For further information reference clause MVP-0002 entitled “Apparent Clerical Mistakes” in Section 01 00 00.

7. UNBALANCED OFFERS. The government may reject as non-responsive any proposal that is materially unbalanced between contract line item numbers or sub-items on the pricing schedule. A proposal is materially unbalanced when it is based on prices that are significantly less than cost for some work and significantly more than cost for other work. A materially unbalanced proposal may be rejected if the Contracting Officer has a reasonable doubt as to whether the proposal will result in the lowest overall cost to the government even though it may be the lowest evaluated offer found technically acceptable. Additionally, a proposal that is unbalanced so as to be tantamount to an advance payment will be rejected as non-responsive even if acceptance of the offer would result in the lowest overall cost to the government.

PLEASE NOTE: Visitors that show up for the Organized Site Visit, In Person Discussions (or at any other time) may be required to show Real-ID compliant http://www.fbo.gov/ http://www.fbo.gov/ http://www.hnc.usace.army.mil/Missions/Engineering/TECHINFO http://www.hnc.usace.army.mil/Missions/Engineering/TECHINFO identification cards, or have two forms of ID for those states that are not yet compliant (i.e. Minnesota standard Driver’s Licenses) A. Basis for Award:

Award will be made to the responsible offeror representing the best value based on the Lowest- Priced, Technically Acceptable (LPTA) proposal. Each technical evaluation factor and subfactor must be found to be “acceptable” in order for the proposal to be found technically acceptable.

Proposals will not be ranked using non-price factors. Award will be made to the lowest priced, technically acceptable proposal. Firms may only submit one proposal. Acceptable/Unacceptable Ratings are defined as follows:

Acceptable: Proposal clearly meets the minimum requirements of the solicitation.

Unacceptable: Proposal does not clearly meet the minimum requirements of the solicitation.

The successful offeror’s key personnel and subcontractors will be incorporated in any resulting contract. The identified key personnel and subcontractors must be used on the project. If any of the key personnel or subcontractors identified in the proposal are not available during construction, the prime contractor may propose a different subcontractor or employee by submitting the name and relevant experience to the Government in the form of a submittal prior to the start of work. The qualifications and experience of the key personnel and subcontractors incorporated into the contract will be considered the minimum acceptable qualifications for any proposed replacements during contract performance. In the event that the contractor cannot provide a listed key personnel or subcontractor, or one of comparable qualification, the contracting officer may reduce the contract price or take such other actions as are necessary to protect the interests of the Government, including the timely completion of the contract work.

B. Definitions:

Hydraulic machinery includes the following components: hydraulic pump and hydraulic motor.

Rated capacity for movable cranes is the stated maximum design load. Rated capacity for movable dam gates is the weight of the gate. Rated capacity for movable bridges is the weight of the bridge.

Movable structures include movable dam gates, movable cranes, or movable bridges with a rated capacity of 10 tons or more.

C. Proposal Submission Requirements

The offeror’s proposal shall be submitted in two volumes:

Volume I-Technical Proposal Volume II-Price Proposal

All pages containing text should be consecutively numbered, type-written on 8 ½ x 11 inch paper, with margins of at least one inch, using a standard font no smaller than 12. The Technical Proposal and Price Proposals should be stapled/bound separately.

Technical Proposal: Offerors shall submit one original and four (4) hard copies. The Technical Proposal shall include the following:

• Solicitation number (“W912ES-18-R-0006”)

• Offeror’s name, address, telephone and email address

• Names, titles, telephone and email addresses of persons authorized to negotiate on the

Offeror’s behalf with the Government in connection with this solicitation

• Name, title, and signature of person authorized to sign the proposal.

• Letter(s) of Commitment (if applicable).

• Responses to all technical evaluation factors. The format used for the Parts below should be strictly adhered to. All responses in the Offeror’s Technical Proposal must clearly indicate the areas to which they are applicable:

• The Technical Proposal is limited to no more than 30 pages, not including supplementary documents (e.g. letters of commitment, joint venture agreements, etc.).

