1.1.1. The work consists of furnishing all plant, labor, materials, and equipment (except materials and equipment provided in the specifications to be furnished by the Government) and performing all work in strict accordance with the contract specifications and schedules forming parts thereof for repairing and modifying the U.S. Surveyboat FLORIDA, principal dimensions and physical data of which are as follows:
Length, overall 64 feet 11 inches Beam, molded 18 feet 2 inches Displacement Long Tons (2,240 lbs) 72 long tons Draft 5 feet 0 inches (Approx.)
Material of hull and house Aluminum (type 5086)
1.1.2. Offerors shall carefully examine the
specifications, go aboard the vessel, if necessary, and fully inform themselves as to all conditions and matters which can in any way affect the work or the cost thereof. Should an offeror find discrepancies in, or omissions from, the specifications or other documents, or be in doubt as to their meanings, the Contracting Officer should be notified at once, in order to obtain clarification prior to submitting any offer. Failure to do so will not relieve offerors from responsibility for properly estimating the difficulty or cost of successfully performing the work. Prospective offerors may contact the Corps of Engineers District Office, 701 San Marco Blvd., Jacksonville, FL 32207;
telephone (Area Code 904) 232-1196 (Mr. P. Bates) in order to make arrangements to inspect the vessel.
1.1.3. Work that is to be done on a unit price basis (see
Bid Schedule) will be pointed out and definitely assigned as to location and amount by the Contracting Officer.
1.1.4. DEFINITIONS -- SHIP REPAIR - For the purposes of this
solicitation and resulting contract, any reference to "job order" will be construed to mean "contract and/or task order" resulting from this solicitation. "Agreement" will be construed to mean "contract."
1.1.5. WORK COVERED BY THE CONTRACT PRICE -- SHIP REPAIR
(a) Lump Sum Jobs. A lump sum for doing any particular job shall cover the cost of all labor, material, and appliances (including hand and machine tools) necessary for fully completing the job unless the detailed description of the job specifies otherwise. When a job provides for the disassembly or replacement of parts of machinery or piping, it shall always be reassembled to proper working condition and all new gaskets, bolts, nuts, packing, or any part incidental thereto which may be necessary for re-assembly shall be furnished by the Contractor. All new work or areas disturbed by repair activities shall be thoroughly cleaned, given a prime coat of paint, and two final coats to restore the repaired work or area to the original surroundings, unless otherwise specified.
(b) Unit Price Jobs. On items in which it is not possible to determine in advance the exact quantities of work to be done, unit prices are required in the Price Schedule. The quantities stated under such items are the Government's best estimate. These quantities may be increased or decreased, to the extent necessary, by the Contracting Officer, for the satisfactory repair of the vessel. Payment for each estimated quantity item will be made at the unit price specified in the line items for the actual quantity ordered, completed and accepted under this contract; regardless of whether or to what extent the quantities are increased or decreased from the estimated amount. The unit price shall include all costs associated with accomplishing the work as specified in subparagraph (a) above.
1.1.6. ADVERSE WEATHER CONDITIONS -- SHIP REPAIR - No
outside work will be performed when (i) the temperature is below 32 degrees F.; (ii) wind, rain, snow, sleet, or ice renders efficient work impracticable; or (iii) ice conditions prevent operation of the Contractor's drydocks. No adjustment of contract price will be allowed for any additional costs incurred as a result of delays caused by conditions described in this paragraph.
1.1.7. Over and Above Work.
(a) "Definitions." - As used in this scope of work --
(1) "Over and above work" means work discovered during the course of performing overhaul, maintenance, and repair efforts that is --
(i) Within the general scope of the contract;
(ii) Not covered by the line item(s) for the basic work under the contract; and
(iii) Necessary in order to satisfactorily complete the contract.
(2) "Work request" means a document prepared by the Contractor which describes over and above work being proposed.
(b) The Contractor and Administrative Contracting Officer shall mutually agree to procedures for Government administration and Contractor performance of over and above work requests. If the parties cannot agree upon the procedures the Administrative Contracting Officer has the unilateral right to direct the over and above work procedures to be followed. These procedures shall, as a minimum, cover --
(1) The format, content, and submission of work requests by the Contractor. Work requests shall contain data on the type of discrepancy disclosed, the specific location of the discrepancy, and the estimated labor hours and material required to correct the discrepancy. Data shall be sufficient to satisfy contract requirements and obtain the authorization of the Contracting Officer to perform the proposed work;
(2) Government review, verification, and authorization of the work; and
(3) Proposal pricing, submission, negotiation, and definitization.
