PLUM0198-005 07/01/2014. PLUM is an abbreviation identifier of the union which prevailed in the survey for this classification, which in this example would be Plumbers. 0198 indicates the local union number or district council number where applicable, i.e., Plumbers Local 0198. The next number, 005 in the example, is an internal number used in processing the wage determination. 07/01/2014 is the effective date of the most current negotiated rate, which in this example is July 1, 2014.
Union prevailing wage rates are updated to reflect all rate changes in the collective bargaining agreement (CBA) governing this classification and rate.
Survey Rate Identifiers
Classifications listed under the ""SU"" identifier indicate that no one rate prevailed for this classification in the survey and the published rate is derived by computing a weighted average rate based on all the rates reported in the survey for that classification. As this weighted average rate includes all rates reported in the survey, it may include both union and non-union rates. Example: SULA2012-007 5/13/2014. SU indicates the rates are survey rates based on a weighted average calculation of rates and are not majority rates. LA indicates the State of Louisiana. 2012 is the year of survey on which these classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination. 5/13/2014 indicates the survey completion date for the classifications and rates under that identifier.
Survey wage rates are not updated and remain in effect until a new survey is conducted.
Union Average Rate Identifiers
Classification(s) listed under the UAVG identifier indicate that no single majority rate prevailed for those classifications; however, 100% of the data reported for the classifications was union data. EXAMPLE: UAVG-OH-0010 08/29/2014. UAVG indicates that the rate is a weighted union average rate. OH indicates the state. The next number, 0010 in the example, is an internal number used in producing the wage determination. 08/29/2014 indicates the survey completion date for the classifications and rates under that identifier.
A UAVG rate will be updated once a year, usually in January of each year, to reflect a weighted average of the current negotiated/CBA rate of the union locals from which the rate is based.
WAGE DETERMINATION APPEALS PROCESS
1.) Has there been an initial decision in the matter? This can be:
* an existing published wage determination
* a survey underlying a wage determination
* a Wage and Hour Division letter setting forth a position on a wage determination matter
* a conformance (additional classification and rate) ruling
On survey related matters, initial contact, including requests for summaries of surveys, should be with the Wage and Hour Regional Office for the area in which the survey was conducted because those Regional Offices have responsibility for the Davis-Bacon survey program. If the response from this initial contact is not satisfactory, then the process described in 2.)
and 3.) should be followed.
With regard to any other matter not yet ripe for the formal process described here, initial contact should be with the Branch of Construction Wage Determinations. Write to:
Branch of Construction Wage Determinations Wage and Hour Division U.S. Department of Labor 200 Constitution Avenue, N.W.
Washington, DC 20210
2.) If the answer to the question in 1.) is yes, then an interested party (those affected by the action) can request review and reconsideration from the Wage and Hour Administrator (See 29 CFR Part 1.8 and 29 CFR Part 7). Write to:
Wage and Hour Administrator U.S. Department of Labor 200 Constitution Avenue, N.W.
Washington, DC 20210
The request should be accompanied by a full statement of the interested party's position and by any information (wage payment data, project description, area practice material, etc.) that the requestor considers relevant to the issue.
3.) If the decision of the Administrator is not favorable, an interested party may appeal directly to the Administrative Review Board (formerly the Wage Appeals Board). Write to:
Administrative Review Board U.S. Department of Labor 200 Constitution Avenue, N.W.
Washington, DC 20210
4.) All decisions by the Administrative Review Board are final.

INSTRUCTIONS OF AWARD
PHASE I SOLICITATION PROVISIONS
1. PROPOSAL SUBMISSION INSTRUCTIONS
1.1. General: This request for proposal (“RFP”) seeks proposals from Offerors interested in being selected for design-build construction of New Parking Garage at the G.V. Montgomery VA Medical Center. Offerors responding to this RFP are required to submit their proposals in accordance with the instructions contained in this section.
This is Phase I of a Two-Phase RFP issued in accordance with FAR Subpart 36.3. This RFP is requesting submission of proposals under Phase I submission criteria ONLY. After evaluating Phase I proposals, the contracting officer will select the most highly qualified Offerors and request that only those Offerors submit proposals for Phase II. It is the Government’s intention to advance up to five of the most highly qualified Offerors from Phase I to Phase II.
Offerors shall not submit any proposals under Phase II submission criteria at this time. Phase II of the solicitation will be issued in an amendment directly to those Offerors selected for Phase II. Submitting any information under Phase II criteria may lead to disqualification of your proposal. This is a Total Service- Disabled Veteran-Owned Small Business competitive RFP. Offerors responding to this RFP are required to submit their proposals in accordance with the instructions contained in this section.
