3.3.3 Adjacent Property and Structures

No dredging will be permitted within 25 feet of any structure. Any damage to private or public property or structures resulting from the Contractor's negligence will result in suspension of dredging and require prompt repair at the Contractor's expense as a prerequisite to the resumption of dredging.

3.3.4 Subaqueous Cable Crossings

Verify the locations and depths of all utility crossings and take precautions against damages which might result from the operations, especially the sinking of dredge spuds and/or anchors into the channel bottom, in the vicinity of utility crossings. If any damage occurs as a result of the operations, suspend dredging until the damage is repaired and approved by the Contracting Officer. Costs of such repairs and downtime of the dredge and attendant plant will be at the Contractor's expense.

3.4 CHARACTER OF MATERIALS

a. Materials to be removed under this Contract are described in Section 00 31 32 GEOTECHNICAL DATA REPORT ( GDR)as referred to in Section

01 11 00 SUMMARY OF WORK.

b. Due to typical harbor activities, debris such as trash, rope, chain, cable, tires, miscellaneous scrap metal, woody debris, etc., may be encountered in the channel. Bring all such materials to the surface and dispose of in a disposal area obtained by the Contractor in a manner approved by the Contracting Officer.

3.5 DISPOSAL OF EXCAVATED MATERIAL

3.5.1 General

Transport and deposit material excavated in the disposal areas designated on the drawings. The average distance to which the material will have to be transported is approximately 2.1 miles and the maximum distance will be approximately 2.5 4.8 miles. The material to be excavated is to be placed in the designated Beach Disposal Area according to the "Estimated Dredging Quantities" table on Drawing G-03.

3.5.2 Beach Disposal

Provide a progress schedule map of the Contractor's design. The progress schedule map will be a plan view drawing depicting the beach disposal site and access areas to used on the project. Show R-monuments, adjacent street names, and pipeline landings anticipated to be used on the project. List the following: Anticipated quantity of material, projected dates for

SECTION 35 20 23 Page 10 disposal to be placed and completed. Provide dates when access areas are to be used and ready for public use. The map will be color coordinated with the following color scheme: Red depicting an area not ready for construction; Orange depicting an area currently being worked, and Green meaning an area accepted by the Contracting Officer and ready for public use. Update the map at least weekly and whenever significant changes occur to the projected dates. Since the map will be used by the Government for coordination with the public and to track progress, provide the update prior to the weekly project progress meeting.

3.5.2.2 Order of Placement

a. Prior to placement of disposal, remove from the site of the work all snags, driftwood, and similar debris lying within the foundation limits of the beach fill section. Dispose of all materials removed in areas provided by and at the expense of the Contractor and approved by the Contracting Officer. Grading and other construction equipment will not be permitted outside the easement lines shown on the drawings except for ingress and egress to and from the site.

b. The Contractor is to place disposal material within the existing berm breach to the lines and grades shown on the drawings prior to placing disposal material within the rest of the beach disposal area. Do not stockpile pipe or any other equipment or debris on the beach except as approved by the Contracting Officer. The beach is subject to changes and the elevations on the beach at the time the work is done may vary from the elevations shown on the drawings. The Contracting Officer reserves the right to vary the width or grade of the berm from the lines and grade shown on the plans in order to establish a uniform beach for the entire length of the project. The beach disposal section shown on the drawing is for the purpose of estimating the theoretical amount of fill needed and will be used by the Contracting Officer in making any change in the lines and grade. The Contractor may not be able to achieve the exact disposal area shown on the drawings.

However, move the pipeline discharge to another part of the disposal area when the discharged the amount of dredged materials in an area that would produce that cross section. Provide earthen pedestrian access ramps across the dredge discharge pipeline at 200-foot intervals. Monitor the dredge and fill operations and notify the Contracting Officer if the quantity to be dredged appears to be excessive for the designated beach disposal area. The Contractor will not be required to dress the fill below the water line to the slope shown but will be required to do the dressing specified in subparagraph DRESSING below.

