SOURCE SELECTION PLAN
A. BASIS FOR AWARD
The award will be based on the best overall (i.e., best value) proposal that is determined to be the most beneficial to the Government, with appropriate consideration given to the five evaluation factors: Technical, Past Performance, Small Business Participation, Project Labor Agreement, and Cost/Price. The Technical factor is approximately equal to the Past Performance factor which is significantly more important than the Small Business Participation factor. The Technical Subfactor 1 – Workplan is approximately equal to the Technical Subfactor 2 – Construction Schedule. The PLA factor will be evaluated separately as acceptable or unacceptable. An acceptable PLA is required to be eligible for award in accordance with FAR 52.222.33(c) and 25.503(b). The PLA will not be part of the trade-off analysis. All evaluation factors other than cost or price and Project Labor Agreement, when combined, are approximately equal to cost or price. To receive consideration for award, a rating of no less than “Acceptable” must be achieved for the technical factor (to include all subfactors), the Small Business Participation factor and Project Labor Agreement. Additionally, any other than small business offeror must have an acceptable Small Business Subcontracting Plan to receive an award in accordance with FAR 19.702(a). Offerors are cautioned that the award may not necessarily be made to the lowest cost offered.

Examples of commitments may include: letters of commitment, joint ventures, Mentor-Protégé Agreements, or other demonstrations of commitment.
c) In order to comply with the requirements for the Small Business Participation Commitment Document, please be sure you have:
1. based your percentages on total contract value and not subcontracted value.
2. included detail documentation supporting the minimum quantitative requirement (MQR) you have proposed and a valid reason why MQRs specified by the Government in the solicitation cannot be met or exceeded.
d) For purposes of this requirement, total contract value is defined as the cumulative value of the base and options. Small business prime offerors may achieve small business participation (meet or exceed MQR) through their own performance/participation as a prime and also through subcontracting to other small businesses. All offerors are required to submit Small Business Participation Commitment Documents in accordance with the RFP instructions. Small business participation commitments will become requirements and be incorporated into the resulting contract.
(4) For Other than Small Businesses ONLY. Compliance with terms and conditions of FAR 52.219-9, Small Business Subcontracting Plan (if required on recent contracts). The Other than Small Business offeror shall provide three Individual Subcontracting Reports (ISRs) for recent contracts (within the past three years from the closing date of this solicitation) that required a subcontracting plan. If not required in any recent contracts, the offeror shall so state. If the offeror has less than three recent contracts, the offeror shall provide the most recent ISR for each contract it has, and state that the offeror does not have three recent contracts.
(v) VOLUME IV – Factor 4 - PROJECT LABOR AGREEMENT (PLA)
The PLA will be evaluated on an Acceptable/Unacceptable basis. The evaluation of the PLA will not play a role in the tradeoff analysis discussed above, but an Offeror’s PLA must be rated acceptable to be eligible for award. Submitted PLAs will be reviewed for compliance with FAR 52.222-33 and all statutes, regulations, Executive Orders, and agency/contract requirements. At a minimum, as stated in FAR 52.222-33, the PLA must:
a) Bind the Offeror and Subcontractors engaged in construction on the project to comply with the project labor agreement;
b) Allow the Offeror and all Subcontractors to compete for contracts and subcontracts without regard to whether they are otherwise parties to collective bargaining agreements;
c) Contain guarantees against strikes, lockouts, and similar job disruptions;
d) Set forth effective, prompt, and mutually binding procedures for resolving labor disputes arising during the term of the project labor agreement;
e) Provide other mechanisms for labor-management cooperation on matters of mutual interest and concern, including productivity, quality of work, safety, and health.
Award can only be made to an offeror with a PLA that is fully compliant with the contract requirements. Offerors not submitting a required PLA will be rated Unacceptable for this factor and may not be eligible for award.
