1.2 WORK COVERED BY CONTRACT DOCUMENTS

1.2.1 Project Description

The La Chuleta site is a triangular 67 acre tract of land bordered by the Rio Puerto Nuevo, Martin Pena Canal and the Diego Freeway (PR22) located in San Juan, Puerto Rico 0.5 mile upstream from the San Juan Harbor. The site is approximately 5 miles west from the Luis Muñoz International Airport located in the eastern part of San Juan, Puerto Rico. The site is reduced in useable size to 36 acres by environmentally protected mangrove swamps which exist along the waterfront areas on its western and northern boundaries. Additional reductions in usable acreage occurs due to 115kV electrical transmission lines and easements which divide the property.

The site was formerly a municipal landfill which was closed in 1952. This project will prepare the site for acceptance of excavated material from Rio Puerto Nuevo Flood Damage Reduction Project sites.

The work includes the following:

a. Site exit and entrance improvements from PR22

b. Security fencing and gates

c. Aggregate surfaced interior roadways

d. A new crane pad and improved grading for access to the existing barge dock

e. Drainage/Water Quality ponds, piping and structures

f. Clearing and Grubbing

g. Grading and site preparation for fill material

h. Retaining walls

i. Entrance lighting i j . Temporary construction traffic control and signage

1.2.2 Location

The site is located in the eastern part of San Juan, Puerto Rico approximately 5.0 miles west of the Luis Muñoz International Airport along the Rio Puerto Nuevo and roughly 0.5 miles upstream from the San Juan

The time for completion does not include establishment of grass. Grass must be established not later than the time stated in the Clause COMMENCEMENT, PROSECUTION, AND COMPLETION OF WORK (FAR 52.211-10) of Section 00700 CONTRACT CLAUSES in Volume 1.

1.4 LIQUIDATED DAMAGES - CONSTRUCTION

Refer to the Clause LIQUIDATED DAMAGES - CONSTRUCTION (FAR 52.211-12) of Section 00700 CONTRACT CLAUSES in Volume 1.

1.5 PHYSICAL DATA

Read this paragraph in conjunction with the Clause PHYSICAL DATA (FAR 52.236-4) of Section 00700 CONTRACT CLAUSES in Volume 1.

1.5.1 Physical Conditions

The indications of physical conditions on the drawings and in the specifications are the result of site investigations by surveys and/or by core borings. When the indicated physical conditions are the result of site investigations by core borings, the core boring logs and laboratory data are in Section 00 31 32 GEOTECHNICAL DATA REPORT (GDR) and the core boring locations are shown on the drawings. Also, see the GDR for instructions concerning availability of core borings for inspection.

1.5.2 Weather, Water Stage and Tide Data

1.5.3 Contractor Investigation

Refer to the Clause SITE INVESTIGATION AND CONDITIONS AFFECTING THE WORK (FAR 52.236-3) of Section 00700 CONTRACT CLAUSES in Volume 1.

1.5.4 Maritime Traffic

Channel Traffic in the project area consists of commercial, pleasure, and small recreational vessels of all types and sizes which can be accommodated by existing depths.

1.5.5 Obstruction of Channel

The Government will not undertake to keep the channel free from vessels or other obstructions, except to the extent of such regulations, if any, as

SECTION 01 11 00 Page 3 may be prescribed by the Secretary of the Army, in accordance with the provisions of Section 7 of the River and Harbor Act approved 8 August 1917. Conduct the work in such manner as to obstruct navigation as little as possible, and in case the Contractor's plant so obstructs the channel as to make difficult or endanger the passage of any vessels, promptly move said plant on the approach of any vessel to such an extent as may be necessary to afford a practicable passage. Upon completion of the work, promptly remove the plant, including ranges, buoys, piles, and other marks placed under the Contract in navigable waters or on shore.

1.6 LAYOUT OF WORK

Read this paragraph in conjunction with the Clause LAYOUT OF WORK (FAR 52.236-17) of Section 00700 CONTRACT CLAUSES in Volume 1.

