EXCEPTION TO FAIR OPPORTUNITY
Emergency Repairs to the Fire Protection System of Bldg. 4055, Fort Wainwright Alaska
1. CONTRACTING AGENCY: United States Army Corps of Engineers, Huntsville Engineering and Support Center (CEHNC) located at 4280 University Square, Huntsville, AL 35816-1822. This Justification for an Exception to Fair Opportunity (EFO) is authorized under FAR) 16.505(b)(2)(i)(C) “Logical Follow-on.”
2. DESCRIPTION OF ACTION: This EFO is for the emergency repairs of the fire protection system and areas of Building 4055 that were damaged by a water pipe that had burst.
3. DESCRIPTION OF SUPPLIES: Task Order W912DY-15-D-0011 Task Order 006 was awarded utilizing fair opportunity under the UMCS-IV Unrestricted/Restricted Multiple Award Task Order Contracts (MATOCs) on 15 July 2015 in the amount of $1,661,770.26.
The task order was awarded to SEI Group, Inc. to furnish and install a fire alarm detection and protection system for Bldgs. (Barracks) 4062/3/4, 3726, 3562 and 3004. One subsequent modification was awarded correcting the period of performance date from 20 October 2015 to 20 October 2016. Funding for this action is O&M funds (2015) from Ft. Wainwright, Alaska.
Building 4055 is a barracks housing soldiers on Ft Wainwright. A dry sprinkler pipe in the attic filled with water and froze over during the winter months, bursting the pipe. With warmer temperatures, the pipe thawed, releasing large amounts of water in the eastern half of the building. Prior to the water being turned off stopping the leak, the fire alarm panel was flooded, and the field devices in the east half were ruined. These items cannot be repaired and must be replaced in order for the fire protection system to become operable. Also, the attic pipe that burst needs to be repaired, and the area of ceiling that was ruined by the water leak must be repaired.
The tenants of Bldg. 4055 have been moved out and will not be allowed back into the building until all repairs are made and accepted by the Ft. Wainwright Fire Chief. Building 4055 and its fire protection system is identical to the buildings currently under contract by this task order for the fire alarm system upgrades and sprinkler installations.
4. IDENTIFICATION OF THE EXCEPTION TO FAIR OPPORTUNITY: Federal Acquisition Regulation (FAR) 16.505(b)(2)(i)(C) “Logical Follow-on.” The current task order did not anticipate the need for emergency repairs for any buildings on Ft. Wainwright, thus no provisions were made at the time of task order award. However, the pipe break and subsequent water flooding has rendered the fire alarm system inoperable in Bldg. 4055, leaving the building uninhabitable due to safety requirements and placing a burden on Ft. Wainwright to find housing for the displaced soldiers. Utilizing the “Logical Follow-on” authority to repair the fire alarm system, broken piping, and ruined ceiling is in the best interest of the Government, based on the economy and efficiency that will be provided by having the contractor, SEI Group, Inc., complete the necessary work for Building 4055. SEI Group, Inc. already has qualified personnel on site at Ft. Wainwright executing similar work in other buildings near Bldg. 4055 as part of this task order. Utilizing the personnel already on site eliminates the need for additional ramp up time, travel time and costs, additional overhead costs and the additional costs associated in the preparation of deliverables such as Technical Data Packages and Safety Plans that would be required with awarding another contractor the requirement to perform the emergency repairs to Bldg. 4055. In addition to cost savings, awarding the Logical Follow-On to SEI Group, Inc. will eliminate the potential for conflict between two contractors, should any issues arise regarding the performance/integration of the fire protection systems within Ft. Wainwright.
The replacement of the fire alarm system and fire protection system is within the scope of SEI Group’s base contract and is identical to the work being executed under this task order. The estimated value of the replacement as a percentage of the total value of the task order is a 15% increase, and the work to be performed is so closely associated with the current task order requirement that separating out the effort would reduce economy and efficiency.
5. Fair and Reasonable Cost Determination:
“I hereby determine that the anticipated price to the Government for this contract action is fair and reasonable. Price reasonableness will be determined by using technical and cost analysis and through comparison to historical data.”

7. Efforts to Obtain Competition: In accordance with FAR 16.505(b)(1)(i), a task order exceeding $3,000.00 is placed on a competitive basis if the contracting officer provides a fair notice of the intent to make the purchase, including a description of the supplies to be delivered or the services to be performed and the basis upon which the contracting officer will make the selection, and affords all contractors responding a fair opportunity to submit an offer and have that offer fairly considered. Task Order W912DY-15-D-0011 Task Order 0006 was awarded utilizing Fair Opportunity standards. All contractors in the UMCS-IV Unrestricted and Restricted MATOCs were provided fair opportunity to propose on the task order. Six proposals were received: Evergreen, EXP, Honeywell, Siemens, SSI and SEI. No further efforts to obtain competition were contemplated for the emergency repair requirement based on the emergency nature of the work, the geographic location of where the work is to be performed and the estimated cost associated with the emergency repairs. Modifying the existing task order as a “Logical Follow-on” to have SEI Group, Inc. make the necessary repairs to the fire protection system, piping and water damaged areas of Bldg. 4055 represents the best value for the Government considering cost, performance, and schedule.
