p. 6 says “The Offeror shall provide (3) Past Performance Questionnaires from references for similar work completed in the last five (5) years.” If our projects have CPARs, should we include those instead?
CPARS assessments may be submitted if they meet the same criteria as the PPQ for recency and relevancy; solicitation amended.
Multiple firms requested an extension to the schedule:
o We are interested in bidding this project, but due to current market conditions 180 days to produce shop drawings, procure materials and fabricate this gate is extremely aggressive. We would like to request a minimum of 365 days to complete this project.
o I have a question regarding the subject project. Multiple fabricators have informed us that they will need 365 days to complete the new emergency gate and lifting beam. Can the project period of performance be extended to 420 days to account for the long lead time items?
o Please consider increasing the duration of the project form 180 days to 300 days. All major gate fabricators in the country are declining to bid this project currently due to the schedule. They cannot meet a 180 day schedule. Without a fabricator, no Prime contract will be able to bid the project, and we all typically use the same fabricators across the country for these projects.
o After speaking with multiple gate fabricators our understanding is that the current 180-day period of performance is not sufficient to complete the project. Most, maybe all, gate fabricators are very busy. The shop drawing, material procurement, and fabrication process will likely require about one year. Please consider extending the period of performance to at least one year if possible.
We would likely be able to get better pricing if the duration was extended to 15 months.
o The contract duration of 180 days is fast with field investigation, submittals, procurement, fabrication availability/fabrication, testing, painting, machine work, and onsite work. Would 270 calendar days be acceptable for a contract duration for the bulkhead. The lifting beam could be provided earlier.
The schedule will be extended to 365 days from the issuance of the second Notice to Proceed, after all submittals are approved; solicitation amended. See next question.
Please consider changing the start of the duration of the project to “from NTP” in lieu of “From award”.
From NTP is typical, and provides the time for P&P bonds to be issued. Typically, once bonds are secured, NTP is provided.
There will be two Notices to Proceed issued. The first NTP from the Administrative Contracting Officer (ACO) will initiate the preconstruction submittals and general project coordination. The second NTP will be issued once the submittals are approved. The second NTP is the beginning of the 365 days to complete the work; Solicitation amended.
Please confirm that we will need two dedicated positions to cover the three roles of
SSHO/Superintendent/QC Manager. It isn’t quite clear to us, but appears the Superintendent can be the SSHO, but can’t be the QC Manager. The QC Manager cannot have any other duties. Making two roles for the three positions.
A dual role for Super and SSHO is acceptable, providing qualifications for both positions are met by the single person. The QCSM role shall be filled by a single individual without other roles assigned. No change to the solicitation.
There is language of the Philadelphia District and the Baltimore District in the solicitation, which district does this project fall under?
The reference to Philadelphia District has been removed. The project falls under the Baltimore District Susquehanna River Project. (Solicitation amended) Under Special Inspections, section 01 45 35, it discusses qualifications for concrete, PT .. and other items that don’t seem applicable to this project. We assume this is just a copy/paste and we don’t need inspectors for non-applicable items?
While the referenced Special Inspections are not anticipated to be required for this project, the specification is not amended in case a change to the anticipated work necessitates a special inspection(s).
Would the Government consider allowing a fabricator that has and follows the qualifications under
ASME NQA-1 Quality Assurance Program in lieu of the AISC requirement?
AISC is required; no change to the solicitation.

INSTRUCTIONS TO OFFERORS
The Government will award a firm-fixed-price (FFP) contract to the responsible Small Business Offeror whose offer is the lowest priced, technically acceptable. Offeror’s must be registered in the System for Award Management (www.sam.gov) at the time a quote is submitted. The quotes will be evaluated based on the following three (3) factors:

Factor II: Past Performance
Factor III: Price Proposal
Offers shall be prepared in accordance with these instructions, providing all required information in the specified format. Timely submission will be documented in accordance with the date and time stamp of the email submission.
An email confirmation will be sent by the Government within one business day to confirm receipt. If the Offeror cannot provide a Bid Guarantee in accordance with FAR 52.228–1, the Offeror’s quote will not be considered valid for this solicitation. Submit the Bid Guarantee electronically with the quote submission.
The Government intends to evaluate proposals and award a contract without discussions with Offerors (except clarifications as described in FAR 15.306(a)). Therefore, the Offeror’s initial proposal should contain the Offeror’s best terms from a price and technical standpoint. The Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary.
Quotes shall be submitted via email ONLY to Ms. Erica Stiner at erica.j.stiner@usace.army.mil by 11 May 2023 at 6:00 PM ET.
Questions concerning this solicitation must be submitted by email (erica.j.stiner@usace.army.mil) no later than 14 April 2023 at 6:00 PM ET. This will allow responses to be posted on SAM.gov prior to the solicitation closing. Offerors are responsible for checking for any amendments to the solicitation at SAM.gov.
A site visit will be hold on 4 April 2023 at 10:30 am local time. The point of contact is Mr. Jeffrey Meadows (570- 213-2264). Advance registration is requested but not required. Attendance is optional and questions will not be answered on-site. Submit all questions in writing as stated above. Attendees should bring steel-toed boots and a hard hat. Parking is located at the dam office/garage. The site visit will be held rain or shine.