3.5.2.3 Dredging and Disposal Plan

Submit a Dredging and Disposal Plan 30 days prior to commencement of dredging, to be approved by the Contracting Officer prior to the commencement of dredging. The dredging and disposal plan will include, but not be limited to the following:

a. Equipment (i.e., dredge, pipeline, heavy equipment, etc) that will be utilized to remove material from the channel and dispose within the beach disposal template

b. Order of dredging and disposal operations.

c. A description of all operations that will be performed in connection

SECTION 35 20 23 Page 11 with the filling of the breach area. Describe the operations in the sequence in which they will be performed.

3.5.3 Grade Stake Installation and Recovery Operations

After the Notice to Proceed, submit a Construction and Grade Stakes Recovery Plan. Outline the steps that the Contractor will implement to recover all the stakes used on the project. Include the use of an inventory log that will be made available for review by the appropriate Government personnel. A sample plan is on the web site indicated in paragraph CONSTRUCTION FORMS AND DETAILS below.

Grade stakes left in the beach after beach fill construction present a safety hazard to beach visitors. Name a designated person whose responsibility is to track, locate, and completely remove all grade stakes in their entirety to the satisfaction of the Contracting Officer. Provide an alternate in place in the event the designated person is absent. Any grade stakes left in the beach will be the sole responsibility of the Contractor. Final payment will not be issued until the Contractor certifies that all grade stakes have been removed. Remove all grade stakes immediately after the acceptance section has been completed and ready for public use. Certify the search and removal of all the stakes prior to releasing the construction area to the public. The Contractor's request for payment will be considered by all parties as the certification that the Contractor has removed all stakes within the acceptance section or project area. If the Contracting Officer finds grade stakes after request for payment or determines a lost grade stake not noted in the Contractor's Quality Control Reports, the Contracting Officer will request the stakes removed and deduct the cost from the Contractor's final payment. To ensure the safety of the public and contractor meets contract guidelines as it pertains to grade staking and removal, at minimum, perform the following duties:

a. Use steel pipe construction or grade staking on the beach or other material that can and will be removed intact after filling as verified during final walk-through inspection. Install stakes with enough length above grade so they may not be accidentally covered by fill.

b. Inventory all construction grade staking used in the Contract for installation as well as removal.

c. Consecutively number the grade stakes approximately located and recorded in the grade stake log using the construction baseline station provided on the plans.

d. Record the removal of each numbered pipe in the grade stake log at the time of the pipe/stake removal with the total removed count meeting the same placed within the noted stationing limits.

e. At the request of the Contracting Officer, provide the grade stake log with the entire placed grade stake pipes displayed and counted after their removal to demonstrate those pipes that have been removed.

f. Document sections of beach upon which the search for, and removal of, stakes is complete in the Contractor's Quality Control Reports and signed by the individual responsible for work.

SECTION 35 20 23 Page 12

3.5.3.1 Grade Stake Log and Recovery

a. Grade Stake Log: Prepare and maintain a log to inventory the grade stakes used on the project. Include information concerning the location, installation, and recovery of all grade stakes. Make this log available for review by the appropriate Government personnel upon request. Upon completion of the project, furnish the log to the Contracting Officer. Keep the log at the active nourishment site.

b. Grade Stake Recovery Certificate: After completion of the project, provide a letter to the Contracting Officer certifying that all grade stakes have been recovered in accordance with the Contractor's approved Construction and Grade Stake Recovery Plan.

3.5.4 Temporary Longitudinal Dikes

Use temporary longitudinal dikes and spreader and/or pocket pipe to prevent gullying and erosion of the beach and fill and to retain the fill on the beach and within the limits of the fill cross section. As the work progresses, construct dikes or mounds along the beach to direct the pipeline discharge longitudinally along the beach to avoid transverse gullying directly from the discharge point to the ocean, and to build the new berm to design grade. Longitudinal dikes must initially be 300 feet long in advance of filling operations. They may need to be lengthened to meet water quality standards, to build to the required lines and grades, and to keep material within the toe-of-fill. The Contractor will not be held responsible for erosion caused by waves after the beach fill has been satisfactorily placed. Do not leave any undrained pockets in any fill during or upon completion of the work. Do not permit wastewater to flow landward of the fill section or water to pond between the fill and upland.

Protect groins, bulkheads, revetments, seawater pipe structures, and other structures within the fill section to prevent damage thereof by the Contractor's operations. Any damages assessed as a result of any of the above items will be at the Contractor's expense.

