SECTION II

RFP PROVISIONS (PHASE I)

A. BASIS FOR AWARD

This request for proposal (“RFP”) seeks proposals from Offerors interested in being selected for design-build construction at East Campus (ECB3) at Fort George G. Meade, Maryland. Offerors responding to this RFP are required to submit their proposals in accordance with the instructions contained in this Section 00100.

This is Phase I of a Two-Phase RFP issued in accordance with FAR Subpart 36.3. This RFP is requesting submission of proposals under Phase I submission criteria ONLY. It is the Government’s intention to advance up to five of the most highly qualified Offerors from Phase I to Phase II.

Offerors shall not submit any proposals under Phase II submission criteria at this time.

Phase II of the RFP will be issued in an RFP amendment directly to those Offerors selected for Phase II. Submitting any information under Phase II criteria during Phase I may lead to disqualification of your proposal. This is a Full and Open (Unrestricted) competitive RFP.

B. FACTORS TO BE EVALUATED

The following evaluation factors will be used to evaluate each proposal. Award will be made to the Offeror whose proposal is the best value and most advantageous to the Government based on an integrated assessment of the evaluation factors described below.

Factor 1: Corporate Experience and Performance Confidence (Phases I and II). The Government will evaluate the extent of recent, relevant corporate experience of the prime contractor and team members for both design and construction. There are three aspect to the performance confidence evaluation: recency, relevancy, and quality. The Government will evaluate these aspects to establish one relevancy and one confidence rating which will be given for this factor. The Government will write a narrative evaluation reflecting the identified findings.

Factor 2: Key Personnel (Phases I and II): The Government will evaluate the key disciplines and alternates submitted for this project and will assign one combined technical and risk rating for this factor. The Government will write a narrative evaluation reflecting the identified findings.

Factor 3: Management Philosophy and Narratives (Phase I): The Government will evaluate the overall technical approach of this design and construction project and its capability to execute an awarded contract with a cohesive and collaborative team effort and design excellence. The Government will evaluate the strengths, weaknesses and any deficiencies in the submission and assign one combined technical and risk rating for this factor. The Government will write a narrative evaluation reflecting the identified findings.

C. PHASE I EVALUATION APPROACH

All proposals shall be subject to evaluation by the Source Selection Team (SST).

1. SUBMISSION CRITERIA

VOLUME I – MINIMUM SUBMISSION CRITERIA (TECHNICAL PROPOSAL, FACTORS 1-

3) For purposes of this RFP, an “Offeror” may include a group of two (2) or more entities that have formed a “contractor team arrangement,” as that term is defined in the Federal Acquisition Regulation, Part 9.6. In the case of entities that have formed a contractor team arrangement, the experience and performance history of any member of the team, whether or not gained while working with the other member(s) of the currently-proposed contractor team arrangement, will be considered as a part of the evaluation of the Offeror’s proposal.

An Offeror that relies upon the experience and performance history of a member, members or affiliates of a proposed contractor team arrangement must provide a teaming agreement or commitment (in the case of any affiliates) signed by all parties. The Teaming agreement/commitment shall:

1. Identify the legal name(s) and cage code(s) of all entities.

2. Describe the nature of each entity’s relationship (partnership, joint venture, prime/sub or mentor/protégé) and their role on this project as a part of their proposal. The Offeror will be expected to maintain that arrangement during performance of any contract awarded to that Offeror under this RFP.

3. The estimated percentage of work to be completed by each member submitted for the RFP.

This can be a rough order of magnitude for Phase I; however, this agreement/letter must be resubmitted with Phase II to include the actual proposed percentages by the advanced Offerors.

In the case of affiliates, past performance of an Offeror’s “affiliate,” as that term is defined in FAR 2.101, will be evaluated (as described within this section) if the Offeror demonstrates a firm commitment that the affiliate will participate meaningfully (e.g., roles, responsibilities, etc.) in the performance of the contract. This commitment, nature of each entity’s relationship and meaningful participation shall be described in a document signed by authorized representatives of both the Offeror and its affiliate. If a teaming agreement or commitment is not provided, the projects and experience of any team members outside of the Prime Offeror will not be considered.

