SUMMARY OF CHANGES

SECTION SF 1449 - CONTINUATION SHEET

SOLICITATION/CONTRACT FORM

The required response date/time has changed from 31-Jul-2024 10:00 AM to 06-Aug-2024 10:00 AM.

The following have been added by full text:

NOTES R0001

The due date for the receipt of proposals is extended to 6 August 2024 at 10:00 AM Pacific Time.

The purpose of this amendment is to accomplish the following:

1. The SF1442 Solicitation, Offer and Award is revised to reflect the date extension.

2. The attached revised sections are to be replaced in their entirety. Specifications changes are generally identified, for convenience by using red font and strikeouts for deletions or updating the specification in red font for additions All portions of the revised sections shall apply whether or not changes have been indicated.

3. NOTICE TO OFFERORS: Offerors must acknowledge receipt of this amendment by number and date on offer.

4. Update the specifications to reflect that emergency/standby generators meeting Tier 2, Tier 3, or Tier 4 Environmental Protection Agency emission standards are acceptable.

4. Provide answers to questions received during the solicitation. Please see the following page for Q&A and the following changes in red in the purchase description.

Q&A

Question: We have reached out to some of our suppliers and most have concerns about the 120-day lead time. Is there a way that could be changed to give more time?

Answer: The delivery schedule remains 120 days, at this time.

Question: Would your agency be interested is purchasing electric generators that are powered by renewable energy?

Answer: No. The requirement is for a Standby Mobile Diesel Generator.

Question: The mobile unit is designed for Camlocks with a pass-through mechanical bus connection. No stub hub as it is on a trailer?

Answer: The specifications remain the same, the requirement is for an oversized electrical stub-up area directly below the circuit breaker.

Question: The requirements are a bit confusing. I was wondering if the attached was a typo. Generator manufacturers are not considered small businesses. The major and reputable manufacturers do not fall into the small business category. Even though my company is considered a small business, we do not manufacture generators, so it would have to be bought elsewhere and they are all not considered small businesses. Can you kindly expound a little bit on this?

Answer: Acknowledged. In accordance with 13 CFR 121.406, this contracting action is subject to the requirements of the Nonmanufacturer Rule (NMR). Regulations require us to attempt to meet the restrictions, as outlined in the NMR, first. This action will be resolicited if no small business manufacturers are identified.

The following have been modified:

NOTES

The emergency generator must meet Tier 4- Environmental Protection Agency emission standards.

The generator must meet Tier 2, Tier 3, or Tier 4 Environmental Protection Agency emission standards.

ALL contracting actions require a Determination of Responsibility of the prospective contractor. Please see FAR 9.104-1 for the general standards for a prospective contractor to be determined responsible.

In accordance with 13 CFR 121.406, this contracting action is subject to the requirements of the nonmanufacturer rule. The emergency generator must be manufactured by a small business. No waiver of the nonmanufacturer rule was granted so Item 3 below is not applicable. Please see FAR Clause 52.219- 33- Nonmanufacturer Rule.

The nonmanufacturer rule states to qualify as a small business concern for this small business set-aside supply contract, the small business must either:

1) Manufacture the product itself,

2) Supply a product manufactured by another small business if it is a nonmanufacturer or, 3)Supply the product of any sized manufacturer if SBA has granted a waiver to the nonmanufacturer rule.