• The Technical proposal shall not include pricing information.

Price Proposal: Offerors shall complete and submit the pricing schedule (schedule of items/bid schedule) with their proposal and include a price for each line item, including subtotals and totals. Failure to do so will result in the proposal being rejected without further consideration.

V. EVALUATION FACTORS

The evaluation factors and significant subfactors are listed below. It is intended that proposals be evaluated, and award made, without discussions with the offerors (other than for the purpose of minor clarification[s]), unless discussions are determined to be necessary. Failure to submit mandatory information for a factor or subfactor, indicated by the word shall, will result in a rating of “unacceptable” for that factor or subfactor, and the offer will be ineligible for award.

Requested information, indicated by the word should, is not mandatory, but missing, incomplete, or ambiguous information may result in a rating of “unacceptable” for that factor or subfactor. It is the offeror’s responsibility to ensure the completeness of its proposal. The Government intends to evaluate solely on the information provided in the initial proposal and not assume that an offeror possesses any capability that is not specifically identified in the proposal.

The technical evaluation factors—Recent and Relevant Experience, Shop Fabrication, Key Personnel Qualifications, and Past Performance, and their subfactors—will be evaluated first.

Price will be evaluated last.

The Government will evaluate the offeror’s and their major subcontractors’ experience and certifications only. If an offeror wishes to be credited with a subcontractor’s or supplier’s experience or certification, a letter of commitment signed by the subcontractor/supplier and the prime contractor (offeror) must be submitted with the proposal. The letter of commitment shall clearly state that the offeror and the subcontractor/supplier have committed to construct this project together if the offeror receives the contract award. In regard to Experience, if an offeror submits projects demonstrating experience in one of the factors, and that project was completed by a subcontractor, a subsidiary, or a supplier, as opposed to the offeror, the offeror MUST submit a signed letter of commitment from the subcontractor who performed and completed the work. If a letter of commitment is not submitted, the experience/certifications will not be considered.

A. Technical Proposal, Part I: Recent and Relevant Experience

Submission Requirements:

The offeror shall provide examples of recent and relevant projects. The technical proposal shall contain information documenting that the firm and its subcontractors (as applicable) have performed construction and field installation, alignment, and commissioning for movable structures. Provide information for a minimum of three (3) and a maximum of five (5) recent projects, with at least one (1) of these projects involving winter field construction in temperatures below freezing. Projects performed inside a shop environment do not qualify.

Project information will be evaluated sequentially. Information for work exceeding five (5) projects will not be considered and only the most recent projects will be evaluated.

Documentation for each project shall include, but not be limited to:

• Project Name

• Location

• Construction Dates

• Major Project Features Constructed

• Total Construction Cost

• Methods Employed to address construction issues related to work adjacent to or over water, as well as winter construction where applicable

• Names and Contact Information for the Project Owner

The offeror shall identify at least one recent project for each of the critical work elements identified below in which they have directly performed or supervised a subcontractor performing the required work. As described above, if an offeror wishes to be credited with a subcontractor’s experience, a letter of commitment signed by the subcontractor and the prime contractor (offeror) must be submitted with the proposal.

Recent is defined as work that was completed within the last ten (10) years from the proposal due date or work that is ongoing but not less than 50% physically complete. The definitions of relevant are included within each of the work element descriptions below (a.-c.)

Work Elements:

a. Precision welding in a field environment

• To be considered relevant, the project should include welding of rails, pipes, beams, plating or other large steel elements, one ton or greater, in a field environment. At least one project should demonstrate experience with welding outdoors in temperatures below freezing.

b. Concrete work in cold weather

• To be considered relevant, the project shall demonstrate experience with cast-in-place concrete in cold weather (below 32 degrees F).

c. Marine Construction

• To be considered relevant, the project must demonstrate the ability to safely work over or adjacent to a navigable body of water.

Each of the listed work elements must be addressed by at least one project. Multiple work elements may be addressed by the same project.

