Background:

The U.S. Army Corps of Engineers (USACE) Rock Island District (MVR) has been coordinating temporary closures of five locks on the Illinois Waterway to address aging infrastructure needs. Through cooperation with navigation industry and Illinois Waterway stakeholders, MVR developed a consolidated repair schedule, which includes a short closure to locks in 2020. The simultaneous closure of multiple locks will provide time for much needed critical repairs and maintenance while reducing impacts to navigation. The Peoria Lock will be closed to navigation from July 6th to September 29th of 2020 at which time critical repairs are needed for the rehabilitation of the Peoria Lock and Dam Miter Gate Hydraulic Cylinders.

BASE BID (see schedule of prices for further details):

Miter Gate Hydraulic Cylinders - Five (5): The base bid consists of rehabilitating five (5) miter gate hydraulic cylinders. The existing hydraulic cylinder rods are ceramic coated, which has failed and is no longer authorized for use by USACE. The new laser cladding on cylinder rod must be able to be field welded/repaired. The Government will remove the five cylinders from the Lock and Dam no later than (NLT) 12 July 2020. All five cylinders will be ready the following day for shipment to the awarded contractor’s facility. The Government will load/unload the cylinders at the Government destination. The contractor is responsible for the means, method and expense of shipment to the contractor’s facility. Once shipped, the cylinders are to be refurbished in accordance with the specifications provided below in the SOW. Once work is completed, four of the five cylinders must be shipped back and onsite at Peoria Lock and Dam NLT 13 September 2020. The contractor is responsible for providing and loading a flatbed truck or similar for shipment to Illinois Waterway Project Office 257 Grant Street, Peoria, IL 61603 where the Government will be responsible for unloading. The fifth cylinder shall be shipped back and onsite at Peoria Lock and Dam NLT 15 October 2020. The contractor is responsible for providing and loading/unloading a flatbed truck or similar for shipment to Illinois Waterway Project Office 257 Grant Street, Peoria, IL 61603 where the Government will be responsible for unloading. FOB Destination is the Peoria Lock and Dam, IL. Contractor is responsible for safely shipping the cylinders and is responsible for any damages occurred during shipping.

OPTIONS (see schedule of prices for further details):

Stainless Steel Upgrade for Miter Gate Hydraulic Cylinder Manifolds (Option 1):

Replace all five miter gate hydraulic cylinder manifolds with stainless steel. The Government reserves the right to exercise the stainless steel options within five (5) weeks of the date of contract award. The manifold shall be assembled to the hydraulic cylinder upon arrival.

Tainter Valve Hydraulic Cylinders - Five (5) (Options 2 – 6): Rehabilitate five (5) Tainter valve hydraulic cylinders. The Government reserves the right to exercise the option(s) for the Tainter valve hydraulic cylinders until 1 December 2020. If the option(s) to rehabilitate the Tainter valve hydraulic cylinders are awarded, the contractor shall have 20 weeks to complete the work from the date of the award.

Stainless Steel Upgrade for Tainter Valve Hydraulic Cylinders (Options 7 – 11): Replace Tainter valve hydraulic cylinder manifolds with stainless steel. The Government reserves the right to exercise the stainless steel option(s) until 1 December 2020. If the option(s) for the stainless steel upgrade are exercised, the contractor shall have 19 weeks to complete the work from the date of the award. If the offeror proposes no other delivery schedule, the required delivery schedule above will apply.

OFFEROR'S PROPOSED DELIVERY SCHEDULE

Within Days

After Date

Item No. Quantity of Contract

(b) Attention is directed to the Contract Award provision of the solicitation that provides that a written award or acceptance of offer mailed, or otherwise furnished to the successful offeror, results in a binding contract. The Government will mail or otherwise furnish to the offeror an award or notice of award not later than the day award is dated. Therefore, the offeror should compute the time available for performance beginning with the actual date of award, rather than the date the written notice of award is received from the Contracting Officer through the ordinary mails. However, the Government will evaluate an offer that proposes delivery based on the Contractor's date of receipt of the contract or notice of award by adding (1) five calendar days for delivery of the award through the ordinary mails, or (2) one working day if the solicitation states that the contract or notice of award will be transmitted electronically. (The term "working day" excludes weekends and U.S. Federal holidays.) If, as so computed, the offered delivery date is later than the required delivery date, the offer will be considered nonresponsive and rejected.

(End of clause)

52.211-11 LIQUIDATED DAMAGES--SUPPLIES, SERVICES, OR RESEARCH AND DEVELOPMENT (SEP 2000)

(a) If the Contractor fails to deliver the supplies or perform the services within the time specified in this contract, the Contractor shall, in place of actual damages, pay to the Government liquidated damages of $1,600.00 per calendar day of delay.

(b) If the Government terminates this contract in whole or in part under the Default--Fixed-Price Supply and Service clause, the Contractor is liable for liquidated damages accruing until the Government reasonably obtains delivery or performance of similar supplies or services. These liquidated damages are in addition to excess costs of repurchase under the Termination clause.

(c) The Contractor will not be charged with liquidated damages when the delay in delivery or performance is beyond the control and without the fault or negligence of the Contractor as defined in the Default--Fixed-Price Supply and Service clause in this contract.

(End of clause)

52.212-1 INSTRUCTIONS TO OFFERORS--COMMERCIAL ITEMS (OCT 2018)

(a) North American Industry Classification System (NAICS) code and small business size standard. The NAICS code and small business size standard for this acquisition appear in Block 10 of the solicitation cover sheet (SF 1449). However, the small business size standard for a concern which submits an offer in its own name, but which proposes to furnish an item which it did not itself manufacture, is 500 employees.

