(d) Excluded Parties List System (EPLS).

(5) Contractors shall affirmatively state that the offer including pricing will be valid for 60 days from the date or quote submission.

4. EVALUATION CRITERIA/FACTORS

The Government will conduct evaluations in accordance with FAR subpart 8.4. The Government intends to evaluate quotes and award a contract without exchanges with the Contractor, unless needed.

The Government will evaluate all aspects of the price quote for fairness and reasonableness.

The Government may determine that a quote is unacceptable if the prices proposed are materially unbalanced between line items or subline items. Unbalanced pricing exists when, despite an acceptable total evaluated price, the price of one or more line items is significantly overstated or understated as indicated by the application of cost and/or price analysis techniques. A quote may be rejected if the Contracting Officer determines that the lack of balance poses an unacceptable risk to the Government.

The evaluation factors are as follows:

1. Factor 1, Technical Approach

2. Factor 2, Price

a. Factor 1—Technical Approach

The technical approach narrative will be evaluated for technical feasibility and thoroughness and adherence to the requirements of the Performance Work Statement), and to assess the Contractor’s understanding of the work. Sufficient details should be provided to allow the government to assess the nature and quality of services being proposed. Specifically, the technical proposal shall address the following elements:

2. Performance Plan – The Contractor shall provide in narrative form its technical approach to meet the PWS requirements. The Contractor shall include:

b. A narrative explanation of how the Contractor intends to perform maintenance and landscaping activities.

c. A narrative explanation of how the Contractor intends to assure quality control.

Contractors should describe the quality control approach, corporate systems, and capabilities to maintain quality control.

d. A narrative explanation of how the Contractor intends to assure safe performance.

Contractors should describe the safety approach, corporate systems, and capabilities to maintain safe working environments.

The adjectival rating scale to be applied for Factor I, Technical, will be used to determine whether the Contractor’s proposal meets the requirements of the RFP. Proposals must receive a technical rating of acceptable to be eligible for award. See Table 1 below for descriptions of the adjectival ratings.

The Government will evaluate Factor I using the following adjectival ratings:

b. Factor 2—Price and Rates, Attachment 1

The Contractor must provide a firm-fixed-price proposal.

The price proposal must be provided in the attached Microsoft Excel workbook.

Contractors are responsible for verifying the accuracy of the formulas in the workbook.

If a Contractor discovers any formula errors within the Workbook, it is requested to notify the Contracting Specialist and Contracting Officer as soon as possible. Any formula changes made to the Pricing Workbook must be explained by inserting a note on the appropriate worksheet within the Workbook. . The format should remain unchanged, size (11x17) and margins should be .25 on all sides.

The Contractor must complete each worksheet of the pricing workbook. Pricing should reflect fully burdened rates including Overhead, G&A, Profit, Escalation, and Other Prime Contractor Markups embedded in the fully burdened rates.

Adjective Description

Acceptable Proposal meets requirements and indicates an adequate Approach and understanding of the requirements, and risk of unsuccessful performance is no worse than moderate.

Unacceptable Proposal does not meet the requirements of the solicitation, and thus, contains one or more deficiencies, and/or risk of unsuccessful performance is unacceptable. Proposal is not awardable.

(1) Direct Labor: The Contractor must propose labor rates for all direct labor categories. This rate represents work completed in the United States, its possessions, and territories.

(2) Travel: Information regarding travel can be found in the PWS.

5. BASIS OF AWARD

The Government intends to award a contract resulting from this solicitation to the responsible Contractor whose proposal represents the lowest price after being evaluated as technically acceptable in accordance with the PWS. In accordance with FAR 2.101, “Best value” means the expected outcome of an acquisition that, in the Government’s estimation, provides the greatest overall benefit in response to the requirement. Best value is expected to result from the selection of the technically acceptable proposal with the lowest evaluated price. The Government reserves the right to make a selection based upon initial proposal submission without exchanges. The Government also reserves the right to make no award.

6. ADMINISTRATIVE

a. Wage Determinations: Wage Determinations for the geographic area where the awarded work is to be performed will be incorporated by reference (see Attachment 2). A copy of the decision/determination is available at https://beta.sam.gov/search?index=wd. The labor rates in effect at the time this Purchase Order is awarded will remain in effect through completion of the project, unless modified due to an increase in the Department of Labor rates.

CLAUSES INCORPORATED BY FULL TEXT

52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

1. Factor 1, Technical Approach

2. Factor 2, Price

Technical is more important than price.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

(End of provision)

52.212-3 OFFEROR REPRESENTATIONS AND CERTIFICATIONS--COMMERCIAL ITEMS (OCT 2018)
