STATEMENT OF WORK
LOCK 8 WINTER MAINTENANCE – DEWATERING
CONCRETE SUPPLY AND DELIVERY
SCOPE OF WORK
1. General. The work shall consist of the concrete being supplied for Lock 8 Winter Maintenance. A total of approximately 130 cy3 shall be delivered and placed by methods of pumping to Lock and Dam No.8.
This amount could vary as the final inspections cannot be completed until the lock chamber is emptied in early December. The placement areas include the upstream bulk head supporting blocks, the downstream bulk head sill beam, and the vertical concrete repair located on the Land and Intermediate wall inside the lock chamber. The proposed bid shall provide for all labor, equipment, materials, and supplies necessary for this work.
2. Construction Schedule. The concrete supplier shall coordinate with the Government Representative for exact placement times, dates and quantities. However, tentative delivery dates are set for mid January 2014 through early March 2014.
3. Site Location.

4. Submittals. The following shall be submitted to the Government for approval no later than 10 days after the award of contract.
1. Concrete Mixture Design A mix design shall be submitted for each concrete mix to be used on the project. Each mix design shall list the proportions by weight of cement, weight or volume of water, weights of aggregates in a saturated surface-dry condition, and type, quantity, and name of admixtures per cubic yard of concrete. All materials included in the mixture shall be of the same type and from the same source as will be used on the project. Each mix shall be accompanied by evidence that demonstrates the mix will produce concrete having the characteristics and quality as specified:
a. Mix Design Study Submit a mix design study complying with ACI 211.1 conducted in the past 12 months. The mix design shall be completed by a testing laboratory complying with ASTM C 1077. For SCC (Self-Consolidating Concrete) submit evidence of the design mix for this project. The evidence shall include test data from the Slump Flow Test including the Visual Stability Index (VSI) per ASTM C 1611 and its appendix. A registered professional engineer knowledgeable and familiar with self-consolidating concrete mixes shall conduct these tests, or have them done under his immediate supervision.
b. Project Data Project data or mix design studies shall be obtained for the exact mix as submitted. Minor mix alterations or substitutions may be accepted if approved by the Contracting Officer. Any alternations or substitutions shall be clearly identified, and shall be accompanied by recommendations from the admixture supplier or a registered professional engineer indicating the expected effects on the concrete.
2. General Concrete Requirements The concrete shall be a Self-consolidating concrete (SCC), that is able to flow under its own weight and completely fill the form work, even in the presence of dense reinforcement without the need of any vibration while maintaining homogeneity. The concrete shall be composed of a cementitious material, water, fine and coarse aggregates, and admixtures. The admixtures shall include High Range water reducers (HRWR), which are an essential component of SCC to provide the necessary work ability; viscosity modifying agents (VMA) for stability and air entraining admixtures (AEA) to improve the freeze-thaw resistance. The design compressive strength as determined by ASTM C 39 shall not be less than 4,000 pounds per square inch in 28 days. Water-cement ratio shall not exceed 0.40. The maximum water-cement ratio will be determined by the weight equivalency method as described in ACI 211.1 (cement plus pozzolan, silica fume, and ground granulated blast furnace slag). This W/C ratio may cause higher strengths than required. The cementitious material content shall be a minimum of 500 and a maximum of 620 pounds per cubic yard. Materials shall meet the requirements of the respective publications and other data specified below.
a. Slump Flow: For SCC (self-consolidating concrete) the slump flow of concrete is identified as the flow of concrete as measured by the Slump Flow Test. The slump flow should be between 22 and 28 inches, with a visual rating of static stability equal to zero or one as determined by the Visual Stability Index (VSI) as described in ASTM C 1611 and its appendix.
b. Admixtures: Admixtures to be used on the project shall be included in the mix design submittals. Accelerating admixtures shall be used only when approved in writing.
c. Air Entrainment: All concrete shall be air entrained to contain between 4-1/2 and 7- 1/2 percent total air.
d. Aggregates:
i. Size of Coarse Aggregate: Nominal maximum size coarse aggregate shall be 3/4-inch.
ii. Composition: Fine aggregate shall consist of natural sand, manufactured sand, or a combination of natural and manufactured sands. Coarse aggregate shall consist of gravel, crushed gravel, crushed stone, or a combination thereof.
iii. Quality: The aggregate particles shall be clean, hard, unweathered, and uncoated. The shape of the particles shall be generally cubical or spherical.
