Section 00 24 00 - Evaluation Factors for Award

00 24 00 – EVALUATION FACTORS FOR AWARD (CRITERIA)

Revisions incorporated into Amendment 0002 – changes in red

1.0 BASIS FOR AWARD

Award of this Contract will be made to the responsible offeror submitting the Lowest Price Technically Acceptable

(LPTA) offer in accordance with FAR Part 15 procedures. This solicitation will result in the award of a firm-fixed price construction contract.

The evaluation of each proposal will be solely on the basis of evaluation factors found in this section

(00 24 00). The Government will evaluate each proposal on an Acceptable/Unacceptable basis only with respect to the evaluation factors (criteria) described herein. In order to be considered for award, a proposal must be rated

Acceptable in every non-price factor. Award will be to the offeror who presents the Acceptable proposal (Factors A and B) with the overall total lowest price (based on the total of all line items on the Bid Schedule).

The offeror’s proposal shall contain a response to all factors and meet the minimum submittal requirements stated.

In accordance with FAR 15.306(a)(3) the Government intends to evaluate proposals and make award without discussions. An offeror’s initial proposal shall contain the offeror’s best offer/terms. Penalty for making false statements in proposals is prescribed in 18 U.S.C. 1001.

2.0 FACTORS TO BE EVALUATED

The following Evaluation Factors will be used to evaluate each proposal:

FACTOR A – CORPORATE EXPERIENCE AND CAPABILITIES

FACTOR B – PAST PERFORMANCE OF THE PRIME OFFEROR

FACTOR C – PRICE

3.0 EVALUATION APPROACH

Proposals will be evaluated by the Source Selection Evaluation Board.

4.0 DEFINITIONS:

Past Performance: Assessment of the offeror’s probability of meeting the minimum past performance solicitation requirements.

Relevant: “Relevant” means having a logical connection with the requirements in this Solicitation; that is, featuring work that is similar in Scope, Magnitude and Complexity to what is required in the current requirement.

Team: The offeror’s “team” is the prime contractor and its subcontracting firms, taken as a whole.

Similar: Not identical but showing a resemblance in qualities or characteristics of the project or feature.

Technical: The term “technical,” as used herein, refers to non-price factors other than past performance.

00 24 00 - 1

FACTOR A: CORPORATE EXPERIENCE AND CAPABILITIES

Submittal Requirements for Evaluation:

The offeror shall submit project experience information for at least one (1) and no more than six (6) projects, demonstrating relevant experience of the offeror team. The offeror must have been either the prime contractor or a subcontractor on each submitted project. If more than six projects are submitted, only the first six projects will be evaluated in the order they are presented in the proposal. All projects submitted shall be complete, or at least 75% complete, within the past ten (10) years from the solicitation response due date.

Each submitted project shall use Attachment A – Offeror Experience Form to describe the projects in which the offeror team has relevant experience. Submit one form per project.

Note that the two areas (medium voltage switchgear and low voltage switchgear) do not necessarily need to be present in the same project.

Submitted projects shall demonstrate specific minimum experience in the following two areas:

A.1. Medium Voltage Switchgear.

Demonstrate the offeror Team has relevant experience by providing a detailed narrative of how the offeror team removed, installed, tested and commissioned medium voltage switchgear (15 kV station class or similar switchgear) in a power plant or industrial environment. To meet the requirement for relevant experience, each project summary must demonstrate all of the following four (4) elements: removal, installation, testing and commissioning of medium voltage switchgear. Absence of any of these elements of work will result in a determination that the submitted project is not relevant.

At least one (1) of the project summaries submitted shall clearly demonstrate the offeror’s team’s relevant experience with Factor A.1 – Medium Voltage Switchgear. For the purposes of this Request for Proposals (RFP), relevant may include projects in a hydroelectric powerhouse or other industrial facility. Offerors should explain their specific roles and responsibilities for each project summary submitted.

A.2. Low Voltage Switchgear

Demonstrate the offeror Team has relevant experience by providing a detailed narrative of how the offeror team removed, installed, tested and commissioned low voltage switchgear (480 volt station class or similar switchgear) in a power plant or industrial environment. To meet the requirement for relevant experience, each project summary must demonstrate all of the following four (4) elements: removal, installation, testing and commissioning of low voltage switchgear. Absence of any of these elements of work will result in a determination that the submitted project is not relevant.

At least one (1) of the project summaries submitted shall clearly demonstrate the offeror’s team’s relevant experience with Factor A.2 – Low Voltage Switchgear. For the purposes of this RFP, relevant may include projects in a hydroelectric powerhouse or other industrial facility. Offerors shall explain their roles and responsibilities for each project summary submitted.

