AMENDMENT 00001

BIDDER’S QUESTIONS AND GOVERNMENT REPLY

The following questions and answers are provided for information only. Nothing contained below amends or revises any provision of the solicitation. This is for bidder’s reference only, and is not to be considered as a part of the Contract Documents. Contract award will be based on what is contained in the printed Plans and Specifications in a hard copy format or Electronic Bid Set if provided and as posted on SAM.Gov.

Q1. The solicitation states that the mobilization item includes "preparation of CDF fill areas (devegetation, repair, grading, etc.)," What does repair and grading of the CDF fill areas entail?

A1. The CDF fill area and surrounding berms are not currently known to need any rehabilitation or repair.

Furthermore, the CDF fill area was successfully utilized for recent placement operations of another municipal contract/contractor. The intent of the excerpt “preparation of CDF fill areas (devegetation, repair, grading, etc.)” is to convey to prospective bidders that it is the responsibility of the would-be contractor to sufficiently prepare the CDF fill area for appropriate use by the contractor and his/her equipment. Equipment types, sizes, and weights may vary amongst prospective bidders and may require unique preparation at the placement site for safe and effective use of such equipment. “Repair and grading” should primarily be considered a part of demobilization activities; should a prospective bidder anticipate damaging the CDF fill area and surrounding berms with his/her equipment and or use of the area. Please see Section 01 11 00 Summary of Work, paragraph 1.8 Existing Work for further requirements Q2. No coordinates are provided to delineate the dredge areas. Can you please provide coordinates?

A2. Coordinates delineating the Browns Creek channel are attached to this amendment, coordinates are also shown on the drawings / plans delineating option work areas.

Q3. The dredge areas shown on the project plans appear to intersect existing piers and bulkheads. What is the instruction for dredging in areas where the dredge prism goes into or near to land? Is there a buffer zone to stay away from existing structures?

A3. Due to the array of prospective bidders’ equipment, it is the responsibility of the contractor to set their own “buffer zone” to safely avoid damage to existing work / structures. Bottom material left behind, reasonably adjacent to structures per the contractors “buffer zone”, will not be considered required for acceptance of work. Please see Section 01 11 00 Summary of Work, paragraph 1.8 Existing Work for further requirements.

Q4. It appears that pilings exist in or near the dredge limits and may be in the way of the cutter head or swing lines. Will existing pilings be pulled out prior to job commencement?

A4. Options 1-3 will only be exercised if the marina owners in the vicinity of those dredging areas remove pilings of concern. Please refer to previous answer for setting buffer zone based on equipment used.

Q5. Dredging Area 2 has limits that are against the western dock edge and do not show any buffer from the docks and bulkheads. Please specify USACE’s requirement on how far the dredging must be conducted from the docks and bulkheads and if this requirement results in a decrease in biddable volume.

A5. Due to the array of prospective bidders’ equipment, it is the responsibility of the contractor to set their own “buffer zone” to safely avoid existing work / structures. Material left behind, reasonably adjacent to structures per the contractors “buffer zone”, will not be considered required for acceptance of work.

Please see Section 01 11 00 Summary of Work, paragraph 1.8 Existing Work for further requirements.

Options 1-3 will only be exercised if the marina owners in the vicinity of those dredging areas remove pilings of concern.

Q6. Please clarify that the 45 days from NTP is for dredging of only Areas 1 & 2 and does not include the options.

A6. Correct, “…complete the entire basic work ready for use, no later than forty-five (45) calendar days after the date the contractor receives the notice to proceed”. Please refer to specifications Section 01 11 00 Summary of Work, paragraphs 1.1 and 1.2.1 for full description and breakdown of the contract performance period.

Q7. Dredging of the Options requires smaller dredging equipment for the various slips that will not yield 1,000 CY per day. Can the options allow for time for 100 CY per day?

A7. Please refer to previous answer with respect to Options 1-3. The contract time for completion remains based on a minimum average production rate of 1,000 cubic yards (CY) per day for dredging, and placement.

Q8. Can the time allowed for completion include some time for mobilization and demobilzation?

We request that the completion timeframe be changed to 90 days from NTP.

A8. Please refer to previous answer and the referenced contract specifications for description of the contract performance period, which remains unchanged.

Q9. Could the USACE provide a depth at points in the channel where ledge or bedrock exist for the contractor’s knowledge?

A9. Please find supplemental documents to the Browns Creek sampling and physical data report attached to this amendment. The USACE does not have a compiled record of points in the channel where ledge or bedrock exist.

Q10. For the options, will all of the boats in the slips be removed prior to dredging?

A10. Please refer to Section 01 30 00 Administrative Requirements paragraph 1.10.e Obstructions for further information on obstructions. Please refer to previous answer for further information with respect to Options 1-3 and Section 01 11 00 paragraph 1.8 for information with respect to Existing Work (i.e.

“…vehicles, vessels, and other property along the routes used by the Contractor’s plant…”.

Q11. Are endangered species monitors required for hydraulic dredging outside of the dredging operations during 1/15 to 6/30?

A11. Please refer to Section 01 57 20.00 10 Environmental Protection paragraph 1.14.1 Protection of Endangered and Threatened Species “… applicable only for work to be performed by Hopper Dredge…”.

Q12. Regarding this statement: “Records of previous dredging operations are available at the U.S.

Army Engineer District, New York, Operations Division, Operations Support Branch, Technical Support Section, Room 16-414, 26 Federal Plaza, New York, N.Y. 10278-0090. See Contract Clause entitled: "SITE INVESTIGATION AND CONDITIONS AFFECTING THE WORK" (FAR 52.236-3).” Can these records be provided to bidders?

A12. Please find 2005 maintenance dredging cycle closeout report amended to this solicitation.

Q13. Can a copy of the NYSDEC Water Quality Certificate (WQC) be provided?

A13. The NYSDEC WQC is currently pending and will be amended to this solicitation no less than 5 calendar days prior to the opening of bids.Q14. Will the government provide pipelines from the CDF discharge location into the waterbody along with a ramp to cover the CDF discharge pipeline(s)?

Q14. Will the government provide pipelines from the CDF discharge location into the waterbody along with a ramp to cover the CDF discharge pipeline(s)?

A14. The work to be performed under this project consists of the Contractor furnishing all materials, plant, labor, equipment, and services to perform maintenance dredging of the contract areas with placement at the CDF. No “pipelines” or “ramps” will be provided. Please refer to Section 01 11 00 Summary of Work paragraph 1.2 Work Covered by the Contract Documents for further information.

Q15. We don't see a staging area on the plans. Where will the USACE provide a staging area for this project?

A15. The contractor should coordinate with local authorities to delineate any necessary staging areas.

Q16. Can we close down Browns River Road 2 and use that as a staging area for building pipeline? If so, can you describe or show the limits of the area that will be provided?

A16. Please refer to previous answer regarding delineation of staging areas.