Where required, fines shall be removed from the aggregates by adequate washing. The aggregates as delivered to the mixer shall meet the quality requirements of ASTM C 33, table 3 for the appropriate type or location of concrete construction for use in a severe climate.
e. Cementitious Materials: Cementitious materials shall be portland cement, or portland cement in combination with pozzolan or ground granulated blast furnace slag. Optional pozzolan replacement of cement shall be limited to 20 percent of the total cementitious material of a mix by weight. Cementitious materials shall conform to appropriate specifications listed below. Use of cementitious materials in concrete which will have surfaces exposed in the completed structure shall be restricted so there is no change in color, source, or type of cementitious material.
i. Portland Cement: ASTM C 150, Type I with a maximum 15 percent amount of tricalcium aluminate, or Type II.
ii. Pozzolan (Fly Ash): ASTM C 618, Class C or F with the optional requirements for multiple factor, drying shrinkage, and uniformity from Table 3 of ASTM C 618.
iii. Ground Granulated Blast – Furnace (GGBF) Slag: ASTM C 989, Grade 120.
5. Method of Placement. The concrete pump shall conform to the following specifications: The pipeline shall be rigid steel pipe or heavy-duty flexible hose. The inside diameter of the pipe shall be at least 4 inches. The distance to be pumped shall not exceed limits recommended by the pump manufacturer. The concrete shall be supplied to the concrete pump continuously. When pumping is completed, concrete remaining in the pipeline shall be ejected without contamination of concrete in place. After each operation, equipment shall be thoroughly cleaned, and flushing water shall be wasted outside of the forms and in compliance with the approved environment protection plan.
6. Safety. All work shall be in conformance with the Corps of Engineers Safety and Health Requirements Manual EM 385-1-1 (15 September 2008 edition).
7. Site Restoration and Cleanup. The contractor shall clean up and dispose of all job related debris in accordance with all state and local laws and ordinances. All surface areas damaged by the Contractor’s operations shall be restored.
8. Measurement and Payment. This work will not be measured for payment. Payment shall constitute full compensation for furnishing all labor, materials, equipment, and incidentals required and performing all work in a satisfactory manner and in accordance with the requirements described herein.

This is a 100% Small Business Set-Aside solicitation. The Contractor’s quote shall contain sufficient information so that the U.S. Army Corps of Engineers can determine whether the proposed elements are realistic for the work to be performed, reflect a clear understanding of the requirements, and are consistent with the proposed methods of performance and materials to be supplied.
The Contractor should be prepared to defend any discrepancies between the quote and a fair and reasonable estimate prepared by the Government. It should include sufficient information to demonstrate that the work effort is reasonable pertaining to the site and scope. Any unusual conditions or factors affecting the work duration/productivity should be identified.

52.204-7 SYSTEM FOR AWARD MANAGEMENT (JULY 2013)
(a) Definitions. As used in this provision--
Data Universal Numbering System (DUNS) number means the 9-digit number assigned by Dun and Bradstreet, Inc.
(D&B) to identify unique business entities.
Data Universal Numbering System +4 (DUNS+4) number means the DUNS number assigned by D&B plus a 4-character suffix that may be assigned by a business concern. (D&B has no affiliation with this 4-character suffix.)
This 4-character suffix may be assigned at the discretion of the business concern to establish additional System for Award Management records for identifying alternative Electronic Funds Transfer (EFT) accounts (see the FAR at Subpart 32.11) for the same parent concern.
Registered in the System for Award Management SAM database means that--
(1) The offeror has entered all mandatory information, including the DUNS number or the DUNS+4 number, the Contractor and Government Entity (CAGE) code, as well as data required by the Federal Funding Accountability and Transparency Act of 2006 (see Subpart 4.14) into the SAM database;
(2) The offeror has completed the Core, Assertions, and Representations and Certifications, and Points of Contact sections of the registration in the SAM database;
(3) The Government has validated all mandatory data fields, to include validation of the Taxpayer Identification Number (TIN) with the Internal Revenue Service (IRS). The offeror will be required to provide consent for TIN validation to the Government as a part of the SAM registration process; and
(4) The Government has marked the record ``Active''.
(b)(1) By submission of an offer, the offeror acknowledges the requirement that a prospective awardee shall be registered in the SAM database prior to award, during performance, and through final payment of any contract, basic agreement, basic ordering agreement, or blanket purchasing agreement resulting from this solicitation.