The contractor team agreement/commitment shall be provided at the beginning of the Offeror’s technical proposal, prior to Factor 1, and will not be included in the overall page count.

The following are to be used in determining the status of the Offeror’s team for the evaluation of project submissions under Factor 1:

1. In the case of contractor team arrangements involving a Prime Contractor and Subcontractor(s), where the Prime Contractor submits the proposal in response to this RFP, the Prime Contractor is considered the “Prime Offeror”.

2. In the case of joint ventures, the “Prime Offeror” experience is limited to entities with signed agreements.

3. In the case of mentor/protégé relationships, the relationship must be established by the two Offerors and approved by the chosen Government Agency prior to proposal submission.

The “Prime Offeror” experience is limited to entities with signed agreements. The approved mentor/protégé document from the Government Agency must be submitted along with the teaming agreement.

4. In the case of additional projects submitted by subcontractors, the subcontractor must submit the final cost of their portion of the project along with total project cost and all other required information.

5. In the case of Offerors that are large, multi-function firms (consisting of subsidiaries), experience must only be submitted by the segment of the firm (e.g., division, group, and unit) that is submitting a proposal in response to this RFP.

6. In the case of affiliates, Past performance of an Offeror's "affiliate," as that term is defined in FAR 2.101, will be evaluated (as described within this section) if the Offeror demonstrates a firm commitment that the affiliate will participate meaningfully in the performance of the contract. This commitment and meaningful participation shall be described in a document signed by authorized representatives of both the Offeror and its affiliate.

If a teaming agreement or commitment is not provided, the projects of any team members outside of the Prime Offeror will not be considered. If the Joint Venture/Mentor Protégé is a Small and Large Business, the Small Business will be evaluated as the Prime Offeror.

1.2.2. PHASE I—FACTOR 1 – CORPORATE EXPERIENCE AND PERFORMANCE

CONFIDENCE REQUIREMENTS

A. CORPORATE EXPERIENCE

Submit ten example projects demonstrating the Offeror’s recent, relevant experience. Of the ten projects, at least three projects must be from the construction contractor and at least two projects must be from the design firm. For ongoing projects, either Design-Build or Design-Bid-Build, 100% of the design and approximately 75% of the major construction milestones must be completed by the date the Phase I Solicitation is issued. In the case of a joint venture teaming arrangement, each member of the joint venture entity must submit at least two projects under this factor.

Multiple Award Task Order Contracts (MATOCs) or any other type of task-order contracts that provide for the issuance of task orders for the performance of tasks will not be considered projects for the purposes of this evaluation. Only individual task order issued under such contracts will be evaluated as projects. Project descriptions that do not clearly describe Offeror’s or team member’s limit of experience, scope of the project or periods of project performance will not be considered.

Provide the following information for each project:

1) Project Title

2) Location

3) Contract Number

4) Project Delivery Method: Indicate Design-Build; Design-Bid-Build; CM@Risk;

Early Contractor Involvement; Integrated Design; Design Only; etc.

5) Designer of Record

6) Role of Offeror: Indicate type and percentage of work performed by the Offeror or

Offeror’s team member.

7) Total Dollar Amount: Indicate if for design only, construction only or both design and construction.

8) Construction Start and Completion Dates: Project construction must be complete or substantially complete. If an Offeror presents a project that is substantially complete, the proposal must include an explanation of why that project should be considered.

9) Brief Description of Project: Address how the project experience is relevant to the building of a new facility or major renovation that is similar in size and scope described in this RFP’s Statement of Work. Indicate facility type, number of facilities, site work, redundant power, cooling or utilities, compliance with Intelligence Community Directive ICD/ICS 705, security measures, sustainability features and any post construction operations and maintenance responsibilities.

10) Customer Primary Point of Contact: Name, relationship to project, agency/firm, phone number, and e-mail address. The Government may contact and interview project references. Reference information will not be revealed to other parties.

