SUMMARY OF CHANGES

SECTION I - CONTRACT CLAUSES

The following have been modified:

52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)

The Government anticipates that the RFQ process will result in a firm fixed price (FFP) contract to the responsible Contractor whose quote conforms to the requirements as stated in this request for quotation (RFQ) using the lowest price, technically acceptable (LPTA) methodology. The Contractor must be registered in the System for Award Management (SAM) to be eligible for award.

The following factors shall be used to evaluate quotes:

Factor 1: Technical capability including past performance Technical and past performance, when combined, are of equal importance of all other non-technical factors.

Award will be made to the responsible Contractor whose quote that conforms to the solicitation and is technically acceptable, has no negative past performance, and is the lowest priced.

The absence of any information required to support the evaluation factors may result in disqualification from competition, as that quote may be found non-responsive and therefore unacceptable. Evaluators will determine if the contractor provided adequate responses and a feasible approach.

a. Adequacy of Response: The quote will be evaluated to determine whether the methods and approach described in the quote have adequately and completely considered, defined, and satisfied the requirements specified in the RFQ.

The quote will be evaluated to determine the extent to which each requirement has been addressed in the quote in accordance with the submission section of the RFQ.

b. Feasibility of Approach: The quote will be evaluated to determine the extent to which the proposed approach is workable and the end results achievable. The quote will be evaluated to determine the extent to which successful performance is contingent upon proven devices and techniques. The quote will be evaluated to determine the extent to which the methods and approach is expected to be able to successfully complete the proposed tasks and technical requirements within the required schedule.

Factor 1: Technical Competency: – Evaluation of the quote will address each element listed below as it applies to the Performance Work Statement (PWS). The submitted material MUST be organized sequentially under tabs, to facilitate evaluation and all pages must be numbered.

1) Management Approach: The quote shall describe their team arrangement for each aspect of work and their general approach to this project. The quote shall also outline the quality control process it plans to use to assure compliance with specifications. The contractor shall describe the source and availability of all equipment and skilled labor necessary for each aspect of the work, and their approach for assuring the availability to mobilize within the time frames indicated in the Performance Work Statement (PWS). The quote shall demonstrate and understanding of typical problems encountered in the execution of work described in the PWS and provide contingencies for completing the work in the specified durations.

2) Cleaning and Confined Space Procedures: The quote shall provide a narrative that describes the Contractor’s approach in providing cleaning services in the interior of underground tanks used for the storage of potable water in volumes of 10 - 30 million gallons. The narrative should demonstrate familiarity with confined space procedures and the pre-emption and clean-up of spills.

3) Collection, Transportation, and Disposal of Solids and Sediment: The quote shall describe the Contractor’s proposed approach related to the removal and disposal of collected sediments and solids in volumes of 100 – 1,000 cubic yard range. The narrative should describe equipment selection, disposal procedures, required layout space and estimated production rates.

4) Application of Chemical for the Dechlorination and Disinfection of Water: The quote shall provide a narrative that describes the Contractor’s experience managing, mobilizing, layout, and operating processes and equipment to intercept and dechlorinate flowing water, and provide for disinfection of remote water storage facilities per American Water-works Association (AWWA) standards, particularly C-652 Method 1.

5) Team Arrangements, The quote may include a group of two (2) or more entities that have formed a “contractor team arrangement,” as that term is defined in the FAR, Part 9.6. In the case of entities that have formed a contractor team arrangement, the experience and performance history of any member of the team, whether or not gained while working with the other member(s) of the currently-proposed contractor team arrangement, will be considered as a part of the evaluation of the quote.

a) In the case of contractor team arrangements involving a prime contractor and subcontractor(s), where the prime contractor submits the quote in response to this solicitation, the prime contractor must have completed at least fifty percent (50%) of the total number of projects that meet the requirements for Factor 1.

b) Contractors that rely upon the experience and performance history of a member or members of a proposed contractor team arrangement must provide a teaming agreement signed by all parties, identifying the legal name(s) of all entities and describing the nature of each entity’s relationship (partnership, joint venture, prime/sub or mentor/protégé) and their role on this project as a part of their quote. The contractor will be expected to maintain that arrangement during performance of any contract awarded to that Quote under this solicitation.

c) If a teaming agreement is not provided, the projects of any team members outside of the Prime contractor will not be considered. If the Joint Venture/Mentor Protégé is a Small and Large business, the Small Business will be evaluated as the Prime contractor. Only subcontractors approved by the government will be utilized on this project.