(2) The offeror shall enter, in the block with its name and address on the cover page of its offer, the annotation “DUNS” or “DUNS +4” followed by the DUNS or DUNS +4 number that identifies the offeror's name and address exactly as stated in the offer. The DUNS number will be used by the Contracting Officer to verify that the offeror is registered in the SAM database.
(c) If the offeror does not have a DUNS number, it should contact Dun and Bradstreet directly to obtain one.

A vendor must provide a price on all items in this solicitation to be eligible for award. The Government will award on an “All or None” basis. Evaluation of bids/offers will be based upon only the total price included on the pricing schedule for all items. 52.222-5 DAVIS-BACON ACT--SECONDARY SITE OF THE WORK (JUL 2005)
(a)(1) The offeror shall notify the Government if the offeror intends to perform work at any secondary site of the work, as defined in paragraph (a)(1)(ii) of the FAR clause at 52.222-6, Davis-Bacon Act, of this solicitation.
(2) If the offeror is unsure if a planned work site satisfies the criteria for a secondary site of the work, the offeror shall request a determination from the Contracting Officer.
(b)(1) If the wage determination provided by the Government for work at the primary site of the work is not applicable to the secondary site of the work, the offeror shall request a wage determination from the Contracting Officer.
(2) The due date for receipt of offers will not be extended as a result of an offeror's request for a wage determination for a secondary site of the work.
52.222-23 NOTICE OF REQUIREMENT FOR AFFIRMATIVE ACTION TO ENSURE EQUAL
EMPLOYMENT OPPORTUNITY FOR CONSTRUCTION (FEB 1999)
(a) The offeror's attention is called to the Equal Opportunity clause and the Affirmative Action Compliance Requirements for Construction clause of this solicitation.
(b) The goals for minority and female participation, expressed in percentage terms for the Contractor's aggregate workforce in each trade on all construction work in the covered area, are as follows:

These goals are applicable to all the Contractor's construction work performed in the covered area. If the Contractor performs construction work in a geographical area located outside of the covered area, the Contractor shall apply the goals established for the geographical area where the work is actually performed. Goals are published periodically in the Federal Register in notice form, and these notices may be obtained from any Office of Federal Contract Compliance Programs office.
(c) The Contractor's compliance with Executive Order 11246, as amended, and the regulations in 41 CFR 60-4 shall be based on (1) its implementation of the Equal Opportunity clause, (2) specific affirmative action obligations required by the clause entitled "Affirmative Action Compliance Requirements for Construction,'' and (3) its efforts to meet the goals. The hours of minority and female employment and training must be substantially uniform throughout the length of the contract, and in each trade. The Contractor shall make a good faith effort to employ minorities and women evenly on each of its projects. The transfer of minority or female employees or trainees from Contractor to Contractor, or from project to project, for the sole purpose of meeting the Contractor's goals shall be a violation of the contract, Executive Order 11246, as amended, and the regulations in 41 CFR 60-4. Compliance with the goals will be measured against the total work hours performed.
(d) The Contractor shall provide written notification to the Deputy Assistant Secretary for Federal Contract Compliance, U.S. Department of Labor, within 10 working days following award of any construction subcontract in excess of $10,000 at any tier for construction work under the contract resulting from this solicitation. The notification shall list the --
(1) Name, address, and telephone number of the subcontractor;
(2) Employer's identification number of the subcontractor;
(3) Estimated dollar amount of the subcontract;
(4) Estimated starting and completion dates of the subcontract; and
(5) Geographical area in which the subcontract is to be performed.
(e) As used in this Notice, and in any contract resulting from this solicitation, the "covered area" is

52.225-10 NOTICE OF BUY AMERICAN ACT REQUIREMENT--CONSTRUCTION MATERIALS (FEB
2009) ALTERNATE I (MAY 2002)
(a) Definitions. “Commercially available off-the-shelf (COTS) item,” “construction material,” “domestic construction material,” and “foreign construction material,” as used in this provision, are defined in the clause of this solicitation entitled “Buy American Act--Construction Materials” (Federal Acquisition Regulation (FAR) clause 52.225-9).
(b) Requests for determinations of inapplicability. An offeror requesting a determination regarding the inapplicability of the Buy American Act shall submit the request with its offer, including the information and applicable supporting data required by paragraphs (c) and (d) of the clause at FAR 52.225-9.