11) Procuring Activity Point of Contact: Name, relationship to project, agency/firm, phone number, and e-mail address. The Government may contact and interview project references. Reference information will not be revealed to other parties.

EVALUATION CRITERIA

The Government desires proposals that offer the best combination of experience considering all criteria. The Government will evaluate the extent of recent, relevant corporate experience of the prime contractor and team members for both design and construction for strengths and weakness in the following areas:

Projects performed by the Offeror as the Prime Contractor.

Projects that demonstrate prior teaming experience between the constructor and designer entity (DORs).

Projects demonstrating experienced with Design-Build delivery method.

Projects with construction that has been completed more recently.

Projects with greater construction size (Dollar amount or Square Foot).

Projects with redundant utility systems (e.g. power or cooling).

Projects with design and/or construction in accordance with Intelligence Community

Directive 705 (ICD 705) or Director of Central Intelligence Directive 6/9 (DCID6/9).

Projects demonstrating LEED certification (Silver or higher), NetZero certification, ASHRAE 189.1 compliance, or other green building/sustainability certifications.

Projects that involved post-construction O&M responsibility.

Projects with design and/or construction of structured parking facility.

Projects within constrained construction environment (e.g., close proximity to active major construction; limited laydown areas; ties-into live facility).

Minimum Criteria for Corporate Experience:

Each of the ten (10) projects submitted must meet the following criteria to be evaluated:

1) Projects must be greater than 250,000 square feet, or must be over $100M in construction costs.

2) Construction must have been completed within the last 10 years from the date the Phase I Solicitation is issued; or for ongoing projects, 75% of the major construction milestones must be completed by the date the Phase I Solicitation is issued.

Proposals should address the following minimum requirements:

1) At least 1 project to serve as example of performance by the Offeror as a Prime Contractor.

2) At least 1 project demonstrating experience between the Contractor and Designer of Record

(DOR) firm.

3) At least 1 project that is Design-Build Contract delivery method.

4) At least 1 project that has redundant utility systems (e.g. power or cooling).

5) At least 1 project that has design and/or construction in accordance with Intelligence

Community Directive 705 (ICD 705) or Director of Central Intelligence Directive 6/9

(DCID6/9)

6) At least 1 project demonstrating LEED certification (silver or higher), NetZero certification, ASHRAE 189.1 compliance or other green building/sustainable certification

7) At least 1 project that involved post-construction O&M responsibility.

8) At least 1 project demonstrating constrained construction environment (e.g., close proximity to active major construction; limited laydown areas; ties-into live facility).

9) At least 1 project demonstrating construction of large structured parking facility.

If projects do not address the above minimum requirements, the proposal will still be evaluated;

however, it may demonstrate a potential increased risk of unsuccessful contract performance.

B. PERFORMANCE CONFIDENCE

For each of the projects submitted, provide a Contractor Performance Assessment Reporting System (CPARS), or Past Performance Questionnaire (PPQ) to a representative of the owner that can provide the owner’s opinion of the Offeror’s past performance for the project. The Past Performance Questionnaire (Form PPQ-0) included in the RFP is provided for the Offeror or its team members to submit to the owner for each project. Ensure correct phone numbers and email addresses are provided for the owner point of contact. Organize all Past Performance Information in the same order in which the Projects are submitted.

Submit completed PPQs with your proposal. If the Offeror is unable to obtain a completed PPQ from an owner for a project(s) before proposal closing date, the Offeror should complete and submit with the proposal the first page of the PPQ, which will provide contract and client information for the respective project(s). At the owner’s discretion, PPQs may be submitted directly to the Government’s point of contact, Ms. Wendy Arsenault, via email at wendy.d.arsenault@usace.army.mil prior to proposal closing date. If you have questions regarding the PPQs, or require assistance, please contact Ms. Arsenault at (443) 749-2022.

Previously completed PPQs may be submitted provided that the documents do not reference any other RFP. Submitted PPQs must only reference this RFP.

