PART 1 GENERAL

1.1 FAR 52.211-10, COMMENCEMENT, PROSECUTION AND COMPLETION OF WORK

a. The Contractor shall be required to (i) commence work under this contract within five (5) calendar days after the date the Contractor receives the Notice to Proceed, (ii) prosecute the work diligently, and

(iii) complete the entire work ready for use, not later than 26 cal endar days after the date the Contractor receives the notice to proceed. The time stated for completion shall include mobilization, de-mobilization and final cleanup of the project area.(FAR 52.212-3)

b. All work shall be in accordance with the drawings and specifications or instructions attached hereto and made a part thereof, or to be furnished hereafter by the Contracting Officer or Contracting Officer Representative (COR)and subject, in every detail, to his supervision, direction, and instructions.

1.2 WORK COVERED BY THE CONTRACT DOCUMENTS

1.2.1 Project Description

The work to be performed under this project consists of providing all materials, plant, labor, equipment and services (except those furnished by the Government) to perform maintenance dredging of an area within the New York Harbor, Sandy Hook Channel , with at a contractor furnished, state permitted, Government approved upland placement site(s) or placement of the material at the South Sea Bright Offshore Borrow Area (SBOBA).

Dredged material placement at SBOBA shall only be placed within the approximately 93-acre placement area in SBOBA with coordinates as identified on the contract plans. The contractor will be solely responsible for coordination and compliance with the transportation, offloading, and placement site(s) requirements. See SECTION 35 20 23.10 18 and SECTION 35 20 29 for more information about dredged material transport, placement and monitoring.

The Maintenance for this project consist of dredging approximately 96,120 CY of material based on a survey done on 24, 25, 31 May 2022. For more detail, see "ESTIMATED QUANTITIES" in Section 01 30 00 "ADMINISTRATIVE REQUIREMENTS" of these Specifications. The dredge material has been determined to be composed sand and gravel.

A summary of the Basic Work and Options are shown on the table below:

TOTAL

ESTIMATED

QUANTITY (CY)

CONTRACT TIME FOR

COMPLETION

(Calendar Days)

SECTION 01 11 00 Page 2

BASIC WORK - Dredging, Transportation and Placement of Dredged Material to a contractor-furnished, state approved, upland placement site(s)(-35 feet MLLW + 2 feet overdepth)

96,120 26

OPTION 1 - Dredging, Transportation, offloading, and Placement of Material from Basic Work Dredging Area

(CLIN 0002) at SBOBA.

This Line Item represents the price difference

(positive or negative) between the Basic Work and Option 1.

96,120 26

Contract time for completion is based on a minimum average production rate of 8, 000 cubi c yar ds ( CY) per day for dredging, transportation and placement at a contractor furnished, state permitted, Government approved upland placement site(s). Should the total quantity of material exceed the estimated quantities within the Solicitation Contract Form, additional time will be allowed at the rate of one (1) calendar day for each 8,000 cubic yards in excess of the established limit. The time stated for completion shall include final clean up.

The contractor must bid on all items of the bid schedule. The following CLINs require dredging of the NY Harbor, Sandy Hook Channel, NJ Federal Navigation Project:

CLI N 0002 BASI C WORK - requires dredging to the plane of -35 feet Mean Lower Low Water (MLLW) plus 2 feet allowable overdepth, with subsequent transportation, and placement of the dredged material at a contractor furnished, state permitted, Government approved upland site(s).

CLI N 0004 OPTI ON 1 - requires dredging to the plane of -35 feet Mean Lower Low Water (MLLW) plus 2 feet allowable overdepth, with subsequent transportation, and placement of the dredged material at SBOBA.

Opt i on 1 represents the difference in price per CY (positive or negative) between the Basic Work with placement of the dredge material at a contractor-furnished, state approved, upland placement site(s) (CLIN 0002) and at the SBOBA as noted in Option 1 (CLIN 0004). For example, if placement at SBOBA would be lower cost than placement at an upland site, then the price per CY for Option 1 would be negative to reflect the reduced cost. If placement at SBOBA is higher cost than placement at an upland site, then the price per CY for Option 1 would be positive to reflect the increased cost of Option 1. If there is no difference in prices between upland and SBOBA placement, then the price per CY for Option 1 would be zero.