SUBMISSION INSTRUCTIONS
The quote shall consist of two separate volumes: a technical proposal and a price proposal. Note: The technical proposal shall not contain any pricing information.
a) Volume 1: Technical Submissions should be limited to 10 pages, not including the table of contents, cover page, tables, images, resumes, schedule, or past performance questionnaires. Text should be at size 12 font, single spaced.
Font limitations do not apply to charts, tables, and figures, but font must be legible. Include a Cover Letter summarizing the pricing total and stating the Offeror’s address, point of contact, Cage Code, and UEI.
i) Factor I: Technical Approach: Offeror shall provide sufficient detail to demonstrate they can realistically meet the requirements of the specifications. The Offeror shall describe their plan to provide the necessary equipment, personnel, materials, and other resources and tentative schedule with key milestones to meet the delivery schedule (365 days from the notice to proceed). The Technical Approach will include:
1. Equipment plan: The proposed equipment list should only include the equipment which will be used on this contract. Include size, make, model, and ownership (owned or rented) of equipment.
2. Staffing plan: The proposed staffing plan shall include both numbers of personnel proposed and position titles. Resumes for proposed key personnel, consisting of experience and other pertinent information, inclusive of superintendents, quality control inspectors, and foremen must also be submitted.
3. Work plan: A work plan shall be submitted indicating how the work will be accomplished including the steps required and definable features of work. A proposed schedule stated in the number of days from award issuance, not in actual dates, should also be provided and shall include the most realistic project completion date.
ii) Factor II: Past Performance: Past performance refers to the quality of recent project experience from the customer’s perspective. The Offeror shall provide (3) Past Performance Questionnaires or CPARS assessments from references for similar work completed in the last five (5) years with narrative description of the work performed for each project, not to exceed one page per project. The Offeror may arrange for the reference customer point of contact to complete the Past Performance Questionnaire ((PPQ) attachment J-4) and forward directly by the references to Erica Stiner, Contract Specialist, at erica.j.stiner@usace.army.mil or provide the PPQs in their submission. Ensure that the PPQ sections 1 to 4 are completed before giving the form to references. The Government will not release the questionnaire forms to the Offeror at any time, for the Government to solicit candid, unbiased responses, and comments. The Government may use data in the Government’s Past Performance Information Retrieval System (PPIRS) and other resources to determine past performance acceptability.
Relevant similar projects must include all of the following elements, but do not have to include all elements in each project individually:

b) Volume 2: Price
i) The Price Proposal shall be provided separately from the technical proposal.
ii) Volume 2 should include any explanations or assumptions associated with the technical aspects of completing the work related to the price.
iii) Pricing shall be provided on a firm-fixed basis according to the contract line item numbers (CLIN 0001 and CLIN 0002) to meet the requirements of the statement of work to be completed. The Contractor is responsible for all labor, material, equipment, permits, transportation, and other resources required to perform the work.
Include the attached Quote Sheet (attachment J-5).
EVALUATION CRITERIA
Quote Compliance Review: A quote compliance review will be performed to ensure that all required representations and certifications are complete, that the bid guarantee and technical and price proposals have been received, and that the Offerors are eligible for consideration.
Volume I
a) Factor I Technical Approach will be evaluated on technical capability to successfully complete the project in accordance with the specifications and scope of work. The Offeror must provide sufficient detail to evaluate the staffing, equipment, material, and other resources are sufficient to complete the work on schedule. The Technical Approach will be rated as acceptable or unacceptable as outlined in Table A-1.

b) Factor II Past Performance will be evaluated for the Offeror’s probability of meeting the minimum past performance solicitation requirements. This assessment is based on the Offeror’s record of relevant and recent past performance information that pertain to the construction work outlined in the solicitation requirements. Past performance will be rated on an acceptable or unacceptable basis using the ratings in Table A-2. Offeror’s without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned shall be determined to have unknown (or “neutral”) past performance. In the context of acceptability/unacceptability, a neutral rating shall be considered acceptable.

Volume II
a) The Government will evaluate price by adding the total of all CLIN prices. Prices will be evaluated to establish the best value to the Government using the price analysis technique in FAR 13.106-3(a)(1): comparison of competitive quotations. If only one offer is received, the price will be evaluated as fair and reasonable based on a comparison with the Independent Government Estimate.
b) Offerors must include all CLIN; partial quotes will not be accepted.
c) The proposed price shall include all resources the Offeror would require to perform the work except the Government equipment (crane) to be provided, including profit, permits, bonds, insurance, and travel/transportation.
SECTION 00 72 00 - GENERAL CONDITIONS
52.211-10 COMMENCEMENT, PROSECUTION, AND COMPLETION OF WORK (APR 1984)
The Contractor shall be required to (a) commence work under this contract within 10 calendar days after the date the Contractor receives the notice to proceed, (b) prosecute the work diligently, and (c) complete the entire work ready for use not later than 365 calendar days. The time stated for completion shall include final cleanup of the premises.