(b) Submission of offers. Submit signed and dated offers to the office specified in this solicitation at or before the exact time specified in this solicitation. Offers may be submitted on the SF 1449, letterhead stationery, or as otherwise specified in the solicitation. As a minimum, offers must show--

(1) The solicitation number;

(2) The time specified in the solicitation for receipt of offers;

(3) The name, address, and telephone number of the offeror;

(4) A technical description of the items being offered in sufficient detail to evaluate compliance with the requirements in the solicitation. This may include product literature, or other documents, if necessary;

(5) Terms of any express warranty;

(6) Price and any discount terms;

(7) "Remit to" address, if different than mailing address;

(8) A completed copy of the representations and certifications at FAR 52.212-3 (see FAR 52.212-3(b) for those representations and certifications that the offeror shall complete electronically);

(9) Acknowledgment of Solicitation Amendments;

(10) Past performance information, when included as an evaluation factor, to include recent and relevant contracts for the same or similar items and other references (including contract numbers, points of contact with telephone numbers and other relevant information); and

(11) If the offer is not submitted on the SF 1449, include a statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation. Offers that fail to furnish required representations or information, or reject the terms and conditions of the solicitation may be excluded from consideration.

(c) Period for acceptance of offers. The offeror agrees to hold the prices in its offer firm for 30 calendar days from the date specified for receipt of offers, unless another time period is specified in an addendum to the solicitation.

(d) Product samples. When required by the solicitation, product samples shall be submitted at or prior to the time specified for receipt of offers. Unless otherwise specified in this solicitation, these samples shall be submitted at no expense to the Government, and returned at the sender's request and expense, unless they are destroyed during preaward testing.

(e) Multiple offers. Offerors are encouraged to submit multiple offers presenting alternative terms and conditions, including alternative line items (provided that the alternative line items are consistent with subpart 4.10 of the Federal Acquisition Regulation), or alternative commercial items for satisfying the requirements of this solicitation.

Each offer submitted will be evaluated separately.

(f) Late submissions, modifications, revisions, and withdrawals of offers:

(1) Offerors are responsible for submitting offers, and any modifications, revisions, or withdrawals, so as to reach the Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that offers or revisions are due.

(2)(i) Any offer, modification, revision, or withdrawal of an offer received at the Government office designated in the solicitation after the exact time specified for receipt of offers is “late” and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; and--

(A) If it was transmitted through an electronic commerce method authorized by the solicitation, it was received at the initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day prior to the date specified for receipt of offers; or

(B) There is acceptable evidence to establish that it was received at the Government installation designated for receipt of offers and was under the Government's control prior to the time set for receipt of offers; or

(C) If this solicitation is a request for proposals, it was the only proposal received.

(ii) However, a late modification of an otherwise successful offer, that makes its terms more favorable to the Government, will be considered at any time it is received and may be accepted.

(3) Acceptable evidence to establish the time of receipt at the Government installation includes the time/date stamp of that installation on the offer wrapper, other documentary evidence of receipt maintained by the installation, or oral testimony or statements of Government personnel.

52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

1. Technical Capability: (Work Plan Narrative and Schedule)

Work Plan Narrative:

The Offeror shall submit a Work Plan that describes their overall plan to complete the contract work. The Offeror is encouraged to provide descriptions and illustrations which show the contractor’s, subcontractor’s, and supplier’s qualifications and methodology to accomplish the work, including, but not limited to, descriptions of equipment, special fabrications, and specialized labor. Items of particular concern to the government are:

• The fabrication of CIMS profile with regard to not only the profile but the ability of the sensor to read profile through the laser cladding.

http://www.sam.gov/

• Compatibility of CIMS profile with existing PLC control logic.

• Complete detailed drawing set, CAD files, and material list for entire hydraulic cylinder assembly and manifolds.

The Government will evaluate the work plan narrative based on the following:

• Completeness of plan with respect to items of concern listed above;

• Demonstration of thorough understanding of and ability to complete the Scope of Work;

• Reasonableness of contractor sequencing; and

• Ability to mitigate risk associated with project features.

Schedule:

The Offeror shall submit a critical path schedule and narrative demonstrating a logical and efficient sequence for completing the Scope of Work. Items of particular concern to the government are:

• Labels and durations on all activities;

• Detailed work sequences for all major activities, including the reasoning for the timing of activities;

• Critical long-lead time materials and fabrications; and

• The fact the timeline is extremely condensed, without the possibility for an extension.

The Government will evaluate the schedule based on the following:

• Completeness and reasonableness of the schedule;

• Demonstration of thorough understanding of the Scope of Work;

• Reasonableness of work sequencing;

• Ability to mitigate scheduling risk;

• Consideration of long lead times for materials.

2. Price:

Offerors SHALL complete and submit the schedule of prices with their quote and include a price for each line item. Failure to do so will result in the offer being rejected without further consideration.

The Offeror shall ensure the information submitted is consistent with and fully supports the dollar values set forth in the SF1449 Schedule of Prices.

The Government may reject any quote that is evaluated and determined to be unrealistic in terms of project commitments, or unreasonably high or low in when compared to Government estimate, such that the quote is deemed to reflect an inherent lack of competence or failure to comprehend the complexity of the project.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

52.212-3 OFFEROR REPRESENTATIONS AND CERTIFICATIONS--COMMERCIAL ITEMS (DEC 2019)