Exercise of the option is at the discretion of the Government and may be exercised at the time of award, if it is exercised at all. The minimum average production rate for the option remains the same at 8, 000 cubi c yar ds ( CY) per day for dredging, transportation, and placement at SBOBA.

Should Option 1 be exercised, only dredging with placement at SBOBA will be required.

Should no Option be awarded, only dredging with placement at a contractor-furnished, state approved, upland placement site(s) will be required (Basic Work).

SECTION 01 11 00 Page 3

Scow monitoring is required for this project. The contractor is required to comply with SECTION 35 20 29 entitled "DREDGED MATERIAL TRANSPORT AND PLACEMENT MONITORING", of these specifications if only BASIC WORK is awarded. If the Option is exercised, the contractor is required to comply with SECTION 35 20 23.10 18 entitled "SBOBA DREDGED MATERIAL TRANSPORT AND PLACEMENT MONITORING", of these specifications.

Grain size sampling was conducted by the Government in 2017, and the grain size test results are included in the specifications in Section 00 90 01 as Attachment J . The complete grain size analysis report can be found as attachments to this solicitation on beta.SAM.Gov. Using the 2017 results, the Apparent Low Bidder shall coordinate with the State(s) to obtain necessary transportation, offloading, and disposal permits/requirements of the site(s) identified by the Apparent Low Bidder.

The New Jersey Department of Environmental Protection (NJDEP) Water Quality Certificate (WQC) for the maintenance dredging cycle of the New York Harbor, Sandy Hook Channel, NJ Federal Navigation Project is included in Section 00 90 02 . The contractor must comply with all conditions of the NJDEP WQC. A copy of NJDEP WQC shall be displayed on the dredge at all times for the duration of the project.

U.S. Fish and Wildlife Service (USFWS) issued a Biological Opinion on October 2017 entitled "Biological Opinion on The Effects of Recurrent Maintenance Dredging of The Sandy Hook Channel, Monmouth County, New Jersey on Four Federally Listed Species" (FBO)

1. The issued Biological Opinion contains dredge window restrictions for the the Sandy Hook Federal Navigation Channel. No dredging of beach or any subtidal area within 300 feet of the MLLW lines shall be performed from 1 March to 31 August of each year to protect Piping Plovers.

2. No installation or removal of security fencing, pipeline, or any other temporary structures on the beach shall be performed from 1 March to 31 August of each year to protect Piping Plovers.

3. Should dredging occur between September 1 and November 30 , the Corps will arrange for a survey of all beach within the impact area for the presence of seabeach amaranth plants no more than 14 days before the start of each dredging action. The Corps will mark any plants occurring inside the impact area, but outside of the sand removal area, with string-and-post fencing and appropriate signage.

Project personnel and vehicles shall not disturb seabeach amaranth plants within the fencing.

National Oceanic and Atmospheric Administration (NOAA) issued a no-dredge window for the most western shoal from 15 November to 31 December to protect winter flounder and blue crabs.

Security: The Contractor shall provide unarmed Site Control Services, including a 4x4 vehicle to secure the beach access points at Parking Lots M and J located in Sandy Hook, for 24 hours per day, 7 days per week.

Site Control Service personnel cannot be the SSHO and cannot have other duties. Ensuring that the beach remains closed off to the public in the location of the dredging work will be their sole responsibility and they will conform with the requirements of the National Park Service. The Site Control Service Personnel shall maintain adequate communication with

SECTION 01 11 00 Page 4

National Park Service Officers and Dispatch as necessary. The Contractor and the Site Control Service Personnel shall review the requirements set forth in the National Park Service (NPS) Special Use Permit and ensure all conditions of Special Use Permit shall be followed. The NPS Special Use Permit for the previous maintenance dredging cycle of Sandy Hook Channel can be found in Section 00 09 02. An NPS Special Use Permit for this dredging cycle will be provided to the contractor prior to construction, The contractor shall erect a fence around the work area that is along the shoreline in order to keep the public from accessing the work area in coordination with the National Parks Service request. See Section 00 09 02 for National Park Service Special Use Permit requirements.