3.5.5 Rehandled Materials

Place any material that is rehandled or moved and placed in its final position by methods other than hydraulic in horizontal layers do not exceed 3 feet in thickness. Compaction of the layers will not be required. Schedule the operations to take advantage of tides so that filling is done in the dry or as directed.

3.5.6 Dressing

Do not conduct final dressing until all dredging is completed, at which time all evidence of haul road or pipeline removed and the fill grade be graded and dressed so as to eliminate any undrained pockets and abrupt humps and depressions in the beach fill surfaces and as necessary to comply with subparagraph TOLERANCES below. Remove grade stakes used in the placement of the fill intact, without breaking. Completely degrade all dikes. Grade down the bank caused by wave forces to a slope no steeper than 1 vertical on 20 horizontal.

3.5.7 Tolerances

A tolerance of 1 foot above the prescribed berm grade and slopes above the wave zone will be permitted in the final beach surface.

SECTION 35 20 23 Page 13

3.5.8 Debris Removal

Clean and remove all debris that has been placed on the beach as a result of the disposal operation from the beach disposal areas. Dispose of the debris in a location provided by the Contractor and accepted by the Contracting Officer.

3.5.9 Pipeline Access

An overland pipeline easement is shown on the plans. The dredge discharge pipeline shall be placed above ground and the route will be flagged in the field. Wherever the pipeline intersects a road, a ramp is to be constructed over the pipeline by the Contractor to allow roadway access.

Ramps are to be maintained promptly by the contractor for safe vehicular use throughout the project, and removed by the contractor upon completion of dredge disposal operations along with any necessary underlying pavement repairs.

3.5.10 Barges

Water and dredged materials are not be permitted to overflow or spill out of barges or dump scows during transport to the disposal site(s). Failure to repair leaks or change the method of operation which is resulting in overflow or spillage will result in suspension of dredging operations and require prompt repair or change of operation to prevent overflow or spillage as a prerequisite to the resumption of dredging.

3.5.11 Placing of Dredged Material

During placement of dredged material in the disposal areas, provide an attendant at each disposal area to maintain constant radio contact with the dredge. This will enable the Contractor's personnel at the disposal areas to immediately notify the dredge in the event of dike or pipeline failure. In the event of dike or pipeline failure, suspend the dredging operations and promptly repair of the dike or pipeline as a prerequisite to the resumption of dredging.

3.5.12 Dredge Pipelines

3.5.12.1 Pipeline Route

The pipeline from the dredge to the beach placement site is to be submerged along the Intracoastal Waterway Jacksonville to Miami (IWW), cross the IWW south of Rattlesnake Island, proceed along the Summer Haven River beneath the State Road A1A bridge, and cross the river and the adjacent barrier island.

3.5.12.2 Dredge Discharge Pipeline

Plainly mark the pipeline access routes with conspicuous stakes, targets and/or buoys to be maintained throughout the contract operations. Maintain a tight dredge discharge pipeline to prevent spilling of dredged material or dredge water outside of the disposal area. Provide and maintain radio communication between the dredge and the disposal areas and the dredge and the Contracting Officer. Inspect the pipeline at least twice daily for leaks. Mark pipelines placed on beaches with access by the public on the landward and seaward sides of the pipe in visible 6-inch lettering at public access locations and every 200 feet in between public access locations with "DANGER KEEP OFF." Pipeline placed on the beach will be

SECTION 35 20 23 Page 14 free of all barnacles, and pick up any flakes of metal that come off the pipeline daily. Failure to immediately repair leaks in the discharge pipeline will result in suspension of dredging operations and require prompt repair of pipeline as a prerequisite to the resumption of dredging. Repair any damage to private or public property resulting from the Contractor's operations at the Contractor's expense.

3.5.12.3 Submerged Pipeline

In the event the Contractor elects to submerge the pipeline, rest the pipeline on the bottom, and the top of the submerged pipeline and any anchor securing the submerged pipeline cannot be higher than the required project depth for the channel in which the submerged pipeline is placed.

If a pipeline material which is buoyant or semi-buoyant, such as PVC pipe or similar low-density materials is used, securely anchor the pipeline to prevent the pipeline from lifting off the bottom under any conditions.

