PERFORMANCE WORK STATEMENT
Applied Biostatistical Services for the Corps of Engineers Northwestern Region’s Anadromous Fish Evaluation Program
I. BACKGROUND
The Corps of Engineers (Corps) Northwestern Region’s Anadromous Fish Evaluation Program (AFEP) conducts scientific investigations to aid in the recovery of listed endangered salmon and other species. This is accomplished through improving fish passage conditions in the Columbia and Snake Rivers to maximize the survival of juvenile and adult salmon and steelhead. The AFEP requires the services of a qualified Biostatistician to provide applied biostatistical expertise for various research projects under the AFEP, the U.S. Army Corps of Engineers (Corps’) comprehensive research program encompassing all the Walla Walla and Portland District’s anadromous fish research efforts. Professional services of biometrician(s)/statistician(s) with demonstrated experience in reviewing anadromous fish research and hydropower operations are necessary to provide an objective and independent review of statistical objectives and parameters of similar research projects.
The objectives of the review requirements are to provide statistical review (hereafter referred to as review) of preliminary and final research proposals and draft reports submitted under the U.S. Army Corps of Engineers Northwestern Region’s AFEP. The statistical review shall evaluate technical merit, applicability and make recommendations to improve statistical design and analysis. In addition, the biometrician(s)/statisticians(s) will be expected to attend some Corps in-house and AFEP meetings to discuss results, reviews, and to provide comments and suggestions on experimental design during the development and implementation of research studies and assist in the interpretation of results. The intent of this Request For Proposals (RFP) is to solicit proposals describing how the Offeror meets the needs of Corps by demonstration of education, experience, past performance references, scientific credibility, and written communication skills.
Most of the anticipated work is to be focused on lab or field evaluations of adult and juvenile salmonids at the hydroelectric projects, although future work may occur anywhere in the Columbia Basin, including near-shore Ocean and tributaries of the Snake and Columbia Rivers. It is anticipated that biological studies similar in nature to those conducted in recent years will continue in the future, although subject matter, scope and details could change.
Examples of biological studies previously conducted by the AFEP can be found on the following Corps web site: http://www.nwp.usace.army.mil/Missions/Environment/Fish/AFEP.aspx. The listing is not all inclusive, but is intended to give the Offeror a representative look at what types of research will likely be conducted in future years.
II. REQUIREMENTS
Standard Reviews Approximately 45 to 60 proposals are received by the AFEP annually. These proposals undergo review to assess whether the proposed methodology is capable of meeting defined objectives with minimal risk to the government. After proposals are discussed briefly at a Studies Review Work Group (SRWG) meeting, a subset of proposals are revised based on reviewer comments and considered for funding. The Offeror shall provide statistical reviews of preliminary proposals (approximately 45-60) as well as final proposals (approximately 30-45).
Following the completion of most research work a thorough review of the draft reports will also be required.
Non-Standard Reviews In addition to the known standard reviews discussed above, instances may occur where additional statistical review or statistical guidance is needed, and the Offeror shall be available to respond to those requests throughout the contract period. These requests could be additional support for the Corps or our contractors to further refine study design, analysis or reporting in response to controversy, changed conditions or new information.
http://www.nwp.usace.army.mil/Missions/Environment/Fish/AFEP.aspx
Meetings As previously identified, the Offeror shall attend meetings pertaining to the development of research proposals, including the Preliminary Proposal Review (2 days) and Final Proposal Review (2 days) meeting for the purpose of answering questions and providing comments of a statistical nature or on experimental design. The government will provide a copy of the minutes of these meetings to the Offeror for review. If the portion of the minutes relating to statistics is inaccurate or unclear, the Offeror shall provide a written clarification within thirty
(30) days of receiving the review request. The Offeror may be expected to attend additional special meetings (normally 1 day duration) focused on design and analysis of particular studies, as discussed above. Typically these meetings will be in Walla Walla, WA or Portland, OR. The Offeror shall attend the AFEP Annual Program Review, held 3-4 days in December, alternately in Walla Walla, WA or Portland, OR.
Deliverables The Offeror shall provide statistical reviews to the review requester (usually the Corps’ technical study lead) and the Contracting Officer’s Representative (COR) in an electronic form within thirty (30) days of receiving a standard review request. For non-standard reviews, the specific deliverables and schedule will be determined bi-laterally by the Offeror and the COR. However, typically a written response to acknowledge receipt of the review request will be required within 48 hours, and the review comments shall be provided to the COR within one week of receiving the non-standard review request. The Offeror’s proposal should consider the implication of a non-standard review request including the occasions in which the primary biostatistician is unable to respond within the required time limit.