SECTION 00 73 00 - SUPPLEMENTARY CONDITIONS
SUPPLEMENTARY CONDITIONS
SPECIAL CONDITIONS
1. Period of Performance: Work shall commence after the notice to proceed and be completed in 365 days.
2. Performance of Work: The Contractor shall perform work only during normal Corps of Engineers duty hours (7:30 a.m. to 4:00 p.m., Monday through Friday, excluding national holidays). Exceptions to this condition must be coordinated with and approved in advance by the Operations Manager, Susquehanna River Project.
3. Accident Prevention: In performing this contract the Contractor shall comply with all current Federal, State, and Local safety regulations, including Corps of Engineers Safety and Health Requirement Manual EM 385- 1-1 and shall comply with any subsequent changes. Information regarding acquiring the Corps of Engineers Safety and Health Requirement Manual EM 385-1-1 may be found on the USACE Headquarters website at http://www.usace.army.mil/SafetyandOccupationalHealth/EM38511,2008BeingRevised.aspx. Prior to commencement of work under this contract the Contractor shall furnish to the Government an Accident Prevention Plan in accordance with Section I, Article 01.A.12 of the EM 385-1-1, dated 30 November 2014.
4. Accident Reporting: In the event of an accident or injury involving contractor personnel or equipment in performance of work, the Contractor shall immediately notify the Government representative by the most expedient means feasible. The Contractor shall complete forms furnished and/or provide a written description of the incident within 24 hours of notification by the Government.
5. Operations and Storage Areas: The Contractor shall confine all operations (including storage of materials) to areas authorized or approved for use by the COR.
6. Housekeeping: The Contractor shall keep the work area, including storage areas, free from accumulations of waste materials. Before completing the work, the Contractor shall remove from the work site and premises, any rubbish, tools, equipment, and materials that are not property of the Government. Upon completing the work, the Contractor shall restore the work area to the original condition, to be approved by the Contracting Officer.
7. Environmental Protection: The Contractor is required to comply with all Federal, State, and Local environmental regulations.
8. Permits and Licenses: The Contractor shall, at his/her own expense, obtain any license or permits required to perform the contract. The Contractor shall comply with all Federal, State, and Local laws and regulations and shall comply with any subsequent changes.
9. Records and Reports: In addition to the administrative requirements dictated elsewhere in this contract, the Contractor shall complete a Daily Quality Control Report form to maintain record of contract performance, accident/injury incidence, and observance of project deficiencies. Forms will be distributed at pre-work conference.
10. Superintendent: The Contractor shall act as or provide a Superintendent who acts as a quality control manager whenever the work specified herein is being performed. The Superintendent shall conduct overall management coordination and be the central point of contact with the Government for performance of all work under this contract. The Superintendent and any individual designated to act for him/her shall have full authority to contractually commit the Contractor for prompt action on matters pertaining to the administration of the entire contract. Such authorization shall be submitted in writing to the Government representative. The Superintendent shall deal directly with the Government representative for normal day-to-day administration of the contract provisions. The Superintendent will be required to attend pre-work conference(s) prior to commencing work under this contract.
11. Project Operation: The Fost Joseph Sayers Dam is a flood control project and the Contractor’s access to the work area and the execution of the requirements specified herein shall not interfere with the daily operations of the project or employees. It is the responsibility of the Contractor to coordinate with the COR for any utilities shutdowns or site access restrictions for Government employees required for completion of the work.
12. The site of the work is subject to flooding. The Contractor shall consider the potential for high water levels in the scheduling of this contract. A specific program shall be established by the Contractor to evacuate personnel, equipment, and materials as necessary in the event of high water.
INVOICES AND PAYMENT
1. Invoices: The Contractor shall submit itemized invoices no later than 15 days from the completion of the total project. The invoice shall accurately reflect work completed. Each invoice at a minimum shall contain the following information:
a) Contractor name and address, exactly as it appears on the contract
b) Contract number
c) Date of invoice submission
d) Invoice number
e) Each CLIN being invoiced
f) Invoice total
2. Corrections: Incorrect invoices will be returned to the Contractor for correction before processing payment.
Corrected invoices shall be re-dated to reflect the new submission date.
3. Remittance: Invoices shall be submitted via e-mail to the COR.
CHANGES
Only a warranted Contracting Officer (either a Contracting Officer or an Administrative Contracting Officer (ACO)), acting within their appointed limits, has the authority to issue modifications or otherwise change the terms and conditions of this contract. If an individual other than the Contracting Officer attempts to make changes to the terms and conditions of this contract, you shall not proceed with the change and shall immediately notify the Contracting Officer. Proceeding with any work not authorized by the Contracting Officer will be at the Contractor’s own risk.
