SECTION 00700 - CONTRACT CLAUSES
The following have been modified:
52.211-10 COMMENCEMENT, PROSECUTION, AND COMPLETION OF WORK (APR 1984)
The Contractor shall be required to (a) commence work under this contract within 10 calendar days after the date the Contractor receives the notice to proceed, (b) prosecute the work diligently, and (c) complete the entire work ready for use not later than as detailed below.
ALL US Army Corps of Engineers locks on the Columbia/Snake River system will be out of service for an extended outage between 6:00 A.M. on 12 December 2016 and ends at 6:00 P.M.
on 20 March 2017.
The Contractor will have access to the Washington Fish Ladder, for work on this contract, from 8 December 2016 through 11:59 p.m. 20 January 2017. See Section 01 14 00.10 28 PROJECT SITE RESTRICTIONS, paragraph FISH LADDER WORK RESTRICTIONS for additional information.
The Project will be performing required maintenance on the tilting weirs during this same fish ladder outage (See Section 01 14 00.10 28 PROJECT SITE RESTRICTIONS, paragraph "Government's Work Schedule" for Government work hours). Initial coordination between the Government and Contractor will take place at the Pre-Work Meeting. See Section 01 11 01.00 28 SUPPLEMENTARY REQUIREMENTS, paragraph Pre-Work Meeting. Anticipate that the required coordination will require the Contractor to work sequentially from one end of the fish ladder exit weirs to the other.
(1) The Contractor shall complete all work for the Lamprey Modifications of the Washington shore fishway by not later than 11:59 p.m. 20 January 2017, to allow rewatering of the fish ladder, and additional project work by the Government.
(2) The Contractor shall complete final cleanup and demobilization (for all items and equipment) by not later than 15 calendar days after completion of work in (1) above
(3) The Contractor shall complete final submission of working “as-built” contract drawings and final approved versions of Contractor prepared drawings (see Section 01 78 00.00 28 CLOSEOUT SUBMITTALS) by not later than 30 calendar days after completion of work in (1) above.

52.211-12 LIQUIDATED DAMAGES--CONSTRUCTION (SEP 2000)
(a) (a) If the Contractor fails to complete the work within the time specified in the contract, the Contractor shall pay liquidated damages to the Government in the amount of $1,270.00 for each calendar day of delay until the work specified in subparagraph (c)(1) of FAR Clause
52.211-10, COMMENCEMENT, PROSECUTION, AND COMPLETION OF WORK(APR
1984), until the Contractor has completed the work as specified or satisfactorily prepared work area in preparation for work to resume in the next in-water work window.
(b) (The Contractor will lose access to the work site beginning 11:59 p.m. 20 January 2017. The Government will resume assessing liquidated damages on 1 January 2018. Liquidated damages will continue to accrue until the Contractor completes all work, including the work referenced in paragraph (c)(1) of FAR Clause 52.211-1, COMMENCEMENT, PROSECUTION AND COMPLETION OF WORK (APR 1984), and work has been accepted by the Government.
(c) If the Government terminates the Contractor's right to proceed, liquidated damages will continue to accrue until the work is completed. These liquidated damages are in addition to excess costs of repurchase under the Termination clause.
