The Contracting Officer may exercise the Optional Items by written notice to the Contractor, postmarked within the period specified above. The Government is not obligated to exercise the Optional Items.
No additional time for contract completion will be allowed when an Optional Item is exercised.
EVALUATION OF OPTIONS:
Except when it is determined not to be in the Government's best interests, the Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. Evaluation of options will not obligate the Government to exercise the option(s).
SCOPE OF WORK
This project consist of the replacement of the filter valves, as well as the conversion of the actuator control system from pneumatic to electric. The project also includes the replacement of ancillary isolation valves, remediation of lead paint, and structural rehabilitation to the interior of large diameter piping and concrete surfaces in the West Filter Building and the replacement of approximately 110 large butterfly valves that range in size from the 18” to 84” diameter and outfitted with either new electric, hydraulic, and/or electrohydraulic valve actuators; providing electrical or hydraulic power for the actuators, replacement of flow measurement (i.e. venturi) devices, instruments, and controls; lead abatement and repainting of metal pipes; minor structural repairs and joint sealing of concrete walls.

Contractors are encouraged to submit Requests for Information (RFI) regarding the solicitation documents. Prospective offerors may submit RFIs at any time; however, the cutoff date for RFIs is September 11, 2017 at 11:00 A.M. EST, unless the Contracting Officer determines an extension is necessary, to be performed by amendment. RFIs received after the cutoff date stated above may or may not be answered by the Government.

52.216-1 TYPE OF CONTRACT (APR 1984)
The Government contemplates award of a firmed fixed price contract resulting from this solicitation.
52.225-10 NOTICE OF BUY AMERICAN REQUIREMENT--CONSTRUCTION MATERIALS (MAY 2014)
(a) Definitions. “Commercially available off-the-shelf (COTS) item,” “construction material,” “domestic construction material,” and “foreign construction material,” as used in this provision, are defined in the clause of this solicitation entitled “Buy American --Construction Materials” (Federal Acquisition Regulation (FAR) clause 52.225-9).
(b) Requests for determinations of inapplicability. An offeror requesting a determination regarding the inapplicability of the Buy American statute should submit the request to the Contracting Officer in time to allow a determination before submission of offers. The offeror shall include the information and applicable supporting data required by paragraphs (c) and (d) of the clause at FAR 52.225-9 in the request. If an offeror has not requested a determination regarding the inapplicability of the Buy American statute before submitting its offer, or has not received a response to a previous request, the offeror shall include the information and supporting data in the offer.
(c) Evaluation of offers. (1) The Government will evaluate an offer requesting exception to the requirements of the Buy American statute, based on claimed unreasonable cost of domestic construction material, by adding to the offered price the appropriate percentage of the cost of such foreign construction material, as specified in paragraph (b)(3)(i) of the clause at FAR 52.225-9.
(2) If evaluation results in a tie between an offeror that requested the substitution of foreign construction material based on unreasonable cost and an offeror that did not request an exception, the Contracting Officer will award to the offeror that did not request an exception based on unreasonable cost.
(d) Alternate offers.
(1) When an offer includes foreign construction material not listed by the Government in this solicitation in paragraph (b)(2) of the clause at FAR 52.225-9, the offeror also may submit an alternate offer based on use of equivalent domestic construction material.
(2) If an alternate offer is submitted, the offeror shall submit a separate Standard Form 1442 for the alternate offer, and a separate price comparison table prepared in accordance with paragraphs (c) and (d) of the clause at FAR 52.225-9 for the offer that is based on the use of any foreign construction material for which the Government has not yet determined an exception applies.
(3) If the Government determines that a particular exception requested in accordance with paragraph (c) of the clause at FAR 52.225-9 does not apply, the Government will evaluate only those offers based on use of the equivalent domestic construction material, and the offeror shall be required to furnish such domestic construction material. An offer based on use of the foreign construction material for which an exception was requested--
(i) Will be rejected as nonresponsive if this acquisition is conducted by sealed bidding; or
(ii) May be accepted if revised during negotiations.

52.228-1 BID GUARANTEE (SEP 1996)
(a) Failure to furnish a bid guarantee in the proper form and amount, by the time set for opening of bids, may be cause for rejection of the bid.
(b) The bidder shall furnish a bid guarantee in the form of a firm commitment, e.g., bid bond supported by good and sufficient surety or sureties acceptable to the Government, postal money order, certified check, cashier's check, irrevocable letter of credit, or, under Treasury Department regulations, certain bonds or notes of the United States.
The Contracting Officer will return bid guarantees, other than bid bonds, (1) to unsuccessful bidders as soon as practicable after the opening of bids, and (2) to the successful bidder upon execution of contractual documents and bonds (including any necessary coinsurance or reinsurance agreements), as required by the bid as accepted.-
(c) The amount of the bid guarantee shall be 20% percent of the bid price or $3,000,000.00, whichever is less.-
(d) If the successful bidder, upon acceptance of its bid by the Government within the period specified for acceptance, fails to execute all contractual documents or furnish executed bond(s) within 10 days after receipt of the forms by the bidder, the Contracting Officer may terminate the contract for default.-
(e) In the event the contract is terminated for default, the bidder is liable for any cost of acquiring the work that exceeds the amount of its bid, and the bid guarantee is available to offset the difference.
52.233-2 SERVICE OF PROTEST (SEP 2006)
(a) Protests, as defined in section 33.101 of the Federal Acquisition Regulation, that are filed directly with an agency, and copies of any protests that are filed with the Government Accountability Office (GAO), shall be served on the Contracting Officer (addressed as follows) by obtaining written and dated acknowledgment of receipt from (for hand delivered and mailed protests):