Factor A Rating Methodology and Standard.

Table 1 will be used to evaluate Factor A.

Table 1: Technical Acceptable/Unacceptable Rating Method

Rating Description

Acceptable Proposal meets the requirements of the solicitation.

Unacceptable Proposal does not meet the requirements of the solicitation.

A rating of Acceptable will be given if all of the criteria for Factor A are met.

A rating of Unacceptable will be given if any of the criteria for Factor A is not met.

00 24 00 - 2

FACTOR B: PAST PERFORMANCE OF THE PRIME OFFEROR

The past performance evaluation is an assessment of the prime offeror’s probability of meeting the minimum solicitation requirements. This assessment is based on the prime offeror’s record of relevant and recent past and current performance information that pertain to the scope of work as outlined in the solicitation requirements.

Each offeror’s past performance will initially be evaluated to determine whether the offeror’s current/past performance is recent, and relevant or not relevant to the solicitation. Recent and relevant projects are those projects completed, or at least 75% complete, within the past six (6) years from the solicitation response due date featuring work that is similar in Scope, Magnitude and Complexity to what is required in the solicitation. Next, the past performance will be evaluated to determine how well the offeror performed on the prior contracts. If the proposal is from a Joint Venture or Partnership, Past Performance information for each partner will be reviewed.

At a minimum, the Government will review past performance information from the Contractor Performance

Assessment Reporting System (CPARS) and Past Performance Information Retrieval System (PPIRS), when available.

Additional sources of Past Performance information for evaluation include, but are not limited to, the following:

Offeror may submit past performance information using the attached Past Performance Questionnaire

(PPQ).

The Government may obtain past performance information from other established systems such as the

Electronic Subcontract Reporting System (eSRS) or other databases; as well as from other sources available to the Government, such as the Defense Contract Management Agency; and interviews with

Program Managers, Contracting Officers, and Fee Determining Officials.

The Government may consider a wide array of information from a variety of sources, but is not compelled to rely on all of the information available.

Factor B Rating Methodology and Standard.

Table 2 will be used to evaluate Factor B.

Table 2: Past Performance Acceptable/Unacceptable Rating Method

Rating Description

Acceptable Based on the offeror’s performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is unknown. *See Note below.

Unacceptable Based on the offeror’s performance record, the Government does not have a reasonable expectation that the offeror will be able to successfully perform the required effort.

* NOTE: In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305(a)(2)(iv)). Therefore, the offeror shall be determined to have unknown (or “neutral”) past performance. In the context of acceptability/unacceptability, a neutral rating shall be considered acceptable.

00 24 00 - 3

FACTOR C: PRICE

The contract will be a firm fixed-price contract. The Government will evaluate offers for award purposes by totaling all line items of the Bid Schedule.

Submittal Requirements for Evaluation:

The Offeror must provide the following:

1. Signed and dated Standard Form 1442

Complete in its entirety, the “offeror” portion of the SF 1442. An official having the authority to contractually bind your company shall sign the SF 1442, blocks 20B and 20C in accordance with FAR

4.102. If the offeror is a Joint Venture, all parties to the Joint Venture shall sign the offer.

2. Pricing Schedule

Include pricing information for ALL line items and totaled where applicable.

Offerors must submit Contract Line Item Numbers (CLINs) with unit price, quantity and extended price where applicable.

All extensions of unit prices shown will be subject to verification by the Government.

In case of discrepancy between the unit price and the extended price, the unit price will govern.

3. Acknowledgement of Amendment(s), if applicable

4. Representations, Certifications and Other Statements of Offerors

5. Bid bond

Factor C Rating Methodology and Standard.

Award will be to the offeror who presents the Acceptable proposal (Factors A and B) with the overall total lowest price (based on the total of all line items on the Bid Schedule).

This Source Selection is conducted with the expectation of adequate price competition – normally competition establishes price reasonableness and a comparison of proposed prices will satisfy the requirement to perform a price analysis. A price reasonableness approach will be utilized by the Government to determine that the proposed prices are fair and reasonable as described in FAR 15.305(a)(1).

All offers with separately priced line items or subline items will be analyzed to determine if the prices are unbalanced (FAR 15.404-1(g)). Offers may be rejected if the Source Selection Authority determines the lack of balance poses an unacceptable risk to the Government.

Note: Executive Order (EO) 13706, Establishing Paid Sick Leave for Federal Contractors applies to all contracts subject to the

Davis-Bacon Act for which the contract is awarded (and any solicitation was issued) on or after January 1, 2017. If this contract is covered by the EO, the contractor must provide employees with 1 hour of paid sick leave for every 30 hours they work, up to 56 hours of paid sick leave each year.