(c) Upon discovery of the need for over and above work, the Contractor shall prepare and furnish to the Government a work request in accordance with the agreed-to procedures.
(d) The Government shall --
(1) Promptly review the work request;
(2) Verify that the proposed work is required and not covered under the basic contract line item(s);
(3) Verify that the proposed corrective action is appropriate; and
(4) Authorize over and above work as necessary.
(e) The Contractor shall promptly submit to the Contracting Officer, a proposal for the over and above work. The Government and Contractor will then negotiate a settlement for the over and above work. Contract modifications will be executed to definitize all over and above work.
(f) Failure to agree on the price of over and above work shall be a dispute within the meaning of the Disputes clause of this contract.
1.1.8. ACCESS TO VESSEL –
(a) Upon the request of the Contracting Officer, the Contractor shall grant admission to the Contractor's facilities and access to vessel, on a non-interference basis, as necessary to perform their respective responsibilities, to a reasonable number of:
(1) Government and other Government contractor employees (in addition to those Government employees attached to the vessel);
and
(2) Representatives of offeror’s on other contemplated Government work.
(b) All personnel granted access shall comply with Contractor rules governing personnel at its shipyard.
1.1.9. VESSEL DELIVERY AND RETURN -- SHIP REPAIR
(a) Delivery of Vessel. It is anticipated that the vessel will be delivered to the Contractor’s yard on or about 6 July 2009; or earlier if negotiated. If tug or pilot service is required during said delivery for maneuvering the vessel between open water and the dry dock, slip, or berth at the Contractor's yard, such service shall be promptly furnished by the Contractor at his expense.
(b) Return of Vessel. The Government will accept return of the vessel at the Contractor's yard upon acceptance of the work.
Should tug or pilot service be necessary for unberthing the vessel or maneuvering into open water from slips or basins on which the Contractor's yard is located, the Contractor shall immediately furnish such service at his expense.
(c) Time of Completion. The date and hour of the completion of all the contract requirements and the vessel is returned to the Government shall be considered as the time of completion of the contract subject to the provisions of the Commencement, Prosecution, and Completion -- Ship Repair paragraph 1.1.13 of this scope of work.
1.1.10. In case of failure on the part of the Contractor to
complete the work within the specified availability period (see paragraph 1.1.13, below) or any extensions thereof, the Contractor shall pay the Government as liquidated damages as specified in Clause 52.211-11, for each calendar day of delay until the work is completed or accepted.
1.1.11. The Contractor shall submit a report to the
Contracting Officer pertaining to any major part or component found to be damaged or exceeding permissible tolerances upon disclosure of the defects.
1.1.12. Should the removal or shifting of any parts of the
vessel or its fittings, stores, fuel, water, etc., be necessary for the carrying out of the repairs specified, the same shall be done by the contractor and all such removals shall be subsequently replaced and any damage or loss resulting there from shall be made good by the contractor at his expense.
1.1.13. COMMENCEMENT, PROSECUTION, AND COMPLETION -- SHIP
REPAIR
(a) It is the intent of these specifications that the vessel be out of service for work under this contract for no longer than a total of 120 calendar days, as follows: Due to the work schedule, the vessel cannot be made available for one continuous period of time; but will have to be made available to the contractor for two separate periods of time, as specified hereafter. The vessel will be delivered to the contractor after award. The vessel must be released by the contractor in order to travel to, and arrive at Fernandina Harbor, FL, on 27 July 2009. Whatever items of repair work (see Part 2, DETAILS OF WORK TO BE PREFORMED, below) the contractor begins during this first period of availability must be completed not later than close of business on July 24, 2009, such that the vessel will be fully functional. The vessel will be returned to the contractor approximately 60 calendar days later, on or about 22 September 2009, for the second period of availability, during which all specified work will be completed, after which the vessel will depart for its next assignment at Miami Harbor, FL.
