AMENDMENT 0001 SUMMARY

Vendor Questions and Answers

Q - What is desired or designed depth of water for zone 5?

A - Water levels are dependent on precipitation and runoff but is controlled by a fixed crest weir with an elevation of 906.3. Zone 5 has an elevation of 901.3 to 905.3 which has corresponding water depths of 1-5 feet.

Q - What are the existing vegetation conditions as they stand now? When was the current cover crop planted and did it have to germinate, grow and senesce/ terminate this past growing season?

A - The cover crop varies between well established and not planted yet. Generally, the excavated portion of the drain is planted, with establishment varying from established to limited germination. The cover crop is more established in the north and west, less so as you proceed south and east. The unplanted area is about 18 acres.

The unplanted area will be planted with a cover crop as soon as conditions allow.

Q - Will USACE allow the selected contractor to dewater zone 5 for the purposes of installing plant material?

A - Water control shall be performed by the Contractor to ensure that the water levels in seeded and planted areas are maintained at a level that is not detrimental to the planting without causing any upstream or downstream impacts as stated in Part 2 of the Performance Work Statement in paragraph 2D. The following sentence is added to the end of paragraph 2D, "The Contractor can utilize the low flow pipe to temporarily dewater Zone 5 for the purposes of installing plant material.”

Q - Does the selected contractor need a general contractor's license in the state of North Dakota?

A - A general contractor's license is not a requirement of this contract; however, the Contractor shall also comply with local and State regulations. The Contractor should contact the North Dakota Secretary of State's office for a determination on whether a general contractor's license is required for this project.

Q - In addition to a QCP does USACE expect any other qualified roles for this project, for example, will a CQM-certified person be required to be on-site for the duration of the project?

A - Contractor personnel requirements are included in the performance work statement. A CQM certified person is not required to be on-site for the duration of the project.

Q - Is there a preferred method of seed installation for zones 1-4 and zone 6 (i.e., no-till vs broadcast)?

A - The Performance Work Statement (PWS) doesn’t state the required or preferred method of seed planting. It is left up to the Contractor to determine the best method of planting in order to meet the performance criteria in the

PWS.

W912ES22B0026

Q - In regard to zone 5, does the USACE have a preference for the type of plant material scheduled for installation?

(i.e., tubers vs plugs vs containerized stock)

A - The Performance Work Statement (PWS) doesn’t state the required or preferred type of planting. It is left up to the Contractor to determine the best method of planting in order to meet the performance criteria in the PWS.

The following have been modified:

PERFORMANCE WORK STATEMENT

Performance Work Statement Part 2, paragraph 2D (page 11), which currently reads:

Water Control: The Contractor shall utilize pumps, ditch plugs, or other means to ensure that the water levels in the seeded areas are maintained at a level that is not detrimental to the seeding without causing any upstream or downstream impacts. The Contractor may use the existing, 8-inch, low-flow pipe through the weir embankment to facilitate site water control. The pipe is designed to drain water from the site at a rate of approximately 1 inch per day.

Is hereby changed to read as follows (change highlighted):
