For additional measurement information see Section 35 20 23 DREDGING, paragraph "PROJECT DEPTH, OVERDEPTH, SIDE SLOPES, AND INFILL." In order to allow for the inaccuracies of the dredging process, the Contractor will be allowed a tolerance of 0.5 feet above project depth in isolated scattered areas providing the total area of under excavated portions does not exceed 10 percent of the total area dredged and providing the average depth throughout the dredge site is equal to or greater than the specified project depth. This tolerance will only apply to 11 to 14 foot project depth sites. Dredging locations for all other project depths will be clear swept to the identified project depth.

River miles are defined as the distance on the marked navigation mid channel sailing line as detailed on the Upper Mississippi River Navigation Charts (current edition). River miles will be computed from the navigation charts as measured from the center of the entire dredge site to the center of the navigation channel at the point directly perpendicular to the center of the placement/bankline placement site, to the nearest tenth of a mile.

No allowance will be made for the distance from the channel centerline to the shoreline at the placement/bankline placement site. In the event the dredge site is a temporary placement site (island unloading) or small harbor dredging site, the river miles will be measured from a point directly perpendicular to the center of the dredging site from the mid

1.4 CONTRACT MAXIMUM AND MINIMUM

1.4.1 Maximum

Task orders will not exceed a cumulative amount of $25,000,000 over the life of the Contract. Individual task orders may not exceed $2,000,000.

1.4.2 Minimum

The Government is obligated to order no less than $50,000 of work specified in the Schedule of Prices for the ordering periods and any exercised subsequent ordering period, as set forth in Clause 52.216-22 INDEFINITE

QUANTITY.

1.5 ADJUSTMENT TO FUEL PRICE

This clause prescribes the adjustments that will be made to the unit price(s) for certain Contract line items in the event of changes (either upward or downward) in diesel fuel prices. The Contracting Officer will calculate the Adjustment to Fuel Price (AFP) for the affected Contract line item unit prices on an individual task order basis. These adjustments are premised on the assumptions set forth in this clause and will be applied uniformly regardless of the Contractor's actual cost experience in performing the work under this Contract.

For purposes of this adjustment, the Contracting Officer will use a Base Fuel Index (BFI). The BFI will be the published price (in dollars/gallon) in effect for Diesel Fuel (all types) for the Midwest (PADD 2) Region as established by the Energy Information Administration (EIA) on 30 November 2020. This information is published at http://www.eia.doe.gov.

The index is currently updated on a weekly basis.

A Current Fuel Index (CFI) in dollars per gallon will be established at issuance of each task order. The CFI will be the published price in effect for Diesel Fuel (all types) for the Midwest (PADD 2) Region as established by the Energy Information Administration (EIA) in effect on the first calendar day of the month during which the task order is issued by the Contracting Officer. The AFP (addition or subtraction) to the unit price for a given line item will be computed by application of the following formula:

AFP = ((BUP*% Fuel Cost / (BFI - 0.513))*(CFI-BFI))

Where:

" AFP = Adjustment to Fuel Price " BUP = Bid Unit Price, the unit prices for each applicable Contract line item " CFI = Current Fuel Index (in dollars per gallon) " BFI = Base Fuel Index (in dollars per gallon) = $2.404 on 30 November 2020 " % Fuel Cost = presumed percentage of bid item cost attributable to

SECTION 01 22 00 Page 12 fuel for a given Contract Line Item subject to adjustment under this clause as indicated in the table below (this percentage IS NOT subject to adjustment as a result of the Contractor's actual cost experience) " 0.513 = the presumed fuel tax rate (in dollars per gallon)

1.5.1 Basis of Adjustment

The AFP will be calculated and applied to (added or subtracted from the price of) each unit of each Contract Line Item Number (CLIN) identified in the table below, that will be used in a given task order. The adjustments to the unit prices for a given task order will be used for the life of that task order, including any modifications or adjustments to it. The adjustments will be rounded to the nearest cent; prices of elements within the formula will be rounded to the nearest tenth of a cent (three decimal places). CLINS not listed in the table below are not subject to adjustment for changes in fuel price under this or any other clause of the Contract.

1.5.2 Contract Line Items Subject to AFP

CONTRACT LINE ITEM UNIT PERCENT

FUEL COST

Dredging CY 20

Transportation of Plant Between Dredging Sites MI 15

Transportation of Dredged Material, 4 – 8 River Miles

CY 20

Transportation of Dredged Material, 8-12 River Miles

CY 20

Dredging/Excavation at Temporary Storage Sites CY 20

Small Boat Harbor Dredging CY 20

In the event the Energy Information Administration (EIA) ceases publication of the weekly diesel fuel price index, the Contracting Officer will, in discretion, designate another fuel price index to be used in making the adjustment.