The Recent and Relevant Experience factor will receive a rating of “acceptable” or “unacceptable” based on its entirety. In order to receive an “acceptable” rating, Offerors must provide the requested information using the SSEB Technical Proposal Evaluation Form (Appendix B) and demonstrate to the evaluators that the Offeror and its personnel or subcontractors (as applicable) have sufficient recent and relevant experience, and the knowledge and capability to successfully perform the tasks described in this solicitation. Missing, incomplete, or ambiguous information could result in a rating of “unacceptable.” Missing mandatory information will result in a rating of “unacceptable.”

B. Technical Proposal, Part II: Shop Fabrication

Submission Requirements:

The offeror shall provide documentation that the firm and/or its subcontractors, as applicable, have performed fabrication of machinery for moveable structures. Hydraulic machinery does not qualify. Provide information for a minimum of two (2) and a maximum of five (5) recent projects. Each of the following work elements shall be included in the cited projects:

Work Elements:

• Bearings (rolling element or plain)

• Fabrication of machined steel weldments

The shop fabrication work shall have been completed within the last ten (10) years from the proposal due date or work that is ongoing but not less than 50% physically complete.

The Shop Fabrication factor will receive a rating of “acceptable” or “unacceptable” based on its entirety. In order to receive an “acceptable” rating, Offerors must provide the requested information using the SSEB Technical Proposal Evaluation Form (Appendix B) and demonstrate to the evaluators that the Offeror and its personnel or subcontractors (as applicable) have performed the fabrication work required by the factor. Missing, incomplete, or ambiguous information could result in a rating of “unacceptable.” Missing mandatory information will result in a rating of “unacceptable.”

C. Technical Proposal, Part III: Key Personnel Qualifications

Offerors shall identify the Erecting Engineer assigned to this project. The Erecting Engineering shall be a licensed mechanical engineer. If the individual is not an employee of the offeror’s firm, a signed Letter of Commitment must be included. If the personnel presented in the offer need to be replaced, replacement personnel must have equal or better qualifications as those proposed and shall be approved by the contracting officer. Key personnel shall speak English fluently. Note that the data requested here are not elements that will be separately evaluated; the Key Personnel Qualifications factor will receive a rating of “acceptable” or “unacceptable” based on its entirety. The offeror shall include the following information:

• Name of the person

• Title of position

• Technical background

• Educational level of person (university degree, technical school, high school, etc.)

• Professional License(s) held

• Number of years of relevant experience

• The person’s level of English language proficiency

Qualifications shall include at least two (2) projects performed in the last ten (10) years, in which the individual has performed field alignment for movable structures with a rated capacity of 10 tons or more to a precision of +/- 1/16 inch or less. Projects performed inside a shop environment do not qualify. The documentation shall include:

• Construction Dates

• Names and Contact Information of Project Owners (telephone and/or email address for valid contact)

• Major project features constructed

• Total construction cost

D. Technical Proposal, Part IV: Past Performance

Offerors’ past performance is a measure of the degree to which an offeror was successful on projects of similar scope, size, and complexity, as measured by the level of past customer satisfaction. It is also a measure of the degree to which an offeror has complied with Federal, state, and local laws and regulations. The Government’s assessment of past performance will be subjective and based mainly on offeror reputations with customers and other sources. The Government will evaluate the reference information/performance data provided by offerors and obtained from other sources, such as Government databases. Note that the data requested below are not subfactors that will be separately evaluated; past performance will receive a consensus evaluation based on its entirety.

Submission Requirements:

(1) Offerors should submit a list of at least three, but no more than five, past performance references for work performed since 2008 that should meet the following conditions. If more than five past performance references are submitted, only the first five will be considered. If less than three past performance references are submitted, they will be evaluated, and the lack of the requested number of projects will not be evaluated favorably or unfavorably for this factor (see subparagraph (4) below).

(a) The past performance reference must have been a client, or client representative, with whom the offeror had a contract, or subcontract (if applicable) for one or more projects.

(b) The past performance reference must hold, or held at the time, a senior position in the client organization with responsibilities for either contract administration, quality control, engineering or technical supervision, or was otherwise in a position to evaluate the offeror’s performance in executing the contract or subcontract. The past performance reference must have first-hand knowledge of the offeror’s performance.

