SECTION M - EVALUATION FACTORS FOR AWARD
The following have been modified:
52.212-2 EVALUATION--COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES (NOV 2021)
(a) The Government will award a contract to the lowest priced technically acceptable proposal. Proposals will be evaluated for technical acceptability. In order for an Offeror to be considered for award, the proposal must receive an “Acceptable” rating. A proposal receiving a rating of “Unacceptable” will not be eligible for award.
FACTOR 1 - TECHNICAL CAPABILITY
To be determined technically acceptable the offeror must provide documentation that demonstrates that the offeror can provide the necessary supplies as outlined in the statement of work.
FACTOR 2 – PRICE
Pricing shall be provided for all line items listed. An authorized official of the firm shall sign the SF 1449 and all solicitation amendments (if any).
(b) Options. The government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the government to exercise the option(s).
For each fuel delivery, the contractor will be paid the market price for the diesel #2, plus the per gallon markup rate applicable to the delivery location. The lowest quote will be evaluated based on the fixed mark up rate for each location listed in the bid schedule. Quotes will be examined to determine the extent to which quoted prices are comparable with the government estimates, previous procurement history, and a determination made of Price Reasonableness. The government may reject any price quote that is determined to be Not Fair and Reasonable, unrealistically high, or low in price when compared to government estimates, or are unbalanced, such that the price quote is deemed to reflect an inherent lack of competence or failure to comprehend the requirements.
AWARD:
It is incumbent upon the offeror to submit sufficient documentation and information for the government to determine technical acceptability and the quoted pricing. Failure to submit sufficient information for the government to determine technical acceptability and price may be cause for rejection of your quote.
Award will be made to the contractor whose price is the lowest of all offers determined to be technically acceptable.
The Government will evaluate the lowest priced offer for technical acceptability. If the lowest priced offer is determined to be unacceptable, the next lowest offer will be evaluated for technical acceptability until an acceptable offer is determined.
(c) A written notice of award or acceptance of an offer mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party.
Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
