About this file

This amendment modifies a solicitation for maintenance dredging of the Sandy Hook Federal Navigation Channel in New York Harbor. The Army Corps of Engineers seeks to dredge approximately 96,120 cubic yards of material from the channel and place it at a contractor-secured upland site between April 1st and November 14th for one area and between September 1st and February 28th for another. Bidders must acknowledge receipt of the amendment by the specified date and bid on all line items, which include mobilization, basic dredging and placement work, installation of a monitoring unit, and an option for dredging and placement at an offshore borrow area. The amendment provides answers to bidder questions, adds survey data, and adjusts quantities and timelines. Award is targeted for early-to-mid September with notice to proceed by the end of September in order to make use of the limited environmental windows.

NOTES TO BIDDERS:

NOTE 1: Bidders must bid on all items. Failure to bid on all work will be cause for rejection of the bid as nonresponsive.

NOTE 2: Award of contract will be based on the responsible and responsive bidder with the lowest total price for the total of the CLINs 0001-0004.

NOTE 3: The unit price for CLIN 0002 and CLIN 0004 represent the cost per cubic yard for the removal of the estimated quantities of dredged material (all material except ledge rock above the plane of -35 feet Mean Lower Low Water, plus 2 feet allowable over-depth).

NOTE 4: All bidders are hereby advised that the estimated dredge quantities for placement in the price schedule are estimated and based on the survey data collected on 24, 25, 31 May 2022.

NOTE 5: The Government may reject a bid as non–responsive if the prices bid are materially unbalanced between line items and if there is a reasonable doubt that the bid will result in the lowest overall cost to the Government even though it may be the low bid.

NOTE 6: Exercise of the option is at the discretion of the Government and may be exercised at the time of award, if it is exercised at all.

NOTE 7: Option 1 represents the difference in price per cubic yard (positive or negative) between the Basic Work with placement of dredged material at a contractor-furnished, state approved, upland placement site(s) (CLIN 0002) and SBOBA placement as noted in Option 1 (CLIN 0004). As an example, if placement at SBOBA is a lower cost than placement at an upland site, then the price per cubic yard for Option 1 would be negative to reflect the reduced cost of Option 1. If placement at SBOBA is a higher cost than placement at an upland site, then the price per cubic yard for Option 1 would be positive to reflect the increased cost of Option 1. If there is no difference in prices between upland and SBOBA placement, then the price per cubic yard for Option 1 would be zero.

NOTE 8: Should Option 1 be exercised, only dredging with placement at SBOBA will be required (Option 1).

NOTE 9: Should no Option be exercised, only dredging with placement at a contractor-furnished, state approved, upland placement site(s) will be required (Basic Work).

NOTE 10: It is the contractor’s responsibility to comply with all conditions and requirements of the SBOBA or upland placement site.

NOTE 11: Bidders are reminded that they must bid on the issued plans and specifications as amended.

Any deviations, conditions or attachments made by the bidder himself may render the proposal non-responsive and may be cause for its rejection.

AMENDMENT 0001

AMENDMENT 0001

Maintenance Dredging of Sandy Hook Channel, New York Harbor

Federal Navigation Project

W912DS-22-B-0013

The purpose of this amendment is to answer the following question(s) / incorporate the following revision(s) to the subject solicitation:

Bidder’s Question, Government Reply, Incorporated Revision (if applicable):

(Questions that may be of general interest to all Offerors and/or the Government and that are not readily answered by the proceeding changes will appear below. These questions may have been paraphrased or altered to represent several questions regarding the same subject and/or simply revised to clarify and simplify the question(s). Questions and answers are issued to the Offerors “for information only ”and do not revise the solicitation, plans or specifications.).

Q1. Page 2 of the NJDEP WQC Letter dated 05/23/22 (pg. 104/319 of specs), Item #2 states that, “no dredging shall occur at the western shoal between November 15 and March 31…” Pg. 122/319 of the specs state, “the contractor must comply with all conditions of the NJDEP WQC.” This same page also gives additional no dredging windows of: March 1 through August 31, and November 15 through December 31. Please confirm the various no dredging windows are a combination of the specs and NJDEP WQC, resulting in an allowable dredging window of September 1 through November 14 for this project.

A1. The NJDEP WQC requires a no dredging window of November 15 through March 31 for the Western shoal ONLY. The USFWS requires a no dredging window of March 1 through August 31 for the Eastern shoal/beach spit ONLY. This amendment confirms that the allowable dredging window for the Western shoal is April 1 to November 14; and the allowable dredging window for the Eastern shoal is September 1 to February 28.

Q2. Will USACE provide the NJDEP WQC required Dredging Inspector, or will the contractor need to source and compensate a 3rd party inspector to perform the twice per week dredge inspections?

A2. USACE will provide the NJDEP WQC required Dredging Inspector to perform the twice per week dredge inspections. The contractor does not need to source a 3rd party inspector for this NJDEP WQC requirement.

Q3. When will USACE provide the XYZ data from the survey shown in the Plans?

A3. The XYZ data from the survey shown in the Plans has been posted with this Amendment.

Q4. Bid items 0002 and 0004 each have a quantity of 134,240 cubic yards. However, spec section 01 11 00 - 1.2.1 Summary of Basic Work shows a dredging quantity of 96,120 cubic yards. Section 01 30 00 1.9 Estimated Quantities also reflects 96,120 CY.

Does the bid quantity of 134,240 include estimated accretion? Please clarify.

A4. 96,120 CY is the correct volume obtained from the Plans and Specifications Survey conducted on 24-31 May 2022. The bid schedule has been updated to reflect the correct volume.

Q5. Spec Section 01 11 00 Page 5 states, “Site Control Services, signs and fencing shall remain active on site until scarping and overall disturbance of the beach at the dredging area has stabilized and general safety of the area at the dredging location is held to be acceptable.” After this area was dredged on the previous project, how many additional days did it take for the shoreline to stabilize and for security to be released?

A5. The shoreline stabilized in approximately 2 weeks. Security was released shortly after.

Q6. The 2021 NPS Special Use Permit shows a “Cost Recovery” fee of $39,600. Does USACE pay that fee directly or is the contractor expected to include the fee in their bid?

If the contractor must include it, what is the fee for this year?

A6. The contractor is responsible for the “Cost Recovery” fee. The fee for this year is expected to be similar to the fee listed within the 2021 NPS Special Use Permit.

Q7. Spec section 01 35 26_1.6.1.4.2 SSHO Requirements & 1.6.1.4.3 CDSO Requirements – If the contractor is working 24 hours per day, and an SSHO is on-site during the primary shift and remains available by phone 24/7, it is acceptable for CDSOs to provide on-site safety coverage for the remaining shift(s) in the 24-hour period, or does an SSHO need to be on-site 24 hours per day?

A7. A USACE Safety Office approved full-time SSHO or Alt-SSHO must be on the project site at all times for each shift. The definition of a project site does not include hotel rooms or local offices. The SSHO or Alt-SSHO cannot dual hat in collateral duty position.

Q8. With the narrow allowable work window due to the environmental restrictions, how soon after the bid does the Gov’t anticipate making award and then NTP?

A8. Award is anticipated in early to mid-September. NTP will be issued by the end of September.

Q9. There appears to be at least 17 Pre-Construction Submittals required by this contract. Considering the contract allowable duration of only 26 days and the narrow environmental window, how quickly will the government review/approve the contractor’s submittals so they can begin work as soon as possible after receiving NTP?

A9. Review of the contractor’s preconstruction submittals will occur as soon as submittals are received.

This amendment does not change any other parts of the solicitation.
