SOURCE SELECTION PLAN

LOWEST PRICE TECHNICALLY ACCEPTABLE (LPTA)

PROPOSAL PREPARATION

A. BASIS FOR AWARD

This acquisition is a 100% small business, local area set-aside utilizing Lowest Price Technically Acceptable (LPTA) best value continuum source selection procedures in accordance with FAR 15.101-2.

A single award will be made to the lowest price technically acceptable offer in response to the solicitation.

Proposed prices will be evaluated but not scored or otherwise combined with the other aspects of the proposal evaluation.

B. FACTORS TO BE EVALUATED

In order for an offeror to be considered for award, the proposal must receive an “Acceptable” rating in every non-price factor. The evaluation factors are listed below:

Volume I: Technical. The Technical Factors consist of:

Factor 1: Schedule and Work Plan Factor 2: Key Personnel Factor 3: Stafford Act Eligibility Factor 4: Past Performance

Volume II: Price.

It is intended that proposals be evaluated, and an award made without discussions with the Offerors. If necessary, the Government may contact Offerors for the purpose of minor clarifications(s). If discussions are determined to be necessary, discussions will occur with all Offerors within the competitive range in accordance with FAR 15.306(d).

If discussions are conducted, the Contracting Officer will schedule the discussion sessions, and each offeror will be notified of the time and place prior to their discussion session. The Contracting Officer will provide additional instructions with the notification. The discussion sessions will take place by the method of the Government’s choosing and provided to the contractor in writing.

Failure to submit mandatory information for a factor, indicated by the word “shall” or “must”, will result in a rating of “unacceptable” for that factor, and the Offeror will be ineligible for award unless the Contracting Officer decides to hold discussions, and includes the Offeror in the competitive range. Technical evaluation factors (Factor I: Schedule and Work Plan, Factor II:

Key Personnel, Factor III: Stafford Act Eligibility, Factor IV: Past Performance) will be evaluated first. Price will be evaluated last.

An offeror that wishes to submit a proposal must propose on all of the work. Award will be made on an “All or None” basis to the lowest priced, technically acceptable proposal. Each non-price evaluation factor must be found to be technically acceptable in order for the proposal to be found technically acceptable. Proposals will not be technically ranked. Only one (1) technical proposal will be evaluated for each offeror.

C. EVALUATION APPROACH

All proposals shall be subject to evaluation by the Source Selection Team (SST).

1. Volume 1: Technical Factors:

The Government will evaluate the Technical Factors on an Acceptable/Unacceptable basis. Each factor identifies the minimum requirement that are imperative to successful contract performance.

The Source Selection Team will evaluate the Offeror’s proposal against the factors listed below to determine whether the proposal is Acceptable or Unacceptable, using the ratings and descriptions outlined in Table A-1:

Factor 1: Schedule and Work Plan

Schedule Requirements: Offerors shall submit a project schedule listing at minimum each phase of construction. The schedule must provide sufficient information such that the technical evaluation team is able to determine the reasonableness of the schedule in comparison to the Specification requirements and the clause FAR 52.211-10, Commencement, Prosecution, and Completion of Work.

Work Plan Requirements: The offeror’s work plan must adequately demonstrate how the offeror proposes to staff/organize the required effort by providing a realistic approach to meeting solicitation requirements. The Offeror is cautioned against merely replicating the below and merely answering the below in the affirmative. The plan should demonstrate the Offeror’s ability to properly staff/organize/subcontract the required effort by providing a realistic management structure for general staff/subcontractor oversight. Offeror shall detail its chain of command structure and methodology, its internal controls for problem resolution, and its plan for identifying and resolving safety issues.

The Schedule and Work Plan will receive a combined rating of “acceptable” or “unacceptable” based upon its entirety. In order to receive an “acceptable” rating, the proposed schedule and work plan shall contain each anticipated phase of construction, a schedule and work plan that must be considered feasible by the government, and shall meet all schedule requirements specified in the solicitation. Missing, incomplete, or ambiguous information may result in a rating of “unacceptable”.

Factor 2: Key Personnel

Submittal Requirements: Key personnel are defined as the offeror’s proposed full-time employees and/or subcontractor employees responsible for directing operations at the construction sites.

