About this file
This document is Standard Form 30 (SF 30), an Amendment of Solicitation/Modification of Contract issued by the U.S. Army Corps of Engineers (USACE) Engineering Support Center located at Redstone Arsenal, Alabama. The amendment number is 0001, with an effective date of 06 May 2026, and applies to solicitation W912DY26QA124, originally dated 23 April 2026.
The sole purpose of this amendment is to incorporate Federal Acquisition Regulation (FAR) clause 52.222-90, "Addressing DEI Discrimination by Federal Contractors" (Deviation 2026-O0038), effective April 2026, into the solicitation. The clause prohibits contractors and subcontractors from engaging in racially discriminatory diversity, equity, and inclusion (DEI) activities, defined as disparate treatment based on race or ethnicity in recruitment, employment, contracting, program participation, or resource allocation. Contractors must furnish requested information and reports to demonstrate compliance, report subcontractor violations to the Contracting Officer, and include the clause substance in all subcontracts at any tier (except those with performance outside the United States). Noncompliance may result in contract cancellation, termination, suspension, or contractor ineligibility for future Government contracts. The clause is material to the Government's payment decisions under 31 U.S.C. 3729(b)(4). All other terms and conditions of the original solicitation remain unchanged. Offerors must acknowledge receipt of this amendment prior to the solicitation deadline using one of three specified methods.