The Contractor will therefore be required to commence work under the contract immediately upon delivery of the vessel to prosecute the work with faithfulness and energy and to complete the work within the availability period specified above. This 120 calendar-day availability period shall include the travel time of the vessel from its last duty station to the Contractor's yard;
the time required to perform all work specified herein; the travel time to and from Fernandina Harbor, FL, during the break in the availability period and the travel time from the Contractor's yard to the vessel's next duty station. (See the Evaluation of Cost to Deliver Vessel -- Ship Repair paragraph in paragraph 1.1.13 below for location of duty stations.) For purposes of this paragraph, it shall be assumed that the vessel travels at a rate of 150 miles per day. The vessel is operated only between the hours of operation of 8:00 a.m. and 4:30 p.m., Monday through Friday, excluding Federal holidays. It shall be the contractor's responsibility to schedule work on the vessel in such a manner as to assure completion in a period, which, with allowance for travel time, does not extend past 120 calendar days.
(b) In computing the time for commencement and completion of the work under the contract, fractional days will be prorated to the nearest hour. The hour of commencement shall be reckoned as the time when the vessel leaves its duty station for the Contractor's yard. The hour of completion of the contract shall be reckoned as the time when the vessel arrives at its next duty station subsequent to leaving the Contractor's yard. The hour of delivery shall be reckoned as the time when the vessel enters the Contractor's yard. The hour of acceptance shall be reckoned as the time all work under the contract is accepted by the Contracting Officer. If all work is not satisfactorily completed when the vessel is returned to the Government, the Contractor shall complete the work remaining to be done. Any operating time lost by the vessel thereafter because of any activities of the Contractor in completing said work shall be included in the computation of time for completion of work under the contract.
(c) In Summary of the above mentioned period of performance, line items 0011, 0016, and 0020 are to be completed by 24 July 2009.
The remaining line items are to be completed between the periods of performance of 22 September 2009 through 27 December 2009.
1.1.14 EVALUATION OF COST TO DELIVER VESSEL -- SHIP REPAIR
(a) The Surveyboat FLORIDA will be located in Jacksonville, Florida at the time offers are received. For the purpose of determining the lowest priced offer, the cost of delivery and return of the vessel will be given due consideration at the rate of $20.00 for each nautical mile that the vessel is required to travel as herein described. Upon completion of the 2 (two) repair periods, the vessel will begin operations at Miami Harbor, Florida; therefore, the vessel will be delivered without cost to yards located between Jacksonville, FL and Miami, FL. Offers from yards located outside this area will be evaluated based on delivery and return of the vessel from and to Jacksonville or Miami Harbor, Florida as appropriate. All distances will be based on the usually traveled route affording safe navigation for the vessel as determined by the Contracting Officer.
(b) Offers must be based on the Contractor's acceptance of the vessel in accordance with the Vessel Delivery and Return -- Ship Repair paragraph of this contract and commencement of work in accordance with the Commencement, Prosecution, and Completion -- Ship Repair paragraph of this scope of work. Offers based on any other schedule will be rejected as non-responsive.
1.1.15. Should any portion of the vessel's structure, housing, fixtures, or equipment require alteration in order to carry out the work, even though not specifically mentioned herein, the contractor shall make such alterations at his expense.
Moreover, should the contractor damage any portion of the vessel's structure, housing, fixtures, or equipment while carrying out this work on the vessel, the contractor shall make such alterations or repairs at his expense to restore the property to its previous condition.
1.1.16. Similarly, should any tank, compartment, void, bilge, or other area of the vessel, except those tanks specified hereafter, require cleaning and gas freeing in order to perform the work, it shall be done at no additional expense to the Government. This shall include furnishing a certificate to the Contracting Officer's representative stating that the area has been tested by a certified marine chemist and is safe for burning and welding.
1.1.17. Dimensions and quantities listed are approximations
only. Contractor shall be responsible for field verification of all dimensions and measurements and reporting any discrepancies to the Government before work is accomplished.

Questions and Answers
General Q&A’s
1. Stability test: Will a hydrostatic table of the vessel be available to create the procedure for stability test?
Answer: This item has been deleted. The USCG is no longer requiring a new Stability Letter.
2. What are the contract requirements?
Answer: The contract requirements are clearly stated in Bid Schedule, Section B; and Scope of Work, Section C, inclusive, of the Solicitation.
3. What will it take to satisfy each item of the contract?
Answer: See paragraph 1.1.5 of the amended specifications, WORK COVERED BY THE CONTRACT PRICE -- SHIP REPAIR. The Authorized Representative of the Contracting Officer, or other person, designated in writing, will make the determination as to when each job or item is fully completed.