Conduct daily inspections of the submerged pipeline to ensure buoyancy has not loosened the anchors. Remove all anchors when the submerged pipeline is removed. Mark the location of the entire length of submerged pipeline with signs, buoys, lights, and flags conforming to U.S. Coast Guard regulations.

3.5.12.4 Floating Pipeline

Should the Contractor's pipeline not rest on the bottom, it will be considered a floating pipeline and will be visible on the surface and clearly marked. In no case will the Contractor's pipeline be allowed to fluctuate between the surface and the bottom or lie partly submerged.

Install lights on the floating pipeline as required in paragraph SIGNAL LIGHTS above. Support the lights either by buoys or by temporary piling, provided by the Contractor and approved by the Contracting Officer. Where the pipeline does not cross a navigable channel, space the flashing yellow all-around lights not over 200 feet apart, unless closer spacing is required by U.S. Coast Guard personnel, in which case the requirements of the U.S. Coast Guard will govern, at no additional cost to the Government.

3.5.13 Booster Pumps

Install booster pumps at least 300 feet from any residential-type building or house. Provide booster pumps, their prime movers, and any auxiliary equipment fitted or equipped with mufflers, noise control enclosures, or other engineering noise control methods, measures, and features such that steady noise emanating from this equipment does not exceed 85 decibels on the A scale at slow response, and impulsive noise does not exceed 140 decibels. Maintain such items throughout the course of the work.

3.5.14 Misplaced Material

Notify the U.S. Coast Guard Marine Safety Office of any misplaced material as stated in the Clause OBSTRUCTION OF NAVIGABLE WATERWAYS of Section 00700 CONTRACT CLAUSES in Volume 1. Materials deposited above the maximum indicated elevation or outside of the disposal area template shown will require the degrading or removal of such materials at the Contractor's expense. The Contractor will not be held responsible for erosion caused by waves after the material has been satisfactorily placed.

3.6 QUALITY CONTROL FOR BEACH DISPOSAL

Continuously ensure beach disposal material is in compliance with the FDEP

SECTION 35 20 23 Page 15

Sand Rule, Florida Administrative Code 62B-41.007(2)(j), contract requirements and permit conditions. Produce daily reports which characterize the nature of the sediments dredged from the dredge area and placed along the project shoreline with specific reference to the "Beach Disposal Observation and Sampling" paragraph below. At the Preconstruction Conference, acknowledge the quality of sediment as described in the Geotechnical Data Report as well as the specific permit conditions associated with beach disposal material. Develop a Noncompliant and Unacceptable Material Contingency Plan and if so directed by the Contracting Officer, acquire the equipment and personnel to remediate the beach disposal area.

3.7 Beach Placement Sediment Criteria

The sediment from the dredge cut(s) is similar to the material in the existing coastal system at the beach placement site. These specifications take into account the natural variability observed within the channel areas as determined using the existing core boring data. Beach fill material which falls outside of these limits will be considered unacceptable and subject to remediation. The acceptable range of values for the placed material is shown in Table 1 below. Unacceptable material also includes construction debris, toxic material, other foreign material, debris, trash, and rocks or rubble larger than 3/4 inch in diameter, which exceed the size of the natural occurrence of rock or shell on the beach.

Deviations from these criteria are acceptable provided that the spatial extent of the deviations does not exceed 10,000 continuous square feet.

Shell content is used as the indicator of fine gravel content for the implementation of quality control/quality assurance procedures.

TABLE 1- Sediment Quality Specifications for Channel Area Material Maximum Silt Content (passing #230 sieve) 10 percent Maximum Shell Content (retained on #4 sieve) 5 percent Munsell Color Value (moist value chroma = 1) similar

Should any beach sample not comply with the beach placement sediment criteria stated above, the Contracting Officer shall be notified at the first available normal business hours. Should three consecutive beach samples not comply with the beach placement sediment criteria, the Contracting Officer shall be notified immediately and the Contractor shall cease material excavation operations and take whatever actions necessary to avoid further discharge of unsuitable material with possible remediation. If remediation requires removal of unacceptable materials, they shall be disposed of offsite in a manner approved by the Contracting Officer.