The work is summarized as follows: The contract will include design and subsequent construction of a new approximately 42,260 gross square foot (133’x122’) parking garage at the G.V. Montgomery VA Medical Center in Jackson. Construction will be on an existing parking lot; however, a third-party contractor will provide off-site parking during construction of new parking garage. The project includes the construction of a new parking garage that, at a minimum, includes the following: parking for up to 464 vehicles; ability to add up to two (2) more levels later. The project also includes demolition/removal of existing items that are located within the footprint of the proposed parking garage. This includes, but not limited to, excavation required to construct the foundation, removal of asphalt, removal of concrete curb and gutter, etc.
This project shall be designed in accordance with the ADA parking stalls per local, state and federal regulations;
landscaping and lighting; emergency communication and security system; parking management system with programmable LED signage; fire protection system per local, state, and federal regulations; antiterrorism features per FEMA-426/BIPS-06/October 2011, and betterments where feasible.
1.2. Basis for Award: This is a competitive acquisition for the award of a firm-fixed-price design-build contract. A contract will be awarded to the Offeror whose proposal represents the “Best Value” to the Government in Phase I and II. The best value determination will be based on a comparative assessment of proposals against all source selection criteria in the solicitation, considering recommendations and minority opinions presented to the SSA.
While the SSA may use reports and analyses prepared by others, the source selection decision shall represent the SSA's independent judgment. The evaluation factors applicable to this procurement appear below.
PHASE I
Factor 1 - Recent/Relevant Experience Subfactor 1 Prime Contractor Experience (Offeror only) Subfactor 2 Lead Design Firm Experience (Offeror or Subcontractor) Subfactor 3 Key Subcontractor Experience (Subcontractor) Subfactor 4 Key Personnel (Offeror and Subcontractor) Factor 2 - Past Performance Factor 3 - Project Management Plan
"Revised by Amendment 0002"
The parking garage shall provide a total minimum of 350 spaces and 16 ADA spaces meeting the requirements described in the solicitation.
Additional spaces above the minimum number required but within the project budget will be reviewed favorably as described in the evaluation criteria.

PHASE II
Factor 1 - Number of Parking Spaces Factor 2 - Design Narratives Subfactor 1 Civil and Architectural Design Subfactor 2 Geotechnical and Structural Design Subfactor 3 Mechanical Electrical Design Factor 3 - Renderings and Drawings Subfactor 1 Site and Architectural Drawings Subfactor 2 Civil and Structural Drawings Factor 4 - Parking and Shuttle Service Factor 5 - Project Schedule
Each factor is rated individually based on the information contained in that specific factor; that is, evaluations will not be made across the factors.
For Phase I, Factors 1, 2, and 3 will be adjectivally rated. Factors 1 (Experience) and 2 (Past Performance) are of equal importance. Factor 3 (Project Management Plan) is of lesser importance than Factors 1 and 2 combined. Within Factor 1, all subfactors are of equal importance.
For Phase II, Factor 1 is considered of significant importance above Factors 4 and 5 and equal in importance to Factors 2 and 3. Therefore, Factors 2 and 3 are each equal in importance to Factor 1 except in the case of a tie. Factors 1, 2, and 3 are each above importance to Factors 4 and 5. Factors 4 and 5 are of equal importance. If proposals are considered technically equal, Factor 1 will be used to break a tie to determine the best technical proposal. All subfactors are of equal importance within each factor.
1.3. Source Selection: It is intent of the Government to seek proposals from qualified Offerors with experience in the significant features of this RFP and who can demonstrate a successful performance history in completing relevant projects. For the purposes of this solicitation, the Government will utilize the Trade-Off Process. The successful Offeror will be selected based on the “Best Overall Value to the Government”. The Government will not make an award at a significantly higher price to obtain only slightly superior technical advantages; however, the degree of importance of price as a factor could become greater depending upon the equality of the proposals submitted.
Where the technical merits of competing proposals are determined to be substantially equal, price could become the controlling factor.
1.4. Each Offeror is required to submit a proposal consisting of the following volumes (binders):
a. Phase I: Volume I – Experience Proposal, Phase I (Factors 1-3), (original and four copies)

2. SUBMISSION CRITERIA
2.1. VOLUME I – MINIMUM SUBMISSION CRITERIA (EXPERIENCE PROPOSAL, FACTORS 1-3): For purposes of this solicitation, an “Offeror” may include a group of two (2) or more entities that have formed a “contractor team arrangement,” as that term is defined in the Federal Acquisition Regulation, Part 9.6. In the case of entities that have formed a contractor team arrangement, the experience and performance history of any member of the team, whether or not gained while working with the other member(s) of the currently-proposed contractor team arrangement, will be considered as a part of the evaluation of the Offeror’s proposal.