(ii) VOLUME V – Factor 5 - Cost/Price. The volume shall be organized into the following sections:
(1) Submittal. The volume shall consist of all information required to support the offered price. The offeror shall provide a completed Schedule of Prices located in section 00100 of the RFP. Certified cost and pricing data are not currently required;
however, the Government reserves the right to request such data prior to award. No pricing information shall be contained in any other volume of this proposal. Electronic links are only permissible within the Cost Volume. If files contain links, the links must be intact and maintained through all revisions. The offeror shall not include pivot tables in Excel spreadsheets. .
(2) Compliance. Failure to comply with the RFP requirements for Cost information may result in an adverse assessment of an offeror’s proposal and reduce or eliminate its chance of being selected for award. Offerors shall ensure that the information presented in this volume is consistent and correlates with the information contained in the other proposal volumes. Also, the offeror shall ensure that the information submitted in this volume is consistent with and fully supports the amounts set forth in the SF1442 as well as the continuation sheets.
(3) General Instructions. In accordance with Federal Acquisition Regulation
(FAR) 15.402 and 15.403-1, certified cost or pricing data are not required based on the fact that adequate competition is expected for this procurement. Information other than certified cost or pricing data may be presented in contractor preferred format provided that sufficient information is made available. Information submitted shall be prepared following the instruction in FAR 15.403-5. If after receipt of proposals the Contracting Officer determines that there is insufficient information available to determine price reasonableness and none of the exceptions at FAR 15.403-1 apply, the offeror may be required to submit cost or pricing data. Additionally, in the event that adequate competition is not obtained, the Contracting Officer may incorporate FAR 52.215-20 entitled, “Requirements for Cost or Pricing Data or Information Other Than Cost or Pricing Data,” into the solicitation and request a Certificate of Current Cost or Pricing Data. There are no page limitations for this volume. Proposal information included in this volume which is not directly related to Cost will be disregarded.
(vi) VOLUME VI – SOLICITATIONS, OFFER AND AWARD DOCUMENTS
AND CERTIFICATIONS/REPRESENTATIONS
Certifications and Representations – Each offeror shall complete (fill-in and signatures) the solicitation sections indicated below using the file (without modification to the file) provided with the RFP. An authorized official of the firm shall sign the SF 1442 and all certifications requiring original signature. An Acrobat PDF file shall be created to capture the signatures for submission.

C. FACTORS AND SUBFACTORS TO BE EVALUATED
The following evaluation factors and subfactors will be used to evaluate each proposal:
Award will be made to the offeror whose proposal is most advantageous to the Government based upon an integrated assessment of the evaluation factors and subfactors described below.
Factor 1: Technical Approach: This factor is further divided into the following subfactors:
a. Subfactor 1: Work Plans
c. Subfactor 2: Construction Schedule
Evaluation of the offeror’s proposal shall address each Technical subfactor as it applies to the Specifications and Drawings. A detailed explanation of the criteria for the evaluation is set forth in the II-D. Evaluation Approach, 2. Factor 1 – Technical Approach. During evaluation of each proposal, the Government will assign the overall Technical factor an adjectival rating and write a narrative evaluation reflecting the identified findings.
Factor 2: Past Performance: Each offeror’s past performance will be reviewed to determine one overall relevancy and confidence assessment. During evaluation of each proposal, the Government will assign the overall Past Performance factor an adjectival rating and write a narrative evaluation reflecting the identified findings.
Factor 3. Small Business Participation: Each offeror’s level and degree of commitment to utilize small business in execution of the requirement will be evaluated. During evaluation of each proposal, the Government will assign the overall Small Business Participation factor an adjectival rating and write a narrative evaluation reflecting the identified findings.
Factor 4. Project Labor Agreement (PLA): Each offeror’s PLA will be evaluated. During evaluation of each proposal, the Government will determine if the PLA is acceptable or unacceptable based on PLA requirements and write a narrative evaluation reflecting the identified findings.
Factor 5: Cost/Price: The resulting award will be a firm fixed price construction contract. Price reasonableness will be utilized in the evaluation of the Firm-Fixed Price effort.
D. EVALUATION APPROACH
All proposals shall be evaluated by the Source Selection Team (SST).