3.8 Beach Disposal Observation and Sampling

Perform beach disposal observation and sampling during construction to ensure that the beach disposal material meets the compliance criteria.

a. Perform beach disposal observation at all times during which beach disposal material is being placed. Have on-site personnel to visually monitor the material being placed on the beach and who can identify obvious changes in sediment quality at the active placement location. The selected individual will have training or experience in beach nourishment, construction inspection and testing and be knowledgeable of the contract requirements and permit conditions. The observer will remain in constant radio contact with the dredge and report encounters with noncompliant materials to the dredge operator.

SECTION 35 20 23 Page 16

b. Conduct assessments of the sediment as follows: Collect a grab sediment sample for every 200 linear feet of constructed beach or from each hopper dredge load to visually assess for compliance criteria. Archive each sample with the date, time, and horizontal location in the project reference datum of the sample. Visually compare the sample to the compliance criteria provided in Table 1 for the respective beach sites.

Store all samples until project completion.

c. Should any beach sample not comply with the compliance criteria stated above, notify the Contracting Officer at the first available normal business hour. Should three consecutive beach samples not comply with the compliance criteria, notify the Contracting Officer immediately, cease dredge area excavation operations, and take necessary actions to avoid further discharge of noncompliant material with possible remediation. The Contracting Officer will then advise the contractor how to adjust the construction operation at the dredge area to avoid placing additional noncompliant material.

d. If requested by the Contracting Officer, analyze the collected beach sediments for grain size distribution, Munsell color, carbonate content, and percent visual shell by a certified laboratory. Perform gradation analysis according to ASTM D422. U.S. Standard sieve sizes will include 3/4 inch, 3/8 inch, and numbers 4, 7, 10, 14, 18, 25, 35, 45, 60, 80, 120, 170, 200, and 230.

3.9 Determination of Aerial Extent of Noncompliant Beach Disposal

In order to determine if an area greater than 10,000 square feet of beach fill is noncompliant, perform the following procedure:

a. Upon determination that the first sediment sample is noncompliant, collect at minimum, five additional sediment samples at a 25-foot pacing in all directions and assess. If the additional samples are also noncompliant, then collect additional samples at a 25-foot spacing in all directions until the aerial extent is identified.

b. Visually compare the samples to the compliance criteria. If deemed necessary by the Contracting Officer, conduct quantitative assessments of the samples. Store all samples until project completion.

c. Determine the total square footage and volume of the noncompliant material and prepare a site map depicting the location of all samples and the boundaries of all areas of noncompliant fill.

d. Notify the Contracting Officer. Notification will include the map with the aerial extent and volume of all areas of noncompliant beach disposal material.

3.10 Remediation

If the Contracting Officer determines remediation is required, remediate.

The method by which the Contractor remediates will be of their own design and be constructed so as to ensure compliance of the material placed.

Methods of remediation may include, but are not limited to:

a. Blending of noncompliant material (i.e., when exceeding compliance values listed in Table 1 at the indicated beach sites for silt, fine gravel, shell, or Munsell color) with compliant material to achieve a sand

SECTION 35 20 23 Page 17 mixture that acceptably complies with the compliance criteria.

b. Screening unacceptable materials such as rocks greater than 3/4 inch or clay balls from the fill within the area for remediation and depth designated by the Contracting Officer. Continue screening until no unacceptable material is encountered or at the Contracting Officer's determination.

c. Removing of screened unacceptable material and disposing of the material.

d. Notwithstanding the above, burial of noncompliant or unacceptable materials, crushing of rock and dispersing within the existing beach or beach disposal is not permitted. Haul all material to be disposed of off site to a disposal area obtained by the Contractor and approved by the Contracting Officer.

3.11 Noncompliant and Unacceptable Material Contingency Plan

Establish a contingency plan in the event that noncompliant or unacceptable materials are encountered. Submit the contingency plan to the Government for information purposes only. The contingency plan will include but is not limited to the following:

a. How the Contractor plans to notify the Contracting Officer if noncompliant or unacceptable materials are encountered.

b. How the Contractor will report encounters with noncompliant and/or unacceptable material in the daily quality control reports, such as approximate elevation and horizontal position (in project reference datum) where the materials were encountered, as well as the location where material was placed in the beach disposal template.

c. Who will conduct the laboratory analyses and how they will be conducted if requested by the Contracting Officer.

d. If three consecutive beach samples do not comply with the compliance criteria, briefly explain how control measures will be established to adjust dredging and disposal…
