About this file

This document is a letter of correction from the New Jersey Department of Environmental Protection (NJDEP) regarding a federal consistency determination for a maintenance dredging project in the Raritan Bay Reaches of the New York and New Jersey Channels. The letter states that the U.S. Army Corps of Engineers (USACE) has submitted additional information demonstrating that certain project-specific conditions related to decant water and decant scow are not applicable, as the dredged material will be discharged to the Historic Area Remediation Site (HARS). As a result, the NJDEP is removing those specific conditions from the previously issued federal consistency determination, while all other conditions remain in effect.

The related federal contract opportunity is for the maintenance dredging of the New York and New Jersey Channels, Raritan Bay Reaches Federal Navigation Project. The U.S. Army Corps of Engineers, New York District proposes to remove approximately 450,000 cubic yards of sediment from the Raritan Bay to Seguine Point reach, with the dredged material to be beneficially used at the HARS.

Dear Mr. Oseback:

A Federal Consistency Determination for the above referenced project was issued on April 18, 2024.

Additional information has been submitted by the ACOE demonstrating that the decant water and decant scow conditions noted in Project Specific Conditions 8, 9, and 10 of the FCD/WQC are not applicable as the material is being discharged to the Historic Area Remediation Site (HARS). Therefore, this letter serves as a correction to hereby remove conditions 8, 9, and 10 from the issued Federal Consistency Determination. All other conditions and requirements of the FCD/WQC remain in full force and effect.
