Response: The reference to FILL MATERIALS in section 35 41 00 paragraph 1.2.4, is referring to paragraph 1.3.1 Levee Fill and Backfill Materials.

Question No. 33: 1) Section #11 of Section 007300 – “Special Contract Requirements” list the requirements of the Government Field Office. Bid Item #0023 – 0026 are Optional Items for Government Field Office for 6 months each. Please clarify if a Government Field office is Required, for the 1,222 day duration, and Section #11 should be included in our Base Bid Cost regardless? Or will a field office (section 11 requirements ) only be required if the Optional Bid Items are exercised? Are Optional Bid Item #0023 – 0026 to cover the maintenance cost for extra 6 month periods after the original 1,222 calendar project, or is Item #0023 to cover the field office set up, and first 6 months of this project? Then bid item #0024 covers the next 6 months, and so on? Please clarify these optional items, and the Government Field Office requirements.

Also, Section #53 of 007300 requires the contractor to provide 1 vehicle for Government use. Is that for the entire

1,222 duration of the project and included in the Base Bid items, or should we include 6 months of use in each Optional Bid Item #0023 – 0026?

Response: The Government field office is not part of the basic contract. The Government field office is only required if Options 3, 4, 5 and/or 6 are exercised. Each Government field office option is for a six month duration.

The vehicle for Government use is included in the basic contract for the entire duration of the contract.

Question No. 34: 2) Section A on plan sheet C-102 calls out the sheeting for the temporary diversion channel to be PZC-18 with a top of wall elevation of 4.0 and a tip elevation of -26.0. However note 2 on page S-901 stations that the diversion channel sheeting is to be PZC-26 with a tip elevation of -55.0. Please clarify the sheet pile size and the top and tip elevations for the diversion channel sheeting.

Response: The diversion channel sheeting on sheet C-102 be amended to state PZC-18 with a top of wall elevation of +4.0 and a tip elevation of -45.0. The diversion channel note 2 on page S-901 will be amended to state PCZ-26 with a tip elevation of -45.0.

Question No. 35: There are a few discrepancies between dimensions. Please clarify them. Also, there is no drawing for lintel beam. Please clarify whether lintel beam is existing one and so we do not need to manufacture it?

Response: Drawing S-705 has been edited as part of this amendment. The dimension discrepancies have been corrected. Drawing S-704 will be edited during an upcoming Amendment. Masonry lintel beams are detailed on S- 503.

Question No. 36: Please clarify the responsibility of the contractor with regards to the design of Temporary Cofferdam and Temp Diversion Channel. Drawing C-102 says that the drawings are conceptual, and spec section 31 41 16 states contractor must submit a design of the temporary cofferdam for approval. But drawing S-901 provides very exact design drawings for both the Temporary Cofferdam and Temp Diversion Channel. If the contractor elects to build these items as shown on drawing #S-901, we assume no design work needs to be performed by the Contractor? Can the Contractor select and design a totally different method of temporary cofferdam and diversion channel if they so choose, or should it be built in accordance with drawing S-901 no matter what?

Response: The contractor shall design the temporary cofferdam based on his work plan and equipment and considering the loading conditions and other requirements discussed in the specifications. The contractor may select a different design as shown on the drawings for the temporary cofferdam. The information presented in the plans are for bidding purposes only.

Question No. 37: The staging area shown on drawing C-100 is very small, and will barely be able to fit the Gov’t field offices or contractor field offices and parking. Will additional staging areas be provided by the Army Corp for the required equipment and material storage?

Response: No other staging areas will be provided. Area shown is sufficient for trailer and parking. See Section 00 73 00, paragraph 11 on Contracting Officer's field office.

Question No. 38: It appears nearly all access to build this project will be done along the top of the existing Keansburg Levee. Drawing C-105A shows final adjustments to the existing levee. But this project will require large equipment such as wide cranes and trucks to access the work area on top of the levee. Can the existing levee be widened at the top to handle wide and heavy loads to be brought along it? We assume the designer has checked the stability of the existing levee for the temporary additional fill loading and construction loading? If not, please provide access means and locations to get to the project site.

Response: Specification 01 55 26 Traffic Control Section SD-01 Preconstruction Submittals will be revised as part of a future amendment to include additional language allowing widening of the levee. If proposed, any temporary widening of the Keansburg levee shall be to east toward the work area only. Any modifications to levee shall be shown on the plans. A lope stability analysis of the levee with a modifications shall be conducted and provided with traffic control plan. Access on the Keansburg Levee shall be limited to one-way traffic only. Any modification needed for widening of the Levee shall be at no cost to the Government. The levee shall be restored to the lines and grades shown on the drawings after construction completion.

Question No. 39: The contract documents appear to state that the Contractor shall hire a JCP&L approved subcontractor to install the JCP&L below grade and above grade JCP&L work items, and that NTE Item #19 only covers JCP&L material supply and JCP&L inspection/oversight. But drawing E-101, Note #2 states that JCP&L shall furnish and install…. Please revise that Note #2 accordingly to minimize confusion.

Response: E-101, Note 2 has been revised. See Amendment #1.

Question No. 40: Spec section 00 21 16, subpart “General Instructions” states that bidders shall submit their bids in both hard copy and on a CD. Please confirm that we must include a CD version of the bid. On the most recent Port Monmouth Phase II, Contract 3 the bidders only submitted hard copies. The requirement of a CD may require a contractor to fill out the entire proposal and make a CD before they leave the office hours before the bids are due.

This may prevent a contractor from taking last minute price reductions before submitting the bid, and therefore the Owner won’t receive the most cost effective proposal. We request this requirement be removed from the contract documents.

Response: The "General Instructions" section under subpart 00 21 16 will be removed in its entirety. No CD will be required.

Question No. 41: On the 1442 form, box 14 has a space for Code and Facility code. Are any of those boxes pertaining to NCAIS # and/or Duns #?

Response: When filling in Box 14, please include your CAGE code in the space for "Code". The Facility Code box can be left blank.

Question No. 42: When returning bid original, bid paper copy and bid CD copy will that be the 76 page solicitation or do I make and hand in 2 paper copies and CD copy of the 1,467 page spec book?

Response: The 76 page solicitation will suffice. Also, as noted above, no CD will be required for this solicitation.

Unlisted classifications needed for work not included within the scope of the classifications listed may be added after award only as provided in the labor standards contract clauses (29CFR 5.5 (a) (1) (ii)).

The body of each wage determination lists the classification and wage rates that have been found to be prevailing for the cited type(s) of construction in the area covered by the wage determination. The classifications are listed in alphabetical order of "identifiers" that indicate whether the particular rate is a union rate (current union negotiated rate for local), a survey rate (weighted average rate) or a union average rate (weighted union average rate).

Union Rate Identifiers

A four letter classification abbreviation identifier enclosed in dotted lines beginning with characters other than "SU" or "UAVG" denotes that the union classification and rate were prevailing for that classification in the survey. Example:

PLUM0198-005 07/01/2014. PLUM is an abbreviation identifier of the union which prevailed in the survey for this classification, which in this example would be Plumbers. 0198 indicates the local union number or district council number where applicable, i.e., Plumbers Local 0198. The next number, 005 in the example, is an internal number used in processing the wage determination. 07/01/2014 is the effective date of the most current negotiated rate, which in this example is July 1, 2014.

Union prevailing wage rates are updated to reflect all rate changes in the collective bargaining agreement (CBA) governing this classification and rate.

Survey Rate Identifiers

Classifications listed under the "SU" identifier indicate that no one rate prevailed for this classification in the survey and the published rate is derived by computing a weighted average rate based on all the rates reported in the survey for that classification. As this weighted average rate includes all rates reported in the survey, it may include both union and non-union rates. Example: SULA2012-007 5/13/2014. SU indicates the rates are survey rates based on a weighted average calculation of rates and are not majority rates. LA indicates the State of Louisiana. 2012 is the year of survey on which these classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination. 5/13/2014 indicates the survey completion date for the classifications and rates under that identifier.

Survey wage rates are not updated and remain in effect until a new survey is conducted.

Union Average Rate Identifiers

Classification(s) listed under the UAVG identifier indicate that no single majority rate prevailed for those classifications; however, 100% of the data reported for the classifications was union data. EXAMPLE: UAVG-OH-0010 08/29/2014. UAVG indicates that the rate is a weighted union average rate. OH indicates the state. The next number, 0010 in the example, is an internal number used in producing the wage determination. 08/29/2014 indicates the survey completion date for the classifications and rates under that identifier.

A UAVG rate will be updated once a year, usually in January of each year, to reflect a weighted average of the current negotiated/CBA rate of the union locals from which the rate is based.

WAGE DETERMINATION APPEALS PROCESS

1.) Has there been an initial decision in the matter? This can be:

* an existing published wage determination

* a survey underlying a wage determination

* a Wage and Hour Division letter setting forth a position on a wage determination matter

* a conformance (additional classification and rate) ruling

On survey related matters, initial contact, including requests for summaries of surveys, should be with the Wage and Hour Regional Office for the area in which the survey was conducted because those Regional Offices have responsibility for the Davis-Bacon survey program. If the response from this initial contact is not satisfactory, then the process described in 2.)

and 3.) should be followed.

With regard to any other matter not yet ripe for the formal process described here, initial contact should be with the Branch of Construction Wage Determinations. Write to:

Branch of Construction Wage Determinations Wage and Hour Division U.S. Department of Labor 200 Constitution Avenue, N.W.

Washington, DC 20210

2.) If the answer to the question in 1.) is yes, then an interested party (those affected by the action) can request review and reconsideration from the Wage and Hour Administrator (See 29 CFR Part 1.8 and 29 CFR Part 7). Write to:

Wage and Hour Administrator U.S. Department of Labor 200 Constitution Avenue, N.W.

Washington, DC 20210

The request should be accompanied by a full statement of the interested party's position and by any information (wage payment data, project description, area practice material, etc.) that the requestor considers relevant to the issue.

3.) If the decision of the Administrator is not favorable, an interested party may appeal directly to the Administrative Review Board (formerly the Wage Appeals Board). Write to:

Administrative Review Board U.S. Department of Labor 200 Constitution Avenue, N.W.

Washington, DC 20210

4.) All decisions by the Administrative Review Board are final.
