This is Amendment 0004 to a solicitation for maintenance dredging services at the Hudson River Federal Navigation Project, Reach N04 Troy Dock Dredging Areas in New York. The amendment is issued by the U.S. Army Corps of Engineers (USACE), W92D Endist New York, with an effective date of 18 June 2026. The solicitation number is W912DS26BA008, and the bid opening remains scheduled for 09 July 2026 at 2:00 P.M. EST, with no extension to the receipt deadline. Bidders must acknowledge receipt of this amendment prior to the bid opening by completing items 8 and 15 on Standard Form 30, acknowledging receipt on each copy of the offer submitted, or submitting a separate letter or electronic communication referencing the solicitation and amendment numbers. Failure to acknowledge may result in bid rejection under FAR 14.304.

The amendment adds two drawings (104 - NOTES2_2026 ReachN04 Troy.pdf and CoreSamp_Enclosure 1-2 Troy dock.pdf) to the contract specifications. No specifications, specification sections, or previously issued drawings were revised or deleted. The amendment primarily provides responses to 16 questions submitted by bidders regarding dredge material classification, work schedules, disposal requirements, site access, monitoring procedures, and operational constraints. Key clarifications include confirmation that dredge material is not hazardous waste but contains PCB contamination up to 20 ppm requiring disposal at certified facilities; work hours restricted to 0700 to 2000 due to Troy Lock & Dam monitoring and local noise ordinances; turbidity monitoring requirements consisting of four daily visual inspections with grab sampling required only if substantial visible contrast is observed; and paid material depths of 14' plus 1' overdepth and 11' plus 1' overdepth with a 3V:1H slope transition between areas. The bid guarantee requirement is clarified as at least 20 percent of bid price but not exceeding $3 million.

W912DS26BA0080004

The following changes shall be made to the drawings and specifications.

DRAWINGS

1. The following DRAWINGS have been REVISED but NOT REISSUED:

- None

2. The following DRAWINGS have been REVISED and REISSUED:

- None

3. The following DRAWINGS have been ADDED:

- 104 - NOTES2_2026 ReachN04 Troy.pdf

- CoreSamp_Enclosure 1-2 Troy dock.pdf

SPECIFICATIONS:

1. The following SPECIFICATIONS have been ADDED:

- None

2. The following SPECIFICATION SECTIONS have been REVISED but NOT REISSUED:

- None

3. The following SPECIFICATION SECTIONS has been REVISED and REISSUED:

- None

4. The following SPECIFICATION SECTIONS have been DELETED in their entirety:

- None

The following are responses to questions received from bidders (FOR INFORMATIONAL

PURPOSES ONLY):

1) The specification says, "the Bid bond 20% of bid price or $3,000,000 whatever is less". Does this mean if our bid price is $4,000,000, we submit a bid bond for 20% of $3 million?

The bid guarantee amount shall be at least 20 percent of the bid price but shall not exceed $3 million

2) There was some discussion about the classification of the dredge material that will be transported and disposed of as required for this contract. I also had a side discussion with one of the ACOE officials pertaining to the classification, and I assured him that I would follow up with an official question so all potential bidders would receive the official response in a question-and-answer section of a future addendum. "After reviewing the analytical report that was provided with the bid documents, I am not sure if the material would be able to be disposed of as "Contaminated /Non-Hazardous Waste" or as "Hazardous Waste." The ACOE official confirmed to me in our discussion that the material is "Hazardous Waste," and the local landfills would not be able to accept them. Could you please confirm this information is correct?

The material is not "Hazardous Waste." The core sample results included in the contract specs indicate PCB contamination of the dredge material up to 20 ppm. USACE is not aware of any local landfills certified by New York State Dept. of Environmental Conservation (NYSDEC) that accepts PCB contaminated dredge material, but some may be present in the area; potential bidders will need to consult NYSDEC (or the equivalent state regulatory body if looking for disposal sites outside of New York State) for active disposal sites approved for the processing and placement of contaminated dredge material.

3) Please advise whether a 24-hour work schedule will be allowed for this project. We understand that the ACOE may not allow off-site trucking operations during nighttime hours; however, please clarify the allowable hours during which contractors will be allowed to transport material off site.

Due to USACE monitoring requirements for the Troy Lock & Dam, as well as city of Troy noise ordinances, work on site will be restricted to 0700 to 2000.

4) The specifications include requirements to protect adjacent properties, outside the work zone, from any contamination impacts resulting from work activities within the project area. Will the ACOE provide additional clarification regarding the specific measures, procedures, and requirements that contractors must implement to protect adjacent properties from contamination-related impacts? Will the contractor be responsible for submitting their means and methods of how they will prevent contamination impact of adjacent properties?

USACE will not specify the measures, procedures, and requirements required to protect adjacent properties outside of what is included in the contract specifications and NYSDEC Water Quality Certification (WQC) permit. Upon award and notice to proceed, the contractor will submit their means and methods through required contract submittals (dewatering plan, environmental protection plan, monitoring plan, etc.) prior to mobilization. Per the WQC permit, the dewatering plan/dredge material placement mitigation plan will require NYSDEC approval prior to the start of in-water work.

