About this file
This is Amendment 0002 to a federal solicitation for maintenance dredging services at Newark Bay's Federal Navigation Channel. The amendment, issued by the U.S. Army Corps of Engineers (W912DS Division, New York District) on 28 July 2026, extends the proposal submission deadline from 31 July 2026 to 6 August 2026 at 2:00 PM ET. The solicitation number is W912DS26BA027, with project number PANNAD-26-P-0000 031007. The amendment provides responses to seven requests for information (RFIs) and clarifications regarding material characterization, survey data, geotechnical information, dredging methods, and sediment sampling coverage across various work areas. Offerors must acknowledge receipt of this amendment by the extended deadline using one of three methods: completing items 8 and 15 on the amendment form, acknowledging receipt on each copy of the offer submitted, or submitting a separate letter or electronic communication referencing the solicitation and amendment numbers.
The RFI responses clarify that Amendment 0001 (22 July 2026) provided additional material characterization and physical sampling data through the Newark Bay APR25_State Analytes Tables and Newark Bay APR25_Technical Report to address areas outside the originally characterized zones. The Government does not warrant uniform sediment types or chemical characteristics across project limits, and offerors must base proposals on the complete amended data suite. Regarding dredging operations, contractors must comply with Water Quality Certificate requirements and environmental permits; box cutting and side slope compensation are permitted only within specified templates and allowable overdepths with no additional payment for overages. Bed leveling is permitted only after substantial dredging completion, subject to Contracting Officer approval, at no additional cost. Survey XYZ data used for CLIN volume calculations and physical parameter testing data including sediment core logs, moisture content, and grain-size distribution are available in the provided reports. Failure to acknowledge amendments by the specified deadline may result in offer rejection under FAR 15.208.

Maintenance Dredging of Newark Bay, Federal Navigation Channel, Amendment 0002 -
W912DS26BA027
This amendment is being issued to address the following:
- RFI/Questions and Government Responses.
- Extend the proposal due date until 2:00PM ET on 6 August 2026.
Questions that may be of general interest to all Offerors and/or the Government and that are not readily answered by the proceeding changes will appear below. These questions may have been paraphrased or altered to represent several questions regarding the same subject and/or simply revised to clarify and
W912DS26BA0270002
simplify the question(s). Questions and answers are issued to the Offerors "for information only" and do not revise the solicitation, plans or specifications.
Q1. According to the sample location map, the 23 samples were collected between two areas, Area 1 (Channel Point IDs 40, 35, 34, 28C, 33, 30, 28B, 23, and 22 depicted in Figure 1b) and Area 2 (Channel Point IDs 1 and 15 depicted in Figure 1a). A lot of the areas to be dredged are outside of the areas characterized (Areas 1 and 2). All but one sample was detected with exceedances above NJ Res. If the waste characterization results are found to be vastly different from the sampling completed for Upland Beneficial Use (Eurofins Report 180-199521 and 180-199686), would there be a change order for the difference in disposal?
A1. Amendment 0001, dated 22 JUL 2026, provided additional material characterization and physical sampling data to address the areas outside of those characterized in the originally included reports. Offerors are directed to review the newly provided attachments:
Newark Bay APR25_State Analytes Tables
Newark Bay APR25_Technical Report
These documents contain additional sediment core data and physical testing parameters for additional areas.
The Government does not represent or warrant that sediment types or chemical characteristics are uniform across the project limits. Offerors must perform their own evaluation of the complete, amended data suite (including all historical and newly provided reports in adjacent or nearby areas) to determine the nature, variability, and behavior of the material to be dredged. Offerors must base their proposals on the entirety of the data provided in the solicitation and its amendments.
Q2. Please provide survey as depicted in the Contract Drawings, in XYZ format, used in calculating the CLIN volumes.
A2. Plans and specifications survey xyz data are already provided in the current solicitation package. See 03 - W912DS-26-B-A027 Tech Specs_NB26.pdf - 00 90 01 ATTACHMENT L.
Q3. Please provide geotechnical investigations relevant to the proposed dredge areas.
A3. Physical parameter testing--including sediment core logs, percent moisture, and grain-size distribution--is included within the following provided reports:
Newark Bay Upland (45-159) Final Report.pdf
Newark Bay APR25_Technical Report.pdf
Offerors should utilize the physical and analytical data contained within these reports to evaluate the material characteristics for the proposed dredge areas.
Q4. The sediment cores presented in the report Technical Report on the Sampling and Physical Testing of Sediment from Newark Bay- Main and Port Newark Branch Channels, Federal Navigation Project No. 64 for Upland Beneficial Use in New York and/or New Jersey, by Aqua Survey, Inc, dated January 19, 2026 only contain sediment cores from within Basic Work Areas 1 and 2 and Option Areas 1 and 3. Please provide additional sediment cores for all Base work and Options or confirm that the government expects relatively uniform sediment types across the project area and that the sediment cores provided are intended to be indicative of material to be removed from all base and options areas to be dredged.
Q5. Please confirm if the contractor is allowed to box cut the side slopes, and be paid for compensating slopes?
A5. Any side slope excavation method--including the decision to employ box cutting--must strictly comply with the authorized dredging depths, allowable overdepths, and environmental conditions set forth in the Water Quality Certificate (WQC/FCD) and all applicable project permits. Subject to these compliance boundaries, the specific excavation technique utilized to achieve the required side slopes is a contractor means and methods determination.
Payment will only be made for material excavated within the specified template, allowable overdepth, and side slope limits as explicitly defined in the contract drawings and specifications. No payment or compensation will be made for material removed outside of these authorized templates.
Q6. Please confirm if dragging/bed leveling is permitted on this project.
A6. The determination of specific dredging equipment, means, and methods--including the potential use of dragging or bed leveling--is the sole responsibility of the Contractor. Any utilized methods must strictly comply with all contract specifications, the Water Quality Certificate (WQC/FCD), and all environmental permits and restrictive windows associated with this project.
Notwithstanding compliance with the above, bed leveling should only be proposed by a Contractor when there is sufficient evidence to suggest that the bed-leveling of residual high spots within a given area would produce less turbidity effects than the dredging of residual high spots of the same area with an environmental bucket. Proposals for bed leveling are only considered after a Contractor performs a progress survey over the area, and the KO/COR has determined sufficient dredging has been performed in that area. Proposed bed-leveling operations remain subject to final review and approval by the Contracting Officer, and the incorporation of such methods shall be at no additional cost or time to the Government.
Q7. Upon review of the sampling data and the locations of the proposed basic work areas and option areas, it has been determined that there is no chemical data for the following areas: Basic Work 3, Basic Work 4, Basic Work 5, Option 2. How is the contractor to propose management of these areas?