(c) The past performance reference must have a current, valid phone number they can be reached at during normal business hours, a fax number, and must be able to speak, read, and write in the English language.

(2) For each of the past performance references described in (a) above, offerors shall submit the following information.

• The name, title, company or government agency, and address of the past performance reference

• A current, valid phone number and fax number at which the past performance reference can be reached during normal business hours. If available, include an e-mail address as well

• A brief description of the qualifying project or projects, including name, location, and year completed, for which the past performance reference will be able to provide valid past performance information

• Offerors may include information on problems encountered on the identified contracts and the offeror’s corrective actions

(3) The government may contact any or all of the past performance references provided by the offerors to collect and evaluate past performance information. This information may be written or oral. The government shall consider this information, as well as information obtained from any other sources, when evaluating an offeror’s past performance. The evaluation will take into account past performance information regarding predecessor companies, key personnel who have relevant experience, or subcontractors that will perform major or critical aspects of the requirement when such information is available and relevant to the instant acquisition.

(4) In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available, the offeror may not be evaluated favorably or unfavorably. If the government is unable to reach an individual past performance reference within a reasonable time, this will be treated as “past performance information not available,” and will not be evaluated favorably or unfavorably.

(5) The Past Performance factor will receive a rating of "acceptable" or "unacceptable" based on its entirety. Collected past performance information will be rated "acceptable" if it reflects performance that met contractual requirements. The Past Performance factor will be rated “acceptable” even if contractual performance of a particular element or sub-element may contain some minor problems for which corrective actions taken by the offeror appear or were satisfactory.

E. Price Proposal

Submission Requirements:

The Price Proposal shall be submitted as a single-sided original, and shall include the following:

1. Completed Standard Form (SF) 1442, including acknowledgement of all Amendments

2. Completed Pricing Schedule with a price for each line item including subtotals and totals

3. Proof of current System for Award Management (SAM) registration including the applicable NAICS code for this acquisition (237990)

4. Representations and Certifications (completed clause 52.204-8, if Offeror’s SAM profile does not contain current FAR and DFARS Reps & Certs)

VI. EVALUATION PROCESS

After receipt of proposals, the SSEB will convene and the voting members will independently evaluate all submitted proposals according to the evaluation factors set forth in the solicitation, beginning with the Technical proposals. Once the Technical evaluations are completed, the SSEB chairperson will lead the SSEB in discussion of each proposal, and they will come to a consensus decision as to the acceptability of each factor for each offeror. A consensus is not a majority opinion, but rather a collective opinion on the acceptability of each factor or significant subfactor. In the event that a consensus cannot be reached, the opposing views will be presented to the Contracting Officer for resolution. After concluding the evaluations, the chairperson will provide an oral briefing of the consensus evaluation results to the SSA and submit a written consensus evaluation report for the record.

The written consensus report will detail the reasons for acceptability or unacceptability of proposals noted during the SSEB evaluation. The SSEB will make no recommendation as to who shall receive the award and additionally shall not establish a rank order or order of merit list pertaining to the offers being evaluated. Upon completion of the Technical proposal report for the record, the SSA will evaluate the Price proposals price in terms of unbalancing and for potential performance risks.

The SSA, or the SSA’s designee, will evaluate each offeror’s price to determine price reasonableness.

In this context, reasonableness will be determined by comparing offered prices to one another, to the government estimate, and to pricing for previous work of a similar nature.

After receiving the SSEB chairperson’s written consensus evaluation report and briefing for the Technical proposals, the SSA, independently exercising prudent business judgment, will make a source selection decision on the basis of the lowest priced proposal meeting the acceptability standard for the technical factors and subfactors. While the SSA may use reports and analyses prepared by others, the source selection decision shall represent the SSA's independent judgment. The source selection decision shall be documented, and the documentation shall include the rationale for any business judgments made or relied on by the SSA.