Offerors shall submit a one-page resume for each of the three (3) key personnel listed below:

Table A-1. Technical Acceptable/Unacceptable Ratings

Rating Description

ACCEPTABLE Proposal clearly meets the minimum requirements of the solicitation.

UNACCEPTABLE Proposal does not clearly meet the minimum requirements of the solicitation.

• Site Safety and Health Officer. The Site Safety and Health Officer shall meet the qualification requirements stated in specification section 01 35 26. A Thirty (30) hour OSHA Course certificate must be provided.

• Contractor Quality Control (CQC) System Manager: The CQC System Manager shall meet the qualification requirements stated in specification section 01 45 04.00 13.

• Site Project Superintendent: The on‐site Project Superintendent shall have experience as a Project Superintendent on projects similar in monetary size and/or scope to the project described in this solicitation.

Resumes for three (3) separate people must be submitted, one (1) for each of the three (3) roles.

Duplication of personnel for these three positions is deemed “unacceptable” for purposes of this solicitation. It is the Government’s intention that the contractor staff all three (3) positions with three (3) separate individuals for the life of the project.

If personnel presented here are later replaced for the execution of this project, replacement personnel must have equal or better qualifications as those proposed and must be approved by the Contracting Officer before they perform work at the project site.

The Key Personnel factor will receive a rating of “acceptable” or “unacceptable” based on its entirety. In order to receive an “acceptable” rating, the proposal must demonstrate that all key personnel proposed comply with the minimum requirements stated in the specifications and have sufficient relevant experience and education to indicate that they have the knowledge and capability to successfully perform their assigned roles. Missing, incomplete, or ambiguous information could result in a rating of “unacceptable”.

Factor 3: Stafford Act Eligibility

Submittal Requirements: The offeror shall complete and submit the provision at 52.226-3, Disaster or Emergency Area Representation (NOV 2007) and provide documentation to support the representation.

In addition to the certification in 52.226-3, Offeror shall provide evidence of the location of its main operating office, evidence showing at least half of its revenue was generated in that office, and evidence that office employed at least half of the offeror’s permanent employees. Evidence of the location of offeror’s main operating office may include a copy of offeror’s incorporation documents, secretary of state filings, or other official information indicating offeror’s primary business location. Offeror shall also indicate length of time that such address has been designated offeror’s primary business location. Any temporary and/or satellite office location shall not be considered by the Contracting Officer as the offeror’s main operating office.

Additionally, locations established in areas zoned residential or with prohibitions on the conduct of official business shall not be considered responsive to this inquiry. If offeror’s main office is located in an apartment, home, or other residential dwelling, offeror shall identify all adult residents who reside in such location greater than three (3) days per week (Sunday-Saturday) and resident’s relation to offeror's business.

In order to show gross revenues and location of permanent employees, offerors shall provide documentation of offeror’s tax return. Failure to provide complete revenue records will result in offer being evaluated as "unacceptable" as to establishing (c)(2) eligibility under FAR 52.226-3.

Subcontractor workforce and/or 1099 documentation shall not be considered by the contracting officer as sufficient proof of the requirements of (c)(2) eligibility.

If an offeror is unable to establish residency or primacy of business under subparagraph (c) of this clause, the Contracting Officer shall consider evidence of factors provided in FAR 52.226- 3(d)(1)-(d)(8), however, the Contracting Officer shall limit consideration of evidence supporting a finding of residency or of primacy of business in the affected area to evidence dated no later than August 11, 2016, the date of the applicable emergency declaration for DR-4277, Louisiana Severe Storms and Flooding.

Failure to disclose all relevant information relating to offeror’s eligibility may be the basis for suspension or debarment and/or subject offeror to civil or criminal penalties under18 USC 1001;

18 USC 1031, or other applicable authorities and such false statement or material omission shall be referred to the appropriate investigative authority.

The Stafford Act Eligibility factor will receive a rating of “acceptable” only if the offeror represents that it meets all of the criteria as stated in the provision and provides sufficient evidence to establish that the offeror meets the criteria. Offerors that do not represent they meet the criteria stated in the provision will receive an “unacceptable” rating. Missing, incomplete, or ambiguous information could result in a rating of “unacceptable”.