(c) Evaluation of offers. (1) The Government will evaluate an offer requesting exception to the requirements of the Buy American Act, based on claimed unreasonable cost of domestic construction material, by adding to the offered price the appropriate percentage of the cost of such foreign construction material, as specified in paragraph (b)(3)(i) of the clause at FAR 52.225-9.
(2) If evaluation results in a tie between an offeror that requested the substitution of foreign construction material based on unreasonable cost and an offeror that did not request an exception, the Contracting Officer will award to the offeror that did not request an exception based on unreasonable cost.
(d) Alternate offers.
(1) When an offer includes foreign construction material not listed by the Government in this solicitation in paragraph (b)(2) of the clause at FAR 52.225-9, the offeror also may submit an alternate offer based on use of equivalent domestic construction material.
(2) If an alternate offer is submitted, the offeror shall submit a separate Standard Form 1442 for the alternate offer, and a separate price comparison table prepared in accordance with paragraphs (c) and (d) of the clause at FAR 52.225-9 for the offer that is based on the use of any foreign construction material for which the Government has not yet determined an exception applies.
(3) If the Government determines that a particular exception requested in accordance with paragraph (c) of the clause at FAR 52.225-9 does not apply, the Government will evaluate only those offers based on use of the equivalent domestic construction material, and the offeror shall be required to furnish such domestic construction material. An offer based on use of the foreign construction material for which an exception was requested--
(i) Will be rejected as nonresponsive if this acquisition is conducted by sealed bidding; or
(ii) May be accepted if revised during negotiations.

General Deliverables include but are not limited to: Design Reports, Plans and Specifications, O&M manuals, environmental reports, photographs, cultural survey/information, Microfilm/Microfiche, scanned legacy documents, monitoring reports, compliance reports, etc…
All geospatial deliverables (defined below) must include Federal Geographic Data Committee (FGDC) compliant metadata.
Standard Geospatial Deliverables:
Geospatial data include GIS drawings/maps, hydrographic surveys, topographic mapping, georeferenced digital drawings generated from hard copy maps/drawings, high-order geodetic control (horizontal and vertical) surveys using a differential Global Positioning System (GPS) and conventional survey techniques for control and property/boundary surveys, controlled and non-controlled aerial photography (film, photos, and digital output), photogrammetric mapping including aero-triangulation, digital- orthophotography image file and map production, remote sensing, radar and satellite imagery and/or aerial imagery products.
CADD-Related Geospatial Deliverables:
Projects involving engineering CADD drawings may be composed of multiple files each containing a specific data theme or covering a specified geographic area of the same theme.
Because metadata for each of these individual files would contain significant repetitive information, it is appropriate to document groups of files that form a well defined dataset with a single metadata file. Pursuant to this fact, it is mandatory that all CADD-related data deliverables have at least one collection metadata file describing the project and individual data layers generated within the project.
The St. Paul District will provide metadata software, documentation, and samples on request.

Section 00600 - Representations & Certifications
52.204-8 ANNUAL REPRESENTATIONS AND CERTIFICATIONS (JUNE 2013)
(a)(1) The North American Industry Classification System (NAICS) code for this acquisition is 238110.
(2) The small business size standard is $14 million.
(3) The small business size standard for a concern which submits an offer in its own name, other than on a construction or service contract, but which proposes to furnish a product which it did not itself manufacture, is 500 employees.

(b) By submission of this offer, the offeror represents, to the best of its knowledge and belief, that all covered DoD officials employed by or otherwise receiving compensation from the offeror, and who are expected to undertake activities on behalf of the offeror for any resulting contract, are presently in compliance with all post-employment restrictions covered by 18 U.S.C. 207, 41 U.S.C. 2101-2107, and 5 CFR parts 2637 and 2641, including Federal Acquisition Regulation 3.104-2.
Section 00700 - Contract Clauses
52.204-13 SYSTEM FOR AWARD MANAGEMENT MAINTENANCE (JULY 2013)
(a) Definitions. As used in this clause--
Data Universal Numbering System (DUNS) number means the 9-digit number assigned by Dun and Bradstreet, Inc. (D&B) to identify unique business entities, which is used as the identification number for Federal Contractors.
Data Universal Numbering System+4 (DUNS+4) number means the DUNS number assigned by D&B plus a 4-character suffix that may be assigned by a business concern. (D&B has no affiliation with this 4-character suffix.) This 4-character suffix may be assigned at the discretion of the business concern to establish additional SAM records for identifying alternative Electronic Funds Transfer (EFT) accounts (see the FAR at subpart 32.11) for the same concern.