Submit copies of Federal/DoD/Navy/Army performance reviews even if they may be in the agency’s databases or likely within the agency’s arm’s reach, i.e., Contractor’s copy of CPARS evaluations for each of the projects submitted, to ensure the agency has all relevant past performance information.

Provide the DUNS number(s) and CAGE code(s) for the prime contractor and all teaming partners, e.g., design firms, key subcontractors, joint venture partners, whose experience is included in this Factor. While the Government may elect to consider data from other sources, the burden of providing detailed, current, accurate, and complete past performance information rests with the Offeror.

The Government plans to contact and interview the owner’s representative identified on the Past Performance Questionnaires, and reserves the right to interview other individuals acting for the owner’s representative, if the owner’s representative is not available. In addition, the Government may review any other sources of information for evaluating past performance.

Past performance information may be obtained from any other sources available to the Government, to include, but not limited to, the Past Performance Information Retrieval System (PPIRS), Contractor Performance Assessment Reporting System (CPARS), Federal Awardee Performance and Integrity Information System (FAPIIS), Electronic Subcontract Reporting System (eSRS), or other databases; interviews with Owners, Program Managers, Contracting Officers, and Fee Determining Officials; and the Defense Contract Management Agency.

At no time during this process, or during any debriefing, or after any award, will the names of the individuals providing reference information about an Offeror’s past performance be revealed to the Offerors or to any other party. If discussions are held, Offerors may be afforded the opportunity to respond to adverse comments made by references in accordance with guidelines identified in FAR Part 15.3. In this case, relevant comments will be extracted and provided to the Offeror.

EVALUATION CRITERIA

PERFORMANCE CONFIDENCE ASSESSMENT

The Government will evaluate the responses from the customers from which Past Performance Questionnaires have been received.

There are three aspects to the performance confidence evaluation: recency, relevancy (including context of data), and quality (including general trends in contractor performance and source of information). In accordance with FAR 15.305(a) (2), the currency and relevance of the information, source of the information, context of the data, and general trends in contractor's performance shall be considered. These will be combined to establish one performance confidence assessment rating for each Offeror.

In reviewing each past performance effort by the Offeror, the SST will first evaluate recency.

More recent is better. Projects completed within the past 10 years from the date the Phase I Solicitation is issued are considered recent.

C. RATING METHODS

In reviewing each past performance effort by the Offeror, the SST will then evaluate relevancy.

The relevancy determination will be based on the Corporate Experience Evaluation Criteria. Each past performance effort will be assigned one of the levels of relevancy shown in Table 1:

Table 1. Past Performance Relevancy Rating Method

Adjectival Rating Definition

Very Relevant Present/past performance effort involved essentially the same scope and magnitude of effort and complexities this RFP requires.

Relevant Present/past performance effort involved similar scope and magnitude of effort and complexities this RFP requires.

Somewhat Relevant

Present/past performance effort involved some of the scope and magnitude of effort and complexities this RFP requires.

Not Relevant Present/past performance effort involved little or none of the scope and magnitude of effort and complexities this RFP requires.

In reviewing each past performance effort by the Offeror, the SST will then evaluate the overall quality of the Offeror's past performance (see FAR 15.304(c) (2)) to determine the performance confidence assessment rating. The past performance evaluation conducted in support of a current source selection does not establish, create, or change the existing record and history of the Offeror's past performance on past contracts; rather, the past performance evaluation process gathers information from customers on how well the Offeror performed those past contracts.

The SST will review all past performance information collected and determine the quality of the Offeror's performance, general trends, and usefulness of the information and incorporate these into the performance confidence assessment (see Table 2 below).

The past performance confidence assessment rating is based on the Offeror's overall record of recency, relevancy, and quality of performance. At the conclusion of the assessment, the Offeror shall be assigned one of the ratings in Table 2. In the case for which there is no information on past contract performance or where past contract performance information is not available, the Offeror will not be evaluated favorably or unfavorably on the factor of past contract performance. In this case, the Offeror’s past performance is unknown and assigned a performance confidence rating of “neutral”.