Factor 4: Past Performance

The Government will evaluate the Past Performance portion on an Acceptable/Unacceptable basis. This factor identifies the minimum requirements that are key to successful contract performance. Offerors who are determined “unacceptable” will not be eligible for award. An Offeror will be determined Acceptable/Unacceptable based on the descriptions outlined in Table A-2.

Table A-2. Past Performance Evaluation Ratings

Rating Description

ACCEPTABLE Based on the Offeror’s performance record, the Government has a reasonable expectation that the Offeror will successfully perform the required effort, or the Offeror’s performance record is unknown.

UNACCEPTABLE Based on the Offeror’s performance record, the Government has no reasonable expectation that the Offeror will be able to successfully perform the required effort.

Note: In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305(a)(2)(iv)), provided the Offeror certifies that additional past performance information is not available and provides an acceptable explanation as to why additional past performance is not available. Such an offeror shall be determined to have unknown (or “neutral”) past performance. In the context of acceptability/unacceptability, a neutral rating shall be considered “acceptable.”

Past Performance Submittal Requirements: Offerors shall provide past performance information for at least (2) projects for completed work by the Offeror within the past thirty-six

(36) months that are similar in scope and specifications of this requirement. For each project, offerors shall provide the following information:

• Reference (Name, title, company, phone, email)

• Project Title and Description

• Contract or Subcontract number

• Date of Award

• Contract Value

The past performance reference must have been a client, or client representative, with whom the Offeror had a contract, or subcontract (if applicable) for one or more projects. The reference must hold, or have held at the time, a senior position in the client organization with responsibilities of contract administration, quality control, engineering, or technical supervision, or was otherwise in a position to evaluate the Offeror’s performance in executing the contract or subcontract. The past performance reference must have first-hand knowledge of the Offeror’s performance. The reference must have a current, valid phone number at which they can be reached during normal business hours, a fax number, and must be able to speak, read, and write in the English language.

The Government’s assessment of past performance will be based mainly on the Offeror’s reputations with customers and other sources. The Government will consider the currency and relevance of past performance information, source of the information, context of the data, and general trends in the contractor’s performance. The Government may contact any or all of the past performance references provided by the Offeror in response to this solicitation, and may also use information obtained from any other sources when evaluating past performance of the Offeror and major subcontractors. Other sources may include, but are not limited to, the Past Performance Information Retrieval System (PPIRS). While the Government may elect to consider data from other sources, the burden of providing detailed, current, accurate and complete past performance rests with the Offeror.

The evaluation will take into account relevant past performance information regarding predecessor companies or subcontractors that will perform major or critical aspects of the requirements when such information is available and relevant to the instant acquisition. If necessary during the evaluation process, any adverse information received regarding subcontractor past performance may be shared with Offerors during clarifications or discussions if held.

2. Volume 2: Price:

Price Submittal Requirements: Offerors shall complete and submit the price proposal schedule in Section 00 00 10 with its proposal and include a price for each line item, including subtotals and totals.

Contract Line Item prices will be evaluated to determine whether the estimated proposed prices are fair and reasonable for the work to be performed; reflect a clear understanding of the requirements; and are consistent with the offeror's technical proposal.

(1)The offeror shall ensure the information submitted in this volume is consistent with and fully supports the dollar values set forth in the SF1442 Price Proposal Schedule.

(2)Prices offered will be evaluated for reasonableness in comparison to the Government estimate. In accordance with 33 U.S.C. 622 and 624, no civil works construction contract shall be awarded if the contract price exceeds the Government estimate by more than twenty five (25) percent.

The Government will evaluate price based on the total proposed price. The Contracting Officer, or the Contracting Officer’s designee, will evaluate the Offeror’s price for unbalancing and other potential performance risks. Price reasonableness will be determined in accordance with FAR 15.404-1. In this context, reasonableness may be determined by comparing offered prices to one another, to the government estimate, and to pricing for previous work of a similar nature.

