The solicitation states "Letters of commitment will need to be submitted for any key subcontractor from the firm and any key personnel." We do not anticipate problems with getting commitment letters from subconsultant firms, but are confused about the letters required from key personnel. All of our employees are "at-will" and are not under contract with the firm. They can leave the firm whenever they like and conversley, we can let them go for economic, workload, or other reasons. Will a letter from the firm committing their resources to this contract vs. letters from the key employees suffice?

4912146 Contracting Solicitation see the question Letters of Commitment

Comment Classification: Public (Public)

1.In the solicitation, it is sated that "Letters of commitment will need to be submitted for any key subcontractor from the firm and any key personnel" We have a team working together for a long time. Is that mean I should get commitment letter from each team member i.e structure engineer, electrical engineer etc.. 2.The solicitation states that "at least 50% of the work is required by employees of the prime contractor on a contract reserved for small business" However, as a prime and team leader, we cannot fulfill this requirement. We may do the work up to 30- 35% but not 50%. Thus, I wonder if you can drop this requirement or suggest otherwise.

On: Nov 20 2012.

Government Response. . Letters of committment are required for any key personnel not employed by the prime or key subcontractor. FAR 52.219-14 requires at least 50% of the work performed by employees of the prime contractor on a contract reserved for small business. This requirement cannot be waived.

However, a small business firm that cannot self perform 50% of the work can compete in the unrestricted portion of the requirement. On: Nov 27 2012

If we pursue a solicitation as a Joint Venture (JV), what level of documentation is normally expected? For example,

1. Should a JV agreement be in place? 2. Should a Fed ID number be applied and in place? 3. Should a DUNS number be in place? If the answers to 2 and 3 above are "yes", then when you look thru the ACASS system, you may not find any past experience - will this affect the normal selection process?

Under Selection Criteria 1 - Specialized Corporate Experience & Technical Competence it is stated that the submitting firm is to: "Provide a comprehensive description of how the Quality Control process will be executed including designation of the primary professionals who, apart from the key personnel design team members, will be responsible for quality review." If we are to identify the primary professionals who will be responsible for QC and who are independent of the design team members, are we not, then, supposed to include resumes for the QC professionals? ProjNet response #4913227 indicates that resumes for any additional team members not specifically requested would not be reviewed, but these would be team members key to the QC process. Question: The government's response to question 4907437 is NOT in compliance with the original or amended solicitation. The Amended (0003) Solicitation states: "The prime shall also submit letters of commitment for key personnel NOT currently employed by the prime or key subcontractor(s)". The government response gives the perception that a commitment letter is required for all key personnel. Which is it?

On: Nov 29 2012.

Government Response. . The question in #4907437 was "Will a letter from the firm committing their resources to this contract vs. letters from the key employees suffice?" The answer to that question is "No, letters of committment from key personnel is a requirment of the synopsis." meaning that letters from a firm cannot be submitted in lieu of a letters of committment from key personnel where required. Please see the latest amendment for the key personnel required to submit a letter of committment. On: Nov 30 2012