1.6.1 Established Project Control

The Government has established monuments along the work site(s). Each monument is represented in the contract drawings by a Designation and in most cases, an alphanumeric Permanent Identifier (PID). Information concerning the location and elevations can be found within the Survey Notes on the plan sheets. The Survey Notes for each included field survey will cite a particular survey number, and specify the control used to conduct that survey. Additional information is included in the Survey Notes that must be duplicated if an attempt to recreate the subject survey is desired.

For navigation channels, the Government has established tidal calibration sites for projects constructed and maintained to a tidal datum. Each tidal calibration site is represented in the plan sheet drawings by Station ID, and is cited in the Survey Notes. All projects constructed and maintained to a tidal datum shall be calibrated to the Station ID specified in the plan sheet drawings. Information regarding the location and associated benchmarks of the referenced Station ID is included on the drawings and in the Monument Description section of these specifications.

See Section 00 31 21 CONTROL MONUMENT DESCRIPTIONS.

1.6.2 Layout

From the monuments, control data and elevations established by the Government, complete the layout of the work and obtain all measurements that may be required for the execution of the work to the location and limit marks prescribed in the specifications or on the contract drawings, subject to such modifications as the Contracting Officer may require to meet changed conditions or as a result of necessary modifications to the contract work.

1.6.3 Survey

Provide equipment, tools, material, labor for laying out any part of the work from the monuments, control data, and elevations established by the Government. Maintain and preserve all monuments, stakes and other marks established by the Contracting Officer until authorized to remove them, and if such marks or monuments are destroyed by the Contractor or through negligence, prior to their authorized removal, they may be replaced by the Contracting Officer, at their discretion, and the expense of replacement will be deducted from any amounts due or to become due the Contractor.

The Contracting Officer may require that work be suspended at any time

SECTION 01 11 00 Page 4 when location and limit marks established by the Contractor are not reasonably adequate to permit checking of the work.

1.7 DAMAGE TO WORK

The responsibility for damage to any part of the permanent work will be as set forth in Clause PERMITS AND RESPONSIBILITIES of Section 00700 CONTRACT CLAUSES in Volume 1. However, if, in the judgment of the Contracting Officer, any part of the permanent work performed by the Contractor is damaged by flood, earthquake, hurricane, or tornado, which damage is not due to the failure of the Contractor to take reasonable precautions or to exercise sound engineering and construction practices in the conduct of the work, make the repairs as ordered by the Contracting Officer and full compensation for such repairs will be made at the applicable Contract unit or job prices as fixed and established in the Contract. If, in the opinion of the Contracting Officer, there are no contract unit or job prices applicable to any part of such work, an equitable adjustment pursuant to Clause CHANGES of Section 00700 CONTRACT CLAUSES in Volume 1 will be made as full compensation for the repairs of that part of the permanent work for which there are no applicable contract unit or job prices. Except as herein provided, damage to all work (including temporary construction), utilities, materials, equipment and plant shall be repaired to the satisfaction of the Contracting Officer at the Contractor's expense, regardless of the cause of such damage.

1.8 DAMAGE TO WORK -- COFFERDAM REQUIRED

a. The responsibility for damage to any part of the work to be performed under this Contract is set forth in Clause PERMITS AND RESPONSIBILITIES of Section 00700 CONTRACT CLAUSES in Volume 1.

However, if the cofferdam(s) is constructed in accordance with plans and progress schedules approved by the Contracting Officer, but is overtopped by flood and such flood causes damage to the cofferdam or if any part of the permanent work is damaged by flood, earthquake, hurricane, or tornado, which damage is not due to the failure of the Contractor to take reasonable precaution or to exercise sound engineering and construction practices in the conduct of the work, make the repairs ordered by the Contracting Officer. Compensation will be made for any such repairs in accordance with the Clause CHANGES of Section 00700 CONTRACT CLAUSES in Volume 1. The equitable adjustment is be based on the contract unit or job prices applicable to any part of the damaged work.

b. The Contracting Officer may order the Contractor to flood or breach the cofferdam during a rise prior to, and in anticipation of, natural flooding due to overtopping. Such flooding or breach will be considered the same as though the cofferdam, if constructed in accordance with plans and progress schedules approved by the Contracting Officer, had been overtopped, in which event an equitable adjustment will be made for damages to the cofferdam and/or any part of the permanent work, as provided in subparagraph a. above.