5) Because any water removed from the dredged material prior to transport originates from the Hudson River, will the Contractor be permitted to direct that water back into the Hudson River?

The WQC permit allows for the discharge of dredging return waters, subject to all discharge monitoring and testing requirements as stipulated by NYSDEC. Barge overflow is not permitted.

6) Amendment #2 shows a revised dredge footprint. I'm a little confused about the solid red line and there is no legend that tells me what that is. Does that solid red line that angles off at T7 and straight lines to T5 represent a new dredge area that eliminates dredging on the landward side of that line, which was in original dredge area?

The red line is the border of the dredging work area. Dredging in the landward site outside of the dredging area is prohibited.

7) It was discussed at the pre-bid walkthrough the reasoning behind the reduction of material to be removed. The ACOE discovered some ledge rock in the area that is closest to the bulkhead and now instead of 14' it has us dredging down to 11'. If the intent of this project is to remove any of the material built up in the newley designated 11'+1' OD area, would the ACOE consider approving the contractor to remove, and get paid for as much material as they can remove, (not to exceed 15') down to the bedrock in the 11' zone?

Paid material from dredging will be to 14' + 1' OD & 11' + 1' OD as specified in the latest contract plans. NOTE: when transitioning between Area A (14') and Area B (11') a 3V:1H slope will be used, extending east from the east channel line: Please see images in attachment.

8) Has the full plan set been provided with the Solicitation? The page numbers on the project plans indicate either 4 or 8 total pages in the set, but only 3 pages have been provided. Tech Specs 01 20 00 - Item 12 Silt Curtain and Item 14 Dewatering/Transportation sections also refer to page P- 104 for additional details, and this page is not included with the plan set.

The full plans consist of 4 pages. Page 4 was omitted and is now included.

See document "104 - NOTES2_2026 ReachN04 Troy.pdf"

9) Is a full part 360 authorization permit required for the contractor to utilize an alternative location for dewatering dredged sediment, stabilization, unloading and loadout to an approved disposal facility?

Any waste processed off-site must take place at a fully compliant Part 360 facility. Per the existing Section 401 Water Quality Certification, Natural Resource Permit Condition #3; the transportation route, transportation method, and proposed final disposal location must be submitted to the NYSDEC for approval.

10) The analytical data shows that sample ID #20250717 contains a total PCB concentration of 20 ppm. This high level of contamination could significantly impact disposal costs. Can the Corps please provide a map of the locations of where all samples were taken, and provide an estimated quantity of how much sediment may have such elevated levels of PCB contamination?

See document "CoreSamp_Enclosure 1-2 Troy dock.pdf"

11) Please clarify the extent of turbidity monitoring required outside the turbidity curtain. Just daily visual inspection, or are twice daily grab samples with lab analysis required for the duration of active dredging?

Visual inspections are required four (4) times per day upon the start of dredging. If dredging is witnessed to cause a substantial visible contrast to natural conditions in the receiving waterbody, then daily grab samples are required until test results show TSS levels returning to within 100mg/L over ambient (ambient levels will be established by a one-time grab sample taken within 72 hours of the start of dredging).

12) What can the contractor expect for amount of boat traffic and lock usage during the course of the project?

USACE estimates on average between 15-25 vessels a day (6AM-10PM) and about 10-15 lockage's for those vessels. On random days, peak usage may see up to 35 vessels and 23 lockage's.

13) How often can we expect the other contractor onsite currently utilizing the yard for storage to need access to the bulkhead? Where along the bulkhead? Are there any other vessels that will need access to the bulkhead? Will the small vessels dock be removed prior to the start of dredging?

Access to the bulkhead will be infrequent and as needed by contractors loading material for their project. Daily access is not expected but when it occurs it will be at the beginning and/or end of the day.

Access to the bulkhead will be near or at the boat ramp.

No regular access will be needed by USACE vessels, but access to the bulkhead by USACE, USCG, or other stakeholders may be necessary if an emergency occurs near or at the Troy Federal Lock & Dam.

The small vessel dock will be removed prior to the start of dredging.

14) Is the contractor permitted to utilize both entrances to the facility at Bond St. and Glen Ave for various truck traffic? Are there any specific security requirements for truck drivers, subcontractors or other personnel to enter the facility?

The contractor is permitted to utilize both entrances to the facility at Bond St. and Glen Ave. for truck traffic.

No specific security requirements will be required, but access to the site, particularly after 1600, will require coordination with USACE staff (onsite until 2200) and security personnel (overnight).

15) Are there any restrictions for days and/or hours of operation?

Due to USACE monitoring requirements for the Troy Lock & Dam, as well as city of Troy noise ordinances, work on site will be restricted to 0700 to 2000.

16) Can the Corps please provide additional information regarding any potential weight restrictions for equipment used alongside the bulkhead?

USACE is not aware of any potential weight restrictions for equipment on the bulkhead. When utilizing the bulkhead, USACE regularly stages our crane and barge spuds at a combined weight of ~59,000 lbs.