Comments provided during conference call participation shall be provided in written format to the COR within two weeks of the date of the call.
Quality Assurance / Performance Requirement Summary (PRS) The Government will monitor the Contractor’s performance under this contract using quality assurance procedures developed by the Government. Typical procedures might include random sampling, checklists, and observation.
If any of the services do not conform to contract requirements, the Government will request the Contractor to perform the services again, where appropriate, in conformity with contract requirements, at no increase in contract amount. When the defects in services cannot be corrected by re-performance, the Government may (1) require the Contractor to take necessary action to ensure future performance conforms to contract requirements and (2) reduce the contract price to reflect the reduced value of the services performed.
If the Contractor fails to promptly re-perform the services or to take the necessary action to ensure future performance in conformity with contract requirements, the Government may by contract, or otherwise (1) perform the services and charge to the Contractor any cost incurred by the Government that is directly related to the performance of such service or (2) terminate the contract in whole or in part.

III. QUALIFICATIONS
The intent and purpose of the professional services are to provide a source of expertise independent of the Corps’ Northwestern Region research program (AFEP). Therefore, to reduce the potential of a conflict of interest compromising the independent nature of the requirements, the successful Offeror shall not be eligible to submit a proposal for biological or aquatic work funded by the Corps’ Northwestern Region, nor may they be under contract to a firm contracted by or submitting a proposal to the Corps’ AFEP within the Northwestern Region. The successful Offeror must guarantee that they are not associated with other Corps-funded work. By signing the proposal/contract, the successful Offeror agrees to withhold their services from obligations that may create a conflict of interest. If the Corps determines a conflict of interest exists, the contract may be terminated.
Following the award of the contract, the successful offeror may submit a request for the addition of a secondary biostatistician to the contract. All secondary candidates must submit their qualifications to the Corps’ COR for evaluation and final approval. The contractor’s proposal should consider the implication of a non-standard review request including the occasions in which the primary biostatistician is unable to respond within the required time limit.
All work conducted by the secondary biostatistician(s) shall be reviewed and approved by the principal biostatistician. Only in an emergency, determined by the Government, shall a secondary biostatistician, approved by the Government, conduct a statistical review without quality control provided by the principal biostatistician. As soon as possible, the principal shall review the work of the secondary and provide a letter of concurrence or clarification to the Corps.
Pre-screen candidates using E-Verify Program The Contractor must pre-screen Candidates using the E-verify Program (http://www.uscis.gov/e-verify) website to meet the established employment eligibility requirements. The Vendor must ensure that the Candidate has two valid forms of Government issued identification prior to enrollment to ensure the correct information is entered into the E-verify system. An initial list of verified/eligible Candidates must be provided to the COR no later than 3 business days after the initial contract award.

and
(2) Intended, by the gratuity, to obtain a contract or favorable treatment under a contract.
(b) The facts supporting this determination may be reviewed by any court having lawful jurisdiction.
(c) If this contract is terminated under paragraph (a) of this clause, the Government is entitled--
(1) To pursue the same remedies as in a breach of the contract; and
(2) In addition to any other damages provided by law, to exemplary damages of not less than 3 nor more than 10 times the cost incurred by the Contractor in giving gratuities to the person concerned, as determined by the agency head or a designee. (This subparagraph (c)(2) is applicable only if this contract uses money appropriated to the Department of Defense.)
(d) The rights and remedies of the Government provided in this clause shall not be exclusive and are in addition to any other rights and remedies provided by law or under this contract.
(End of clause)
52.212-1 INSTRUCTIONS TO OFFERORS--COMMERCIAL ITEMS (APR 2014)
(a) North American Industry Classification System (NAICS) code and small business size standard. The NAICS code and small business size standard for this acquisition appear in Block 10 of the solicitation cover sheet (SF 1449). However, the small business size standard for a concern which submits an offer in its own name, but which proposes to furnish an item which it did not itself manufacture, is 500 employees.
