STATEMENT OF WORK

1. Background and Scope:

This contract includes control of woody and herbaceous invasives, supplying and applying herbicide for site prep in open prairie pockets, root dipping, supplying and planting 760 bare root tree seedlings, supplying and planting 56 Root Production Method (RPM) trees, supplying and installing 816 Plantra tree tubes, and supplying and applying deer repellant tablets. This statement of work provides a description of forest restoration work to be conducted by contract on Willow Island in Pool 10 of the Upper Mississippi River adjacent to Guttenberg, IA. The purpose of this contract is to control pockets of black locust and to do some supplemental planting to restore Willow Island to an Oak Savanna like condition. Willow Island is an island created from material dredge out of Bussey Lake as part of the Bussey Lake EMP project. The island consists of an out ring on high ground that served as a containment dike and planted with prairie species during the EMP project. It was later planted in groups of Root Production Method (RPM) trees on a 30x30 foot spacing. Willow Island is roughly 0.06 miles east of Guttenberg, IA and is on the Iowa side of the main navigation channel. The total acreage to be restored on Willow Island is 1.12 acres.

The current management prescription is to plant bare root seedlings on an 8x8 foot spacing and to plant RPM trees on a 30x30 foot spacing.

Species and quantities include:

Bare root seedlings (18-24”): (190) Bur Oak, (190) Black Oak, (190) Northern Pin Oak, and

(190) Swamp White Oak

RPM Trees: (28) Swamp White Oak, and (28) Bur Oak

2. Project Site Access:

Access to the planting area is by boat. The Contractor is responsible for providing their own boat(s) and transporting all Contractor personnel, equipment and supplies to and from the planting area for the duration of the contract. A public boat ramp, Bussey Lake Landing, is located off of Highway X56 on Marina Rd on the north side of Guttenberg, IA and is 0.65 miles from the planting site (see map below for directions).

3. Work Schedule:

Black locust trees (2-6” dbh) will be basal bark treated, then after 1 ½ months will be cut down and crown vetch will be controlled with a foliar herbicide. Herbicide work shall occur between June 1st and July 31st. In the spring, bare root seedlings and RPM (Root Production Method) tree planting can start April 14th and be finished by June 8th.

4. Contractor Furnished Materials:

The Contractor will provide all the herbicide and herbicide equipment needed to control crown vetch and black locust and the equipment needed to cut, buck and fell the black locust. The Contractor will provide all bare root seedlings (760) and RPM trees (56). The Contractor will provide mycorrhizal fungi root dip to inoculate the roots of each bare root seedling before planting. The root dip must contain low host specificity endo- and ectomycorrizae fungi. The Contractor will provide the Repellex Deer Repellant tablets for each bare root seedling and RPM tree. The Contractor will provide a Plantra tree tube for every bare root seedling and RPM tree.

5. Herbicide Application:

All black locust stems in the project area (see attached map) shall be treated between June 1st and July 31st with a basal bark application of the appropriate herbicide (e.g. triclopyr) according to label instructions. 1 ½ months after herbicide application all dead stems shall be cut within 6” of ground level. Any live stems at this point shall be re-applied with basal bark treatment. In addition, foliar applications of clopyralid or another broadleaf specific herbicide labeled for control of crown vetch shall be applied to all crown vetch plants in the project area. Distribution of crown vetch is spotty and total control is desired in this contract. The total acreage to be treated for black locust is approximately 0.25 acre while crown vetch may occur throughout the entire

1.12 acre project area. The contractor shall avoid applications in locations or using chemicals or formulations that may damage established hardwood seedlings and saplings.

To prep the site for tree planting, the Contractor will spray glyphosate at a rate not to exceed 5% solution in a 3 ft diameter circle at each bare root and RPM planting location, roughly at an 8x8 foot spacing for bare roots and 30x30 foot for RPMs. Herbicide applications for site prep should be implemented between two weeks and one month in advance of the tree planting.

6. Planting Procedures:

Bare seedling procedure:

The Contractor shall dip the entire root system of each bare root plant in a solution containing mycorrhizal fungal inoculants upon removing the plant from the nursery bag or box. The quantity of seedlings placed in a planting bag or planting machine holder shall be limited to that which allows the removal of individual seedlings without damage to tops or roots. The Contractor shall remove only one seedling at a time from a planting bag or planting machine holder only after the planting hole has been prepared.

The Contractor shall prepare a planting hole that is wide enough to fully suspend the roots of the plant material. The Contractor shall suspend the root system near the center of the planting hole, with roots in a near-natural arrangement, at a depth at which the top of the root system is covered by approximately one inch of top soil after filling, packing and leveling. A “near-natural arrangement” means that roots approximate the position they would have when growing in nature, and are not twisted, tangled, compacted, curled, or bent relative to a position that is perpendicular to the ground surface. Each plant shall be set firmly in the ground, with moist soil filled in and placed firmly around the roots. The Contractor shall level the soil near the plant after planting and firming so there are no depressions or mounds near the stem. The Contractor may prune seedling roots prior to planting, but must leave minimum of 12” of root length measured from the root collar.