Three (3) large signs shall be placed at the fence line at each end of the fence closure and additional signs shall be posted at the beach access points at Parking Lots M and J in Sandy Hook National Recreational Area.

These signs shall be 3'x 3' and include wording indicating; Beach Closed, Dredging Project, and Beach Collapse Hazard. The signs shall contain a warning drawing identifying the hazards of the sandy beach collapse into deep water adjacent to dredging operations. Other signs shall be posted along the fence line in accordance with Section 01 50 00 Temporary Construction Facilities And Controls - Paragraph 2.2.4.

Site Control Services, signs and fencing shall remain active on site until scarping and overall disturbance of the beach at the dredging area has stabilized and general safety of the area at the dredging location is held to be acceptable. Prior to the expiration of the National Park Service Special Use Permit or at the direction of the USACE and National Park Service, all signs, fencing, and appurtenances shall be removed from the Project Area.

Due to the inability for a hopper dredge to safely complete the work during a previous dredging cycle, it is recommended that a hopper dredge not be used to complete the anticipated work.

The work is anticipated to be performed within the approximate time period of September 2022 through February 2023.

1.3 PERFORMANCE OF WORK BY THE CONTRACTOR

The Contractor shall perform on the site, and with its own organization and equipment, work equivalent to at least forty (40) percent of the total amount of work to be performed under the contract. This percentage may be reduced by a supplemental agreement to this contract if, during performance of the work, the Contractor requests a reduction and the Contracting Officer and/or his Representative determines that the reduction would be to the advantage of the Government. (FAR 52.236-01)

1.4 FARS 36.204, DISCLOSURE OF THE MAGNITUDE OF CONSTRUCTION PROJECTS

The entire work (Mob/Demob, Basic Work and Options) is estimated to cost approximately $1,000,000.00 to $5,000,000.00.

1.5 DATUM AND BENCH MARKS

Soundings and Elevations shown in the contract drawings are in US Survey Feet and refer to Mean Lower Low Water (MLLW) [EPOCH 1983-2001]. The Plane of MEAN LOWER LOW WATER (MLLW) is 2.8 FEET BELOW NAVD88 AS DETERMINED USING VDATUM (VER. 4.3). The following Benchmark information

1.2 JOB PAYMENT ITEMS

Payment items for the work of this contract for which contract job payments will be made are listed in the BIDDING SCHEDULE and described below. All costs for items of work, which are not specifically mentioned to be included in a particular job or unit price payment item, shall be included in the listed job item most closely associated with the work involved. The job price and payment made for each item listed shall constitute full compensation for furnishing all plant, labor, materials, and equipment, and performing any associated Contractor quality control, environmental protection, meeting safety requirements, tests and reports, and for performing all work required for which separate payment is not otherwise provided.

1.2.1 Mobilization and Demobilization

1.2.1.1 Payment

Payment will be made for costs associated with mobilization and demobilization, as defined in Special Clause PAYMENT FOR MOBILIZATION AND

DEMOBILIZATION.

Mobilization shall include all costs for operations accomplished prior to commencement of actual dredging operations, such as transfer of dredge and attendant plant and equipment to site, initial installations of pipe, preparation of beach fill areas, and other incidentals in advance of the actual dredging. Demobilization shall include general preparation for transfer of plant to home base, removal of pipelines, cleanup of beach fill areas, and transfer of plant to its home base. The cost of work other than mobilization and demobilization of the Contractor's dredging plant and equipment shall not be included in this item. For payment for Mobilization and Demobilization see contract clause Section 00 72 00 Contract Clauses.

All costs connected with the mobilization and demobilization of all of the contractor's dredging plant and equipment will be paid for at the contract lump sum price for this item. 60 percent of the lump sum price will be paid to the Contractor upon completion of his mobilization to the work

SECTION 01 22 00.00 10 Page 2 site. The remaining forty percent 40 percent will be included in the final payment for work under this contract.

