conforms to the solicitation requirements and whose proposal is determined to be technically acceptable and offers the best-value tradeoff to the Government, with respect to experience, past performance and price. This source selection approach, called Best-Value Tradeoff, includes an evaluation of all factors: experience, past performance, qualifications of key personnel, organizational management approach, and price. The Government reserves the right to award to other than the lowest proposed price offeror; however, the degree of importance of price as a factor will become greater as the non-price factors of proposals approach equality. The greater the equality of non-price factors of proposals, the more important price shall become in selecting the best-value to the Government.

Unreasonably high or low proposed prices may be grounds for eliminating a proposal from the competitive range based upon an assessment that the Offeror does not understand the requirement or the Offeror has made an unreasonable proposal.

3. Relative Importance of Factors: The proposals will be evaluated based on the five (5) evaluation factors; Phase I: Factor One (1) Experience, Factor Two (2) Past Performance ; Phase II: Factor One

(1) Qualifications of Key Personnel and Factor Two (2) Organizational Management Approach and Factor Three (3) Price. All non-price factors are of equal importance and when combined are approximately equal to price.

4. Discussions:

It is the Government’s intent to award without discussions. However, in accordance with FAR 15.306, should discussions become necessary, the Government reserves the right to hold them. If this occurs, a competitive range will be determined and Offerors notified in accordance with FAR 15.503.

5. Competitive Range:

The competitive range may be limited for purposes of efficiency in accordance with FAR 15.306(c)(2).

Offerors are urged to reflect their best possible terms, to include price related elements, since less than the best potential terms / prices could result in the exclusion of the proposal from further consideration.

6. The following are definitions of commonly used terms in the evaluation process:

Significant Strength is an aspect of an Offeror’s proposal that has appreciable merit or appreciably exceeds specified performance or capability requirements in a way that will be appreciably advantageous to the Government during contract performance.

4. An Offeror will not receive credit under this factor for the relevant experience of an individual or for key personnel experience proposed for this project. An Offeror should not submit base indefinite quantity contracts and multiple award construction contracts as projects, however, individual task orders under those contracts may be submitted as projects.
