BIDDER’S QUESTIONS AND GOVERNMENT REPLY

Questions that may be of general interest to all Bidders and/or the Government and that are not readily answered by the preceding changes will appear below. These questions may have been paraphrased or altered to represent several questions regarding the same subject and/or simply revised to clarify and simplify the questions(s). All questions and answers are issued to the bidders “For Information Only” and do not revise the solicitation, plans, or specifications. This applies to prior questions and replies as well.

Please note that the Government may, but is not obligated to, respond to RFIs sent by contractors after 10 September 2024, 11:59pm EST. RFIs are to be submitted to point(s) of contact listed on the solicitation.

Bidder Inquiry 01: Please clarify the response to Amendment Number 4, Bidder Inquiry #4. Should the response read: “before November 30 (sturgeon) and AFTER January 1…”?

Government Response: Correct. Prior to modification, window reflected work ceasing January 1st. In accordance with the Uniform Procedures Regulations (6NYCRR Part 621), the dredging and in-water work in Moriches Bay needed to complete the Cupsogue CPF are authorized on a one-time-only basis to February 1, 2025 inclusive.

Bidder Inquiry 02: Will the Government please request a WQC modification to allow in‐ water work in Moriches Bay until 3/31/25, matching the requirements for the offshore portion of work?

Government Response: 1 February 2025 shall be the latest date for in-water work within Moriches Bay. Demobilization can occur through 14 March 2025. No additional requests will be made. It is notable that the Government believes this project to be feasible to complete the work within the windows provided.

Bidder Inquiry 03: In regard to Option Item 0005, please reduce the time to award from 60 days from NTP to 30 days from NTP. This will allow the contractor to begin work as early as possible to ensure completion of Item 0005 before environmental deadlines.

Government Response: This change will not be made. 60 days was determined with consideration to environmental timelines. If the optional item is to be exercised, it will be exercised at the earliest opportunity available to the Government.

Bidder Inquiry 04: The contract allows 180 days from NTP to complete, which is the minimum time needed for completion of a project of this magnitude. That equates to an NTP of October 1, which is highly unlikely. When does the government anticipate the Award and NTP? Will the environmental window be shifted accordingly?

Government Response: Award and NTP are anticipated on/around the beginning of October. No additional requests will be made regarding environmental windows.