1. The overarching evaluation approach for all factors and subfactors is as follows:
a. Adequacy of Response. The proposal will be evaluated to determine whether the offeror’s methods and approach have adequately and completely considered, defined, and satisfied the requirements specified in the RFP. The proposal will be evaluated to determine the extent to which each requirement has been addressed in the proposal in accordance with the proposal submission section of the
RFP.
b. Feasibility of Approach. The proposal will be evaluated to determine the extent to which the proposed approach is workable and the end results achievable.
The proposal will be evaluated to determine the extent to which successful performance is contingent upon proven devices and techniques. The proposal will be evaluated to determine the extent to which the offeror is expected to be able to successfully complete the proposed tasks and technical requirements within the required schedule.
2. Factor 1 – Technical Approach:
The Technical factor is divided into two subfactors (Work Plans, and Construction Schedule). Each subfactor will be rated separately and then consolidated into an overall Technical factor rating. The following details how each subfactor will be evaluated:
Subfactor 1 – Work Plans:
The Government will evaluate the work plan narrative based on the following:
1. Completeness of plan with respect to items of concern listed.
2. Demonstration of thorough understanding of and ability to comply with the project requirements.
3. Reasonableness of contractor sequencing in terms of site constraints and challenges associated with the work.
4. Ability to mitigate construction and scheduling risk associated with project features.
Subfactor 2: Schedule – Construction Schedule:
The Government will evaluate the schedule based on the following:
1. Activities labeled, interdependence including finish-start and start-start, critical path, durations, exclusion periods, and milestones.
2. Completeness, reasonableness, and compliance of the schedule with the contract requirements
3. Reasonableness of work sequencing in terms of site constraints, river hydrologic conditions, and challenges associated with the work.
4. Logical sequence of activities to minimize critical path activities to mitigate construction and scheduling risks associated with project features and project locations.
5. Ability for the offeror to complete the project within the contract duration specified in the solicitation.
Subfactor 1 Work Plans and Subfactor 2 Construction Schedule will be rated via this methodology and consolidated into one rating for the overall Technical Approach Factor.
In accordance with the Army Source Selection Supplement (AS3), Section 3.1, the Army methodology for evaluating Technical Approach and Related Risk is the Combined Technical/Risk Rating, (see Table 1 below). This methodology considers risk, in conjunction with the strengths, weaknesses, significant weaknesses, uncertainties, and deficiencies in determining technical ratings.
TABLE 1 – COMBINED TECHNICAL/RISK RATINGS
Color Rating Description
Blue Outstanding Proposal indicates an exceptional approach and understanding of the requirements and contains multiple strengths, and risk of unsuccessful performance is low.
3. Factor 2 - Past Performance. The Government will evaluate the offeror’s record of past and current performance to ascertain the probability of successfully performing the required efforts of the contract requirement.
a. Evaluation of past performance shall be in accordance with this plan utilizing the forms and questionnaires enclosed.
b. The Government will focus its inquiries on the Offeror’s (and major subcontractor’s) record of performance as it relates to all solicitation requirements, including cost, schedule, performance and management of subcontractors. Major subcontractors for the purpose of Past Performance evaluation are defined as members of an Offeror’s overall team who are expected to perform twenty (20%) percent or more of the proposed effort. A significant achievement, problem, or lack of relevant data in any element of the work can become an important consideration in the evaluation process. Therefore, Offerors shall be reminded to include the most recent and relevant efforts (within the past ten (10) years) of the solicitation issue date in their proposal. A maximum of five relevant contracts for the prime offeror and each major subcontractor will be evaluated. If more than five contracts are submitted for the prime offeror and subcontractor then only the first five will be evaluated. The Government may use data provided by the Offeror in its proposal and data obtained from other sources, including data in Government files or data obtained through interviews with personnel familiar with the contractor and their current and past performance under Federal, State or Local government or commercial contracts for same or similar services as compared to the North American Industry Classification System (NAICS) 237990. Data used in conducting performance risk assessments shall not extend the past ten (10) years prior to the solicitation issue date.
