Amendment 0001 to Solicitation W912DW26QA057

This is a Standard Form 30 amendment to solicitation W912DW26QA057, issued by the U.S. Army Corps of Engineers (USACE), Seattle District on 15 July 2026. The amendment extends the response due date from 20 July 2026 to 21 July 2026 and modifies key contract performance requirements.

The primary changes include: (1) extending the begin delivery lead time performance period from unspecified to Mandatory; (2) extending work completion from within 30 calendar days to within 47 calendar days after Notice to Proceed; and (3) adding a Q&A document (dated 15 July 2026) to the list of contract attachments. The solicitation involves equipment rental on a firm-fixed-price basis with estimated hourly rates. The amendment clarifies that payment will be made for actual hours worked at the quoted hourly rate, quantities can be modified only via supplemental agreement at the accepted hourly rate, and a single award will be made to the contractor providing all requisite items/equipment. The solicitation requires performance and payment bonds, as well as bid guarantees, pursuant to the Revolutionary FAR Overhaul Part 28 requirements for construction contracts exceeding $150,000. Offerors must acknowledge receipt of this amendment prior to the extended deadline of 21 July 2026.

1. Will the contract be awarded entirely to the lowest collective responsible, bidder, or will it be awarded as it has typically been awarded before to the lowest bidder for each piece of equipment?

(ANSWER) The intent is to make a single award to the quoter/bidder who provides all the requisite items/equipment. There is currently no intention to make multiple awards as a result of this solicitation.

2. Since these are being bid as firm fixed price per 1 Job, however, they are based on hourly estimates, in the event that the contractor is directed to use more hours will the firm fixed price be adjusted and if so, how will that be adjusted?

(ANSWER) Any changes to the contract such as an increase in quantities will be at the direction of the Contracting Officer via a supplemental agreement pursuant to RFO 52.212-4. Any increase in quantities will be at the hourly rate accepted/stated in the original firm-fixed price award.

3. In the event that the contractor works fewer hours than the firm fixed price. Will the hours be adjusted or will the fixed price that has been entered be paid?

(ANSWER) Payment will be made for actual hours worked at the hourly rate accepted/stated in the original firm-fixed price award.

4. The contract shows that work shall begin within 7 days of NTP and completed within 30 days. The Period of Performance says from NTP through 1 October. This contractually binds the Contractor to have work completed when the Contractor has no control over the progress or scope of the Work.

(ANSWER) We are amending the within 30 days to the correct amount of within 47 days.

5. There is no description of the Work to be completed under the performance portion of the Contract.

(ANSWER) This is stated in 3) for the SOW (WORK TO BE DONE)

6. Is there a reason that the ACE has gone away from the traditional method of hourly contracting and has switched this to a firm fixed price? It seems like it’s a recipe for disaster because once the contract is entered as firm fixed, it will require change orders to ultimately reconcile everything.

(ANSWER) Seattle District USACE contracts for equipment rental are firm-fixed price.

The quoted price is firm and fixed. The hours are estimated. Payment will be made for actual hours worked at the quoted hourly rate.

7. There is no way that we can provide a performance bond as there is no performance criteria in this contract. No bonding company will issue a performance Bond based on an hourly contract because it effectively puts them on the hook for an unknown dollar amount and scope of work. Can you eliminate the requirement for a payment and performance Bond? If not, can you revise this to only be a payment bond?

(ANSWER) Pursuant to the Revolutionary FAR Overhaul (RFO) Part 28.102 Performance and payment bonds and alternative payment protections for construction contracts 40 U.S.C. chapter 31, subchapter III, Bonds (formerly known as the Miller Act), requires performance and payment bonds for any construction contract exceeding $150,000.

8. Can the requirement of a bid bond be removed?

(ANSWER) Pursuant to the RFO Part 28.101 Bid guarantees, bid guarantees must be required whenever a performance bond or a performance and payment bond is required.