If, during the evaluation process, any offerors are eliminated from the competition, the offerors excluded from the competition shall be promptly notified in writing. The notice shall state the basis for the determination and that a proposal revision will not be considered. The Procuring Contracting Officer shall award a contract to the successful offeror by furnishing the executed contract or other notice of the award to that offeror. Each offeror whose proposal was not selected for award, will be notified in writing within three days after the date of the contract award. Debriefings will be provided to unsuccessful offerors who submit timely requests.

(a) Definition. As used in this provision--

Commercial and Government Entity (CAGE) code means—

(1) An identifier assigned to entities located in the United States or its outlying areas by the Defense Logistics Agency (DLA) Commercial and Government Entity (CAGE) Branch to identify a commercial or government entity;

or

(2) An identifier assigned by a member of the North Atlantic Treaty Organization (NATO) or by the NATO Support and Procurement Agency (NSPA) to entities located outside the United States and its outlying areas that the DLA Commercial and Government Entity (CAGE) Branch records and maintains in the CAGE master file. This type of code is known as a NATO CAGE (NCAGE) code.

(b) The Offeror shall enter its CAGE code in its offer with its name and address or otherwise include it prominently in its proposal. The CAGE code entered must be for that name and address. Enter ``CAGE'' before the number. The CAGE code is required prior to award.

(c) CAGE codes may be obtained via--

(1) Registration in the System for Award Management (SAM) at www.sam.gov. If the Offeror is located in the United States or its outlying areas and does not already have a CAGE code assigned, the DLA Commercial and Government Entity (CAGE) Branch will assign a CAGE code as a part of the SAM registration process. SAM registrants located outside the United States and its outlying areas shall obtain a NCAGE code prior to registration in SAM (see paragraph (c)(3) of this provision).

(2) The DLA Commercial and Government Entity (CAGE) Branch. If registration in SAM is not required for the subject procurement, and the offeror does not otherwise register in SAM, an offeror located in the United States or its outlying areas may request that a CAGE code be assigned by submitting a request at https://cage.dla.mil.

(3) The appropriate country codification bureau. Entities located outside the United States and its outlying areas may obtain an NCAGE code by contacting the Codification Bureau in the foreign entity's country if that country is a member of NATO or a sponsored nation. NCAGE codes may be obtained from the NSPA at https://eportal.nspa.nato.int/AC135Public/scage/CageList.aspx if the foreign entity's country is not a member of NATO or a sponsored nation. Points of contact for codification bureaus, as well as additional information on obtaining NCAGE codes, are available at http://www.nato.int/structur/AC/135/main/links/contacts.htm.

(d) Additional guidance for establishing and maintaining CAGE codes is available at https://cage.dla.mil.

(e) When a CAGE Code is required for the immediate owner and/or the highest-level owner by 52.204-17 or 52.212-3(p), the Offeror shall obtain the respective CAGE Code from that entity to supply the CAGE Code to the Government.

(f) Do not delay submission of the offer pending receipt of a CAGE code.

(End of Provision)

52.204-22 ALTERNATIVE LINE ITEM PROPOSAL (JAN 2017)

(a) The Government recognizes that the line items established in this solicitation may not conform to the Offeror's practices. Failure to correct these issues can result in difficulties in acceptance of deliverables and processing payments. Therefore, the Offeror is invited to propose alternative line items for which bids, proposals, or quotes are requested in this solicitation to ensure that the resulting contract is economically and administratively advantageous to the Government and the Offeror.

(b) The Offeror may submit one or more additional proposals with alternative line items, provided that alternative line items are consistent with subpart 4.10 of the Federal Acquisition Regulation. However, acceptance of an alternative proposal is a unilateral decision made solely at the discretion of the Government. Offers that do not comply with the line items specified in this solicitation may be determined to be nonresponsive or unacceptable.

(End of provision)

52.211-5000 EVALUATION OF SUBDIVIDED ITEMS

Item Nos. 0005 and 0006 are subdivided into two or more estimated quantities and are to be separately priced. The Government will evaluate each of these items on the basis of total price of its sub-items.

(End of provision)