In the event the Contracting Officer and/or his Representative considers that the amount in this item 60 percent, which represents mobilization, does not bear a reasonable relation to the cost of the work in this contract, the Contracting Officer and/or his Representative may require the Contractor to justify this portion of the bid. Failure to justify such price to the satisfaction of the Contracting Officer and/or his Representative will result in payment of actual mobilization costs as determined by the Contracting Officer and/or his Representative, at the completion of mobilization and payment of the remainder of this item in the final payment under this contract. The determination of the Contracting Officer and/or his Representative is not subject to appeal.

1.3 UNIT PRICE PAYMENT ITEMS

Payment items for the work of this contract on which the contract unit price payments will be made are listed in the BIDDING SCHEDULE and described below. The unit price and payment made for each item listed shall constitute full compensation for furnishing all plant, labor, materials, and equipment, and performing any associated Contractor quality control, environmental protection, meeting safety requirements, tests and reports, and for performing all work required for each of the unit price items.

1.3.1 Dredging

1.3.1.1 Payment

Payment will be made for costs associated with dredging of the project, which includes performing required dredging and other operations incidental thereto Contractor-furnished disposal area(s) and disposition of dredged material.

1.3.1.2 Measurement

The total amount of material removed and paid for under the contract will be measured by the cubic yard dredged. Measurement of the number of cubic yards dredged will be made by computing the volume between the bottom surface shown by soundings of the last survey made before dredging and the bottom surface shown by soundings of the survey made as soon as practicable after the entire work specified has been completed. The volume for measurement shall include the material within the limits of the overdepth, side slopes described in SECTION 35 20 23, Paragraph 1.5 Quantity of Material, 1.6 Overdepth Dredging, and 1.7 Side Slopes.

The soundings maps and/or drawings accurately represent the channel conditions existing as of May 2022 in NY Harbor, Sandy Hook Channel, New Jersey. The soundings shown on the contract drawings were taken with an electronic depth recorder and/or multi-beam surveying system with a transducer frequency of 200-400 KHz. New soundings will be taken generally two weeks prior to dredging. Soundings after dredging will be made by an electronic depth recorder with a transducer frequency of 200-400 KHz or may be made by using a multi-beam surveying system of the same frequency. After-dredging-surveys will be completed generally within five days of completion of the project. Determination of quantities to be paid in the area specified after having been made once, will not be reopened, except on evidence of collusion, fraud or obvious error.

SECTION 01 22 00.00 10 Page 3

Computations for payment purposes will generally be made by the Corps of Engineers utilizing the Triangulated Irregular Network (TIN) method.

Shoaling in the areas to be dredged on this project does not occur at a rapid rate from existing depths. However, the unit price for dredging based on the above method of computation of the quantity for which payment is to be made shall include the Contractor evaluation of shoaling, changes in the regime of the waterway, or changes caused by the Contractor's operations that may occur during the period between the survey before dredging and the survey for acceptance of work.

Scows and Hopper Dredges: Where scows and hopper dredges are used in performance of work and where the Contractor maintains load measuring devices on such scows or hopper dredges, copies of all recorded measurements made in connection with the work shall be furnished to the Contracting Officer and/or his/her representative. If as the work progresses the Contractor determines that a significant difference exists between the recorded bin or scow quantities and the survey quantities computed from the check surveys described above, he shall immediately notify the the Contracting Officer and/or his/her representative of any such discrepancies. Such notification shall include a description of the Contractor's methods of measuring scow or bin quantities, certification of measuring techniques, documentation of material sampling and methods used to convert bin or scow measurements to in-place density.

It is emphasized that bin or scow measurements shall not be used as basis for partial or final payments.

14-day partial payments will be based on approximate quantities determined by soundings or sweepings taken behind the dredge by the Contractor. The Contractor soundings are to be used for partial payments only and will not form a basis for the acceptance of the work.

The Contractor must inform the Government, in witting, within three calendar days of completing the work.

The total quantity of excavated material for which payment will be made will be the theoretical quantity between the ground surface as determined by a survey and the grade and slope of the theoretical cross sections indicated. No allowance will be made for the removal of any material outside the required slope lines unless authorized.

When the Government perform surveys using multibeam, the data will be binned using the median soundings for contours and volumes. The maximum bin size will not exceed 3'x3'.

In the event that unforeseen obstructions or hard material is discovered, shoals in these areas will be assessed using the minimum sounding within the bin. This method will not be used for computation.
