1. Objective: The U.S. Army Corps of Engineers (USACE), Learning Center (ULC), is tasked to develop, update, or revise, and present professional development training to employees located around the world through various modes of delivery. This contract is designed to provide training on HVAC Testing and Balancing Quality Verification (HVAC TAB QV) and HVAC Systems Commissioning.
2. Acquisition Approach: This is a “best value” competitive acquisition for the award of a firm-fixed price (FFP) contract. Award will be made to the best overall proposal, which is determined to be the most beneficial to the Government.
3. Contract Term: Contract will be for a base year (12 months), four (4) options years (12 months each), and one (1) six (6) month option to extend services. There is no guarantee that these options will be exercised.
4. Detailed price breakdown with tasks, position classification, estimated direct labor-hours, and profit for all phases and sub-phases of work. Include copies of your subcontractor quotes or a detailed breakdown of subcontractor costs, if any. Additionally, your proposal shall clearly state any assumptions, clarifications, or exceptions used in preparing your proposal.
5. The offeror’s past performance information shall be included within the proposal.

CONTACTS:
7. The contractor shall NOT engage into any form of contract with installation personnel regarding this requirement prior to submission of proposal and Contract Award. Contract regarding the requirements set forth in this RFP shall only occur with the Contracting Officer and Contract Specialist. Discussions or information obtained via other sources could make you ineligible for award if deemed a Conflict of Interest or a Violation of the Procurement Integrity Act.

(b) The Offeror represents that--
(1) It is [ ] is not [ ] a corporation that has any unpaid Federal tax liability that has been assessed, for which all judicial and administrative remedies have been exhausted or have lapsed, and that is not being paid in a timely manner pursuant to an agreement with the authority responsible for collecting the tax liability; and
(2) It is [ ] is not [ ] a corporation that was convicted of a felony criminal violation under a Federal law within the preceding 24 months.
(End of provision)
52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
The award will be made based on the best overall (i.e., best value) proposals that are determined to be the most beneficial to the Government, with appropriate consideration given to the following four evaluation factors: 1) Technical Capability, 2) Technical Experience, 3) Past Performance of Similar Projects, and 4) Price.
FACTOR 1 – TECHNICAL CAPABILITY
The offeror shall briefly describe the lab equipment including a summary of how each individual lab station is configured including a photograph of each station and the overall facility including the proposers past experience with this type of lab/training arrangement.
Element 1: Facilities – The Government will evaluate the offeror’s proposed classroom and HVAC laboratory to ensure they are adequate for the HVAC Testing and Balancing Quality Verification (QV) and HVAC Systems Commissioning courses. The Government will consider if the proposed facilities are adequate in accordance with the requirements stated on the PWS paragraphs 2.1 and 2.3.
Element 2: Equipment – The Government will evaluate if the offeror has the necessary equipment as identified in the PWS paragraphs 2.4.2, 2.4.5 and Appendix 3.. The Government will consider if the proposed equipment will work and if it will likely achieve the desired outcome.
This factor will receive one of the adjectival ratings described in the DoD Source Selection Procedures which focuses on the strengths, weaknesses and deficiencies of the offeror’s proposal. The color rating depicts how well the offeror’s proposal meets requirements. In arriving at a best value decision, the Government reserves the right to give positive consideration for performance in excess of threshold requirements, up to the objective requirements. No further positive considerations will be given for performance in excess of the objective requirements.
Table 1. Technical Capacity/Risk Rating Method
Color Rating
Adjectival
Description
Blue Outstanding Proposal indicates an exceptional approach and understanding of the requirements and contains multiple strengths, and risk of unsuccessful performance is low.
Purple Good Proposal indicates a thorough approach and understanding of the requirements and contains at least one strength, and risk of unsuccessful performance is low to moderate.
Green Acceptable Proposal meets requirements and indicates an adequate approach and understanding of the requirements, and risk of unsuccessful performance is no worse than moderate.
Yellow Marginal Proposal has not demonstrated an adequate approach and understanding of the requirements, and/or risk of unsuccessful performance is high.
Red Unacceptable Proposal does not meet requirements of the solicitation, and thus, contains one or more deficiencies, and/or risk of unsuccessful performance is unacceptable. Proposal is unawardable.
FACTOR 2 – TECHNICAL EXPERIENCE
The offeror shall list the working experience of no less than eight laboratory instructors (four per course) and provide a brief description of their prior teaching experience.