(b) Submission of offers. Submit signed and dated offers to the office specified in this solicitation at or before the exact time specified in this solicitation. Offers may be submitted on the SF 1449, letterhead stationery, or as otherwise specified in the solicitation. As a minimum, offers must show--
(1) The solicitation number;
(2) The time specified in the solicitation for receipt of offers;
(3) The name, address, and telephone number of the offeror;
(4) A technical description of the items being offered in sufficient detail to evaluate compliance with the requirements in the solicitation. This may include product literature, or other documents, if necessary;
(5) Terms of any express warranty;
(6) Price and any discount terms;
(7) "Remit to" address, if different than mailing address;
(8) A completed copy of the representations and certifications at FAR 52.212-3 (see FAR 52.212-3(b) for those representations and certifications that the offeror shall complete electronically);
(9) Acknowledgment of Solicitation Amendments;
(10) Past performance information, when included as an evaluation factor, to include recent and relevant contracts for the same or similar items and other references (including contract numbers, points of contact with telephone numbers and other relevant information); and
(11) If the offer is not submitted on the SF 1449, include a statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation. Offers that fail to furnish required representations or information, or reject the terms and conditions of the solicitation may be excluded from consideration.
(c) Period for acceptance of offers. The offeror agrees to hold the prices in its offer firm for 30 calendar days from the date specified for receipt of offers, unless another time period is specified in an addendum to the solicitation.
(d) Product samples. When required by the solicitation, product samples shall be submitted at or prior to the time specified for receipt of offers. Unless otherwise specified in this solicitation, these samples shall be submitted at no expense to the Government, and returned at the sender's request and expense, unless they are destroyed during preaward testing.
(e) Multiple offers. Offerors are encouraged to submit multiple offers presenting alternative terms and conditions or commercial items for satisfying the requirements of this solicitation. Each offer submitted will be evaluated separately.
(f) Late submissions, modifications, revisions, and withdrawals of offers:
(1) Offerors are responsible for submitting offers, and any modifications, revisions, or withdrawals, so as to reach the Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that offers or revisions are due.
(2)(i) Any offer, modification, revision, or withdrawal of an offer received at the Government office designated in the solicitation after the exact time specified for receipt of offers is “late” and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; and--
(A) If it was transmitted through an electronic commerce method authorized by the solicitation, it was received at the initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day prior to the date specified for receipt of offers; or
(B) There is acceptable evidence to establish that it was received at the Government installation designated for receipt of offers and was under the Government's control prior to the time set for receipt of offers; or
(C) If this solicitation is a request for proposals, it was the only proposal received.
(ii) However, a late modification of an otherwise successful offer, that makes its terms more favorable to the Government, will be considered at any time it is received and may be accepted.
(3) Acceptable evidence to establish the time of receipt at the Government installation includes the time/date stamp of that installation on the offer wrapper, other documentary evidence of receipt maintained by the installation, or oral testimony or statements of Government personnel.
(4) If an emergency or unanticipated event interrupts normal Government processes so that offers cannot be received at the Government office designated for receipt of offers by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of offers will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.
(5) Offers may be withdrawn by written notice received at any time before the exact time set for receipt of offers.
Oral offers in response to oral solicitations may be withdrawn orally. If the solicitation authorizes facsimile offers, offers may be withdrawn via facsimile received at any time before the exact time set for receipt of offers, subject to the conditions specified in the solicitation concerning facsimile offers. An offer may be withdrawn in person by an offeror or its authorized representative if, before the exact time set for receipt of offers, the identity of the person requesting withdrawal is established and the person signs a receipt for the offer.
(g) Contract award (not applicable to Invitation for Bids). The Government intends to evaluate offers and award a contract without discussions with offerors. Therefore, the offeror's initial offer should contain the offeror's best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in offers received.
(h) Multiple awards. The Government may accept any item or group of items of an offer, unless the offeror qualifies the offer by specific limitations. Unless otherwise provided in the Schedule, offers may not be submitted for quantities less than those specified. The Government reserves the right to make an award on any item for a quantity less than the quantity offered, at the unit prices offered, unless the offeror specifies otherwise in the offer.
(i) Availability of requirements documents cited in the solicitation. (1)(i) The GSA Index of Federal Specifications, Standards and Commercial Item Descriptions, FPMR Part 101-29, and copies of specifications, standards, and commercial item descriptions cited in this solicitation may be obtained for a fee by submitting a request to--GSA Federal Supply Service Specifications Section, Suite 8100, 470 East L'Enfant Plaza, SW, Washington, DC 20407, Telephone (202) 619-8925, Facsimile (202) 619-8978.

The offeror shall enter, in the block with its name and address on the cover page of its offer, the annotation “DUNS” or “DUNS +4” followed by the DUNS or DUNS +4 number that identifies the offeror's name and address. The DUNS +4 is the DUNS number plus a 4-character suffix that may be assigned at the discretion of the offeror to establish additional SAM records for identifying alternative Electronic Funds Transfer (EFT) accounts (see FAR Subpart 32.11) for the same concern. If the offeror does not have a DUNS number, it should contact Dun and Bradstreet directly to obtain one.
