The contract includes options for 4 additional years of maintenance dredging.
1.1.1 Number of Dredging Plants
The Contractor shall provide one primary dredging plant for the areas specified and one secondary plant that may be mobilized at the discretion of the Contracting Officer if additional capacity is required. Either or both plants may also be used for emergency dredging if necessary. The Contracting Officer may require both plants to remain ready for use from time of mobilization until the end of the ordering period. However, the Contractor is not obligated to make the secondary plant available for dredging after June 30 unless the Government has notified the Contractor on or before 30 June of the basic period (or any exercised option year) that it will require the availability of the second plant beyond that date.
1.1.2 Dredging Production
The Contractor shall schedule operations in order to perform a minimum of 2,000 cubic yards (CY) per day of maintenance dredging or 10,000 CY per week for the primary plant and 1,500 CY per day of maintenance dredging or 7,500 CY per week for the second plant. The Contracting Officer may, however, require 24 hours per day seven days per week operation depending on the amount of shoaling, or emergencies. The Contractor will be expected to work on ten premium days during each dredging season as directed by the Contracting Officer. Premium days are defined in SECTION 35 20 23:
DREDGING. Production lost due to Contractor equipment failures or breakdowns, shall be regained by scheduling additional shifts or by scheduling work on days classified as Premium, without charge to Premium day allotment. The Contractor shall notify the Contracting Officer of their means, methods and schedule to regain lost production.
1.1.3 Historical Data
Computation sheets which list potential dredging locations, the frequency of dredging and other statistical information, and potential dredge material placement sites, are included at the end of this SECTION. The river miles for these dredging locations and dredge material placement sites are provided on the computation sheets and may be referenced with a current edition of Upper Mississippi River Navigation Charts published by the U.S. Army Corps of Engineers. These computation sheets are compiled from historical data; they are not a warranty or representation as to which specific areas will require dredging, the quantities that will be dredged, or the placement sites which will be used under this contract.
SECTION 01 00 00.00 13 Page 2 W912ES-11-B-0004
1.1.4 Memorandums of Understanding and Permits

MEMORANDUM OF UNDERSTANDING BETWEEN THE
ST. PAUL DISTRICT- U. S. ARMY CORPS OF ENGINEERS AND THE
STATE OF WISCONSIN, DEPARTMENT OF NATURAL RESOURCES
CONCERNING PLACEMENT OF DREDGED MATERIAL
This agreement is entered into by and between the St. Paul District, Department of the Army, U.S. Army Corps of Engineers and the State of Wisconsin, Department ofNatural Resources, pursuant to section 30.202, Wisconsin Statutes, for the purpose of facilitating long term channel maintenance and recreational beach enhancement activities related to the placement of dredged material for the Upper Mississippi River System (UMRS) nine-foot channel project (project), Environmental Management Program- Habitat Rehabilitation and Enhancement Projects, water level management projects, and any future ecosystem restoration programs such as the proposed Navigation and Ecosystem Sustainability Program (NESP)
WHEREAS the State of Wisconsin, Department ofNatural Resources (hereinafter Department) regulates dredging and placement of materials in the lakes, rivers and streams of the State of Wisconsin to protect the public interest, fish and wildlife resources, water quality, flood flow capacity, recreational uses and the riverine environment, under the Wisconsin Public Trust Doctrine and
WHEREAS the U. S. Army Corps of Engineers (hereinafter Corps) has the responsibility under federal law to conduct dredging operations in the project to protect the public interest in maintaining and improving navigability in and near the Mississippi River, and
WHEREAS the Great River Environmental Action Team, GREAT I, and the UMRS Master Plan have developed a comprehensive Mississippi River Channel Maintenance Plan after extensive research, detailed interdisciplinary evaluations, the consideration of environmental consequences and the participation of the State of Wisconsin, the Corps, the U.S. Fish and Wildlife Service, and other agencies and states, and
WHEREAS the GREAT I Channel Maintenance Plan was endorsed by the Upper Mississippi River System Master Plan which was adopted by the Upper Mississippi River Basin Association on January 1, 1982, and
WHEREAS the Wisconsin Legislature adopted section 30.202, Wisconsin Statutes, effective April 26, 1982, and found that:
a) the regulation of disposal ofthe dredged material associated with navigation projects of the Corps required a balancing of public interest, and the interest of the federal government, and State of Wisconsin and other states, and
b) the existing state statutes, rules, and ordinances do not provide sufficient latitude to provide a balanced approach to the regulation of the disposal of these dredged materials for the Mississippi River, St. Croix River and Black Rivt<r nine foot channel conditions, and
c) because of these special circumstances a more flexible regulatory mechanism needs to be developed by the Department and the Corps, and
WHEREAS the Wisconsin Legislature in section 30.202, Wisconsin Statutes, authorized the Department to enter into a memorandum of understanding with the Corps concerning dredged material placement based upon the extensive studies of GREAT I and the UMRS Master Plan, and
WHEREAS members of the River Resources Forum (Corps, USFWS and states) refined GREAT I study recommendations and channel maintenance reconnaissance reports into a comprehensive District-wide long term document called the Channel Maintenance Management Plan (CMMP) endorsed 08/96 and containing approved dredged material placement plans based on a forty year planning period for each dredging location, and
WHEREAS Section 1103 of the Water Resources Development Act of 1986 authorized the Corps of Engineers, in consultation with the Secretary of the Interior and the States of Iowa, Minnesota and Wisconsin, to undertake, as identified in the Master Plan, an Environmental Management Program for the planning, design, construction, and evaluation of habitat rehabilitation and enhancement projects, which include the placement of fill in the UMR floodplain.
WHEREAS there is proposed legislation that may authorize the Corps of Engineers, in consultation with Secretary of Interior and States of Iowa, Minnesota and Wisconsin to undertake ecosystem restoration projects, as identified in the Final Integrated Feasibility Report and Programmatic Environmental Impact Statement for the UMR-IWW System Navigation Feasibility Study, which include the placement of fill in the UMR floodplain.
NOW, THEREFORE, in consideration of the mutual covenants hereinafter set forth, it is agreed between the Corps and the Department:
1. This memorandum of understanding is entered into by the Department under the authority granted to the Department by Section 30.202, Wisconsin Statutes. Should a conflict arise between Section 30.202 and applicable federal law, this agreement will be voidable at the option of either party.
2. Channel maintenance, Environmental Management Program, recreational beach enhancement, water level management, and the proposed Navigation and Ecosystem Sustainability Program activities related to placement of dredged material subject to this agreement and carried out in accordance with this agreement are exempt from any prohibition, restriction, requirement, permit, license, approval, authorization, fee, notice, hearing, procedure or penalty specified under sections 29.29, 30.01 to 30.20, 30.21 to 30.99, 59.692 or 87.30 or chapters 285 or 283, Wisconsin Statutes, or specified in any rule promulgated,.order issued or ordinance adopted under those sections or chapters.
3. The Corps will continue to implement a sound, balanced, long term channel maintenance program that is consistent with the objectives of the GREAT study recommendations that culminated in the development of the CMMP.