Table 2. Performance Confidence Assessment

Adjectival Rating Description

Substantial Confidence Based on the offeror’s recent/relevant performance record, the Government has a high expectation that the offeror will successfully perform the required effort.

Satisfactory Confidence Based on the offeror’s recent/relevant performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort.

Neutral Confidence No recent/relevant performance record is available or the offeror’s performance report is so sparse that no meaningful confidence assessment rating can be reasonably assigned. The offeror may not be evaluated favorably or unfavorably on the factor of past performance.

Limited Confidence Based on the offeror’s recent/relevant performance record, the Government has a low expectation that the offeror will successfully perform the required effort.

No Confidence Based on the offeror’s recent/relevant performance record, the Government has no expectation that the offeror will be able to successfully perform the required effort.

EVALUATION CRITERIA

The Government will evaluate the key disciplines and alternates submitted for this project and will assign one combined technical / risk rating for this factor. The Government desires proposals that offer the best combination of experience considering all criteria. The Government will evaluate the following for strengths and weakness:

1) Experience working on Factor 1 submitted projects or similar projects meeting criteria defined in Factor 1.

2) Experience working with other proposed key personnel on Factor 1 projects or similar projects meeting criteria defined in Factor 1.

3) Years of experience in the same role as that proposed for this RFP.

6) Professional registration.

7) Relevant certifications, professional positions and other qualifications.

Minimum Criteria for Key Personnel and Alternates: Proposals should address the following minimum requirements:

1) Worked on at least one Factor 1 or similar project.

2) Worked with at least one other proposed key personnel on Factor 1 or similar projects.

3) At least 3 years’ experience in the same role as that proposed for this RFP.

4) At least 5 years’ relevant professional experience.

The following are contract requirements and if not met, the proposal will be considered a failure to meet the Government requirements:

1) Professional registration is required for all proposed Architects and Engineers identified as “Lead” or “Designers’ of Record (DOR)” as required by ER 1110-1-8152.

2) At all times, at least one of the nine key personnel working on the project must have a secret or higher security clearance.

If projects do not address the above minimum requirements, the proposal will still be evaluated;

however, it may demonstrate a potential increased risk of unsuccessful contract performance.

1.2.5. PHASE I-- FACTOR 3 -- MANAGEMENT PHILOSOPHY AND NARRATIVES

REQUIREMENTS

Overall Corporate Management Structure (Approach) Workforce and Subcontractor Management Narrative Design Approach and Narrative Construction Approach and Narrative Design and Construction Integration Approach and Narrative Scheduling Approach and Narrative Operations and Maintenance Narrative

Overall Corporate Management Structure (Approach): Describe the overall corporate management structure of the Offeror’s design-build team. If the Offeror is made up of more than one firm, describe the business relationship, the authorities of the team members, and the delegation of authorities, if any, within the team to include partnering firms and subcontractors.

Provide a narrative description of the roles and responsibilities of the key personnel (name/title/firm) identified in Factor 2 and include an organizational chart depicting the hierarchical structure of the team members responsible for project execution.

Workforce and Subcontractor Management Narrative: East Campus Building 3 shall be designed and constructed to Sensitive Compartmented Information Facility (SCIF) physical and technical security standards. All work performed under this contract, including, but not limited to, design, construction, on-site work, and off-site work, shall be performed by U.S. companies using U.S.

citizens. The Prime Contractor must have a Top Secret Facility Clearance. The Offeror must describe the strategies it intends to employ to address these challenges.

Design Approach and Narrative: The Offeror shall describe its organizational structure for and approach to the design process. The narrative shall state why the Offeror’s design team is uniquely qualified to undertake this project. The narrative must describe the design team’s approach to working with the customer and the means to integrate its input during the design phase, how it will manage design quality control – track design evolution and coordinate the different design disciplines - during the design process, and how design refinement will be documented and executed after acceptance of Issued for Construction (IFC) design documents.

The Offeror shall describe how its approach will facilitate providing the interior design package(s) later in the design process. The Offeror shall describe how its design approach will facilitate the operations and maintenance of installed equipment and systems.