NOTE 1: Offerors shall furnish unit prices for all items listed on the schedule of proposal items, which require unit prices. If the offeror fails to insert a unit price in the appropriate blank for required items, but does furnish an extended total or an estimated amount for such items, the

Government will deem the unit price to be the quotient obtained by dividing the extended estimated amount for that line item by the quantity.

IF THE OFFEROR OMITS BOTH THE UNIT PRICE AND THE EXTENDED ESTIMATED

AMOUNT FOR ANY ITEM, HIS/HER OFFER MAY BE DECLARED NONRESPONSIVE.

In the event there is a difference between a unit price and the extended total, the unit price will be held to be the intended proposal. If the offeror shows only the total price but fails to enter a unit price, the total divided by the estimated quantity will be held to be the intended unit price.

Any price for items indicated above which are unbalanced as to price may be rejected as non-responsive. An unbalanced offer is one which is based on price significantly less than cost for some work and price which is significantly overstated for other work.

NOTE 2: If an offer or modification to an offer based on unit prices is submitted and provides for a lump sum adjustment to the total estimated cost, the application of the lump sum adjustment to each unit price, including lump sum units, in Price Proposal Schedule must be stated, or, if it is not stated, the offeror agrees that the lump sum adjustment shall be applied on a pro rata basis to every unit price in the Price Proposal schedule.

It is the Offeror’s responsibility to ensure the completeness of the proposal. The Government may evaluate solely on the information provided in the initial proposal and not assume that an Offeror possesses any capability that is not specifically identified in the proposal.

Failure to submit mandatory information for a factor, indicated by the word “shall”, will result in a rating of “unacceptable” for that factor, and the Offeror will be ineligible for award unless the Contracting Officer decides to hold discussions, and includes the Offeror in the competitive range.

D. EVALUATION PROCESS

1. After receipt of proposals, the Contract Specialist will separate the Technical Proposals from the Price Proposals. Technical Proposals will be provided to the technical evaluation team.

2. The technical evaluation team will convene and independently evaluate the submitted proposals according to the evaluation factors. After concluding the evaluations, the technical evaluation team will provide the evaluation worksheets documenting their evaluation to the Source Selection Authority (SSA). The technical evaluation team will make no recommendation as to which firm should receive the award and additionally shall not establish a rank order or order of merit list pertaining to the offers being evaluated.

3. After receiving the evaluation documentation, the SSA, independently exercising prudent business judgment, will make a source selection decision on the basis of the lowest priced proposal meeting or exceeding the acceptability standards for non-price factors. While the SSA may use reports and analyses prepared by others, the source selection decision shall represent the SSA's independent judgment. The source selection decision shall be documented, and the documentation shall include the rationale for any business judgments made or relied on by the

SSA.

4. If, during the evaluation process, any Offerors are eliminated from the competitive range, the Offerors excluded from the competitive range shall be promptly notified in writing. The notice shall state the basis for the determination and that a proposal revision will not be considered.

The contracting officer shall award a contract to the successful Offeror by furnishing the executed contract or other notice of the award to that Offeror. Each Offeror whose proposal was in the competitive range, but was not selected for award, will be notified in writing within three

(3) days after the date of the contract Debriefings will be provided to unsuccessful Offerors who submit timely requests.

(a) Definitions. As used in this provision--

“Discussions” are negotiations that occur after establishment of the competitive range that may, at the Contracting Officer's discretion, result in the offeror being allowed to revise its proposal.

“In writing or written” means any worded or numbered expression which can be read, reproduced, and later communicated, and includes electronically transmitted and stored information.

“Proposal modification” is a change made to a proposal before the solicitation's closing date and time, or made in response to an amendment, or made to correct a mistake at any time before award.

“Proposal revision” is a change to a proposal made after the solicitation closing date, at the request of or as allowed by a Contracting Officer as the result of negotiations.

“Time”, if stated as a number of days, is calculated using calendar days, unless otherwise specified, and will include Saturdays, Sundays, and legal holidays. However, if the last day falls on a Saturday, Sunday, or legal holiday, then the period shall include the next working day.

(b) Amendments to solicitations. If this solicitation is amended, all terms and conditions that are not amended remain unchanged. Offerors shall acknowledge receipt of any amendment to this solicitation by the date and time specified in the amendment(s).