Registered in the System for Award Management (SAM) database means that—
(1) The Contractor has entered all mandatory information, including the DUNS number or the DUNS+4 number, the Contractor and Government Entity (CAGE) code, as well as data required by the Federal Funding Accountability and Transparency Act of 2006 (see subpart 4.14), into the SAM database;
(2) The Contractor has completed the Core, Assertions, Representations and Certifications, and Points of Contact sections of the registration in the SAM database;
(3) The Government has validated all mandatory data fields, to include validation of the Taxpayer Identification Number (TIN) with the Internal Revenue Service (IRS). The Contractor will be required to provide consent for TIN validation to the Government as a part of the SAM registration process; and
(4) The Government has marked the record ``Active''.
System for Award Management (SAM) means the primary Government repository for prospective Federal awardee and Federal awardee information and the centralized Government system for certain contracting, grants, and other assistance-related processes. It includes—
(1) Data collected from prospective Federal awardees required for the conduct of business with the Government;
(2) Prospective contractor-submitted annual representations and certifications in accordance with FAR subpart 4.12; and
(3) Identification of those parties excluded from receiving Federal contracts, certain subcontracts, and certain types of Federal financial and non-financial assistance and benefits.
(b) The Contractor is responsible for the accuracy and completeness of the data within the SAM database, and for any liability resulting from the Government's reliance on inaccurate or incomplete data. To remain registered in the SAM database after the initial registration, the Contractor is required to review and update on an annual basis, from the date of initial registration or subsequent updates, its information in the SAM database to ensure it is current, accurate and complete. Updating information in the SAM does not alter the terms and conditions of this contract and is not a substitute for a properly executed contractual document.
(c)(1)(i) If a Contractor has legally changed its business name, doing business as name, or division name (whichever is shown on the contract), or has transferred the assets used in performing the contract, but has not completed the necessary requirements regarding novation and change-of-name agreements in subpart 42.12, the Contractor shall provide the responsible Contracting Officer a minimum of one business day's written notification of its intention to—
(A) Change the name in the SAM database;
(B) Comply with the requirements of subpart 42.12 of the FAR; and
(C) Agree in writing to the timeline and procedures specified by the responsible Contracting Officer. The Contractor shall provide with the notification sufficient documentation to support the legally changed name.
(ii) If the Contractor fails to comply with the requirements of paragraph (c)(1)(i) of this clause, or fails to perform the agreement at paragraph (c)(1)(i)(C) of this clause, and, in the absence of a properly executed novation or change-of-name agreement, the SAM information that shows the Contractor to be other than the Contractor indicated in the contract will be considered to be incorrect information within the meaning of the ``Suspension of Payment'' paragraph of the electronic funds transfer (EFT) clause of this contract.
(2) The Contractor shall not change the name or address for EFT payments or manual payments, as appropriate, in the SAM record to reflect an assignee for the purpose of assignment of claims (see FAR subpart 32.8, Assignment of Claims). Assignees shall be separately registered in the SAM. Information provided to the Contractor's SAM record that indicates payments, including those made by EFT, to an ultimate recipient other than that Contractor will be considered to be incorrect information within the meaning of the ``Suspension of Payment'' paragraph of the EFT clause of this contract.
(3) The Contractor shall ensure that the DUNS number is maintained with Dun & Bradstreet throughout the life of the contract. The Contractor shall communicate any change to the DUNS number to the Contracting Officer within 30 days after the change, so an appropriate modification can be issued to update the data on the contract. A change in the DUNS number does not necessarily require a novation be accomplished. Dun & Bradstreet may be contacted—
(i) Via the internet at http://fedgov.dnb.com/webform or if the Contractor does not have internet access, it may call Dun and Bradstreet at 1-866-705-5711 if located within the United States; or
(ii) If located outside the United States, by contacting the local Dun and Bradstreet office.

52.211-10 COMMENCEMENT, PROSECUTION, AND COMPLETION OF WORK (APR 1984) -
ALTERNATE I (APR 1984)
The Contractor shall be required to (a) commence work under this contract within 120 calendar days after the date the Contractor receives the notice to proceed (approximately mid-January 2014), (b) prosecute the work diligently, and (c) complete the entire work ready for use not later than approximately 31 March 2014. The time stated for completion shall include final cleanup of the premises.