RPM procedure:

The Contractor shall prepare a planting hole that is large enough to hold the potted tree. The Contractor shall place the RPM tree so that it is level and the tree is standing straight, then filled with top soil 1” above the root collar after filling, packing and leveling. The contractor shall also pull apart roots in the root ball to reduce the likelihood of continued root spiraling and eventual girdling of the trees.

The Government Inspector may also specify where certain plant species or associations of plant species are to be planted within the project area. Plant material planted in inappropriate places will be subject to rejection by the Government Inspector during inspections.

Inappropriate places include in rock, standing water or other media that prevent planting tools from making an acceptable planting hole. When an inappropriate place is encountered, the Contractor shall plant the plant material in the nearest appropriate location.

The Contracting Officer may suspend planting work if weather conditions could damage plant material, even if the material is handled in accordance with this agreement. The Contracting Officer may also suspend planting work at any time if the Contracting Officer determines that the Contractor is not handling plants or planting in accordance with this agreement.

Excess and waste material shall be removed and properly disposed of off-site. Areas that have been damaged by planting operations shall be restored to original condition at the Contractor’s expense.

7. Applying Deer Repellant Tablets:

The Contractor must apply 1 Repellex deer repellant tablet for every foot of stem of the bare root seedling and RPM tree. EXAMPLE: a 4ft bare root seedling or RPM tree would require 4 Repellex deer repellant tablets. After the Contractor makes the planting hole, the tablets will be placed before the seedling is put into the ground.

8. Storage and Handling of Bare Root Seedlings and RPM Trees:

The Contractor must ensure that plant materials are properly stored and handled up until the time of actual planting. Temporary refrigerated storage must be provided by the Contractor. The Contractor must ensure bare root seedlings are stored at temperatures from 36 to 45 degrees F, or properly healed-in at the planting location up until the day of actual planting.

Contractor shall be responsible for transporting plant material to the project site under covers to protect plant materials from freezing or drying. Plant material shall not be transported in heated crew vehicles.

At the planting locations, the Contractor shall keep plants covered at all times using light colored tarps or insulating blankets and shall protect all plants from loss, destruction or damage of any kind, including physical injury, freezing, heating or drying. Contractor shall be responsible for all loss, destruction or damage to plant material that occurs from the time contractor takes possession of the plants until plants are planted.

9. Quality Control:

This contract requires a Quality Control Inspector provided by the Contractor. It is the duty of the Quality Control Inspector to closely monitor the planting quality of the Contractor crew and notify the foreman and planters of any issues regarding planting quality, so that deficient trends may be remedied before becoming a detriment to the overall unit quality. The Quality Control Inspector shall keep written records of the crew’s planting quality and provide the record to the Contracting Officer as each planting unit (island) is completed.

Quality control is understood to mean taking those measures necessary to ensure that the planting is completed in full accordance with all specifications set forth in this contract. The Contractor will be ultimately responsible for quality control. Quality control will be reviewed during the pre-work meeting. In addition, Government representatives will be available during the first day of planting and will occasionally visit the site during planting. They will also be available for consultation, but they will not serve as daily inspectors. It is the responsibility of the Contractor to provide day-to-day oversight of the planting crews. The Government will conduct an inspection at the completion of the planting to determine the acceptability of the planting.

The Government will inspect the planting to determine compliance with specifications. Inspection of planting will include visual inspection of 100% of the area and random sampling of planting procedures above and below ground and seedling spacing. Inspection plots will be located throughout the planting area(s) so as to obtain a representative sample of the work. Inspections will consist of observations of seedling handling, planting and inspection procedures, and examination of a sample of individual seedlings.

Planting shall be suspended, if in a planting day, three inspection plots fall below 90 percent and the overall stand percentage is lower than 90 percent. The Contractor, after consultation with the Government Inspector, shall determine the cause for the error and shall convey to the crew methods to prevent future mistakes before continuing work. If after resuming work, two more plots indicate the planting quality of at least 90 percent will be considered non-compliance with the terms of this contract and may be grounds for termination.

Planting procedures will be observed and planted seedlings from a representative sample will be dug and examined to assure compliance with specifications.

Above Ground Inspection:

(a) Spacing

(b) Planting spot selection

(c) Tree location on spot

(d) Planting depth and exposed roots

(e) Firmness

Below Ground Inspection:

(a) Planting hole orientation

(b) Root configuration and orientation

(c) Altered root length and damage

(d) “Foreign” material in planting hole

(e) Loose soil or air pockets (f) A minimum of twelve 1/250th acre square plots will be randomly chosen (13.2 ft. per side).

Inspect and record the number of planted trees meeting above-ground contract specification.