(c) Submission, modification, revision, and withdrawal of proposals. (1) Unless other methods (e.g., electronic commerce or facsimile) are permitted in the solicitation, proposals and modifications to proposals shall be submitted in paper media in sealed envelopes or packages (i) addressed to the office specified in the solicitation, and (ii) showing the time and date specified for receipt, the solicitation number, and the name and address of the offeror.

Offerors using commercial carriers should ensure that the proposal is marked on the outermost wrapper with the information in paragraphs (c)(1)(i) and (c)(1)(ii) of this provision.

(2) The first page of the proposal must show--

(i) The solicitation number;

(ii) The name, address, and telephone and facsimile numbers of the offeror (and electronic address if available);

(iii) A statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation and agreement to furnish any or all items upon which prices are offered at the price set opposite each item;

(iv) Names, titles, and telephone and facsimile numbers (and electronic addresses if available) of persons authorized to negotiate on the offeror's behalf with the Government in connection with this solicitation; and

(v) Name, title, and signature of person authorized to sign the proposal. Proposals signed by an agent shall be accompanied by evidence of that agent's authority, unless that evidence has been previously furnished to the issuing office.

(3) Submission, modification, or revision, of proposals.

(i) Offerors are responsible for submitting proposals, and any modifications, or revisions, so as to reach the Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that proposal or revision is due.

(ii)(A) Any proposal, modification, or revision received at the Government office designated in the solicitation after the exact time specified for receipt of offers is “late” and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; and--

(1) If it was transmitted through an electronic commerce method authorized by the solicitation, it was received at the initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day prior to the date specified for receipt of proposals; or

(2) There is acceptable evidence to establish that it was received at the Government installation designated for receipt of offers and was under the Government's control prior to the time set for receipt of offers; or

(3) It is the only proposal received.

(B) However, a late modification of an otherwise successful proposal that makes its terms more favorable to the Government, will be considered at any time it is received and may be accepted.

(iii) Acceptable evidence to establish the time of receipt at the Government installation includes the time/date stamp of that installation on the proposal wrapper, other documentary evidence of receipt maintained by the installation, or oral testimony or statements of Government personnel.

(iv) If an emergency or unanticipated event interrupts normal Government processes so that proposals cannot be received at the office designated for receipt of proposals by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation, the time specified for receipt of proposals will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.

(v) Proposals may be withdrawn by written notice received at any time before award. Oral proposals in response to oral solicitations may be withdrawn orally. If the solicitation authorizes facsimile proposals, proposals may be withdrawn via facsimile received at any time before award, subject to the conditions specified in the provision at 52.215-5, Facsimile Proposals. Proposals may be withdrawn in person by an offeror or an authorized representative, if the identity of the person requesting withdrawal is established and the person signs a receipt for the proposal before award.

(4) Unless otherwise specified in the solicitation, the offeror may propose to provide any item or combination of items.

(5) Offerors shall submit proposals in response to this solicitation in English, unless otherwise permitted by the solicitation, and in U.S. dollars, unless the provision at FAR 52.225-17, Evaluation of Foreign Currency Offers, is included in the solicitation.

(6) Offerors may submit modifications to their proposals at any time before the solicitation closing date and time, and may submit modifications in response to an amendment, or to correct a mistake at any time before award.

(7) Offerors may submit revised proposals only if requested or allowed by the Contracting Officer.

(8) Proposals may be withdrawn at any time before award. Withdrawals are effective upon receipt of notice by the Contracting Officer.

(e) Restriction on disclosure and use of data. Offerors that include in their proposals data that they do not want disclosed to the public for any purpose, or used by the Government except for evaluation purposes, shall--

(1) Mark the title page with the following legend: This proposal includes data that shall not be disclosed outside the Government and shall not be duplicated, used, or disclosed--in whole or in part--for any purpose other than to evaluate this proposal. If, however, a contract is awarded to this offeror as a result of--or in connection with-- the submission of this data, the Government shall have the right to duplicate, use, or disclose the data to the extent provided in the resulting contract.