` c. Other sources may include, but are not limited to, past performance information retrieved through the Past Performance Information Retrieval System
Purple Good Proposal indicates a thorough approach and understanding of the requirements and contains at least one strength, and risk of unsuccessful performance is low to moderate.
Green Acceptable Proposal meets requirements and indicates an adequate approach and understanding of the requirements, and risk of unsuccessful performance is no worse than moderate.
Yellow Marginal Proposal has not demonstrated an adequate approach and understanding of the requirements, and/or risk of unsuccessful performance is high.
Red Unacceptable Proposal does not meet requirements of the solicitation, and thus, contains one or more deficiencies, and/or risk of unsuccessful performance is unacceptable. Proposal is not awardable.
(PPIRS), including Contractor Performance Assessment Reporting System (CPARS), using all CAGE, DUNS Number and Unique Enitity ID (UEI). of team members (partnership, joint venture, teaming arrangement, or parent company/subsidiary/affiliate) identified in the Offeror’s proposal, inquiries of owner representative(s), Federal Awardee Performance and Integrity Information System (FAPIIS), Electronic Subcontract Reporting System (eSRS), and any other known sources not provided by the Offeror. While the Government may elect to consider data from other sources, the burden of providing detailed, current, accurate and complete past performance information rests with the Offeror.
d. The past performance factor considers each offeror’s demonstrated recent and relevant record of performance in supplying products and services that meet the contract requirements. One performance confidence assessment rating is assigned for each Offeror after evaluating the Offeror's recent past performance, focusing on performance that is relevant to the contract requirements. There are three aspects to the past performance evaluation: recency, relevancy, and performance confidence.
(i) RECENCY: The first aspect is to evaluate the recency of the offeror’s past performance. Projects that were substantially completed within 10 years of this RFP issuance date are considered recent for the purposes of this evaluation.
(ii) RELEVANCY: The second aspect is to determine how relevant the offeror’s past performance is to the effort solicited in this RFP. Relevancy is not separately rated; however, the following criteria (see Table 2) will be used to establish what is relevant which shall include similarity of service/support, complexity, dollar value, contract type, and degree of subcontract/teaming.
Table 2 - Past Performance Relevancy Ratings Rating Definition Relevant Present/past performance effort involved similar scope and magnitude of effort and complexities this solicitation requires.
Not Relevant Present/past performance effort involved little or none of the scope and magnitude of effort and complexities this solicitation requires.
(iii) PERFORMANCE CONFIDENCE ASSESSMENT: The third aspect of the past performance evaluation is to perform a confidence assessment of the expectation the Offerer will successfully perform the required effort. The performance confidence assessment will utilize the most appropriate rating from the table below. This rating considers the assessed confidence of the relevant/recent efforts gathered.
TABLE 3 - Performance Confidence Assessments
Rating Definition
Substantial Confidence Based on the offeror’s recent/relevant performance record, the Government has a high expectation that the offeror will successfully perform the required effort.
Satisfactory Confidence Based on the offeror’s recent/relevant performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort.
Limited Confidence Based on the offeror’s recent/relevant performance record, the Government has a low expectation that the offeror will successfully perform the required effort.
No Confidence Based on the offeror’s recent/relevant performance record, the Government has no expectation that the offeror will be able to successfully perform the required effort.
Unknown Confidence (Neutral)
No recent/relevant performance record is available, or the offeror’s performance record is so sparse that no meaningful confidence assessment rating can be reasonably assigned.
4. Factor 3 - Small Business Participation. IAW Defense FAR Supplement
(DFARS) 215.304(c)(i), the extent to which offeror’s identify and commit to small business performance of the contract shall be evaluated.
The Government will evaluate the Small Business Participation Factor based on Table 4 Small Business Ratings. This methodology considers risk, in conjunction with the strengths, weaknesses, significant weaknesses, uncertainties, and deficiencies in determining the Small Business Participation ratings.
5. Factor 4 – Project Labor Agreements (PLA). The Government will evaluate the offeror’s PLA IAW FAR 22.504(b) (1-6) to confirm that the PLAs fully conform to all statutes, regulations, and Executive orders in accordance with Table 5 below. All PLAs shall:-