PREAWARD SAFETY CONFERENCE
a. Where an apparent awardee, in performance of contracts during the previous three year period incurred one or more accidents, or where, in the opinion of the Contracting Officer, there is any question regarding his compliance with any safety or accident prevention requirement, the apparent awardee, on request of the Contracting Officer prior to any award under this solicitation, shall attend a conference with representatives of the Contracting Officer to discuss any such accidents or non-compliance, the reasons for their occurrence, and measures which will be taken to preclude any recurrence thereof.
b. Information elicited at this conference will be used by the Contracting Officer, in conjunction with other information obtained in the pre award survey, in determining the awardees’ responsibility.
c. B. PROPOSAL CONDITIONS
1. Contractors must bid all items in the above price schedule, with no exceptions.
Should a contractor fail to fully complete the price schedule, its BID will not be considered responsive to the solicitation and ineligible for the resultant contract award. Therefore, the bidder’s total price for the work must be based on the TOTAL of the Base Bid Items included in the Schedule and for each item bid, the Contractor must show the unit price and extended price for the quantity of the item.
2. Split awards or multiple award contracts will not result from this Solicitation.
3. Arithmetic Discrepancies:
a) For the purpose of initial evaluation of bids, the following will be utilized in resolving arithmetic discrepancies found on the face of the price schedule as submitted by bidder:
(1) Obviously misplaced decimal points will be corrected;
(2) Discrepancy between unit price and extended price, the unit price will govern;
(3) Apparent errors in extension of unit prices will be corrected;
(4) Apparent errors in addition of lump-sum and extended prices will be corrected.
b) For the purpose of bid evaluation, the Government will proceed on the assumption that the bidder intends his bid to be evaluated on the basis of the unit prices, the totals arrived at by resolution of arithmetic discrepancies as provided above and the bid will be so reflected on the abstract of bids.
c) These correction procedures shall not be used to resolve any ambiguity concerning which bid is low.
4. Caution to Bidders – Bid Errors: You are cautioned to exercise extreme care in preparation of your bid. Errors in bids are costly and could result in substantial loss to you as well as delayed award of contracts. Actions you can take to avoid errors are:
a) Make sure your bid takes into consideration all amendments to the IFB.
b) If you feel bidding requirements are unclear, contact the Baltimore District Office in writing for an explanation before preparing and submitting your bid.
c) Verify all quantities and prices, especially quotations from subcontractors. Make sure no line items have been overlooked in recapitulating. Have your bid reviewed by qualified personnel other than those preparing the bid.

D. SUBMISSION OF BIDS
1. All bids must be submitted in accordance with the procedures set forth in Block 13 of
Page 1 of this Solicitation document. BIDS OR MODIFICATIONS TO BIDS THAT
ARE RECEIVED BY FACSIMILE WILL NOT BE CONSIDERED.
2. SF 1442 BACK (Page 2 of the Solicitation): Bidders are required to acknowledge the receipt of all amendments to the Solicitation on the Standard Form 1442 in Block 19.
Bidders shall fully complete all the required areas located under the section designated as “OFFER” (refer to Items 14 through 20C).
3. Section 00600 (Representation and Certifications): The bidders must fully complete
Section 00600 of this Solicitation and submit it along with all other documents required by this Solicitation. Bidders received without this Section fully completed may be rejected, considered non-responsive and ineligible for award.
4. BID GUARANTEE: The bidders are required to submit a Bid Guarantee for this procurement. Any bidders failing to submit an authentic Bid Guarantee will be considered non-responsive to the Solicitation and ineligible for award. The Bid
Guarantee shall be in the amount of 20% of the bidder’s price or $3,000,000.00, whichever is less.
5. BONDS AND INSURANCE: The Contractor will be required to furnish proof of insurance, including copies of the required endorsements, and performance and payment bonds within 10 calendar days following the Contractor’s receipt of the contract award.
E. DELIVERY OF BIDS
1. Sealed Bids: Regardless of the method of delivery (mailed or hand-carried), bids and all other documents called out in the Solicitation shall be enclosed and sealed in an envelope that is clearly marked “Bid” and shall include the assigned Solicitation Number, and the Bid Opening Date and Time.

F. EVIDENCE OF AUTHORITY TO SIGN BIDS/PROPOSALS
Evidence of the authority of individuals signing bids/proposals to submit firm bids/proposals on behalf of the bidder/offeror is required except where the bid/offer is signed, and shows that it is so signed, by: The President, Vice-President, or Secretary of Incorporated bidders; a partner in case of partnership; the owner in the case of sole proprietorships. Failure to submit with the bid satisfactory evidence of authority of all other persons may be cause for rejection of bid as an invalid or non-responsive bid.
G. BID OPENING ROOM:
1. Each visitor is required to check-in at the USACE Main Office, Room 7000, where they will be asked to sign-in and will then be directed to the Bid Opening Room. All individuals intending to attend the Bid Opening must allow enough time to go through security and check in at the USACE office before being escorted to the Bid Opening room.

(c) CAGE codes may be obtained via--