The completion date is based on the assumption that the successful offeror will receive the notice to proceed by 27 September 2013. The completion date will be extended by the number of calendar days after the above date that the Contractor receives the notice to proceed, except to the extent that the delay in issuance of the notice to proceed results from the failure of the Contractor to execute the contract and give the required performance and payment bonds within the time specified in the offer.
52.219-6 NOTICE OF TOTAL SMALL BUSINESS SET-ASIDE (NOV 2011)
(a) Definition.
"Small business concern," as used in this clause, means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the size standards in this solicitation.
(b) Applicability. This clause applies only to--
(1) Contracts that have been totally set aside or reserved for small business concerns; and
(2) Orders set aside for small business concerns under multiple-award contracts as described in 8.405-5 and 16.505(b)(2)(i)(F).
(c) General. (1) Offers are solicited only from small business concerns. Offers received from concerns that are not small business concerns shall be considered nonresponsive and will be rejected.
(2) Any award resulting from this solicitation will be made to a small business concern.
(d) Agreement. A small business concern submitting an offer in its own name shall furnish, in performing the contract, only end items manufactured or produced by small business concerns in the United States or its outlying areas. If this procurement is processed under simplified acquisition procedures and the total amount of this contract does not exceed $25,000, a small business concern may furnish the product of any domestic firm. This paragraph does not apply to construction or service contracts.
52.219-28 POST-AWARD SMALL BUSINESS PROGRAM REREPRESENTATION (JULY 2013)
(a) Definitions. As used in this clause--
Long-term contract means a contract of more than five years in duration, including options. However, the term does not include contracts that exceed five years in duration because the period of performance has been extended for a cumulative period not to exceed six months under the clause at 52.217-8, Option to Extend Services, or other appropriate authority.
Small business concern means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the criteria in 13 CFR part 121 and the size standard in paragraph (c) of this clause. Such a concern is ``not dominant in its field of operation'' when it does not exercise a controlling or major influence on a national basis in a kind of business activity in which a number of business concerns are primarily engaged. In determining whether dominance exists, consideration shall be given to all appropriate factors, including volume of business, number of employees, financial resources, competitive status or position, ownership or control of materials, processes, patents, license agreements, facilities, sales territory, and nature of business activity.
(b) If the Contractor represented that it was a small business concern prior to award of this contract, the Contractor shall rerepresent its size status according to paragraph (e) of this clause or, if applicable, paragraph (g) of this clause, upon the occurrence of any of the following:
(1) Within 30 days after execution of a novation agreement or within 30 days after modification of the contract to include this clause, if the novation agreement was executed prior to inclusion of this clause in the contract.
(2) Within 30 days after a merger or acquisition that does not require a novation or within 30 days after modification of the contract to include this clause, if the merger or acquisition occurred prior to inclusion of this clause in the contract.
(3) For long-term contracts--
(i) Within 60 to 120 days prior to the end of the fifth year of the contract; and
(ii) Within 60 to 120 days prior to the date specified in the contract for exercising any option thereafter.
(c) The Contractor shall rerepresent its size status in accordance with the size standard in effect at the time of this rerepresentation that corresponds to the North American Industry Classification System (NAICS) code assigned to this contract. The small business size standard corresponding to this NAICS code can be found at http://www.sba.gov/content/table-small-business-size-standards.
(d) The small business size standard for a Contractor providing a product which it does not manufacture itself, for a contract other than a construction or service contract, is 500 employees.
(e) Except as provided in paragraph (g) of this clause, the Contractor shall make the representation required by paragraph (b) of this clause by validating or updating all its representations in the Representations and Certifications section of the System for Award Management (SAM) and its other data in SAM, as necessary, to ensure that they reflect the Contractor's current status. The Contractor shall notify the contracting office in writing within the timeframes specified in paragraph (b) of this clause that the data have been validated or updated, and provide the date of the validation or update.
(f) If the Contractor represented that it was other than a small business concern prior to award of this contract, the Contractor may, but is not required to, take the actions required by paragraphs (e) or (g) of this clause.
(g) If the Contractor does not have representations and certifications in SAM, or does not have a representation in SAM for the NAICS code applicable to this contract, the Contractor is required to complete the following rerepresentation and submit it to the contracting office, along with the contract number and the date on which the rerepresentation was completed:
