AMENDMENT 0005
Job Order Contract Seneca Army Depot Activity
AMENDMENT 0005
1. The following changes shall be made to the Solicitation/RFP:
The following is added to RFP Section 00110 – II. Price Proposal:
A. Specification for Gordian Group software The Contractor shall be required to purchase licenses to The Gordian Group's Internet based JOC management system, eGordian(r), for use by Seneca Army Depot and the Contractor(subsequently referred to here as “Gordian software”). The contractor shall use the software for preparing and submitting proposals. The Government may use the software to prepare estimates, receive electronic proposals from the Contractor and manage the JOC process. The Contractor will need a broadband Internet connection to access eGordian(r).
eGordian(r) requires a yearly subscription for each user. The cost of subscriptions for the Contractor shall be paid for by the Contractor on the anniversary of the contract. The estimated cost of the first year is $15,885.00, which includes all set‐up fees, one (1) government user license, a minimum of one
(1) user license for the contractor, Construction Task Catalog(r) and Technical Specifications. Additional user subscriptions may be added for an estimated cost of $1,390.00 each with annual renewals estimated at $895.00 each. These prices include the Proposal Preparation and Submittal Modules.
Software Training
The Contractor shall be required to purchase The Gordian Group's eGordian(r) software training for the Government and Contractor staff at an estimated cost of $5,500.
The Contractor may submit an invoice for payment of the initial cost of $21,385 upon award of the contract. Future renewal costs and any additional licensed required by the contractor will then be included as part of the owner’s coefficient and not invoiced for separately.
2. Q&A – W912DS‐12‐R‐0003
Q1. Is there a scheduled site visit or pre‐proposal conference scheduled for this
SOL?
A1. No Site Visit or Pre‐proposal Conference was scheduled.
Q2. Is Progen going to be used as the proposal processing software from the Gordian Group?
A2. Yes, Gordian Group’s Progen software is to be used for this Job Order Contract.
Q3. The contractor is to submit their price proposal on the solicitation page 3 of 93, along with other items. The tem “Contractors Coefficient %” is used. Is this term “Contractors Coefficient %” what is described as “The Adjustment Factors” as used in the “Construction Task Catalog” specification 00 – 2.
A3. The “Contractors Coefficient %” and the “Adjustment Factor” referred to in the Construction Task Catalog are the same.
Q4. Is there an existing JOC in place at Seneca Army Depot Activity? If so, is the current JOC contractor a verified SDVOSB?
If there is a current JOC in place, can the USACE provide the current‐year coefficients.
How often are the Construction Task Catalogs updated? The version included in the Solicitation is dated February 2012.
Can Past Performance Questionnaires be electronically mailed to you, or do you prefer original + four copies mailed via USPS, as required for the Proposal?
A4. No, there is not currently an existing JOC in place at SEDA. PPQs can be sent by the offeror in their proposal or by the client, emailed to the Contract Specialist at matthew.lubiak@usace.army.mil.
Q5. Page. 65‐66 ‐ 1.4.3.1. refers to Table C‐2. This Table does not appear in the Solicitation.
Page. 65‐66 ‐ 1.4.3.1. refers to pages C‐7 through C‐9. These pages do not appear in the Solicitation.
Page 66 ‐ 1.4.3.2 states a list of abbreviations for UPB is included as attachment to Solicitation. Other than Wage Determination, there are no attachments to Solicitation.
Page 66 ‐ 1.4.7 refers to Table C‐3. This Table does not appear in the Solicitation.
A5. Table C‐2 is provided as an attachment to this Amendment. The Unit Price Book (UPB) is the “Construction Task Catalog”.
Q6. On Pg 7, Item 1.)a. states: “ Explain plan for interaction between the Government and Contractor staff. Provide an organizational chart to clearly delineate the lines of authority and leadership of key personnel and project managers. Outline the proposed corporate and on‐site staff, their resumes, responsibilities and authorities with regard to this contract and how they will interface with each other.”
Can you please clarify what is meant by: “Outline the proposed corporate and on‐ site staff, their resumes, responsibilities and authorities with regard to this contract and how they will interface with each other.” How do we outline a resume? What are you looking for exactly?
A6. Offerors must specify how are they planning on running the contract, and who their key personnel are, such as who runs the company, who will run the contract and work efforts in the field if different for the work and for the contract, and their qualifications/resumes as specified.
This factor evaluates their qualifications; this needs a description of how they are planning to do the work and how experienced and knowledgeable their personnel are to evaluate the technical qualifications of bidding contractors to perform the work.
For example, does the president of the company manage all work, or will there be a project manager, and/or site supervisor, multiple supervisors/managers for different work such as utilities or construction or the same supervisor/manager for all, sub‐contractors for some or all of the work, and what kind of experience all have to perform the work.
Q7. The RFP states that a complete QC Plan must be included with the proposal.
The page limit for the proposal is 75 pages. Our QC Plan, itself, is 74 pages.
Do you really want us to include an entire QC Plan and, if so, can it be exempt from page count?
A7. The QC Plan does not count toward the page limit.
Q8. In preparing the proposal we see that you have asked for a payment and performance bond, which we can provide upon award of particular projects.
We also noticed you are asking for a "Bid guarantee". It is not clear to us what you are asking for here as there is not a specific project we are bidding on.
Would you please clarify this for us?
A8. Payment and Performance Bonds will be required of the awardee for the minimum guaranteed amount, which is $20,000. Additional Payment and performance bonds may be required for individual Job/Task Orders. See amended clause 52.228‐15 included in this amendment.
Bid guarantee is required for the minimum guaranteed amount of the basic contract, which is $20,000. See amended provision 52.228‐1 included in this amendment.
3. Revised Wage Determination:
NOTE: The following three DOL Wage Determinations are applicable to the basic Job Order Contract (JOC) and Task Orders issued under the JOC. For individual task orders, the applicable determination shall be the one, either Highway, Heavy or Building, that represents a preponderance of the work for that task order.

Unlisted classifications needed for work not included within the scope of the classifications listed may be added after award only as provided in the labor standards contract clauses (29CFR 5.5 (a) (1) (ii)).
The body of each wage determination lists the classification and wage rates that have been found to be prevailing for the cited type(s) of construction in the area covered by the wage determination. The classifications are listed in alphabetical order of "identifiers" that indicate whether the particular rate is union or non-union.
Union Identifiers
An identifier enclosed in dotted lines beginning with characters other than "SU" denotes that the union classification and rate have found to be prevailing for that classification. Example: PLUM0198-005 07/01/2011. The first four letters , PLUM, indicate the international union and the four-digit number, 0198, that follows indicates the local union number or district council number where applicable , i.e., Plumbers Local 0198. The next number, 005 in the example, is an internal number used in processing the wage determination. The date, 07/01/2011, following these characters is the effective date of the most current negotiated rate/collective bargaining agreement which would be July 1, 2011 in the above example.
Union prevailing wage rates will be updated to reflect any changes in the collective bargaining agreements governing the rate.
0000/9999: weighted union wage rates will be published annually each January.
Non-Union Identifiers
Classifications listed under an "SU" identifier were derived from survey data by computing average rates and are not union rates; however, the data used in computing these rates may include both union and non-union data. Example: SULA2004-007 5/13/2010. SU indicates the rates are not union rates, LA indicates the State of Louisiana; 2004 is the year of the survey; and 007 is an internal number used in producing the wage determination. A 1993 or later date, 5/13/2010, indicates the classifications and rates under that identifier were issued as a General Wage Determination on that date.
Survey wage rates will remain in effect and will not change until a new survey is conducted.
WAGE DETERMINATION APPEALS PROCESS
1.) Has there been an initial decision in the matter? This can be:
* an existing published wage determination
* a survey underlying a wage determination
* a Wage and Hour Division letter setting forth a position on a wage determination matter
* a conformance (additional classification and rate) ruling
On survey related matters, initial contact, including requests for summaries of surveys, should be with the Wage and Hour Regional Office for the area in which the survey was conducted because those Regional Offices have responsibility for the Davis-Bacon survey program. If the response from this initial contact is not satisfactory, then the process described in 2.)
and 3.) should be followed.
With regard to any other matter not yet ripe for the formal process described here, initial contact should be with the Branch of Construction Wage Determinations. Write to:
Branch of Construction Wage Determinations Wage and Hour Division U.S. Department of Labor 200 Constitution Avenue, N.W.
Washington, DC 20210
2.) If the answer to the question in 1.) is yes, then an interested party (those affected by the action) can request review and reconsideration from the Wage and Hour Administrator (See 29 CFR Part 1.8 and 29 CFR Part 7). Write to:
Wage and Hour Administrator U.S. Department of Labor 200 Constitution Avenue, N.W.
Washington, DC 20210
The request should be accompanied by a full statement of the interested party's position and by any information (wage payment data, project description, area practice material, etc.) that the requestor considers relevant to the issue.
3.) If the decision of the Administrator is not favorable, an interested party may appeal directly to the Administrative Review Board (formerly the Wage Appeals Board). Write to:
Administrative Review Board U.S. Department of Labor 200 Constitution Avenue, N.W.
Washington, DC 20210
4.) All decisions by the Administrative Review Board are final.