1.9 EXISTING WORK

In addition to FAR 52.236-9, Protection of Existing Vegetation, Structures, Equipment, Utilities, and Improvements:

a. Remove or alter existing work in such a manner as to prevent injury or damage to any portions of the existing work which remain.

SECTION 01 11 00 Page 5

b. Repair or replace portions of existing work which have been altered during construction operations to match existing or adjoining work, as approved by the Contracting Officer. At the completion of operations, existing work must be in a condition equal to or better than that which existed before new work started.

1.10 LOCATION OF UNDERGROUND FACILITIES

Verify the elevations of existing piping, utilities, and any type of underground obstruction not indicated or specified to be removed but indicated in locations to be traversed by piping, ducts, and other work to be installed.

1.10.1 Notification Prior to Excavation

Notify the Contracting Officer at least 15 days prior to starting excavation work. Contact Departmento de Transportatcion y Obras Publicas (DTOP) 15 days prior to excavating. Contractor is responsible for marking all utilities not marked by DTOP.

1.11 TIME EXTENSIONS FOR UNUSUALLY SEVERE WEATHER (31 OCT 1989)

This provision specifies the procedure for the determination of time extensions for unusually severe weather in accordance with the Clause DEFAULT (FIXED-PRICE CONSTRUCTION) of Section 00700 CONTRACT CLAUSES in Volume 1. In order for the Contracting Officer to award a time extension under this clause, the following conditions must be satisfied:

a. The weather experienced at the project site during the contract period must be found to be unusually severe; that is, more severe than the adverse weather anticipated for the project location during any given month.

b. The unusually severe weather must actually cause a delay to the completion of the project. The delay must be beyond the control and without the fault or negligence of the Contractor.

1.11.1 Schedule of Monthly Anticipated Adverse Weather Delays

The schedule of monthly anticipated adverse weather delays is based upon National Oceanic and Atmospheric Administration (NOAA) or similar data for the project location and will constitute the base line for monthly weather time evaluations. The Contractor's progress schedule must reflect these anticipated adverse weather delays in all weather dependent activities.

See Section 00 33 50 WEATHER, WATER STAGE AND TIDE DATA to obtain MONTHLY

ANTICIPATED ADVERSE WEATHER DELAY WORK DAYS BASED ON 5-DAY WORK WEEK. A

reasonable number of anticipated weather delay work days is obtained from the average number of days per month (rounded to the nearest whole number) with precipitation greater than that indicated in Section 00 33 50

WEATHER, WATER STAGE AND TIDE DATA.

1.11.2 Contractor Responsibility

Upon acknowledgment of the Notice to Proceed (NTP) and continuing throughout the Contract, record on the daily CQC report the occurrence of adverse weather and resultant impact to normally scheduled work. Actual adverse weather delay days must prevent work on critical activities for 50 percent or more of the Contractor's scheduled work day. Include the

SECTION 01 11 00 Page 6 number of actual adverse weather delay days impacted by actual adverse weather (even if adverse weather occurred in previous month), be calculated chronologically from the first to the last day of each month, and be recorded as full days. If the number of actual adverse weather delay days exceeds the number of days anticipated in Section 00 33 50 WEATHER, WATER STAGE AND TIDE DATA (rounded to the nearest whole number), the Contracting Officer will convert any qualifying delays to calendar days, giving full consideration for equivalent fair weather work days, and issue a modification in accordance with the Clause DEFAULT (FIXED PRICE CONSTRUCTION) of Section 00700 CONTRACT CLAUSES in Volume 1.

1.12 UNITS OF MEASURE

The standard U.S. system of measure will be utilized by the Contractor in the performance of work. Clearly denote which system of measure is being utilized, referenced or discussed on all survey records, official documentation, engineering data, and all correspondence, including any submittals and shop drawings. Any omission or inaccurate use of a unit of measure will not relieve the Contractor of their responsibilities under the Contract terms. The unit of measure used in this specification is the standard U.S. system. The contract drawings denote both standard U.S.

system and metric system where appropriate. If no unit of measure is indicated on the drawing such as on ranges, stations, slope elevations, and distance numbers, then they are to be considered the standard U.S.

system.