Employees must be permitted to use paid sick leave for their own illness, injury or other health-related needs, including preventive care; to assist a family member (or person who is like family to the employee) who is ill, injured, or has other health-related needs, including preventive care; or for reasons resulting from, or to assist a family member (or person who is like family to the employee) who is a victim of, domestic violence, sexual assault, or stalking. Additional information on contractor requirements and worker protections under the EO is available at www.dol.gov/whd/govcontracts.

Unlisted classifications needed for work not included within the scope of the classifications listed may be added after award only as provided in the labor standards contract clauses

(29CFR 5.5 (a) (1) (ii)).

The body of each wage determination lists the classification and wage rates that have been found to be prevailing for the cited type(s) of construction in the area covered by the wage determination. The classifications are listed in alphabetical order of "identifiers" that indicate whether the particular rate is a union rate (current union negotiated rate for local), a survey rate (weighted average rate) or a union average rate

(weighted union average rate).

Union Rate Identifiers

A four letter classification abbreviation identifier enclosed in dotted lines beginning with characters other than "SU" or

"UAVG" denotes that the union classification and rate were prevailing for that classification in the survey. Example:

PLUM0198-005 07/01/2014. PLUM is an abbreviation identifier of the union which prevailed in the survey for this classification, which in this example would be Plumbers. 0198 indicates the local union number or district council number where applicable, i.e., Plumbers Local 0198. The next number, 005 in the example, is an internal number used in processing the wage determination. 07/01/2014 is the effective date of the most current negotiated rate, which in this example is July 1, 2014.

Union prevailing wage rates are updated to reflect all rate changes in the collective bargaining agreement (CBA) governing this classification and rate.

Survey Rate Identifiers

Classifications listed under the "SU" identifier indicate that no one rate prevailed for this classification in the survey and the published rate is derived by computing a weighted average rate based on all the rates reported in the survey for that classification. As this weighted average rate includes all rates reported in the survey, it may include both union and non-union rates. Example: SULA2012-007 5/13/2014. SU indicates the rates are survey rates based on a weighted average calculation of rates and are not majority rates. LA indicates the State of Louisiana. 2012 is the year of survey on which these classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination. 5/13/2014 indicates the survey completion date for the classifications and rates under that identifier.

Survey wage rates are not updated and remain in effect until a new survey is conducted.

Union Average Rate Identifiers

Classification(s) listed under the UAVG identifier indicate that no single majority rate prevailed for those classifications; however, 100% of the data reported for the classifications was union data. EXAMPLE: UAVG-OH-0010

08/29/2014. UAVG indicates that the rate is a weighted union average rate. OH indicates the state. The next number, 0010 in the example, is an internal number used in producing the wage determination. 08/29/2014 indicates the survey completion date for the classifications and rates under that identifier.

A UAVG rate will be updated once a year, usually in January of each year, to reflect a weighted average of the current negotiated/CBA rate of the union locals from which the rate is based.

WAGE DETERMINATION APPEALS PROCESS

1.) Has there been an initial decision in the matter? This can be:

* an existing published wage determination

* a survey underlying a wage determination

* a Wage and Hour Division letter setting forth a position on a wage determination matter

* a conformance (additional classification and rate) ruling

On survey related matters, initial contact, including requests for summaries of surveys, should be with the Wage and Hour

Regional Office for the area in which the survey was conducted because those Regional Offices have responsibility for the

Davis-Bacon survey program. If the response from this initial contact is not satisfactory, then the process described in 2.)

and 3.) should be followed.

With regard to any other matter not yet ripe for the formal process described here, initial contact should be with the

Branch of Construction Wage Determinations. Write to:

Branch of Construction Wage Determinations

Wage and Hour Division

U.S. Department of Labor

200 Constitution Avenue, N.W.

Washington, DC 20210

2.) If the answer to the question in 1.) is yes, then an interested party (those affected by the action) can request review and reconsideration from the Wage and Hour Administrator

(See 29 CFR Part 1.8 and 29 CFR Part 7). Write to:

Wage and Hour Administrator

U.S. Department of Labor

The request should be accompanied by a full statement of the interested party's position and by any information (wage payment data, project description, area practice material, etc.) that the requestor considers relevant to the issue.

3.) If the decision of the Administrator is not favorable, an interested party may appeal directly to the Administrative

Review Board (formerly the Wage Appeals Board). Write to:

Administrative Review Board

U.S. Department of Labor

4.) All decisions by the Administrative Review Board are final.