An Offeror that relies upon the experience and performance history of a member, members or affiliates of a proposed contractor team arrangement must provide a teaming agreement or commitment (in the case of any affiliates) signed by all parties. The Teaming agreement/commitment shall:
a. Identify the legal name(s) and cage code(s) of all entities.
b. Describe the nature of each entity’s relationship (partnership, joint venture, prime/sub or mentor/protégé) and their role on this project as a part of their proposal. The Offeror will be expected to maintain that arrangement during performance of any contract awarded to that Offeror under this solicitation.
c. The estimated percentage of work to be completed by each member submitted for the solicitation.
This can be a rough order of magnitude for Phase I; however, this agreement/letter must be resubmitted with Phase II to include that actual proposed percentages.
In the case of affiliates, past performance of an Offeror’s “affiliate,” as that term is defined in FAR 2.101, will be evaluated (as described within this section) if the Offeror demonstrates a firm commitment that the affiliate will participate meaningfully (e.g. roles, responsibilities, etc.) in the performance of the contract. This commitment, nature of each entity’s relationship and meaningful participation shall be described in a document signed by authorized representatives of both the Offeror and its affiliate. If a teaming agreement or commitment is not provided, the projects of any team members outside of the Prime Offeror will not be considered.
The contractor team agreement/commitment shall be provided at the beginning of the Offeror’s technical proposal, prior to Factor 1, and will not be included in the overall page count.
The following are to be used in determining the status of the Offeror’s team for the evaluation of project submissions under Factor 1:
• In the case of contractor team arrangements involving a Prime Contractor and Subcontractor(s), where the Prime Contractor submits the proposal in response to this solicitation, the Prime Contractor is considered the “Prime Offeror”.
• In the case of joint ventures, the “Prime Offeror” experience can come from any of the entities involved in the venture.
• In the case of mentor/protégé relationships, the relationship must be established by the two Offerors and approved by the chosen Government Agency prior to proposal submission. Once the relationship has been approved, the “Prime Offeror” experience can come from any of the entities involved in the relationship. The approved mentor/protégé document from the Government Agency must be submitted along with the teaming agreement.
• In the case of additional projects submitted by subcontractors, the subcontractor must submit the final cost of their portion of the project along with total project cost and all other required information.
• In the case of Offerors that are large, multi-function firms (consisting of subsidiaries), experience must only be submitted by the segment of the firm (e.g., division, group, and unit) that is submitting a proposal in response to this solicitation.
• In the case of affiliates, Past performance of an Offeror's "affiliate," as that term is defined in FAR 2.101, will be evaluated (as described within this section) if the Offeror demonstrates a firm commitment that the affiliate will participate meaningfully in the performance of the contract. This commitment and meaningful participation shall be described in a document signed by authorized representatives of both the Offeror and its affiliate.
If a teaming agreement or commitment is not provided, the projects of any team members outside of the Prime Offeror will not be considered. If the Joint Venture/Mentor Protege is a Small and Large business, the Small Business will be evaluated as the Prime Offeror. Offerors submitting as joint ventures should provide sufficient information demonstrating each partner’s experience or role on this project.
2.2. FACTOR 1 – RECENT/RELAVENT EXPERIENCE: The submitted material MUST be organized sequentially under tabs for each numbered section to facilitate evaluation. All narratives must contain sufficient detail to demonstrate technical capability.
2.2.1. EXPERIENCE IN RELEVANT PROJECTS: The Offeror shall submit information on Recent relevant projects are defined as multilevel concrete parking garages and multilevel concrete structures which requires large structural concrete placements or coordination and installation of pre-cast members completed within the last 10 years. Multi-level structure projects with large structural concrete placements or pre-cast members
"Revised by Amendment 0002" is considered more relevant than multi-level structure with minimal concrete placements and pre-cast members. Parking garage projects are considered more relevant than multi-level concrete structures with design-build parking garage projects considered most relevant. Experience with Federal Government or US Army Corps of Engineers (USACE) projects similar in type, size, and complexity as well as projects greater than $10M will be given additional weight. Offerors submitting as joint ventures should provide sufficient information demonstrating each partner’s experience or role on this project and address the discussions requested on Attachment A while meeting the teaming agreement requirements in section 2.1 above.
If the Offeror’s submission exceeds the maximum project limitation of five completed projects, the first 5 projects submitted will be evaluated only, while the remaining additional project(s) will not be evaluated.
It is the responsibility of the Offeror to identify, detail and demonstrate the relevancy of the submitted projects to the solicitation criteria elements. The evaluation committee WILL NOT make assumptions. If projects submitted have comparable scope to this solicitation including warehouse construction experience, full building demolition experience, and working within secure facilities (e.g., restricted site access, vetting of employees, clear background checks, security coordination/escorting) it may demonstrate a potential increase ability of successful contract performance.