After determining the number of satisfactory above-ground trees on the plot, a minimum of three planted trees within the plot are dug for below-ground compliance. Trees will be dug starting with the one closest to the plot center and progressing outwards. The number of trees meeting below-ground specifications will be recorded. Planting quality will be computed by the following formula:

Planting = # of sat. trees above-ground # of sat. dug trees Quality _______________________ X _______________ X 100

# of plantable spots # of dug trees

10. Safety Manual:

The Contractor must comply with all safety and health requirements as outlined in the U.S. Army Corps of Engineers Safety and Health Requirements Manuel, EM 385-1-1 dated September 2008, to insure safe working conditions for contractor employees and government visitors to the site. If the Contractor does not have a copy of this manual, one will be provided or can be downloaded from http://www.publications.usace.army.mil/Portals/76/Publications/EngineerManuals/EM_385‐1‐1.pdf

11. Pre-Work Meeting:

After a notice to proceed has been issued by the Contracting Officer, the Contractor will contact the Government Inspector and arrange a pre-work meeting before actual work begins.

Unlisted classifications needed for work not included within the scope of the classifications listed may be added after award only as provided in the labor standards contract clauses (29CFR 5.5 (a) (1) (ii)).

The body of each wage determination lists the classification and wage rates that have been found to be prevailing for the cited type(s) of construction in the area covered by the wage determination. The classifications are listed in alphabetical order of "identifiers" that indicate whether the particular rate is a union rate (current union negotiated rate for local), a survey rate (weighted average rate) or a union average rate (weighted union average rate).

Union Rate Identifiers

A four letter classification abbreviation identifier enclosed in dotted lines beginning with characters other than "SU" or "UAVG" denotes that the union classification and rate were prevailing for that classification in the survey.

Example: PLUM0198-005 07/01/2014. PLUM is an abbreviation identifier of the union which prevailed in the survey for this classification, which in this example would be Plumbers. 0198 indicates the local union number or district council number where applicable, i.e., Plumbers Local 0198.

The next number, 005 in the example, is an internal number used in processing the wage determination. 07/01/2014 is the effective date of the most current negotiated rate, which in this example is July 1, 2014.

Union prevailing wage rates are updated to reflect all rate changes in the collective bargaining agreement (CBA) governing this classification and rate.

Survey Rate Identifiers

Classifications listed under the "SU" identifier indicate that no one rate prevailed for this classification in the survey and the published rate is derived by computing a weighted average rate based on all the rates reported in the survey for that classification. As this weighted average rate includes all rates reported in the survey, it may include both union and non-union rates. Example: SULA2012-007 5/13/2014. SU indicates the rates are survey rates based on a weighted average calculation of rates and are not majority rates. LA indicates the State of Louisiana.

2012 is the year of survey on which these classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination. 5/13/2014 indicates the survey completion date for the classifications and rates under that identifier.

Survey wage rates are not updated and remain in effect until a new survey is conducted.

Union Average Rate Identifiers

Classification(s) listed under the UAVG identifier indicate that no single majority rate prevailed for those classifications; however, 100% of the data reported for the classifications was union data. EXAMPLE: UAVG-OH-0010 08/29/2014. UAVG indicates that the rate is a weighted union average rate. OH indicates the state. The next number, 0010 in the example, is an internal number used in producing the wage determination.

08/29/2014 indicates the survey completion date for the classifications and rates under that identifier.

A UAVG rate will be updated once a year, usually in January of each year, to reflect a weighted average of the current negotiated/CBA rate of the union locals from which the rate is based.

WAGE DETERMINATION APPEALS PROCESS

1.) Has there been an initial decision in the matter? This can be:

* an existing published wage determination

* a survey underlying a wage determination

* a Wage and Hour Division letter setting forth a position on a wage determination matter

* a conformance (additional classification and rate) ruling

On survey related matters, initial contact, including requests for summaries of surveys, should be with the Wage and Hour Regional Office for the area in which the survey was conducted because those Regional Offices have responsibility for the Davis- Bacon survey program. If the response from this initial contact is not satisfactory, then the process described in 2.) and 3.) should be followed.

With regard to any other matter not yet ripe for the formal process described here, initial contact should be with the Branch of Construction Wage Determinations. Write to:

Branch of Construction Wage Determinations Wage and Hour Division U.S. Department of Labor 200 Constitution Avenue, N.W.

Washington, DC 20210

2.) If the answer to the question in 1.) is yes, then an interested party (those affected by the action) can request review and reconsideration from the Wage and Hour Administrator (See 29 CFR Part 1.8 and 29 CFR Part 7). Write to:

Wage and Hour Administrator U.S. Department of Labor 200 Constitution Avenue, N.W.

Washington, DC 20210

The request should be accompanied by a full statement of the interested party's position and by any information (wage payment data, project description, area practice material, etc.) that the requestor considers relevant to the issue.

3.) If the decision of the Administrator is not favorable, an interested party may appeal directly to the Administrative Review Board (formerly the Wage Appeals Board).

Write to:

Administrative Review Board U.S. Department of Labor 200 Constitution Avenue, N.W.

Washington, DC 20210

4.) All decisions by the Administrative Review Board are final.