6) Qualification & Capabilities: The following qualification information shall be submitted by all Contractors with their quotes:

a) A statement on company letterhead that the Contractor has been actively and regularly engaged in the type of work described in this request for quote. The statement shall include contact information for references for verification of performance on projects of a similar type.

b) A list of all equipment including vehicles with descriptions and identifying numbers.

c) A list of residuals disposal sites which can accept the volume and type of residuals proposed. Include copies of all permits for both the site and the hauling contractor, if applicable, and a description of each site and its potential to accept the estimated volumes of sediment.

d) The Contractor is hereby advised that he shall be responsible for submission of Attachment D "Contractor Disposal Site Certification" prior to award. The submission shall have adequate description of the area(s) he proposes to use including size, capacities and a document which grants usage including ingress and egress. The Contractor will be required to coordinate and submit prior award, copies of all necessary permits and certificates required by Federal, state and local law to verify that the site(s) are approved to operate within their legal jurisdictions. If the Contractor fails to furnish this information, he will be deemed non-responsive.

e) A list of at least three references, including the names and telephone numbers of a contact for each.

These references must be for similar services as outlined in paragraph 1.3 “REQUIREMENTS PRIOR TO MOBILIZATION” in the Performance Work Statement.

The Technical Factor Ratings. The adjectival ratings depict how well the quote meets the Technical requirements.

Marginal levels of technical expertise and methodology will be interpreted to indicate a lack of understanding concerning the requirements and may result in the entire quote receiving an unacceptable rating and/or being eliminated from the competitive range. The evaluation will focus on the contractor capability and experience in cleaning confined spaces, collection and disposal of solids and sediment, and chemical applications

RATING DESCRIPTION

ACCEPTABLE Quote clearly meets the minimum requirements of the solicitation.

UNACCEPTABLE Quote clearly does not meet the minimum requirements of the solicitation.

Past Performance:

a) The Contractor shall submit information on at least two (2), but not more than five (5) completed similar projects similar in size, scope, and complexity.

b) In addition, the Contractor shall provide three (3) references for past performance of similar projects completed within the last five (5) years of the original date of issuance of this RFQ.

References need to include a point of contact, phone numbers, and email addresses if available.

c) The Contractor shall request that each of the three references fill out the attached Past Perfomrance Questionnaire and return to Ian Weiss, Contract Specialist, e-mail at Ian.Weiss@usace.army.mil. The questionnaires must be forwarded directly by the references and must be received no later than the closing date of the solicitation. The Government will not release the questionnaire forms to the Contractor at any time.

Past Performance – There are two aspects to the Past Performance evaluation. The first is to evaluate each Contractor’s past performance to determine how relevant a recent effort accomplished by the Contractor is to the effort to be acquired. The second aspect of the past performance evaluation is to determine how well the Contractor performed on the contracts. This will be assess by the performance confidence of the references provided.

1) Relevancy: The first aspect of the past performance evaluation is to assess the Quoters past performance to determine how relevant a recent effort within the past five (5) years was. “Relevant” is define as those contracts involving any effort for the same or similar type related to the requirement.

2) Performance Confidence Assessment: The second part is to arrive at a rating on the performance of the relevant referenced contracts. The Government will document the rational for the rating reached. In addition to the questionnaires receives the Government may also analyze the past performance by reviewing the Past Performance Information on the System for Award Management (SAM), or use any other sources including interviewing or checking references.

The following ratings will be assigned to each quote Past Performance submission:

PAST PERFORMANCE RATING DESCRIPTION

ACCEPTABLE - Based on the contractor’s recent/relevant performance record, the Government has a reasonable expectation that the contractor can successfully perform the required effort.

UNACCEPTABLE - Based on the contractor’s recent/relevant performance record, the Government does not reasonably expect that the contractor will successfully perform the required effort.

NEUTRAL - No recent/relevant performance record is available for the contractor’s performance record or it is so sparse that no meaningful confidence assessment rating can be reasonably assigned.

Factor2: Price Price/Cost Factor Evaluation - Price will be evaluated in accordance with FAR 13.106-2. The government may require additional pricing information to assist in determining the extent to which the price is fair and reasonableness and the pricing information shall be provide if requested. The Government will evaluate quotes for award purposes by adding the total of all CLIN prices to ensure that pricing is not unbalanced.

No adjectival rating will be given for cost/price. The following criteria will be used to evaluate cost/price:

1) Fair and Reasonableness.

2) Completeness, Accuracy, and balance of the quote.

The total price shall be equal to the sum of the total of all of the cost elements. The Government will verify the Quote calculation of the total quoted price.

The contractor shall ensure that the rates quoted for all of the labor categories subject to the Service Contract Act (SCA) comply with the minimums specified by the applicable Department of Labor Wage Determination.

a) The Government will evaluate quotes for award purposes by adding the total price for all items for the basic requirement.

b) A written notice of award or acceptance of a quote, mailed or otherwise furnished to the successful quoter within the time for acceptance specified in the quote, shall result in a binding contract without further action by either party. Before the quoter's specified expiration time, the Government may accept a quote (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