1.5.3 Example

The following example is used to demonstrate the application of the AFP clause. This example is purely hypothetical and solely for demonstrating the operation of the clause as none of the indices applicable to this Contract has yet been published. For purposes of this example assume that:

" The CLIN being adjusted is Dredging " The BUP is $5.00 " The BFI is $3.705 " The CFI is $3.431

The AFP would be calculated as follows:

1 AFP = ((5.00 * .20/(3.705 - .513))*(3.431 -3.705)) (1 / 3.192) * -.274

= -.086 = -.09

SECTION 01 22 00 Page 13

The AFP for this CLIN would be -.09 resulting in a price of $4.91 for that CLIN on that Task Order.

in station quantities is required. No standby or non-effective time will be paid for cut layout, survey work, or resolution of disputes over Government survey data.

3.1.2 Land Based Plant

Provide land based plant to unload materials and maintain placement sites.

Plant to be capable of transporting, placing, and shaping material.

Material may be spread and leveled over a large area or stockpiled in small restricted areas.

3.1.3 Equipment and Computations

The sonic depth recorder, properly calibrated, will be considered equivalent to a lead line for measurement of depths. The planimeter will be considered a precise instrument for measuring cross sectional area. If cross sections are plotted according to a coordinate system, preprogrammed calculators or computers may be used instead of a planimeter. The Government surveys will be performed with electronic positioning equipment (typically Differential Global Positioning System (DGPS). A copy of original notes, computations, and records may be furnished to the Contractor upon request. Use electronic positioning equipment that is acceptable to the Contracting Officer.

U.S. Coast Guard towers within the Rock Island District are no longer broadcasting differential corrections. Remote work areas require alternative means of obtaining consistent differential corrections.

Furnish the means for obtaining differential corrections.

3.2 STANDBY

In the event a dredging/unloading site has not been identified or the Contracting Officer determines that it is otherwise in the Government's interest for the Contractor to remain mobilized and available to perform work immediately, the Contracting Officer may elect to place the Contractor's plant on standby status. The decision to place the Contractor's plant on standby status (or not) is purely at the discretion of the Contracting Officer.

3.2.1 Movement of Plant

When in standby status the Contractor's plant will not be moved from the designated standby location without approval of the Contracting Officer.

3.2.2 Removal from Standby Status

Upon notice of removal from standby status, be prepared to resume operations within 24 hours.

SECTION 35 20 23 Page 6

3.6.2 Contractor Placement Quantity Measurements and Disputes

If the Contractor disputes the Government's preplacement or post placement surveys or chooses to perform interim surveys either for progress payments or for verification, Perform the surveys with an electronic system that collects data in a XYZ format. Provide XYZ and descriptor ASCII file output that is compatible with the Government's HYPACK system. Use survey equipment that has elevation/depth accuracy of plus or minus 0.5 feet and horizontal position accuracy of 6 feet. All surveys in accordance with Section 02 21 00 SURVEYS.

3.6.3 Government Specified Placement Sites

The Contractor may be required to use multiple placement sites to place the dredged material from a single dredge cut. Other placement sites not listed may be specified, however general site conditions are similar to those listed. The Government may direct the Contractor to change placement sites at anytime. Prepare the placement site(s) as necessary for equipment access, construction of any berms necessary to contain dredged material, and maintenance of the Government specified placement sites. Maintenance to include preservation of existing dikes and berms. All dredged material piles to be free draining and finished to a uniform surface free from mounds and windrows. Upon completion of placement operations, restore the ground area outside the sites to their preconstruction conditions. Remove any material spilled in the river along the shoreline at the unloading site at no additional cost to the Government. The Government will guarantee access to Government specified placement sites such that a minimum draft of seven feet over a minimum channel width of 150 feet is obtained to within 25 feet of shoreline. If dredging is necessary to obtain these minimum provisions it will be measured under dredging bid item. Dredging required for the Contractor's convenience to obtain access beyond these provisions and all dredging to provide access to Contractor furnished placement sites will not be measured for payment.

3.6.4 Deleted

3.6.5 Government Specified In-Water Placement Sites

Placing dredge cut material may have to be constructed into the water. In this case, place the dredged material as directed. Place material in the water such that soft riverbed will be pushed outward and not trapped under the newly placed material. Place dredged material in-water in accordance with the permits, as indicated and as directed. The maximum drop of fill tolerance is 6 inches above the water surface.