Construction Approach and Narrative: The Offeror shall describe its organizational structure for and approach to the construction of this project. The narrative shall include the roles and responsibilities of key and/or specialty subcontractors. The narrative must state why the Offeror’s construction team is uniquely qualified to undertake this project. The narrative must also include the Offeror’s approach to working within a constrained site while integrating its construction into an occupied facility.

Design and Construction Integration Approach and Narrative: The Offeror shall describe its management approach to integrating the Design and Construction Teams throughout the project until it is completed. Describe the organization of the on-site design-build team and the duties and responsibilities of each staff member. Include in the narrative the Offeror’s approach to effectively coordinate work between subcontractors to minimize design and construction conflicts.

Scheduling Approach and Narrative: The Offeror shall provide a narrative description of how it plans to schedule both design and construction activities in order to execute this project within the incremental funding profile provided and within the period of performance. The Offeror must describe and discuss its plan to sequence and manage key activities such as design, permitting, procurement, construction, and project close-out. The Offeror shall clearly articulate any assumption made in its plan to sequence and mange key activities and any constraints that may be levied on the proposed schedule. The Offeror shall include a risk management plan that identifies major risk to the proposed schedule and proposed mitigations.

Operations and Maintenance Narrative: Operations and maintenance activities will be performed in a SCIF and must be performed by personnel cleared to the Top Secret level. Describe the Offeror’s plan for transitioning, staffing, and executing the O&M portion of the contract.

EVALUATION CRITERIA:

Based on the submission provided, the Government will evaluate the Offeror’s overall technical approach of this design and construction project and its capability to execute an awarded contract with a cohesive and collaborative team effort and design excellence. The Government will evaluate the strengths, weaknesses and any deficiencies in the submission and assign one combined technical / risk rating for Phase I Factor 3.

Minimum Criteria for Technical Approach:

Proposals should address the following minimum requirements:

1) Provide an organizational chart and matrix or list of roles and responsibilities highlighting key personnel.

2) Describe the overall design and construction management approach; means of integrating client and location of major design and production work; means of integrating the interior design package during the construction phase of the project, role of key subcontractors and management of efficiencies of the schedule and execution; staffing and managing the O&M portion of the contract.

3) Describe the approach for coordinating work between subcontractors.

4) Describe coordinating with ongoing construction projects.

5) Describe DOR integrator approach lifecycle.

If projects do not address the above minimum requirements, the proposal will still be evaluated;

however, it may demonstrate a potential increased risk of unsuccessful contract performance.

1.2.6. SOURCE SELECTION BOARD

The SSEB will conduct a review of the Technical Evaluation Team (TET) evaluation of proposals against the RFP requirements and the approved evaluation criteria to ensure an equitable, impartial, and comprehensive evaluation against the RFP requirements. The SSEB does not compare proposals against each other. The SSEB will therefore prepare a summary report containing adjectival assessments for each factor and their supporting rationale for each Offeror and brief the SSAC. The SSAC will brief the SSA; and prepare any necessary items for discussion.

1.2.7. TRADE-OFF ANALYSIS

The SSA’s decision shall be based on a comparative assessment of proposals against all source selection criteria in the RFP. While the SSA may use reports and analyses prepared by others, the source selection decision shall represent the SSA’s independent judgment. The source selection decision shall be documented, and the documentation shall include the rationale for any business judgments and tradeoffs made or relied on by the SSA, including benefits associated with additional costs. Although the rationale for the selection decision must be documented, that documentation need not quantify the tradeoffs that led to the decision.

1.2.8. PHASE I DOWN-SELECT

It is the Government’s intention to advance up to five of the most highly qualified Offerors from Phase I for determining Phase II. The following chart describes the evaluation factors and their relationship:

Factor Number Description Relative Importance Factor 1* Corporate Experience and

Performance Confidence Factor 1 is more important than Factor 2.

Factor 2* Key Personnel Factor 2 is more important than Factor 3.
