When hiring personnel, the Contractor shall keep in mind that the stability and continuity of the work force are essential.

1.7 WORK RESTRICTIONS: There may be mission situations that require the contractor to work other than normal duty hours. Examples of these situations are military exercises, contingency operations, or weather emergencies. When access to a work area conflicts with an installation mission requirement, work shall be scheduled to minimize the disruption. Such scheduling may require work to be accomplished at times other than normal duty hours. The Contractor will schedule work activities to minimize impact on the Military Treatment Facility (MTF).

1.8 SAFETY AND HEALTH PROGRAM: Site Activities in conjunction with this program may pose safety and health hazards, which require specialized expertise to effectively address and eliminate. The Contractor shall be responsible for the following:

1.8.1 General: The Contractor shall provide safety and health program management in accordance with the US Army Corps of Engineers Safety and Health Requirements Manual (EM 385-1-1, 30 November 2014), Section 01.

1.8.2 Safety Health Program: The Contractor is required by regulation to develop and maintain a written Safety and Health Program (SHP) in compliance with the requirements of the Occupational Safety and Health Administration (OSHA), the U.S. Army Corps of Engineers (USACE) and Federal Acquisition Regulation (FAR) safety and health requirements, the NFPA National Fire Codes, 29 CFR 1910, 29 CFR 1926, 29 CFR 1904, AR 385- 10 and EM 385-1-1. The Contractor shall submit this plan to the KO for review within 30 calendar days after contract award and prior to the commencement of any work under the awarded contract.

1.8.3 Accident Prevention Plan: Submit an accident prevention plan to the KO within 10 calendar days after the task/delivery order award. Accident Prevention Plans (APP) shall address applicable items listed in Appendix A of the US Army Corps of Engineers Safety and Health Requirements Manual (EM 385-1-1) in addition to the other applicable requirements of EM 385-1-1 and OSHA requirements. An APP is, in essence, a safety and health policy and program document. The plan shall be job-specific and shall also address any unusual or unique aspects of the project or activity for which it is written. The APP is a document that details how the safety and health requirements of OSHA; other regulatory codes and documents; and the U.S. Army Corps of Engineers Safety and Health Requirements Manual, EM 385-1-1 are to be implemented at this project site. It is a living document and shall represent real/present site conditions and safe worker practices.

1.8.4 Activity Hazard Analysis: An AHA shall be prepared and documented for all field operations. Develop an Activity Hazard Analysis (AHA) for each principal step of the work. Detail the work phase, the associated hazards, and the corrective measures used to minimize or eliminate the hazards. Before beginning each work activity involving a type of work presenting tasks and hazards not experienced in previous project operations or where a new work crew or sub-contractor is to perform work, the Contractor performing that work activity shall prepare an AHA.

AHAs will define the activities being performed and identify the sequences of work, the specific hazards anticipated, the site conditions, equipment, materials, and the control measures to be implemented to eliminate or reduce each hazard to an acceptable level of risk. Work will not begin until the AHA for the work activity has been accepted by the Huntsville Center Safety Office. AHAs shall be prepared in accordance with the US Army Corps of Engineers Safety and Health Requirements Manual (EM 385-1-1).

1.8.5 Site Safety and Health Officer: The Contractor shall employ a qualified and competent person at each project to function as the Site Safety and Health Officer (SSHO). The SSHO will manage the Contractor's APP. For personnel qualifications see the US Army Corps of Engineers Safety and Health Requirements Manual (EM 385-1- 1), Ol.A.l7. This duty is a full time responsibility unless otherwise specified in the contract. This position must be approved by the Huntsville Center Safety Manager.

1.8.6 Safety Training: The Contractor is responsible for providing employee training in accordance with the US Army Corps of Engineers Safety and Health Requirements Manual (EM 385-1-1), Section Ol.B.

1.8.7 Hazardous Materials: In the event that hazardous materials (asbestos, mold, lead-based paint, etc.) are encountered, the Contractor shall immediately stop all work and notify the KO, Contracting Officer's Representative (COR), and the Facility Manager in writing within 24 hours. Remaining work shall not commence until written notification from the KO.

1.8.8 Accident Experience and Exposure: In accordance with Engineer Manual (EM) 385-1-1, complete a monthly summary report of accident experience and exposure on the electronic data collection tool provided by the Huntsville Center Safety Office, and forward to the Government Designated Authority no later than close of business (COB) the 10th calendar day of the following month. The Government Designated Authority will be identified in the individual delivery orders.

1.9 PERSONNEL: For purposes of this contract, the term "Contractor Personnel" applies to all contractor employees, subcontractor employees, or any other person(s) acting for or on behalf of the contractor to perform work on this contract.

1.9.1 Contractor Personnel: The Contractor shall have demonstrated knowledge of codes, standards, directives, and criteria governing and related to healthcare facilities, including Army requirements, The Joint Commission (TJC) or the Accreditation Association for Ambulatory Health Care (AAAHC) as applicable, National Fire Protection Association (NFPA), Occupational Safety and Health Administration (OSHA), and the Environmental Protection Agency (EPA). The Contractor will remain abreast of any changes in codes which impact work under this contract and will notify the KO when modifications may be needed to ensure that upon the completion of a task order the facility is fully code compliant.

1.9.2 Contractor Key Personnel Replacement: The Contractor shall notify the Government of any key personnel changes. For temporary and/or permanent replacement of Key Personnel, the Contractor shall provide a resume for each individual to the KO. Resumes shall be provided at least two weeks (or as mutually agreed upon) prior to making any personnel changes. The Government reserves the right to disapprove any changes that are not in the best interest of the Government. Any replacement personnel shall have equal or better qualifications than the individual being replaced.

1.9.3 Conflict of Interest: The Contractor shall not employ, hire, or contract with employees of the United States Government or the Department of Defense, either military or civilian, if such employment would create a conflict of interest. The Contractor shall not employ any person who is an employee of the Department of Defense, unless such person receives prior approval, in writing, from the KO or designated representative.

1.9.4 Conduct of Personnel: The KO or designated representative may require the Contractor to remove from the job site any employee working under this contract for reasons of misconduct, security violations, or found to be or suspected to be under the influence of alcohol, drugs, or other incapacitating agent.