4. No general arrangement drawings, tank drawings, capacity plans, docking plans or shell expansions drawings are provided. It is requested that USACE provide the drawings.
Answer: The vessel was built in 1973, and drawings were obtained with the vessel. Some, but not all, drawings were revised/updated in 2004 when the main engines were replaced.
No drawings have been revised since 2004. The 2004 drawings will be furnished to all prospective offerors, see attachment;
but may not include all of the items requested by this offeror. These drawings may or may not accurately describe the current configuration of the vessel, and the Government makes no warranty or representation as to their accuracy. A prudent offeror would have gone aboard the vessel, if necessary, in order to fully inform themselves as to all conditions and matters which could in any way affect the work or the cost thereof. Failure to do so does not relieve offerors from responsibility for properly estimating the difficulty or cost of successfully performing the work.
5. "as required" cannot be quantified, therefore cannot be priced. What work will USACE specifications require as a contract deliverable to satisfy each line item of the specifications were (sic) "as required" is noted.
Answer: The term "as required" in these sentences [the offeror does not specify in the question, but it is believed this question pertains to paragraphs b,(3) and b.(4)] is used as a modifier pertaining to surface preparation, and, as such is qualitative, NOT quantitative. The words "as required" as used in this sense pertain to how well the surfaces are prepared to accept new primer, paint, etc., for a finished paint system/job where the existing paint coating is failing.
The "as required" in these paragraphs also pertains to the offerors selection of sand blasting, mechanical removal, etc., to properly and adequately prepare the surface to accept the new primer and top coats. Again, a prudent offeror would have visited the vessel and inspected these above water surfaces.
6. The contract states that June 18, 2009 is the deadline for bids, but in your emails you say it is June 22, 2009. Which one is correct?
Answer: Both dates were amended. The most current due date is 1 July 2009 by 2:00 p.m. eastern time.
SECTION 0002 Q&A’s
7. Item 0002 states that the new plates and shapes are welded in place, but the requested quote is price per pound, which would be materials only. Please verify that this is either materials only or if the welding labor needs to be included in this quote. If the labor needs to be included in item 0002, why does item 0003 (page 12) request welding labor also? Also is the 100 pounds of plates and shapes a minimum?
Answer: With respect to the difference between the requirements under Bid Item 0002, Aluminum Plate and Shapes;
and Bid Item 0003, Welding Service: The welding labor specifications under Bid Item 0003 is for miscellaneous welding anywhere throughout the vessel, EXCEPT that associated with the renewal of plate and shapes (which would be included in Bid Item 0002). One example of such other welding would be to weld up cracks in shell plating, where the plate itself is not to be renewed. Such welding hours would include grinding out the crack on one or both sides of the plate, in order to properly prepare it for welding, drilling a hole at each end of the crack to stop propagation thereof; making the weld repair, and grinding the finished weld on one or both sides to blend with the adjacent plate surface(s), performing surface preparation, priming and painting, clean-up, etc., etc., all as specified in subparagraphs 1.1.5(a) and 1.1.5(b) of the solicitation. Costs for ALL labor, material, appliances, etc., Is specified for each item, whether Lump Sum or Unit Price;
and the Offerors shall estimate, prepare, and submit their prices accordingly.
8. For those items not quantified or specified will a Unit Price or a NSP (No Specifications Price) be acceptable.
Answer: Unit prices are only acceptable for the Unit Price items on the Bid Schedule for which the U/M (Unit of Measure) is Lbs., Hours, LF, or some other variable, but specifications, quantity. For all Lump Sum bid items (those for which the U/M is "Job"), the only acceptable response is a Lump Sum dollar amount. Any other responses or notations on the Bid Schedule will cause the entire bid to be rejected as non-responsive.
9. Per section 1.1.13, (a) the contract states that we will have 180 days to complete the job, but the dates show as to availability add up to only 60 days. The available dates are July 1 through July 24; then again on September 22 through October 29. This appears to be only 60 days for the work to be performed, is that the case?
Answer: The correct total performance period is 180 calendar days with 120 calendar days for that the vessel will be available for the contractor to perform the repairs minus days to mob and de-mob. The boat will be made available as soon as the contract is awarded and the first performance period work must be completed by July 24th, 2009. The boat will be made available again on or about September 22nd , 2009 for approximately 96 days making the end of the performance period on or about December 27th , 2009.
