About this file
This document is an Amendment to a Solicitation for a federal contract opportunity.
The amendment revises and reissues the bid schedule, provides answers to Requests for Information, and outlines project-specific conditions from the New Jersey Department of Environmental Protection. The bid opening date is extended to June 20, 2024 at 3:00 PM EST. The amendment modifies the contract by changing the units for two line items from "Job" to "CY", decreases the bid acceptance period from 120 to 90 days, and clarifies that certain dewatering conditions do not apply since the dredged material will be placed at the Historic Area Remediation Site. The underlying federal contract opportunity is for maintenance dredging of the Raritan River to Arthur Kill Cut-off Federal Navigation Channel, with a basic work dredging depth of -20 feet MLLW plus 1 foot of allowable overdepth (280,000 CY), and an option to dredge an additional 1 foot of overdepth (80,000 CY). The dredged material will be placed at the Historic Area Remediation Site.

(Questions that may be of general interest to all Offerors and/or the Government and that are not readily answered by the proceeding changes will appear below. These questions may have been paraphrased or altered to represent several questions regarding the same subject and/or simply revised to clarify and simplify the question(s). Questions and answers are issued to the Offerors “for information only ”and do not revise the solicitation, plans or specifications.)
1. When does the Government anticipate issuing contract award and NTP?
A1: The Government would like to issue contract award as early as practicable, anticipated in the July-August timeframe but is subject to change at the government’s discretion.
The Government would like to issue Notice to Proceed as early as practicable, anticipated in the August- September timeframe but is subject to change at the government’s discretion.
2. SF 1442 #13 D - Considering the short contract duration of 48 days, please lower the 120 calendar days allowed for Government acceptance to 60 days. Requiring the contractor to provide such a long guarantee for a small job is not practical. It could also lead to reduced competition by encouraging contractors to pass on bidding the project for fear of missing other projects while they wait for the 120-day guarantee to expire.
Additionally, 120 days potentially pushes the award, and then NTP, several months beyond the earliest allowable Environmental Window start of July 1st. Finally, the 120-day allowance also potentially pushes the project into the winter months with more adverse weather, which increases bid pricing due to that risk.
A2: Bid acceptance period is hereby changed to 90 days.
3. Bid Items 0002 and 0004 state the unit is “Job.” The “Notes to Bidders” area states these units should be
“CY”. Please change Bid Item 0002 and 0004 units from “Job” to “CY.”
A3: By this amendment, the unit for bid items 0002 and 0004 is changed from “Job” to “CY”.
4. Project Specific Condition #10 in the “Federal Consistency Determination / Water Quality Certification” letter dated April 4,2024, states, “all barges or scows used to transport sediment shall be of solid hull construction or be sealed with concrete.” The material on this project is going to HARS and spilt hull scows must be used. Please correct.
A4: Per the New Jersey Department of Environmental Protection (NJDEP) email attached, the dewatering conditions noted in Project Specific Conditions #10, 12, and 14-17 of the FCD/WQC issued on 04 April 2024, are not applicable as the material is being discharged to the Historic Area Remediation Site (HARS). All other conditions and requirements of the 04 April 2024 FCD/WQC remain in full force and effect.
5. Project Specific Condition #3 in the “Federal Consistency Determination / Water Quality Certification” letter dated April 4,2024, states, “all sediments from this project shall be removed using a closed clamshell environment bucket.” The material is approved for HARS disposal. We request this language is amended to allow closed clamshell navigation buckets to perform the work. The navigation bucket is very similar to a closed clamshell environmental bucket. The only difference being the navigation bucket has rubber seals along the sides instead of overlapping side plates.
A5: The use of a closed clamshell environmental bucket is a standard requirement found in NJDEP issued FCD/WQCs for maintenance dredging projects in the NY/NJ Harbor area. Per the New Jersey Department of Environmental Protection (NJDEP) email attached, Condition #3 requiring the use of a closed clamshell environmental bucket remains in full force and effect. Subsequent to contract award, the awardee may submit a request to have the NJDEP FCD/WQC modified to allow the use of a closed clamshell navigation bucket. As the regulatory agency, the NJDEP will determine if a modification to the current FCD/WQC may be made.
